SUMMARY & RECOMMENDATION
The golf course's current 15 Year old Toro VTII central and satellite irrigation controllers are outdated and parts
availability is limited and soon to become obsolete. We are requesting to upgrade to Toro Touchnet computerize
wireless communication controllers, which would provide the capability for future expansion. Upgrading to these
controllers will ensure compatibility with the existing Toro irrigation system,
We are requesting Professional Turf Products, exclusive distributor and sole source provider ofToro in the State of
Texas, provide the site survey, all materials, and FCC licenses for the quoted amount of $60,366.96.

The golf course's current 15 year old Toro VTII central and satellite irrigation controllers
are outdated and parts availability is limited and soon to become obsolete, We are
requesting to upgrade to Toro Touchnet computerized, wireless communication
controllers, which would provide the capability for future expansion. Upgrading to these
controllers will ensure compatibility with the existing Toro irrigation system.
We are requesting Professional Turf Products, exclusive distributor and sole source
provider of Toro products in the State of Texas, provide the site survey, all materials,
and FCC licenses for a quoted alT!ount of $60,366.96. An additional five (5) year
warranty for technical service support on ~oth hardware and software can be purchased
for $4,150. '
Funds are budgeted as follows:.
$25,000 - Budgeted 2002-03 (did not spend)
$35,000 - Budgeted 2003-04 .

SUMMARY & RECOMMENDATION
The City currently uses two (2) ffiM AS/400 computers on a wide-area network supporting HTE
applications, The Police Deparbnent computer/server was installed in 1996. In order to adequately
. support the recently acquired GIS software, this system must be significantly upgraded, The City Hall
system -is almost five (5) years old and also needs upgrading. While reviewing the process and costs
associated with upgrading, staff discovered it was more cost efficient to lease the hardware and software,
In expending the same dollar amount to upgrade, leasing will provide newer, more modem equipment and
technology, decrease the possibility of obsolescence, and distribute the funds over a three (3) year period,
Sealed RFP #0105 for ffiM Midrange Computers & Software Lease were received on October 27, 2003,
Requests for Proposals were mailed to eight (8) suppliers with two (2) returning proposals. Both offerors
submitted proposals for a 36-month lease, including a set fee for the HTE migration. Although the total
cost for the 36-month period is $75,024, the cost for the first year would be $31,008, including the set fee
for migration. The remainin.g years would be $22,008 per year,
MIS staff contacted and verified references for both offerors, Using the evaluation criteria provided in
the specifications, Sirius Computer Solutions' proposal was chosen as the best offer,
Staff Recommendation:
Staff recommends award ofRFP #0105 - ffiM Midrange Computers & Software Lease to Sirius
Computer Solutions for a thirty-six month period in the amount of $75,024.

Linda Westergren of 1231 CR214, Weimar, Texas - addressed the screening issue; currently there is a
pharmacy and an art studio on the north end of the block on Broadway. There are some vacant areas, and a
closed clinic, Ms. Westergren does not object to some screening, but would object to major screening,
considering this will be affordable housing. In the vacant areas, in reading the requirements for commercial
development, the future developer has the responsibility of providing the screening and not the homeowners;
which would be unfair, Ms, Westergren answered Council's questions,

Lighting at Fairmont Park Baptist Church
I have worked with staff and we have identified a section of the zoning ordinance (Sec. 106-835(h)} that addresses lighting
in parking lots. While it does not require any special permits it is a penal section that everyone must adhere to, We have
discussed this with John Armstrong late yesterday afternoon, and I spoke with Dan Chappel of the church and informed
him that he must adjust his lights so as not to affect the adjacent properties, I will go out there tonight before my ad hoc
committee meeting and survey the situation, Mr, Chappel informed me that there was still some work to be done, but that
he would work to conform with the ordinance. I told him we would work with him and after he has made adjustments to let
us know so that we could investigate. I did inform him he may have to use other poles or install new ones to make it work,
He was trying to use existing poles. There are poles on the easement that the power company suggests using that direct
the light back onto the church but the easement is actually in the adjacent property owners rear yard, That is an
alternative we could explore.

During 2003-2004 Budget preparations, there was discussion regarding the possibility of an electronic agenda.
The implementation of an electronic agenda would eliminate the mass amount of supporting documentation that
Council receives prior to Council Meetings; reducing the time/cost required to reproduce the agenda, also reducing
the time department heads spend preparing,
Staffhas communicated with the Cities of Sugar land, Missouri City, and Friendswood to gather essential
information on the process of implementing an electronic agenda.
If Council desires to move in this direction a Task Force Committee consisting ofa Representative from the City
Manager' Office, Assistant City Secretary, and a Computer Systems Administrator will be required to assure the
process. The Committee will be responsible for purchasing the required hardware, software, training of the staff
members who will be instrumental in providing items electronically for the agendas.
The Committee will demonstrate electronic Executive Staff agendas for at least three consecutive meetings to
smooth out any possible flaws during the process, before ultimately rolling the electronic agenda over to City
Council.

