CALL TO ORDER The meeting was called to order by Mayor Norman Malone at 6:00 p.m. . Reverend David Hubbard of First Methodist Church delivered the invocation. 3. Mayor Malone led the Pledge of Allegiance. 4. Council considered approving the Minutes of the Regular Meeting and Workshop Meeting of La Porte City Council held on December 9, 2002. Motion was made by Councilmember Warren to approve the minutes of the Regular Meeting and Workshop Meeting held on December 9. 2002. Second by Councilmember Engelken. The motion carried. Ayes: Mosteit, Engelken, Ebow, Meismer, Warren, Young, Beasley and Malone Nays: None Abstain: Griffiths 5. PRESENTATIONS A. A representative from The Bridge was to make a presentation to the City, but had not yet arrived. City Council Meeting — January 13, 2002 — Page 2 B. Mayor Norman Malone, Fire Chief Mike Boaze and Assistant Fire Chief Champ . Dunham recognized. retiree, James Bridge, for his service with the City. C. Mayor Norman Malone, Police Chief Richard Reff and Lieutenant Ron Parker recognized retiree, Tim Bird, for his service with the City. 6. PETITIONS, REMONSTRANCES, COMMUNICATIONS, AND CITIZENS AND TAXPAYERS WISHING TO ADDRESS CITY COUNCIL Mary Phillips of 500 South Virginia, La Porte, Texas, voiced her concerns regarding police officers handling robberies at her home. Dr. Bobbye Worsham, Pastor of Second Baptist Church of La Porte, 9025 Carlow, La Porte, Texas, voiced their support of Item Number 9 regarding the right-of-way on Canada Street; they feel an urgency -of having this expedited. Bill Scott of 1802 Lomax School Road, La Porte, Texas, thanked Council for their efforts in their investigation of City credit card usage. Mr. Scott voiced his concern of not .being approached to sign the Lomax petition regarding the area remaining rural. He and his family are in favor of this. 7. Open Public -Hearing — Mayor Norman Malone opened the Public Hearing at 6:18 p.m. Review by Staff - Director of Planning Doug Kneupper presented summary and recommendation and answered questions regarding Zoning Ordinance 1501-YY and #R-02- 002. Kent Marsh of Knudson and Associates, Consultant for the Port of Houston Authority, provided an overview of business industrial zoning to planned unit development. Jimmy Jamison, Operations Director and Barbours Cut Terminal Manager of the Port of Houston Authority, provided an overview. Herb Weisend, Engineer for the Port Project, discussed design and drainage issues related to the project. Public Input Bill Scott of 1802 Lomax School Road, La Porte, Texas, brought forward concerns and objections to the project. Director of Planning Doug Kneupper stated the Planning and Zoning Commission recommends approving the Port of Houston Authority Project. Mayor Norman Malone -closed the Public Hearing at 7:18 p.m. 8. Council to consider approval or other action of an Ordinance amending the Code of Ordinances of the City of La Porte, Chapter 106, more commonly referred to as the Zoning Ordinance of the City of La Porte. City Attorney read: ORDINANCE 1501-YY AND #R-02-002 — AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, CHAPTER 106, MORE COMMONLY REFERED TO AS THE ZONING ORDINANCE OF THE City Council Meeting — lary 13, 2002 — Page 3 • CITY OF LA PORTE, BY CHANGING THE ZONING CLASSIFICATION OF THAT CERTAIN PARCEL OF LAND HEREIN DESCRIBED; MAKING CERTAIN FINDINGS OF FACT RELATED TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Motion was made by Councilmember Mosteit to approve Ordinance 1501-YY and #R-02- 002 as presented by Mr. Kneupper. Second by Councilmember Ebow. The motion carried. Ayes: Mosteit, Ebow, Engelken, Beasley, Warren, Meismer and Malone Nays: Young and Griffiths Abstain: None 9. Council to consider approval or other action of a Resolution authorizing the acquisition of right-of-way for the construction of Canada Road. City Attorney read: RESOLUTION 2003-01 — A RESOLUTION AUTHORIZING THE ACQUISITION OF RIGHTS -OF -WAY FOR ROAD RIGHT-OF-WAY PURPOSES, FOR THE WIDENING AND IMPROVEMENT OF CANADA ROAD FROM SPENCER HIGHWAY TO FAIRMONT PARKWAY; CONTAINING A REPEALING CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Motion was made by Councilmember Engelken to approve Resolution 2003-01 as presented by Mr. Kneupper. Second by Councilmember Griffiths. The motion carried. Ayes: Mosteit, Ebow, Engelken, Griffiths, Beasley, Warren, Young, Meismer and Malone Nays: None Abstain: None 10. Council to consider approval or other action of a Resolution to participate in the Violence Against Women's Act Grant, made possible through the Office of the Governor, Criminal Justice Division, for the funding of the Victims' Assistance Liaison position. Police