1. CALL TO ORDER
The meeting was called to order by Mayor Norman Malone at 7:30 a.m.
Members of City Council Present: Councilmembers Mike Mosteit, Peter Griffiths, Chuck
Engelken, Howard Ebow, Bruce Meismer, James Warren, Charlie Young, Barry Beasley
and Norman Malone
Members of Council Absent: None
Members of City Executive Staff and Cit~Employees Present: Acting City Manager John

2. Mayor Norman Malone delivered the invocation.
3. Mayor Malone led the Pledge of Allegiance.

TAXPAYERS WISHING TO ADDRESS CITY COUNCIL
Bill Scott of 1802 Lomax School Road, La Porte, Texas, advised City Council that he did
not support Acting City Manager John Joerns as City Manager.

Council retired into Executive Session at 7:38 a.m.
551.074 -(Personnel Matter) -Deliberate the appointment, employment, evaluation,
reassignment, duties, discipline, or dismissal of a public officer or employee: Interview
applicants for the position of City Manager and discuss appointment of a City Manager.
The interview process began with Acting City Manager John Joerns from 8:10 a.m. until
8:50 a.m.; the second candidate was F. Michael McGregor, Midland, Texas, from 10:00 a.m.
until 10:20 a.m.; the third candidate was J. C. Hughes, Jr., Nacogdoches, Texas, from 1:00
p.m. until 1:50 p.m.; and lastly Mrs. Debra Feazelle, Lamesa, Texas, from 2:47 p.m. until
3:27 p.m.
6. Council reconvened the Council Meeting at 4:23 p.m. and no action was taken during
Executive Session.

Motion was made by Councilmember Meismer to consider Debra Feazelle as the next City
Manager of the City of La Porte. Second by Councilmember Young. The motion carried.

Mayor Norman Malone read: ORDINANCE 20033 - AN ORDINANCE
APPROVING AND AUTHORIZING A CONDITIONAL OFFER OF EMPLOYMENT
FOR THE OFFICE OF CITY MANAGER OF THE CITY OF LA PORTS APPROVING
AND AUTHORIZING THE NEGOTIATION OF AN EMPLOYMENT AGREEMENT
BETWEEN THE CITY OF LA PORTS AND THE CITY MANAGER OF THE CITY OF
LA PORTS; MAKING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE
SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND
PROVIDING AN EFFECTIVE DATE HEREOF.
Motion was made by Councilmember Young to consider approval of the ordinance as
presented by Mayor Malone. Second by Councilmember Meismer. The motion carried.

4. Council considered approving the Minutes of the Regular Meeting of La Porte City Council
held on January 27, 2003.
Motion was made by Councilmember Warren to approve the Minutes of the Regular
Meeting of La Porte City Council held on January 27, 2003. Second by Councilmember
Griffiths. The motion carried.

5. PRESENTATIONS
Mayor Norman Malone read a proclamation in honor of the Columbia Shuttle crew who lost
their lives on Saturday, February 1, 2003.
6. PETITIONS, REMONSTRANCES, COMMUNICATIONS, AND CITIZENS AND
TAXPAYERS WISHING TO ADDRESS CITY COUNCIL
Stan Gardner, owner of Bayport and Pine Bluff Apartments of La Porte, Texas, spoke
regarding Larry Martinez's property and Kathy Glash's property. Mr. Gardner desires the
City of La Porte and the City of Shoreacres to work jointly on the submitted proposals in
order for an amicable agreement to be met.
7. Open Public Hearing -Mayor Malone opened the Public Hearing at 6:07 p.m.
Assistant City Manager John Joerns noted that 618 South Iowa was removed from the list
for building destruction at this time.
Review by Staff -Building Official Debbie Wilmore presented summary and
recommendation and answered questions regarding Ordinance 2003-2610 condemning (13)
substandard structures.
Public Input
Felix Vigier, recently purchased a house on 217 North Broadway, wanting to demolish the
home and rebuild, or if necessary, remodel.
Lang Glover of 11635 Rowan Lane, Houston, Texas, requested action be suspended on the
property at 3122 Andricks, La Porte, Texas.
Spero Pomonis of La Porte, Texas, questioned if citizens are delinquent on taxes on any of
the substandard properties.
Mayor Norman Malone closed the Public Hearing at 6:53 p.m.
8. Council to consider approval or other action declaring substandard buildings condemned.
Building Official Debbie Wilmore presented summary and recommendation and answered
Council's questions.
Assistant City Attorney read: ORDINANCE 2003-2610 - AN ORDINANCE
DECLARING THE BUILDINGS LOCATED IN HARRIS COUNTY, TEXAS, TO BE IN
FACT A NUISANCE; ORDERING SUCH BUILDINGS CONDEMNED; FINDING
THAT THE RECORD OWNER OF SAID PROPERTY; ORDERING THE SAID
OWNER(S) TO ENTIRELY REMOVE OR TEAR DOWN SUCH BUILDING;
ORDERING THE SAID OWNER(S) TO COMMENCE SAID REMOVAL OR
DEMOLITION WITHIN (10) DAYS FROM THE EFFECTIVE DATE OF THIS
ORDINANCE; ORDERING THE BOARD OF INSPECTION TO PLACE A NOTICE ON
SAID BUILDING; ORDERING THE CITY SECRETARY TO FORWARD A COPY OF
THIS ORDINANCE TO SAID OWNER(S); PROVIDING FOR THE REMOVAL OF

