July 12,2004
1. CALL TO ORDER
The meeting was called to order by City Secretary Martha Gillett at 6:00 p.m.
Members ofCitv Council Present: Councilmembers Chuck Engelken, Howard Ebow, Peter Griffiths, Tommy
Moser, Mike Mosteit and Louis Rigby
Members of Council Absent: Mayor Pro Tern Barry Beasley

2. City Secretary Martha Gillett requested a motion to elect a temporary Mayor Pro Tempore for today's
meeting.
Motion was made by Councilmember bv Chuck Engelken to appoint Peter Griffiths as Mavor Pro Tempore for
this meeting.. Second by Councilmember Ebow. Motion carried.
Ayes: Engelken, Griffiths, Moser, Mosteit, Rigby and Ebow

3. Reverend Mary Currie ofSt. James Presbyterian Church delivered the invocation.
4. Mayor Pro Tempore Peter Griffiths led the Pledge of Allegiance.

B. Council to consider approval of second renewal of Service Agreement for a term of one (1) year per

Motion was made by Councilmember Moser to approve the Consent Agenda as presented. Second by

Interim Planning Director Nick Finan provided a summary of Special Conditional Use Permit for 2.14 acres,
allowing expansion to existing La Porte Self Storage.
Public Input: There were no citizens wishing to provide input.
Planning and Zoning Recommendation - the Planning and Zoning Commission recommended approving the
request.
Public Hearing was closed at 6: 10 p.m.
8. Council to consider taking action on an Ordinance for a Special Conditional Use Permit for 2.14 acres,
allowing expansion to existing La Porte Self Storage located at 2915 North 23rd Street as requested by Mr.
William Thomas.

AMENDING THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, CHAPTER 106, MORE
COMMONLY REFERRED TO AS THE ZONING ORDINANCE OF CITY OF LA PORTE, BY
GRANTING A SPECIAL CONDITIONAL USE PERMIT FOR THAT CERT AIN PARCEL OF LAND
DESCRIBED AS FOLLOWS, TO WIT: 2.14 ACRES, PART OF THE RICHARD PEARSALL 1/3
LEAGUE, ABSTRACT 625, LA PORTE, HARRIS COUNTY, TEXAS, FOR THE PURPOSE OF
EXPANDING A MINI-STORAGE AND WAREHOUSING MAKING CERTAIN FINDINGS OF FACT
RELATED TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND

9. Open Public Hearing - Mayor Pro Tempore Griffiths opened the Public Hearing at 6: 11 p.m.

located along Caniff Road to rezone the property
Public Input: There were no citizens wishing to provide input.
Planning and Zoning Recommendation - the Planning and Zoning Commission recommended approval.
Public Hearing was closed at 6: 17 p.m.
10. Council to consider taking action on an Ordinance for 4.9 acres of land located along Caniff Road to rezone
the property from R-l to R-2 for proposed expansion ofthe church's parking lot at 9601 W. Fairmont Parkway
as requested by First United Methodist Church.

CHANGING THE ZONING CLASSIFICATION FROM LOW DENSITY RESIDENTIAL TO MEDIUM

11. Open Public Hearing -Mayor Pro Tempore Griffiths opened the Public Hearing at 6: 19 p.m.
Review by Staff - Interim Planning Director Nick Finan provided an overview on an ordinance for 2.520 acres
of land located in the 700 block of SH 146 to be rezoned.
Recommendation of the Planning and Zoning Commission - the Planning and Zoning Commission
recommended denial of the request by a 6-0 vote. If City Council wishes to overturn the negative
recommendation, it requires a % vote of the entire Council (7 members).
Public Input: Rebecca Terry spoke against the approval of the new Truck Stop site. She also informed
Council of existing problems in the area with drugs and prostitution.
Public Hearing was closed at 6:30 p.m.
12. Council to consider taking action on an ordinance for 2.520 acres of land located in the 700 block of SH 146 to
be rezoned from GC to BI as requested by Ajay Jain. The applicant seeks to rezone the property for a
proposed development of a truck stop.
The Planning and Zoning Commission recommended denial of the request by a 6-0 vote. If City Council
wishes to overturn the negative recommendation, it requires a % vote of the entire Council (7 members).