Chief Richard Reff presented summary and recommendation and answered Council's questions. The City Attorney acknowledged the Resolution, but did not read the caption. Motion was made by Councilmember Engelken to approve Resolution 2003-02 as presented by Mr. Reff. Second by Councilmember Griffiths. The motion carried. Council to consider approval or other action of two ordinances: an ordinance authorizing an Industrial District Agreement with Jacobson Warehouse, Inc. and an ordinance executing a Water Service Agreement with Jacobson Warehouse, Inc. City Council Meeting — *nary 13, 2602 — Page 4 • City Attorney read: ORDINANCE 2000-IDA-68 - AN ORDINANCE AUTHORIZING THE EXCUTION BY THE CITY OF LA PORTE OF AN INDUSTRIAL DISTRICT AGREEMENT WITH JACOBSON WAREHOUSE, INC.; FOR THE TERM COMMENCING JANUARY 1, 2001, AND ENDING DECEMBER 31, 2007; MAKING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. City Attorney read: ORDINANCE 2003-2605 - AN ORDINANCE APPROVING AND AUTHORIZING A WATER SERVICE AGREMENT BETWEEN THE. CITY OF LA PORTE AND JACOBSON WAREHOUSE, INC.; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Motion was made by Councilmember Beasley to approve Ordinance 2000-IDA-68 and Ordinance 2003-2605 as Nesented by Mr. Kneupper. Second by Councilmember Ebow. The motion carried. Council to consider approval or other action of an ordinance authorizing proposed changes to Salary Administration guidelines — Chapter 5, Section 3, of the City's Personnel Policy Manual. . Director of Administration Carol Buttler presented summary and recommendation and answered Council's questions. City Attorney read: ORDINANCE 2003-2606 - AN ORDINANCE AMENDING CHAPTER 5, SECTION 3, "SALARY ADMINISTRATION", OF THE CITY OF LA PORTE PERSONNEL POLICY MANUAL DATED JANUARY 1, 1992, AS AMENDED; PROVIDING A SEVERABILITY CLAUSE; MAKING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Motion was made by Councilmember Warren to approve Ordinance 2003-2606 as presented by Mrs. Buttler. Second by Councilmember Griffiths. The motion carried. Council to consider approval or other action of an ordinance executing a Professional Services Agreement between the City of La Porte and Geographic Technologies Group, Inc. for the first year of GIS implementation. Director of Planning Doug Kneupper presented summary and recommendation and answered Council's questions. City Attorney read: ORDINANCE 2003-2607 - AN ORDINANCE APPROVING AND AUTHORIZING AN.AGREEMENT BETWEEN'THE CITY OF LA PORTE AND GEOGRAPHIC TECHNOLOGIES GROUP, TO PROVIDE PROFESSIONAL SERVICES FOR THE FIRST YEAR OF GIS IMPLEMENTATION; APPROPRIATING $58,500.00 City Council Meeting —wary 13, 2002 — Page 5 • TO FUND SAID CONTRACT; MAKING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; PROVIDING A SAVINGS CLAUSE AND A SEVERAMLITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE HEREOF. Motion was made by Councilmember Engelken to approve Ordinance 2003-2607 as presented by Mr. Kneupper. Second by Councilmember Griffiths. The motion carried. Council to consider approval or other action of an ordinance executing an agreement with Claunch and Miller, Inc. to provide professional engineering services for waterline replacement in the amount of $42,565.00. Director of Public Works Steve Gillett presented summary and recommendation and answered Council's questions. City Attorney read: ORDINANCE 2003-2608 - AN ORDINANCE APPROVING AND AUTHORIZING AN ENGINEERING AGREEMENT BETWEEN THE CITY OF LA PORTE AND CLAUNCH & MILLER, INC., FOR PROFESSIONAL ENGINEERING SERVICES FOR WATERLINE REPLACEMENTS; APPROPRIATING NOT TO EXCEED $42,565.00 TO FUND SAID CONTRACT; MAKING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Motion was made by Councilmember Beasley to approve Ordinance 2003-2608 as presented by Mr. Gillett. Second by Councilmember Griffiths. The motion carried. Council to consider approval or other action of authorizing the reappointment of Subsidence District Board Member Jodi (Bobo) Norris as recommended by Mayor Norman Malone. Motion was made by Councilmember Warren to approve the reappointment as presented by Mayor Malone. Second by Councilmember Meismer. The motion carried. Ayes: Mosteit, Engelken, Ebow, Beasley, Griffiths, Warren, Young, Meismer and Malone Nays: None Abstain: None 16. Council to review the Dangerous Building Board of Inspection findings and then authorize a public hearing for the purpose of condemning and ordering demolition of these structures. A hearing date of February 10, 2003 is requested. Chief Building Official Debbie Wilmore presented summary and recommendation and answered Council's questions. Motion was made by Councilmember Young to approve a Public