Motion was made by Councilmember Griffiths to table demolition of the structure at 506
Circle Drive, La Porte, Texas -Ordinance 2003-261.0-C for 60 days; table demolition of the
structure at 217 North Broadway, La Porte, Texas -Ordinance 2003-2610-F for thirty days
table demolition of the structure at 3122 Andricks. La Porte, Texas -Ordinance 2003-2610-
N for thirty days; and to approve the remaining demolitions of Ordinance 2003-2610 as
vresented by Mrs. Wilmore. Second by Councilmember Meismer. The motion carried.

9. Council to consider approval or other action of a Resolution approving the amended
investment policy.
Director of Finance Cynthia Alexander presented summary and recommendation and
answered Council's questions.
Assistant City Attorney read: RESOLUTION 2003-03 - A RESOLUTION OF THE CITY
OF LA PORTE, TEXAS, AMENDING AN INVESTMENT POLICY CONFORMING TO
ALL STATUTES GOVERNING INVESTMENT OF THE CITY OF LA PORTE'S
FUNDS, INCLUDING, BUT NOT BY WAY OF LIMITATION, THE PUBLIC FUNDS
INVESTMENT ACT, CHAPTER 2256, TEXAS GOVERNMENT CODE; FINDING
COMPLIANCE WITH THE OPEN MEETINGS LAW; AND SETTING AN EFFECTIVE
DATE THEREOF.
Motion was made by Councilmember Ebow to approve the amendment of the investment
op lice. Second by Councilmember Engelken. The motion carried.

10. Council to consider approval or other action of a Resolution encouraging members of the
Texas Congressional delegation to actively support funding for Homeland Security.
Mayor Norman Malone presented summary and recommendation and answered Council's
questions.
Assistant City Attorney read: RESOLUTION 2003-04 -WHEREAS, THE 107TH
CONGRESS PASSED LEGISLATION CREATING THE DEPARTMENT OF
HOMELAND SECURITY; AND WHEREAS, THE LEGISLATION CREATING THE
NEW DEPARTMENT DID NOT PROVIDE FUNDING FOR PRESIDENT BUSH'S $3.5
BILLION FIRST RESPONDER INITIATIVE; AND WHEREAS, THE FIRST
RESPONDER INITIATIVE WAS INTENDED TO PROVIDE FUNDING TO HELP
CITIES PAY FOR PLANNING, TRAINING, EQUIPMENT, AND OTHER RESOURCES
TO MEET THE CHALLENGES OF PREPARING FOR AND RESPONDING TO
TERRORIST ATTACKS; AND WHEREAS, TEXAS CITIES HAVE BEEN REQUIltED
TO SPEND MILLIONS OF DOLLARS TO IMPLEMENT HEIGHTENED SECURITY
MEASURES SINCE SEPTEMBER 11, 2001; AND WHEREAS, MANY TEXAS CITIES
ARE EXPERIENCING SEVERE BUDGET SHORTFALLS; NOW THEREFORE, BE IT

RESOLVED, THAT THE CITY OF LA PORTE, TEXAS STRONGLY ENCOURAGES
MEMBERS OF THE TEXAS CONGRESSIONAL DELEGATION TO ACTIVELY
SUPPORT PASSAGE OF AN APPROPRIATIONS BILL THAT INCLUDES THE $3.5
BILLION FIItST RESPONDER INITIATIVE TO PROVIDE FUNDS TO HELP CITIES
PAY FOR SOME OF THE RESOURCES NEEDED TO MEET THE CITIES' NEW
RESPONSIBILITIES FOR HOMELAND SECURITY.
Motion was made by Councilmember Beasley to approve the Resolution as presented by
Mayor Malone. Second by Councilmember Griffiths. The motion carried.