CHANGING THE ZONING CLASSIFICATION FROM GENERAL COMMERCIAL TO BUSINESS
INDUSTRIAL REQUESTED BY MR. BOBBY GRISHAM ON BEHALF OF MR. NlRANJAN PATEL,
THE OWNER OF THIS 2.520 ACRE TRACT LOCATED ALONG FEEDER ROAD OF THE STATE
HIGHWAY 146 HEREIN DESCRIBED; MAKING CERTAIN FINDINGS OF FACT RELATED TO THE
SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; PROVIDING AN
EFFECTIVE DATE HEREOF.

13. Council to consider taking action on Resolution 2004-06-A to extend and expand the moratorium on new
construction in the Main Street area up to 180 additional days. This item was previously tabled at the June 14,
2004 City Council Meeting.

Planning Staff recommends the extension and expansion of Resolution 2004-06-A.

Assistant City Attorney Clark Askins read: RESOLUTION 2004-06-A - A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF CITY OF LA PORTE, TEXAS, RENEWING, EXTENDING, AND
EXPANDING A MORATORIUM ON THE ACCEPTANCE FOR FILING AND THE ISSUANCE OF
BUILDING PERMITS AND ALL OTHER ZONING AND/OR DEVELOPMENT PERMITS FOR NEW
CONSTRUCTION IN THE MAIN STREET DEVELOPMENT DISTRICT; PROVIDING THAT SUCH
MORATORIUM SHALL EXPIRE AFTER ONE HUNDRED EIGHTY (180) DAYS OR DISPOSITION OF
ZONING CHANGE PROCEEDINGS WITH REGARD TO SUCH DISTRICTS, WHICHEVER COMES
FIRST; PROVIDING FOR SPECIAL EXCEPTIONS IN THE EVENT OF HARDSHIP AND PROVIDING
AN EFFECTIVE DATE.

14. Council to consider approval of an ordinance authorizing the Mayor Pro Tempore to execute an agreement
with Harris County for the construction of Canada Road.

P ARKW A Y; MAKING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT;
FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE
DATE HEREOF.

questions. This item was previously tabled at the June 28, 2004 City Council Meeting.

CHAPTER 102, NATURAL RESOURCES, ARTICLE IV, PIPELINE TRANSPORTATION SECTIONS
102-231 THROUGH 102-265, INCLUSIVE, BY REPEALING CURRENT SECTIONS 102-231 THROUGH
102-265 AND REPLACING THEM WITH THE FOLLOWING; AND FURTHER AMENDING APPENDIX
A - FEES OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, SECTIONS 102-264 BY
REPEALING THE FEES ESTABLISHED HEREIN AND REPLACING THEM WITH THE FOLLOWING;

MIS Manager Al Owens presented summary and recommendation and answered Council's questions.

AND AUTHORIZING A CONTRACT BETWEEN THE CITY OF LA PORTE AND RJS SOLUTIONS
FOR PROVIDING SERVICES FOR NETWORKS RESTRUCTURE AND IT MANAGEMENT SERVICES;
APPROPRIATING $34,000.00 TO FUND SAID CONTRACT; MAKING VARIOUS FINDINGS AND
PROVISIONS RELATING TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS
LAW; PROVIDING AN EFFECTIVE DATE HEREOF.
Motion was made bv Councilmember Rigbv to aoorove the contract as Dresented. Second by Councilmember

17. The Regular Meeting closed and the Workshop Meeting opened at 6:57 p.m.
A. Receive 90 Day Report from Human Resources Manager Sherri Sampson.
Ms. Sampson provided an overview of Human Resources accomplishments within the last 90 days. (See
attached slide show).
B. Receive Report from Bayport Expansion Review Committee from Chairman Chuck Engelken. Minutes of
the meeting have been placed in the vault as a permanent record.
18. The Workshop Meeting closed and the Regular Meeting reconvened at 7:35 p.m.
19. ADMINISTRATIVE REPORTS
Early voting for Mayor and District 6 Special Election will be held at the City Hall Council Chambers
beginning July 7, 2004 and ending on July 20, 2004 from 8:00 a.m. to 5:00 p.m. and on Saturday July 10,2004
at City Hall Council Chambers from 8:00 a.m. to 5:00 p.m. on Election Day July 24, 2004.
The Newly Elected City Offiicals' Orientation will be held July 23-24 and August 20-21, 2004 in Austin,
Texas.
Budget Workshop Meetings week of August 9, 2004.
Ms. Feazelle announced that Mr. Finan the Interim Planning Director has accepted a position with another
City. She thanked him for all his hard work and efforts while with the City of La Porte.