The Advance Funding Agreement with TxDOT for the SH 225 @ Sens Road, Palm Trees and
Oleanders project, as approved by Council, identified $45,602 as the estimated cost of the project, and
authorized an expenditure of $46,000, As a part of the agreement, Council also agreed to pay any costs in
excess of the Federal participation. As it stands currently, the estimated costs in excess of the Federal
participation is $33,780.87. As you know, we asked Ha1ff & Associates to reduce the amount of trees to
be planted one time already, to get within our budgeted amount. The way the project is set up, a reduction
in trees requires adjustment of almost every other line item in the budget (Le, fertilizer, mulch). At the
time we were reducing the project, we were not aware that TxDOT would add line items to the budget
total at the end of the review process (i.e. sediment fencing, traffic control devices, etc.) and a large
contingency, that pushed the estimated costs above the budget by almost $34,000. In addition the cost of
the major portion of the project, the Palm Trees, increased from $2,500 each to an estimated $3,500 each,
TxDOT is requiring us to submit our estimated share in advance of the actual construction award that is
scheduled for 7-8 January 2004. If costs are less than the estimate, we will be refunded the difference; if
costs exceed the estimate, we will be required to make up the difference.
. I have asked the TxDOT Project Administrator to reduce the number of trees again from 40 to 30
in order to get the number down to close to the projected budget, The Deer Park Project at SH 225 @
Battleground Road has 34 Palm Trees; the big difference in our project design and theirs is, they don't
have any trees on the east side of Battleground in the medians, Ours would be very similar with 30 trees.
We can add trees to the project later if funds are available. The reduction of 10 trees reduces the total
,project estimate to $228,315, with the City's share at $47,467, As an alternative, we can add additional
funding now to get the 40 trees as designed. This option would require an additional $33,800 to fund.
Please keep in mind that these are all estimates and, even though TxDOT requires the money in advance,
we won't know exactly how much the project will cost until the bids are received,

As you know, the City of La Porte's primary Interest in the Sylvan Beach Erosion
Protection and Beach Nourishment Project' (USACE Permit #23069) has been to
restore the Sylvan Beach Park "beach" that has eroded away over time, and to
reduce the likelihood of future erosion by adding shoreline protection. The
project has been designed by URS under an agreement between the City of La
Porte and the Texas General Land Office, and Harris County. The project has
been approved and a permit has been issued by the U.S. Army Corps of
Engineers for the project. All that remains now is to put the funding In place for
the actual construction of the project.

As a result of the Texas Legislature's "belt tightening" in the last session, the
amount of money allocated to coastal protection projects was reduced from $15
million to 7.5 million. Subsequently, the Texas General Land Office changed Its
match requirements from 850/0-15% match for coastal erosion protection
projects, to a 600/0 state, 400/0 local match. Given our estimated cost of $2.43
million for our overall project, that increases the City of La Porte/Harris County
share from $360,000 to $972,871, or $486,435 for each local parmer, if the
project remains classified strictly as a coastal erosion protection project. This
amounts to a 630/0 increase in our original cost estimates for the local match.
The TGLO has an alternative classification under the program, "Beach
nourishment/replenishment" that allows a. 75% state, 250/0 local match. A
portion (approximately 400/0) of our project could potentially be classified under
this category because of the beach establishment portion of our project, and we
have asked the Texas General Land Office to consider this option by submitting
an Amended Project Goal Summary.
If the TGLO agrees to re-classify this project as described above, the
savings would amount to just under $73,000 each, for Harris County and the City
of La Porte.

There are two ways that the project can move forward, given the
expanded budget requirements and depending on Harris County's, and Ci.ty of La
Porte's continued participation:
· The project can be constructed as a single project
. The project, which is permitted as a whole, can be constructed in
2 or more phases, based on funding as it becomes available.

Harris County Precinct 2 officials have indicated that they have budgeted
their share in its entirety, but expect to be reimbursed by the Tax Increment
Reinvestment Zone #1 that they: are partners in. This option is available for us as
well, and is probably our best opportunity for funding this project.
Another funding possibility is to borrow against the revenues generated by
the Sylvan Beach Fishing Pier. Our share of revenues in the past has been fairly
constant at $30,000 per year. We just increased tees at the beginning of this
fiscal' year and expect revenues to increase by about 25-30%, which should bring
in around $38,000 annually. We equid issue revenue bonds at about 10 times
this revenue flow and expect to receive a roughly $380,000 that could be placed
toward our share of the project.
The TGLO Project Administrator has Indicated that the state "probably"
will fund V2 of this project, primarily because of the severe funding cuts they
have received. There is a drawback to phased construction; that Is, that
mobilization costs would be expected'to be increased by about $60,000 if it's
divided into two phases.

The positive part of all this is, the project is still a bargain in that development of
an established beach at Sylvan Beach Park will be a tremendous asset to our
community, both as a recreational destination and as an economic boon to the
local economy. Our share will, in any event be approximately 200/0 of the total
cost, while the benefits to the aty of La Porte should be much higher. The llRZ
Board will meet to discuss these issues shortly, and we are awaiting word from
the Texas General Land Office as to what they will require from the City
regarding funding assurances (i.e. Resolution, Letter of Agreemen.t, etc.). If a
Resolution is required, one will be presented for Council consideration at the
January 12th Council meeting. The TGLO is expected to make a decision on their
funding level sometime in January 2004.
Note: Our Project Administrator indicates that the State "probably" will fund 1/2 of this project.
If so, we will need to add $60,000 to the North End of Project for mobilization (not included in the above estimates).

Previously, the Port of Houston instituted a value assurance program as a gesture to insure the property
values surrounding their proposed truck entry station on Barbour's Cut Blvd. The Port assures property
values within" roughly two blocks of the facility will not decrease or it will purchase the property. Once
signed up, the individual has up to five years to determine ifhe/she is negatively impacted and wishes to
sell. All interested property owners must sign up by the first week of February.
The City is trustee for seven parcels of land. Under the program, as trustee we can sign up to participate.
However, after February 3, it is non-transferable. Given the uniqueness that we hold as trustee and
likelihood of a future sale since we do not hold title, we would like the Port to allow us to transfer the
value assurance certificate to the eventual owner within five years, The Port said it would have to go
before the Port Commission and the Commission may not want to do this,
Staff is requesting some guidance on how much to push the issue, In addition, the City could sell the
property to the Port under the requirements set out in the program, but it would require the other entities
approval.