Hearing, to be held on February 10, 2003, for the purpose of condemning and ordering demolition of these City Council Meeting — *nary 13, 2002 — Page 6 0 structures as presented by Mrs. Wilmore. Second by Councilmember Warren. The motion carried. Ayes: Mosteit, Ebow, Engelken, Beasley, Griffiths, Warren, Young and Malone Nays: None Abstain: Meismer 17. Council considered a consent agenda as follows: a. Consider awarding bid for golf course and parks equipment as recommended in the amount of $163,327.00. b. Consider authorization to. amend the Motor Pool Fund to purchase a 2003 Ford marked Patrol Unit from Lawrence Marshal Ford to replace Police Unit 53-83, a 1997 Ford, this budget year. . Motion was made by Councilmember Warren to approve the consent agenda and bids as presented. Second by 'Couiicilmember Griffiths. The motion carried. Administrative Reports Acting City Manager John Joerns reminded Council of the Chamber of Commerce Installation Banquet on Thursday, January 23, 2002, at Sylvan Beach Pavilion. Mr. Joems informed Council of an automobile accident today, involving a La Porte police officer; the officer's injuries were not as serious as first thought, he was released from the hospital. 19. Council Comments Councilmembers Mosteit, Engelken, Ebow, Griffiths, Beasley, Warren, Young, Meismer and Mayor had: comments. 20. EXECUTIVE SESSION — PURSUANT TO PROVISION OF THE OPEN MEETINGS LAW, CHAPTER 551.071 THROUGH 551.076, 551.086, TEXAS GOVERNMENT CODE, (CONSULTATION WITH ATTORNEY, DELIBERATION REGARDING REAL PROPERTY, DELIBERATION REGARDING PROSPECTIVE GIFT OR DONATION, PERSONNEL MATTERS, DELIBERATION REGARDING SECURITY DEVICES, OR EXCLUDING A WITNESS DURING EXAMINATION OF ANOTHER WITNESS IN AN INVESTIGATION, DELIBERATION REGARDING ECONOMIC DEVELOPMENT NEGOTIATIONS). Council retired into Executive Session at 8:37 p.m. Council reconvened the Council Meeting at 10:10 p.m. 21. From: Charles Boyle, Finance Officer, The American Legion Post 428, LaPorte, Texas. Tonight, at Council Meeting, you will meet some La Porte young people who attended the American Legion Texas Boys State and American Legion Auxiliary's Bluebonnet Girls State, 2002. We are saddened that our City may no longer be financially involved with these outstanding programs. We have been informed that using Hotel Tax revenues must show a benefit to our city in the way of tourism. We understand that other programs by local organizations are also effected. Although we know this benefit has occurred due entirely to the fact of our young people going to Austin as delegates to Boys and Girls State ---representing our Post, La Porte High School and our City ---how do you prove it? We do know of people that toured our city because they wanted to learn how we were able to send so many of our High School students when they were having such a hard time sending 1 or 2. We don't know where they spent the night. A few years ago when the La Porte Chamber of Commerce dropped their commitment to these programs we were able to replace them with another local sponsor. Losing the City's participation will not be as easy. Oh! We may get someone to replace the money ---but the respect our City is given, Nation wide, because you have been involved for so long, will not! Hopefully you will find a way. The Officer was traveling Westbound on Fairmont when a young man driving a 94 GMC pickup pulled out in front of the officer from the crossover at Driftwood. The Officer took immediate evasive action to avoid striking the Pickup but in the process over steered his vehicle causing it to go into the median between the East and Westbound lanes of Fairmont. The Patrol Unit upon hitting the median rolled over in the median. Due to the Officers action in avoiding the collision no one was injured; however, the Patrol Unit 53-83 was heavily damaged. Harris County Constables Officer Precinct 8 investigated the accident per Police Department policy. The vehicle was evaluated and totaled Patrol Unit 53-83 is scheduled to be replaced in FY 04 Budget and is fully funded in the current Motor Pool Fund, Account # 009-5253-521-8050. Lawrence Marshal Ford, who was awarded the bid for the marked police units purchased in this budget year, when contacted by Purchasing agreed to honor their previous bid price for a replacement unit ($21,332.00). The Police Department is requesting a budget amendment to the Motor Pool Fund to purchase a replacement for Patrol Unit 53-83 during this budget year. Action Required by Council: Authorization to amend the Motor Pool Fund to purchase a 2003 Ford marked Patrol Unit from Lawrence Marshal Ford to replace Police Unit. 53-83 a 1997 Ford this budget year.