SUMMARY & RECOMMENDATION
Advertised Sealed Bid #04029 for Firefighter Protective Clothing was opened and read on July 6, 2004.
Bid requests were mailed to seven (7) suppliers, with four (4) returned bids.
Dooley Tackaberry submitted pricing for protective clothing that did not meet specifications.
Using estimated yearly quantities, the total cost would be $29,950. This is four percent (4%) increase
over current pricing.
The contract is for one (1) year with four (4) additional one (I) year renewable option periods.
Staff Recommendation:
Staff recommends award of annual contract for firefighter protective clothing (bunker gear) to low bidder
meeting specifications.

Mayor Pro- Tem and City Council:
The La Porte Planning and Zoning Commission, during a regular meeting on May 20,
2004, held a public hearing to consider renaming Canada Road to East Boulevard
connecting with Deer Park and planned to continue through La Porte into Pasadena. The
request was made in conjunction with the proposed widening of Canada Road.
The Planning and Zoning Commission, unanimously (by a 6-0 vote), recommends that
City Council adopt the proposed change.

RE: Reimbursement to citizens affected by renaming of Canada Road
Dear Mr. Finan:
In connection with questions raised by members of the La Porte City Council
concerning possible economic reimbursement to citizens affected by the renaming of
Canada Road to East Boulevard, you have asked our office to prepare a memorandum
regarding the allowable scope of such measures.
After consultation with Assistant City Attorney John Armstrong and City Attorney
Knox Askins, it is the legal opinion of our office that the City of La Porte may legally
provide limited, monetary assistance to qualifying residents who live on Canada Road,
or have a Canada Road mailing address, and who face actual out-of-pocket expenses
due to the name change to East Boulevard. Those individuals, or entities, as the case
may be, that do not actually incur quantifiable expenses should not be considered for
reimbursement, as this would in essence amount to a gratuitous appropriation or
donation in violation of Texas Constitution Article XI, Section 3. As such, we are
recommending that City Council adhere to the following general guidelines if the
decision is made to institute a reimbursement program:
1) A formal claims process should be provided for affected residents, in which
applicants are asked to complete an application form and other necessary
paperwork, to document their claims for out-of-pocket expenses.
2) For purposes of administrative efficiency, it is recommended that City
Council by resolution authorize the City Manager's office to process and
render the final decision on each application.
2) The application should itemize by category and cost the list of expenses the
applicant is claiming.
3) The City Manager should not be limited to a straight up or down vote on each
application, but may take a "line-item" approach in which the City Manager's

office accepts or rejects individual claims for reimbursement where multiple
claims are made by a single applicant.
4) The City Manager should take each application on a case-by-case basis,
based on consideration of the merits of each application, the facts and
circumstances of the underlying case(s), and consideration of the guidelines
contained within this memorandum.
, 5) The City Manager's office should establish caps for reimbursement to
individuals, families, or businesses, as the case may be, to a set dollar
amount. This may be a graduated scale, whereby an individual is limited to a
certain sum, and a family or business is entitled to a higher cap
6) In general, the City Manager should limit reimbursement to "small" items, such
as changes in lettering, minor signage, stationary, etc.
7) Finally, we would recommend that city staff be cognizant about contacting
associated utility companies in connection with the name change.

Canada Road Residents - Opposition to Changes
Dear Council members,
The undersigned residents of Canada Road, La Porte, TX respectfully oppose the renaming of our street and the
renumbering of homes thereon. We have many reasons, and the more relevant ones are listed below:
1. The request to change came from a person who does not even live on Canada Road. Advantages to this
person are readily offset by the disadvan~es to residents who do live there.
2. Examples of the disadvantages are:
a. This is a major, unnecessary inconvenience for residents on Canada Road.
b. Extensive address clUmges must be sent to every supplier of materials and services.
c. Residents will be notifying family and friends of their new addresses for a long time.
d. Residents must notify banks and other financial institutions of new mailing addresses.
e. Banks must veritY addresses on Canada Road so statements and notices will mive on time.
f. Drivers Licenses, Social Security, Teachers Retirement, and Health-Care, and other documents will have
to be upgraded.
g. Responses to emergencies on Canada Road may be delayed because of address confusion.
h. Out-of-tOWD businesses will struggle over a long period to correct customers' addresses.
i. Memories of the expense, aggravation, and inconvenience of unneeded changes will last a long time.
j. The list goes on, but we believe Council will understand that the problems far outweigh the rewards.
We ask and believe that you will objectively consider our concerns, and conscientiously decide in our favor.