WHEREAS, the Port of HoustoJ?, Authority of Harris County, Texas (port Authority) is
working with the City of LaPorte, Texas, to replat, rezone, and approve a Planned Unit
Development on property the Port Authority plans to use for a Truck Entry Station,
(TES) on Barbours Cut Blvd.; and
WHEREAS, the adjacent property owners in Blocks 433, 432, 980., 981,.982, 983, 984;
985, 973, 974, and 988, Town of LaPorte, Harris County, Texas, that are within 40.0. feet
of the TES have concerns about declining property values once construction of the TES is
begun and want assurance that, should their current property value decline, the Port
Authority. will purchase their propel1y; and
WHEREAS, the Port Authority is willing to offer the option to all property owners in the
Blocks mentioned above to sign up for the Barbours Cut Terminal Truck Entry Station
Value Assurance Program, described below, within 180. days following the date the City
of LaPorte, Texas, grants a Special Conditional Use P~rmit to the Port Authority for the
TES,
NOW THEREFORE BE IT RESOLVED THAT, th~ Port of Houston Authority of Harris
County, Texas, establishes the following Barbours Cut Terminal Truck Entry Station
Value Assurance Program, for the propertY owners who sign up for the program:
1. Owners of property in the Blocks described in the Preamble of this Resolution may
sign up for the Value Assurance Program after the City of LaPorte issues a Special
Conditional Use Permit (SCUP) to the Port Authority for its Truck Entry Station for
Barbours Cut Terminal, and those owners may sign up for 180. days after that date.
Owners who sign up' for the Program must allow the Port Authority to conduct a
Phase I site assessment of their property prior to its being enrolled in the Program.
The Port Authority will only disqualify from the Program property with material
environmental concerns not of the kind typically found in a residential subdivision.
Fer example; lead paint and ashestos siding do not disqualify property from the
Program,
. 2. The Value Assurance Program (program) is not transferable to subsequent owners of
the property. No property may participate in the Program after the 180.-day time
frame expires. .
3. The Port Authority will purchase the above-described property that is unimproved
property at the 20.0.3 Harris County Appraisal District Appraised Value, Unimproved
property is considered to be vacant land, that is, land with no structures on it. Under
the Program, a slab or utilities are not considered improvements,

5. The Port Authority's obligation to purchase property under the Program will not
begin until the Port Authority receives a Building Permit from the City of LaPorte,
Te::fa..c;;for the Port Authority's Truck En.try Station on BarboUr's Cut Blvd,
6. The term of the Value Assurance Program shall be for five years from the date the
Building Permit referred to in Paragraph 5, above, is issued by the City of LaPorte to
the Port Authority for the TES.
7, The Port Authority will notify all property owners in the Blocks mentioned in the
Preamble of this Amended Resolution that are within 400 feet of the TES by regular
mail, certified mail, telephone, advertisement, and/or personal meetings, The City of
LaPorte will be informed of the notification progress for the Program.
8. The Port Authority shall contact each property owner who has signed up for the
Value Assurance Program at 90 days, 60 days~ and 30 days prior to expiration of the
Program,
9. The Port Authority will use the Application "and Contract forms attached to this
Amended Resolution, The Port Authority, through its Executive Director, may
change these forms with the prior approval of the City of LaPorte, Texas.
10, The Port Authority's obligation to pay money under the Program shall not exceed $2
million unless this amount is increased "by the Port Commission,

SUMMARY & RECOMMENDATION
At the last meeting of City Council, staff was requested to provide additional information on Mr. Gray's request for
a water well. As a brief background, Mr. Gray owns property north of the railroad adjacent to SH225 frontage road
and Strang Road. No water is available at the site. Water and sewer is available within 500 feet, but would require
boring under the railroad. Across Strang is a non-conforming well serving a trucking filcility. See Exhibit A for last
City Council meeting's packet material.
Since the last meeting, several options were explored:
1.) Tying onto Mr. Angel's non-conforming well across Strang Road: Mr. Gray bas stated he has Mr. Angel's
approval and is in the process of obtaining an agreement. However, Section 1 1 68-A of the Code of
Ordinances, which prohibits the drilling of new wells, also prohibits any selling, bartering, or giving away
of water. So, while this is considered better than drilling a new well, it is prohibited by ordinance. A
moditication would need to be made to the ordinance to allow such an agreement,
2,} Allowing wells to be drilled where the City does not have water available within 500 feet: There are
numerous tracts, both small and large acreage that would tit into this category (several tracts cut-off by
major roadways or railroad line that would require boriiIg). To change the ordinance to allow wells when
water is not within 500 feet, the City could see numerous requests for wells.
3.} City staff explored extending water and sewer.to the site. City staff viewed two routes as being viable due
to right-of-way and proximity. The longer route would benetit two property owners (four tracts, not
including the railroad property) at a cost of$97,257,80. Ifwater only were considered, it would be roughly
$37,000. With a sewer bore for future sanitary sewer, it would be under $50,000 ($25,000 per landowner).
This would require permits from the railroad for borings and crossing their line. The City could participate
lJy performing this work at a cost of roughly $10,000 less than the $50,000 to include the waterline, fire
hydrant, and bore for future sanitary sewer.
The attached memo from Robert Cummings, Supervising Engineer, outlines the various estimates and routes for
extension of water and sewer lines.