11. Council to consider approval or other action of an Ordinance calling General and possible
Run-Off Elections.
Assistant City Attorney John Armstrong presented summary and recommendation and
answered Council's questions.
Assistant City Attorney read: ORDINANCE 2003-2611- AN ORDINANCE CALLING
THE REGULAR ANNUAL ELECTION OF THE CITY OF LA PORTE; CALLING A
RUN-OFF ELECTION, IF NECESSARY; DESIGNATING ELECTION PRECINCTS
AND POLLING PLACES; PROVIDING FOR THE USE OF VOTING MACHINES;
APPOINTING ELECTION OFFICIALS; PROVIDING FOR METHOD AND DATES OF
EARLY VOTING; PROVIDING FOR AN EARLY VOTING BALLOT BOARD;
PROVIDING FOR RETURN AND CANVASS OF VOTES OF SAID ELECTION;
PROVIDING FOR NOTICE; PROVIDING FOR FILING DEADLINE AND FILING FEES

12. Council to consider approval or other action of an Ordinance authorizing the Acting City
Manager to sign the Interlocal Agreement between the City of Baytown to continue
participation in the HCOCNTF.
Police Chief Richard Reff presented summary and recommendation and answered Council's

Assistant City Attorney read: ORDINANCE 2003-2612 - AN ORDINANCE APPROVING
AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF LA PORTE AND THE
CITY OF BAYTOWN, FOR PARTICIPATION IN THE HARRIS COUNTY
ORGANIZED CRIME AND NARCOTIC TASK FORCE GRANT PROGRAM;
APPROPRIATING NOT TO EXCEED $35,227.00, TO FUND SAID AGREEMENT;
MAKING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT;

18. Mayor Norman Malone administered the Oath of Office to the newly appointed City
Manager of La Porte, Debra Brooks Feazelle.
19. CONSIDERATIONS AND POSSIBLE ACTION ON ITEMS CONSIDERED IN
EXECUTIVE SESSION
There was no action taken during Executive Session.
20. There being no further business to come before Council, the Regular Meeting and Public
Hearing was duly adjourned at 8:15 p.m.

On 10-10-02 the assistant city manager sent me and each council member a
letter in response~to my 10-7-02 meeting with him: He presented that letter as an
answer to my. written question: He attached a series of my E-mails to that letter .
that made it look like he answered my question.
Fact is; he left the most~important E-mail out of the attachment. That missing
5-21-02 E-mail to the city planning director, nailed. the .question down ~to only two
possible answers... and your.plarining director never responded to. the question.
In that 10-7-02 meeting. with`your assistant city manager, ~I repeatedly eicplained
to him the only two possible answers~to my question and gave him a copy of the
5=21-02 E-mail that specifically stated- the only. two possible answers..And with all
that instruction and allthat explanation, as you see in his response, he still did
not answer the question.. " ." ~ .
So I'll repeat the question as a 1435 question to .this Council. Did the. Board of
Adjustment. address limiting the. number of animals at the feed lot? There are
ohly two possible answers.
'I : Yes, they did address limiting the number of animals; or
2. No,.they did not, address:timiting the number of animals. "
And now, I have the obvious additional 1435 questions to-this council:
1. Why did your assistant city_manager leave the most important E-mail out of
his .letter attachment.
2. Why did your assistant city manager not~answer my question.
3. .Why did your assistant city manager repeatedly try to claim, in"our meeting,
that City staff made a recommendation~to the BOA to limit the"# of feed lot
animals, when in fact: City staff:made no such recommendation. When I
repeatedly countered this bluff, :your. assistant city manager city claimed that
he was going to look it up in the BOA information,. implying that he"was going
to prove to me, he was right ~ab~out this. Well, he has never gotten back to me
on his findings, so question 4 is: ~ - .
4. What were his findings? ~ : ~ ~ .
Gentlemen, I think I've been very patient. For over 2 years your City staff has
avoided giving me a simple .answer to a. simple question. I'm a taxpayer and I .
~.have~a right to a straight answer on this question. and~the additional questions?
For those that are riot•aware of 'if; for some time now this has not been just
about a feedlot of. unlimited animals; it~has been about local. government~ethics
and so these 1435 questions als"o: go'to the Council members up for re-election.
. I have a lot more to say to this. council about Mr: Joems involvement in the
feed .lot of unlimited cattle, but I pelieve State Iaw~gives.him the opfion of having
that evidence produced ~in executive~~session. So my 5th question to this council
is; what are the formalities of".niaking;that executive session happen.

Information Collected on Traffic Citations and Arrests
Senate Bill 1074 upon becoming law became Texas Code of Criminal Procedure, Article
2.131 Racial Profiling Prohibited. Under this law, in Article 2.132 Law Enforcement
Policy on Racial Profiling, there is a requirement that all law enforcement agencies must
collect data "relating to traffic stops in which a citation is issued and to arrests resulting
from those traffic stops, including information relating to:
1. The race or ethnicity of the individual detained; and
2. Whether a search was conducted and, if so, whether the person detained
consented to the search.
Under Article 2.132 law enforcement agencies are required to report to their governing
agency, the City Council, the information collected for the previous year. The report
must be submitted prior to March 1, 2003 and must be for the period of January 1, 2002
to December 31, 2002.
The information gathered for this report comes through the H.T.E. computer system of
the Municipal Court and Police System. On all citations during the past year officers
have been required to indicate whether a search was conducted and if the search was
consensual. The following is a compilation of that information from the H.T.E. system.