When Lewisville senior citizens and disabled people receive their tax bills this
year, they can breathe a sigh of relief. The amount they pay in 2004 will be the
amount they will pay for years into the future.
The tax freeze was approved, 4-1, by the city council last night, with the
amendment that the council would, in January, consider adjusting the senior
homestead exemptions already in place.
Council member Mike Nowels, who cast the vote against the freeze, said he is not
against a reduction of taxes paid by senior citizens and disabled persons, but
that he did not want to make a quick, irreversible decision, when he felt not
enough research on the long-term results had been done.
Council member Rudy Durham, who is also the deputy chief appraiser in the Denton
County Appraisal District, requested that the item be put on Monday's agenda for
consideration. He said the idea of the tax freeze had been discussed in the past
by the council, but was put off while legislators were debating school finance
reform.
"In my mind, we can't wait to see what the legislature does," Durham said. "My
intent would be to keep the exemptions the way they are, but I can see that there
may be a need to adjust them."
Currently, property owners ages 65 and older receive a $60,000 exemption -
meaning that $60,000 is knocked off the total value of the house. An exemption of
$20,000 is granted for disabled persons. The exemptions are not income-based and
a person can qualify for only one, not both.
They are also considerably higher than those given in the other cities that have
passed tax freezes, which include Euless, Grand Prairie, Hurst and Plano. The
city's current exemption is also much higher than the minimum set by the state.
Council members agreed to gradually adjust the exemption amount, starting in
2005, to offset some of the future revenue lost because of the freeze. They also
said they would like to see less of a difference between the exemption amount
given to seniors and that given to disabled persons.
There was much discussion among the council members before they reached a
decision, including concern about the uncertainty of the state legislature
regarding school finance reform. Others were very cautious about putting the
freeze in place, because it is a permanent move and cannot be repealed.
But a decision had to be made on Monday if the freeze would occur with the 2004
tax bill.

In the end, council members decided that because the city has been.prudent with
its business in the past, the city could afford to watch out for their senior
citizens and disabled persons by providing them with this benefit.

BEDFORD - The city's tax-freeze saga is over.
Many seniors got their way Tuesday night after an eight-month clash that cost a
City Council member his seat and forced a debate on the city's financial future.
The council voted 4-3 to lock in property-tax bills for disabled residents and
the nearly 2,100 senior households in Bedford.
The freeze cannot be revoked, city officials said. Budget projections have
indicated that the freeze will cost about $5.2 million over the next decade,
though supporters dispute that figure.
Mayor Rick Hurt, who voted against the freeze, said the city will have to raise
taxes for the other Bedford residents to keep property-tax revenues where they
are.
"It does create some challenges," Hurt said. "It falls to our younger taxpayers"
to make up the difference.
Bedford resident Bob Stewart, who spoke in favor of the tax break at the meeting,
said Hurt is making excuses.
"Now everything is going to be blamed on the tax freeze," he said. "All they need
to do is be more prudent in other spending."
Backers saw the vote as a victory for residents older than 65 who have paid taxes
for years and face financial difficulties on fixed incomes.
Opponents worry that the city is already facing a tight budget, and they have
argued that the city's $50,000 property-tax exemption for seniors is more
generous than breaks given by nearby cities.
Councilwoman Lori Nail, the council's chief backer of the freeze, said residents
have been heard. She said the city's finances were already unstable before the
freeze.
"We need to move forward," she said.
Councilwoman Alicia McGlinchey, who voted against the freeze, said the tax freeze
is the least of the city's problems. Council members and residents pointed out
Tuesday night that the city's sales tax revenues have also been declining.
"It's just piling onto an already precarious financial situation," she said.