SUMMARY & RECOMMENDATION
Eddie Gray has requested to utilize a water well and bottled water for a trucking yard to be located at the feeder of
SH 225 and Strang Rd. Clll'rCntly, there is no water and sewer adjacent to this property. Water and sanitary sewer is
available approximately 385 and 450 feet, respectively, to the southwest. It would be necessary to bore under the
'railline located to the south of this 'property. It is believed that there is a non-confonning well currently being
utilized to the east of this property; Staffis investigating this,

available, the Subsidence District woul~ most likely grant a permit

This is a workshop item and not set for action: Staffhas no specific recommendation at this time, but the following
is a list of concerns: fire protection from a sprinkler system only is typically inadequate (City Fire Code requires a
fire hydrant within 300 feet of acommereial building; requires variance from Fire Code Review Committee or a
special exception from the Fire Marshal and Fire Chief for other consideration); difficult to grant water wells in only -
one section of the City without reviewing other similar concerns; subsidence; and a site plan haS not been submitted,
so we may be granting something that may have other items of concern or ~y not be permissible.

. This letter concerns the 4, 7792 ,.~res that I own at the intersection of Hi. 225
Feeder at Strang Road in the City of LaPorte. The property is bounded on the north by
Hi. 225 Feeder, on the east by Strang Road and on the south and west by the Union
Pac~fic Railroad line. A survey of the prop~rty and a metes and bounds legal descnption
are attached: There is no water utility service to this tract by the City of LaPorte and due
to its location, there is little possibility of water service being extended'to this, area

..' The legal title on the aCreage is held in my name as trustee and the property is not
encumbered by any mortgage liens. The tract is zoned Light Industrial. It is
undeveloped now, but I have a potentiallong-tenn lease pending on the tract, The lease
tenant plans to build a trucking yar4. The operation will have a portable office and the ,
only need for water is .to operate the restroom and run the fire protection sprinkler system
in the portable o:ffice. There are no other requirements for water for this business use. The
lease tenant has proposed drilling a water well on the tract to ~erve its needs, The well
. will be of ample size to provide water to the restroom and to provide fire protection to the
portable office. No other use will be made of the well on the property and no other tract
other than the 4,7792 acres will be served by the well. Wastewater from the site will be
hauled from the site by a licensed wastewater disposal company. Bottled water will be
used for any drinking water used on the sit~. '
,I request that the City Council grant a variance from City of LaPorte Code of
Ordinances, Article I, Sec, 74-2, to permit the drilling of a water well on this tract for
purposes of serving only the 4.7792 'acres. This variance shall be conditioned on the fact
that in the event the City of LaPorte ever provides City water service to the property that
the use of the water well will be discontinued and that the owner/user of the tract will
immediately make application to',connecfto City of LaPorte water serVice to this tract.
The need for the grantmg of'this variance is urgent due to the impending lease of
the tract. The lease tenant needs to begin construction on the lease premises as soon as
possible and no later than thirty (30) days from today.

. Eddie Gray delivered this letter addressed to City Council to the Planning Department.
It was then brought to my attention. 'When I checked with the City ,Secretary's office,
Mr, Gray had not provide~ cOpies for distribution to Council,
Mr. Gray's request cannot be considered a variance, The existing ordinance (1168-.
A/1984) is a policy that essentially outlaws the drilling of new wells inside the city limits
of La Porte and prohibits use of water originating from any other source than the City of
La Porte. If Council wishes to assist Mr. Gray in his request there will need to be a new
ordinance passed that would have several provisions created to allow it here and
prevent the proliferation of wells in other areas of the community..
I seem to recall that the tract next to Mr. 'Gray's has an exi'sting well on it. 'If so, it would
be preferable if the two parties could reach an agreement for use of that well with the
City then granting an easement to cross the City right-of-way with a ,line. I called Mr.
'Gray this morning to discuss this but ,was not able to reach him. .

There are other sections of the City's' codes that also need to be checked before
assuming this is Mr. Gray's only hurdle, There could be other locations in the City's
codes/policies that require public,' ~tilities for issuance of a building permit or
, development approval. .," .
We will place this on the next Council meeting agenda as a workshop item for Council
discussion and further direction. '

applicable to the sale of distilled water, or other bottled water
approved' for human consumption, by the Texas Department of Health.
In addition, the provisions of this ~rdinance shall not be appli-
cable to the coll~ction of rain water for use to water ve~e~ation.
Section 4. ~is Ordinance shall be effective fourteen (14)
days after its passage and approval. The - City Secretary shall
give notice of the passage of th~s ~rdinance by causing the
caption' hereof to be published in the official newspaper in the
City of La Porte at least twice within ten (10) days' after the
passage of this ordinance.

Section 6. Any person, as defined in Section 1.07(27),
Texas Penal, Code, who shall violat~ any provision of this 'ordi-
'nance, shall be deemed guilty ofa misdemeanor and upon conviction
shall be punished by a fine not to exceed Two Hundred Dollars.
($200.00). Each day any violation of this ordinance shall con-
tinue shall constitute a' separate violation.

Attached are the cost estimates you requested. I ran the cost estimates four basic ways:
\
1) The most direct route and city installed. This would require the purchase of
easements and allow for no reimbursement availability.
2) The most direct route installed by a contractor which would require the purchase
of easements and allow for no reimbursement availability.
3) Going down the existing 60 V.E. which would not require easements to be
purchased but would be a longer run, would allow for three other businesses to tie
onto the lines and allow for reimbursement. Cost estimate #3 is based on the City
installing the lines.

private contractor installing everything.
All of these were scenarios were run under the assumption that gravity flow could be
achieved. They were subsequently run using a force main and lift station. When boring
under a railroad bed, the railroad requires that a dry bore be used. Dry boring is always
much more expensive than wet boring and will require the use of casing at least 6-inches
in diameter larger than the service pipe. Taking the utilities the long way would be the
best scenario even if it would be the most expensive as that would allow at least three
other businesses to tie on. Given that the City of La Porte has an ordinance against the
use of wells, it is recommended that at least the water line should be taken the long way.
Given the great importance on arresting subsidence in the greater Houston area, there is
no scenario in which I could recommend the .allowance of a water well.

24 hours of the time notice is received and will thereafter proceed to repair the well in a good and

right at-all reasonable hours to enter Lessor's premises for the purposes of inspection, maintenance,

7. Assignmen~, and Subletting. Lessee may assign this lease or sublet the premises, in whole or

9. No Other Re.presentations. No representations or promises shall be binding on the parties
hereto except those representations and promises contained herein or in some future writing signed by
the party making such representations or promises.
10. Governme- Law. This lease shall be governed exclusively by the provisions hereof and by
the laws ~f the State of Texas, as the same may from ~ to time exist.
11. Notices. Whenever, in the provisions of this lease, notice is required to e givep. by either
party herein, it shall not be construed to require personal notice, but notice may be given in writing by
depositing the same in the Post Office with postage prepaid in a sealed envelope, and addressed to such

(Revoke and re-issue permit with stricter guidelines.)

Again, Fairmont Park Baptist Church (FPBC) leaders are unsympathetic, unconcerned, and uncooperative with their
adjacent neighbors. Since January 2001 FPBC l~hip's choices are still creating nuisances which disturb the
homeowners' comfort and peacefulness in Fairmont Park Section IV. Please protect the homeowners.
See attached petition from homeowners. .
Latest nuisance: 11 stadium parking lot lights (1000 watts pet' light = 11,()()(J watts total) - installed Oct. 28-29, 2003
NOTE: (1) On Wed., Nov. 12,2003, Shannon Gibbs, FPBC Worship Leader, told me (Penny Garcia) that I would
have to make the ..eighbors' problem with the church's new parking lot lights a City issue since
ttreir lights are legal and the church had received a permit.

(2) Gibbs did not show at our home for our appointment at 8:45 p.m. of the same night.
(3) Also, Wayne Spears (pastor) did not return either of Penny Garcia's Oct. 30 and Oct. 31 phone calls.
(4) Dan Chappell (Minister of AdiDinisttation) did not return P~nny's Nov. 11 phone call
(5) On Dec. 1, Penny called , ChappeD, who suggested we put aluminum foil on our windows (tacky and
against deed restrictions).
Problems (new and ongomg) with Fairmant Park Baptist Church since Januarv 2001:
1. Garda 1003 property appraisal iowered $9,800 (from $106,500 to 596,700). NOTE: 31'11 year in a row.
2. Lighting: Excessive overflow of lighting for small size'ofparking lot (Must see to believe.)
3. Stadium lighting extending 400 ft., more than the distance between the church and their adjacent neighbors.
4. Stadium lights angled/positioned into neighbors' bedrooms, kitchens, and living room windows, including
sliding glass doors. (Light beams shOuld be angled perpendicular to their parking lot.)
5. Blinding lights into adjacent yards. ..
6. Blinding lights when driving int~ the Section IV neighborhood from Farrington and Be1f3st.
7. Skateboarding/ramps: Ramp insulation insubicient. "'Thumps" still heard inside homes. .
8. Skateboard airborne jumping and slamming onto concrete noisy/offensive ("gunshot sounds" all hours of day
and night). .
9. Unsupervised skateboardirig occurring daily &. nightly on ramps in spite of the metal barricades and the 2
church vans parked between the Fun Box and giant ramp.
10. Fun Box is noisiest ramp because of metal-bars and metal base on all 4 sides, in addition to its insufficient
insulation. .
II. Non-regulation homemade ramps too often brought by young people to .church parking lot.
12. Unsupervised skateboarding on ramps and in parking lot continuing on Wednesdays after the 8:00 P.M. City
of La Porte permit deadline. (Parking lot lights make skateboarding easier and inviting.)

13, Neighbors having to continue to make numerous calls to the La Porte Police Department to stop the
unsupervised and noisy skateboarding on the barricaded ramps and concrete,
14. Unsupervised 4-6 year olds climbing & running down ramps after school.
15. Dirt mounds: Two (2) unsightly mounds still remain on north side of church near Farrington.
16, Maintenance: Irregular (sporadic and inconsistent) maintenance of church property: north drainage ditch
and their not mowing up to the Garcias and Shaws' fence line (their church property, not easement).
17. Parking on Farrington: Cars parked daily, Wednesday night, and Sunday from Belfast to Rizzuto
Elementary.
Recommenctations for changes:
1. Stadium lights:
a. Require FPBC to turn off their stadium lights until lights in compliance with ordimince.
b, Prevent FPBC from adding lighting to the utility poles in the easement, which are ih the neighbors'
fenced back yards (less than 21 ft. from Garcias' back door).
c, Require hooding on the east lights, which are close to their adjacent neighbors on qaken Lane,
d. Require an immediate date for the church to make the light changes if lights are not turned off now,
2. Skateboarding and ramps: '
a. Adjust FPBC's lax permit to match what the City requires for its skateboarding ramp park, including
supervised skateboarding.
b, Require more insulation to ramps, especially to the Fun Box to eliminate the thumping (low density
sounds) still heard in adjacent homes.
c, Require effective barricades on all ramps, preferably a fence. The metal pieces do not deter use,
d. Require removal of all metal pieces from Fun Box. (Low density noises carry into adjacent homes,)
e, Require fencing around skateboarding ramp parle
f. Require posted signs that do not permit (1) unauthorized skateboarding, (2) unauthorized motorized
vehicles, and (2) homemade ramps on the premises.
g. Issue citations when young people are reported to LPPD for skateboarding the barricaded ramps and
parking lot during unsupervised hours.
h. Issue citations to the church when young people are in skateboarding violation and: reported to LPPD.
1. Do not permit skateboarding on the church parking lot, especially jumping airborne and pouncing onto
the concrete, which creates shotgun low density sounds.
j, Require a specified date for church to make the changes, re: ramps, fencing, signs!, etc.
3, Dirt mounds: Require removal of2 remaining unsightly mounds by a specified date,
4, Maintenance:
a. Require regular maintenance of the north drainage ditch and regular mowing up to Garcias and Shaws'
fence line.
b, Require the church to follow a regular schedule for their lawn and ditch mainte~ce during the spring