Nail was joined by counc~en Leahmon Chambers, Roy sa~e and Jim Griffin in
voting for the freeze. Hurt, McGlinchey and Councilwoman Pam Conley voted against
it.
Since November, the council has grappled with the measure four times, with 4-3
votes see-sawing each time. In November, the council narrowly passed the freeze,
only to backtrack in January.
In response, a community activist group targeted former Councilman Kim Smith, who
opposed the freeze, in the May election. The group backed Chambers, who won along
with Nail.
Earlier this month, the new council majority reversed the January decision and
approved the first reading of the ordinance.
Colleyville, Southlake and. several other area cities have adopted the freeze
since September, when voters approved a state constitutional amendment allowing
municipalities to enact the tax break.
Many opponents of the freeze had wanted voters to decide the matter, but Nail,
among others, said the May election gave the council a mandate.
School districts are required by state law to freeze property taxes for
homeowners who are 65 and older. School districts must also grant a $10,000
property-tax exemption to senior citizens.
Many at Tuesday's meeting said the city now needs to put aside its differences
and move on.
"I hope this is the last time we have to discuss this," said Ralph Good, a
Bedford resident who spoke on behalf of the measure.
Hurt said later that he couldn't agree more.
"If I never hear the words tax freeze again, it will be too soon," he said.

Critics of three City Council members who voted to freeze property taxes for
senior adults and disabled people submitted 635 signatures Thursday on a petition
asking for a recall election.
If the city secretary confirms that at least 500 signatures are those of
registered voters in Benbrook, the council would ratify the petition at its July
1 meeting. The recall election would then be set for Sept. 11, city officials
said.
Council members John Vander Pan, Ron Saurna and Keith Bailey said they voted for
the tax freeze March 4 because more than 80 percent of the city's residents voted
in favor of a state constitutional amendment allowing cities; counties and junior
college districts to enact. the tax break.
Councilman Al Griner, who did not seek re-election in May, also favored the
freeze.
Mayor F.T. Hebert and council members Jerry Dittrich and Rickie Allison voted
against freezing taxes.
Mark Greene, an organizer of Recall 357, said the council members made an
irresponsible decision because the tax freeze cannot be rescinded.
"The council knew that it was irrevocable," Greene said. "You don't pass things
that are irrevocable."
Greene said he voted for the constitutional amendment but did not realize then
that the tax freeze couldn't be rescinded once it passed.
Saurna said he was "proud that I was able to freeze seniors' taxes in our city."
"I believe that seniors on fixed incomes and people with disabilities deserve
this," he said. "How can anybody deprive them of a break?"
Bailey agreed, saying that before voting, he talked to many residents who favored
freezing taxes.
Vander Pan said he wasn't surprised that the group got the signatures, but is
concerned about the expense of the election.
City Manager Cary Conklin said renting voting machines and printing ballots
probably would cost $5,000 to $7,000, which does not include city employees'
salaries. The city budgets money for elections every year, he said.

Members of Recall 357 sai~the council made a hasty de!l!ion with the 4-3 vote,
disregarding information from the city staff showing that Benbrook would lose tax
revenue while seeing an increasing senior citizen population.
Vander Pan said the council did not receive "complete" information from city
staff about the prospect of new commercial development along u.s. 377, or that
more homes would be built in Benbrook. The loss of revenue from the tax freeze
will be minimal in the city's budget, he said.
Conklin said he gave the council information based on facts. The city's senior
population is increasing, he said, pointing to the 2004 census, which showed that
18 percent of the city's residents are senior adults, compared with 10 percent
seniors in the 1990 census.

HALTOM CITY - The City Council granted final approval to a senior tax freeze
Monday night after two hours of testimony from residents who were sharply divided
over the issue.
The council approved the tax freeze 5-2, with Councilmen Bill Lanford and Dale
Clark voting against it.
About half of the 21 residents who addressed the council said seniors deserve a
tax break after years of paying their dues to the city. The others pushed the
council to reject the tax cap, saying it would force the city to cut services and
place a larger tax burden on businesses and younger residents.
"Times right now are kind of hard for people on fixed incomes, and I am on fixed
income," said Morris McCormick, 79, one of about 80 people who packed City Hall.
"Every dollar I make, I try to use it wisely."
The tax freeze is expected to cost the city about $1.9 million over the next 10
years, according to city estimates that assume a 5 percent annual increase in
property values, an increase in the number of seniors and disabled residents, and
a stable tax rate. The rate is 52.095 cents per $100 of assessed value.
A more conservative estimate puts the lost revenue at $1.1 million over 10 years,
assuming a 3.29 percent annual increase in property values and a slower rate of
increase in the number of seniors and disabled residents.
"I believe it is fiscally sound," Councilman Jim Sutton said. "I believe the
numbers and projections I have personally done show the impact will not be great
over time."
Seniors make up 2,344 and disabled residents 156 of the 13,500 households in
Haltom City. If the tax freeze had been in place for the last 10 years, the city
would have lost $582,370, based on actual figures.
Lanford said he voted against the freeze because he wanted to be fair to all
residents, young and old.
"The tax freeze could have a bad effect on the city's credit rating," Lanford
said. "The city is struggling to do the best we can already. There are other ways
we can help senior citizens here. We should. This is just not the way."
David Harper, 48, said he is worried that the loss of revenue will cause the city
to fall into disrepair.