5, Parking on Farrington: Place ''No Parking" signs on Farrington between Belfast and Rizzuto Elementary,
Four neighbors have moved and one house is vacant due to the homeowner's death since the church began their
disruptive activities January 2001. The church has rejected all of the homeowners' efforts to, get their cooperation.
Please hold FPBC responsible for their activities and require the church to respect the privaCy of the adjacent
homeowners.
Please place the above items on the Council's agenda ASAP to protect the homeowners and to restore our rights
because Fairmont Park Baptist Church has not, does not, and will not show conside~ation for their neighbors. The

. We, the undeniped, oppose the parkinllot sttulium lights at Fairmont Park Baptist Church
(10401 Belfast La Porte TX 77571) for a variety of reasons:
I. Sympathetic to the neighbors who are affected by the lights' direction into their home windows.
2. Lights angled/positioned into neighbors' bedroom, kitchen, and living room windows, including
their sliding glass doors. (Lights,should be downward toward, the parking lot.)
3. Excessive wattage for size of parking lot (1000 wans per lighi = 11,000 wans total):
a. Blinding lights from Oaken Lane backyards and Belfast front yards; comfortable evening
use of personal property not possible.
b. Blinding lights when driving into the Section IV neighborhood from Farrington and
Belfilst.
4. Lighting set on the timer past 9:00 P.M. (9:00 bedtime hours/or early morning risers)
5. Unsupervised skateboarding continuing on Wednesdays after the 8:00 P.M. City of La Porte
permit deadline due to the acute visibility from the lights
6. Unsupervised skateboarding occurring all week during the evenings in the parking lot because of
their new lighting creating a ~ore conducive atmosphere for skateboarding and gathering.

All improvements to Owner's site shall include adequate drainage facilities to ensure proper

5. Owner's site is subject to all ordinances and regulations of the City of La Porte and all other
applicable laws.
Skateboard Ramps:
6. Owner shall install skateboard ramp modifications to reduce sound emissions as shown on Owner's
submittal attached as Exhibit 4 within 90 days.
7. Owner shall relocate Skateboard Ramps to approved location within 30 days.
8. All landscaping enhancements within the existing parking lot shown on Exhibit 2 shall be completed
within 90 days.
Bicycle Park:
9. For the Bicycle Park, owner shall provide Landscape Buffers as shown on the general site
development plan, Exhibit 2. Said Landscape Buffers as specified in Sec. 106-334 of the City's
Code of Ordinances shall be a minimum of four-feet wide, be evergreen plant types, be a minimum
of two-feet in height at time of planting, grow to a minimum height of six-feet in two years, and
create a solid screen. ' .
10. Landscape buffering associated with the proposed Bicycle Park shall be installed within 60 days
after relocation I installation of the fence surrounding the Bicycle Park.
11. Owner will take steps to mitigate dust emissions from Bicycle Park activities.

Failure to begin construdion of the Bicycle Park within one (1) year after issuance or as scheduled under the
terms of a special conditional use penn it shall void the pennit as approved, except upon an extension of time

If construction is tenninated after completion of any stage and there is ample evidence that further development
is not contemplated, the ordinance establishing such special conditional use pennit may be rescinded by the
City Council, upon its own motion or upon the recommendation of the Planning and Zoning Commission of the
City of La Porte, and the previous zoning of the entire tract shall be in full effect on the portion which is
undeveloped.

Dear Ladies and Gentlemen:
The above referenced Agreement between our two cities, for emergency 911-dispatch
and jail service; fire protection; and emergency ambulance service, expires by its terms
on September 30, 2003. Paragraph A (I) of the Agreement calls for ninety (90) days
written notice to the other party to thereafter cancel the Agreement. ,This letter shall
serVe as the ninety (90) day written notice by the City of La Porte, that this Agreement
will be cancelled at the close of business on January 17, 2004.
The City of La Porte offers to the City of Morgan's Point, a n'ew one year Agreement.
effective October 1, 2003. If acceptable, please place this on your City Council agenda
for approval by ordinance, and forward to the City of La Porte, which will then place on
its agenda for approval by ordinance.

water well located on Lessor's property during the period of the lease.
5. Notice to Lessee of Need for Reoair. Lessor shall notify Lessee by fax or by email any
time the water well is out of service and Les~ee shall have its contractors or agents inspect the water
well within 24 hours of the time notice is received and will thereafter proceed to repair the well in a
good and worlananlike manner until the repair IS completed. Further, Lessee will perform

. SUMMARY & RECOMMENDATION
Economic Development was one of the City Council's top priorities in our goal development
session. The vitality of Main Street is critical to that endeavor.
In a recent retreat with City Council, staff presented the-enclosed proposal to attain a
professional Main Street Coordinator to assist the City Manager's Office in focusing solely on
this element and pursue inclusion in the Main Street Program. This proposal will not only
address the needs of Main Street, but would also assist all downtown revitalization and
Economic Development endeavors. If approved by City Council, staff plans to attain a
professional to attend training in early 2004, a grant could be presented in Summer 2004, for an
award in Fall 2004.
Staff met with the Main Street Association Board regarding this proposal. The Board members
present at the meeting expressed their support of this program.
The proposal includes a budget of appropriately $100,000. Appropriately one-half of this
amount is for administrative costs. The other one-half is for possible projects and grant
matching. Staff is requesting funding one-half of this project from the General Fund
Contingency and the other half with expected increases in sales tax revenue.

Texas Main Street Program Overview
The Texas Main Street Program, part of the Texas Historical Commission's (THC)
Community Heritage Development Division, helps Texas cities revitalize their historic
downtowns and neighborhood commercial districts by utilizing preservation and
economic development strategies.
,The Texas Main Street Program is among the most succes,sful downtown revitalization
programs in the nation, and has assisted more than 130 Texas cities through the program.
The program has resulted in the private reinvestment of more than $860 million in Texas
downtowns and neighborhood commercial districts, the creation of more than 18,200 jobs
and the establishments of more than 4,600 new businesses.
Program Benefits and Requirements
Each year the Texas Historical Commission selects up to five Texas cities and urban
areas as official Texas Main Street cities. Selected communities are eligible to receive a
range of services.

Requirements
Texas cities with historic commercial buildings in their downtowns and neighborhood

Cities with population up to 50,000 must agree to hire a full-time Main Street Manager'

Cities that complete the three-year program may enter the Graduate Program and
continue to participate in the Main Street network.

Benefits
The Main Street Program works with each of the selected comrtlunities for 3 years,
providing start up assistance and developing more local initiative and expertise in the
second and third year. Cities designated as Texas Main Street cities are generally favored
when applying for grants.
Training and supervision of the local manager is provided, as well as professional
assistance and supervision in design, restoration, marketing, parking, and other areas
where the community does not have local expertise.
Options if a community is not selected
A community may be designated a self-initiated Texas Main Street city ifit applies for
the official program the previous year and meets other program requirements. The
community must have a full-time program manager that has been trained by the Main
Street program and meets other program requirements.
Self-initiated cities receive limited assistance in the form of periodic Main'Street staff
visits, merchandising and display assistance, participation in Main Street training
sessions, and help in finding professionals to provide required design, marketing,
parking, and other assistance.

. City of La Orange agreed to provide funding for a Main Street Manager and Office

. At the end of the 3 years, the City opted to extend and continue the Main Street

. Main Street La Grange also accepts private donations and sponsorships for the
downtown revitalization efforts.
. The La Grange Main Street Program holds various fundraisers throughout the year to
raise funds for an Incentive Grant Program targeted at building .and business owners
in the community to assist them with improvements.

participate in the Main Street Program (excerpts attached).

DEFINITION
Responsible for the implementation of the Texas Main Street Program and for
coordinating downtown interests in a unified manner. Identifies available resources
to preserve and revitalize the downtown area. Develop a long-term strategy,

Several related plans and studies have previously addressed redevelopment needs within La Porte.
City of La Porte Comorehensive Plan (t 984)

The City in 1993 re~ained' a consu>'lnt team to develop a Marina Waterfront District Master Plan.
This study was intended to stimulate new ecoi,::,mic development, diversify ,the City's economic base
through stimulation of tourism; and encourage impro\'\;~ent in the physical environ,ment by taking b~tter
advantage of La Porte's waterfront assets. The report pointe~ ::,ut that while La Porte's baY-front was once
the site of grand celebrations and intense summer holiday actiyiry, ~l,e area had experienced considerable
decline ,as a regional recreation destination. The consultant recomn;~ndations ranged from "safe,
immediately-achievable" physical improvements to more ambitious project prop~~~ls t~at would 'vastly
transfonn La Porte. The City continues to desire the types of major waterfront deveivk- " nts depicted in
this plan, including a hotel and conference center and a marina on Galveston'Bay.
Historic: Downtown Area
A Central Business District (CBD) , is traditionaIIy the commercial center of a city. This is
characterized in most cities as an area of higher land values; a concentration of retail businesse:i. ,';':1ces, ..
governmental functions, fmancial institutions,' and service businesses; and,' cultural and entertainment
activities. A vital component to the CBD is its re~aiI patrons. However, patrons and visitors will not come
to the CaD without adequate parking, pedestrian amenities, a variety and balance of retail and service
stores, pleasant aesthetics, s~ft1cient street lighting to create a secure and s~fe environment, and ease of
access. The photograph shown in Figure 12.1 - Historic Downtown La Porte, illustrates the existing
conditions in downtown.' '
As in many cities, La Porte's historic downtown area along Main Street is no longer the City's
primary commercial center. However, it is an area that clearly is still valued by La Porte residents; as
indicated during the current comprehensive planning process. Improvements can be made to the physical
appearance and functionality of the downtown area that will have a significant impact. Currently, there
, ,
may be a perception of architectural discontinuity, a lack of .identity, and aging or deteriorating buildings
and infrastruct~e that define the image of the old downtown. ,Nonetheless, existing building and vacant
parcels may present opportunities for fulfilling special needs or uses in the downtown area such as parks
and open space, parking and other locally identified retail, entertainment and service needs. The City's
1984 Comprehensive Plan pointed out the need for ,more retail development in La Porte~, and this need
continues. In the City's current marketing brochure, "La Porte, Texas: Ready for Business," La Porte's
City Manager notes the City's desire to attract new retail businesses, including supermarkets, shopping
centers and new full serVice franchise restaurants. Some of these uses could be attracted to downtown or
the vicinity to bolster this area.