"As well-intentioned as Allhink the tax freeze is, I d~t think it's fair, and I
think it cripples the city," Harper said.
The council granted preliminary approval to the freeze in October, but a final
vote was delayed as city officials gathered financial information. A recall
election that shut down the city government for three months also delayed the
process.
On the advice of the city attorney, the council decided last week not to hold a
special election Sept. 11 that would have let voters decide whether to allow the
freeze.
City Attorney Wayne Olson said the state constitution provides two ways to
implement the freeze: The council can approve it, or residents can force an
election with a petition. But the council cannot set an election, he said.
North Richland Hills set an election for Sept. 11 to decide on a tax freeze, but
that city's charter has different election provisions, allowing a different
interpretation, Olson said.
Bedford, Colleyville, Southlake and several other area cities have also approved
the freeze, which cannot be revoked.
What it means to you
The tax freeze will apply to seniors 65 and older and disabled residents. Their
tax bills will not increase, even if property values and property-tax rates do,
beginning with the tax bills that will be mailed in October.

SUMMARY & RECOMMENDATION
The Dangerous Building Board ofInspection is established by Ordinance No. 97-2198 and amended by Ordinance
#04-2700, Article VIII; Section 82-472. The Board is comprised of Debbie Wilmore, Chief Building Official;
Laurie Christensen, Fire Marshal; and Mike Boaze, Fire Chief. The Board has inspected ten (10) and found them to
be dangerous or substandard and declared a public nuisance and hazard, as described by Section 82-473.
Council is requested to review the Board's findings and then authorize a public hearing for the purpose of
condemning and ordering demolition of these structures. A hearing date of August 23, 2004 is requested.

L-l. Whenever any protective or safety device specified in The Electrical Code and of this title is not
provided or is inoperative, defective, dilapidated, or deteriorated SO as to threaten to fuil or function as originally
intended;
L-2. Whenever any installation or any portion thereofbec:ause of (a) dilapidation, deterioration, or
decay; (b) faulty construction; (c) obsolescence; (d) inadequate maintenance, which in relation to existing use
constitutes a hazard to life, health, property or safety;
3. Whenever any installation or any portion thereof which is damaged by fire, wind, earthquake,
flood or any other cause so as to constitute a potential hazard to life, health, property or safety;

cause to such an extent that the structural strength or stability thereof is materially less than it was before such
catastrophe and is less than the minimum requirements of the building code for new buildings of similar structure,
purpose or location;
L-3. Whenever any portion or member or appurtenance thereof is likely to fail, or to become detached
or dislodged, or to collapse and thereby injure persons or damage property;
L- 4. Whenever the building or structure, or any portion thereot: because of (a) dilapidation,
deterioration, or decay; (b) fiwlty construction; (c) the removal, movement or instability of any portion of the
ground necessary for the purpose of supporting the building; (d) the deterioration, decay, or inadequacy of its
foundation, or (e) any other cause, is likely to partially or completely collapse;
L-S. Whenever, for any reason, the building or structure, or any portion thereot: is manifestly unsafe for
the purpose of which it is being used;

decay; (b) faulty construction; (c) obsolescence; (d) inadequate maintenance, which in relation to existing use
constitutes a hazard to life, health, property or safety;
L-3. Whenever any installation or any portion thereof which is damaged by fire, wind, earthquake,
flood or any other cause so as to constitute a potential hazard to life, health, property or safety;
L- 4. Whenever any installation or any portion thereof was constructed, installed, altered or maintained
in violation of the building code and/or fire code so as to constitute a potential hazard to life, health, property or