.An initial step that the City can take in the downtown area is to conduct an inventory of existing
building conditions. Each building would be classified as standard, sl,lbstandard, or dilapidated. A standard
condition is defined as a building with few or no visual defects, and any defects that do exist are considered
minor. A building with a substandard condition requires repair that is typically not within the regular
course, of maintenance and upkeep, such as rotted awnings, cracked ~oundations and deteriorating mortar.
These repairs are of an intermediate nature. The final condition category is dilapidated, 'which is defined as
a building with major structural defects. Once this information is assembled, City staff can then determine
which blocks have a disproportionate share of deteriorated buildings and where rehabilitation needs are
greatest.
It is also important to document those buildings that have been renovated, are well maintained,
have unusual architecture, or otherwise add to the appearance of the downtoWn area. Some structures might

A significant industrial and retail business community frames and encapsulates the residential
area of the Northside. One cannot enter the Northside neighborhood without crossing the natural
geographic boundaries created by Main Street businesses on the south, Broad way commercial
areas on the west, the Port of Houston industrial complexes and truck traffic from Barbour's Cut
on the north, and the light industries and small businesses on the SH 149 feeder and 8 Ib Street on
the east., These border areas are pennanent, immutable parts of the Northside neighborhood, as
intricately intertwined in the future of the residential community as the residents themselves.
Without doubt, they are part of the neighborhood's problems and will be part of their solution.

Since a major factor driving the entire planning process is the community's desire to attract new
families to the Northside, it is important to understand that prospective home buyers seek more
than just a house. They also want to live in areas that show strong si gos of social and economic
vitality. For better or worse, the bordering commercial zones create a visitor's tirst impression of
the Northside. And, like the neighborhood they surround, the business areas show evidence of
decline. While there are a number of well-kept, apparently thriving retail businesses on Main
Street, there are also numerous vacant, boarded-up storefronts. Along Broadway and 8th Street
some poorly maintained industrial and light commercial properties need to be cleaned up. Lastly,
overgrown vacant lots that front on 81b Street, Barbour's Cut and Broadway attract illegal
dumping, harbor vennin and detract from the overall appearance of the Northside area. Strategies
and action recommendations described in the Beautification and Urban Design section will help
increase the Northside's overall appeal.

Besides the improvement of the commercial zones' physical condition, there perhaps are more
important opportunities available to benefit both present and potential Northside citizens, Th ese
opportunities lie in building up the business community and attracting new commerce. A major
concern ofNortbside citizens expressed in the September community meeting, by the Steering
Committee, and by respondents to the neighborhood survey is the ne ed for jobs and job training.
Two factors offer hope that these needs may be met. First is the fact that the state of the national
and regional economy is strong, and the outlook for the future looks bright. Texans have more
disposable income, the job market is tight, and opportunities for new business and job creation
abound. The second factor is the Port of Houston's plans to build a new container tenninal at
Bayport. With funding approved by Harris County voters, this project will produce an estima ted
28,580 jobs for the area and 5633.3 million in revenues. By taking certain proactive steps now,
the Northside area has an excellent opportunity to capture a portion of these strong economic
trends and new developments for itself.
Strategy: Develop a visionary, community-based system to direct actions toward building
a strong economic base for new business,s and Jobs together with affordable housing

To seize the opportunities for renewal that now seem apparent requires consideration of a method

reach its potential. This is a task that requires the development of a common vision among all '

neighborhood residents, property owners, church leaders, school administrators and teachers,
business owners, government officials and, by extension, all those who live and work in La Porte.

This exhibit summarizes the site and base data analysis and identifies specific ,
opp.ortunities for development/redevelopment and beautification. These include
properties both within the study area and immediately outside it but logically
linked to the strategic development of the Marina Waterfront District. The latter
description applies to the Main Street corridor, to the Filirmont Parkway corridor
from Highway 146 to Broadway, to the significant area of undeveloped land
immediately west of the golf course, and to the residential district north of the
study area between E and Main Streets.
Since a primary goal in conducting the Marina Waterfront District Master Plan
study is the stimulation of tourist visitation of La Porte's historic waterfront, the
Consult~nt team's plan recommendations are perhaps best presented a,s they
would be experienced by a visitor to the District. A logical starting point in
describing the waterfront improvement plans is at the intersection of Highway 146
and Main Street. This intersection, the northern-most entrance to the District from
Houston, is a natural gatew:ay for the visitor to the City of La Porte: , '

The western area of Main Street is characterized by a significant number qf
vacant lots with some interspersed historic structures. At approximately
Sixth Street, the frequency of historic structures increases, and between
Fourth Street and Broadway, Main Street has,a succession of residual historic
structures. This area (from Sixth Street to Broadway) has been recently, " ':" ' :
resurfaced and offers the visitor an image of La Porte's historic commercial,',' ..

movements at this,intersection have to be controlled to avoid line-of-sight ,,:," ,:", '
problems and traffic conflicts. An alternate solution to this intersection that " ..
would greatly enhance the visual character of Main Street while addressing
the traffic issue would be the construction of a large rotary, or roundabout, ,
with a significant landscape feature in the center. This feature could be '
comprised of planting and/or fountains and/or statuary, perhaps .... ,
celebrating some important part of La Porte's history. The rotary would also
naturally guide traffic toward Sylvan Beach by way of San Jacinto Boulevard.

A third potential project is the restoration of San Jacinto Boulevard as an
important vehicular access to Sylvan Beach. The existing right-of-way will
allow a boulevard road section which would accommodate an esplanade for

Boulevard is largely publicly-owned land, and as such, the street is a logical