catastrophe and is less than the minimum requirements of the building code for new buildings of similar structure,
pwpose or location;
L-3. Whenever any portion or member or appurtenance thereof is likely to fail, or to become detached
or dislodged, or to collapse and thereby injure persons or damage property;
4. Whenever the building or structure, or any portion thereot: because of (a) dilapidation,
deterioration, or decay; (b) fiwIty construction; (c) the removal, movement or instability of any portion of the
ground necessary for the purpose of supporting the building; (d) the deterioration, decay, or inadequacy of its
foundation, or (e) any other cause, is likely to partially or completely col1apse;
L-S. Whenever, for any reason, the building or structure, or any portion thereat: is manifestly unsafe for
the purpose of which it is being used;

heating apparatus or other cause, is detennined by the Board to be a fire hazard;
B. Dangerous or substandard electrical, plumbing, or mechanical installations.

L-I. Whenever any protective or safety device specified in The Electrical Code and of this title is not
provided or is inoperative, defective, dilapidated, or deteriorated so as to threaten to fiW or function as originally
intended;
L-2. Whenever any installation or any portion thereof because of(a) dilapidation, deterioration, or
decay; (b) faulty construction; (c) obsolescence; (d) inadequate maintenance, which in relation to existing use
constitutes a hazard to life, health, property or safety;
L-3. Whenever any installation or any portion thereof which is damaged by fire, wind, earthquake,
flood or any other cause so as to constitute a potential hazard to life, health, property or safety;
L- 4. Whenever any installation or any portion thereof was constructed, installed, altered or maintained
in violation of the building code and/or fire code so as to constitute a potential hazard to life, health, property or

2. Whenever any portion thereof has been damaged by fire, earthquake, wind, flood, or by any other
cause to such an extent that the structural strength or stability thereof is materially less than it was before such
catastrophe and is less than the minimum requirements of the building code for new buildings of similar structure,
purpose or location;
_3. Whenever any portion or member or appurtenance thereofis likely to fail, or to become detached
or dislodged, or to collapse and thereby injure persons or damage property;
_4. Whenever the building or structure, or any portion thereof, because of (a) dilapidation.
deterioration, or decay; (b) faulty construction; (c) the removal, movement or instability of any portion of the
ground necessary for the purpose of supporting the building; (d) the deterioration. decay, or inadequacy of its
foundation, or (e) any other cause, is likely to partially or completely collapse;
_5. Whenever, for any reason. the building or structure, or any portion thereof, is manifestly unsafe for
the purpose of which it is being used;

L-6. Whenever the building or structure bas been so damaged by fire, wind, earthquake, or flood, or bas
become so dilapidated or deteriorated as to become (a) a public nuisance, (b) a harbor for vagrants, or as to (c)
enable persons to resort thereto for the purpose of committing unlawful acts;
L-7. Whenever a building or structure, used or intended to be used for dweIling purposes, because of .
inadequate maintenance, dilapidation, decay, damage, faulty construction or arrangement, inadequate light, air, or
sanitation facilities, or otherwise, is determined by the Board to be unSanitary, unfit for human habitation or in
such a condition that is likely to cause sickness or disease;
_8. Whenever any building or structure, because of obsolescence, dilapidated condition, deterioration,
damage, inadequate exits, lack of sufficient fire-resistive construction, fiwlty electric wiring, gas connections, or
heating appamtus or other cause, is detennined by the Board to be a fire hazard;

1. Whenever any protective or safety device specified in The Electrical Code and of this title is not
provided or is inoperative, defective, dilapidated, or deteriorated so as to threaten to fail or function as originally
intended; .
2. Whenever any installation or any portion thereof because of ( a) dilapidation, deterioration, or
decay; (b) faulty construction; (c) obsolescence; (d) inadequate maintenance, which in relation to existing use
constitutes a hazard to life, health, property or safety;
3. Whenever any installation or any portion thereof which is damaged by fire, wind, earthquake,
flood or any other cause so as to constitute a potential hazard to life, health, property or safety;
4. Whenever any installation or any portion thereof was constructed, installed, altered or maintained
in violation of the building code and/or fire code so as to constitute a potential hazard to life, health, property or
safety.
