MINUTES OWGULAR MEETING AND WORKS MEETING
OF THE LA PORTE CITY COUNCIL
September 12, 2005
1. CALL TO ORDER
The meeting was called to order by Mayor Alton Porter at 6:00 p.m.
Members of City Council Present: Mayor Alton Porter, Councilmembers Chuck Engelken, Tommy Moser, Mike
Clausen, Peter Griffiths, Mike Mosteit, Louis Rigby, Howard Ebow and Barry Beasley.
Members of Council Absent: None.
Members of City Executive Staff and City Employees Present: City Manager Debra Feazelle, Assistant City
Manager John Joerns, Assistant City Attorney Clark Askins, Assistant Finance Director Michael Dolby, City

2. Reverend Bobbye Worsham of Second Baptist Church of La Porte delivered the Invocation.
3. Mayor Porter led the Pledge of Allegiance.
4. PRESENTATIONS / PROCLAMATIONS
A. Mayor Porter presented a proclamation in honor of Cancer Awareness Months.
Theresa Graves, Jay Dunham, Mildred Rosamond, Leroy Griffin, Olga Trevino, Chris
Caruthers, Dorris Baker, Marjorie and Carl Steubing and several citizens were present to receive
the Proclamation.
Ms. Graves invited the Council to attend the relay for Life in April 2006.
B. Mayor Porter presented a proclamation in honor of Constitution Week.
Candice Pulleine and Imogene Pulleine were present to receive the Proclamation.
C. Mayor Porter presented a proclamation to the La Porte Fire Department, Police Department, and
Emergency Medical Services recognizing their amazing demonstration to the University of
Texas MD Anderson Cancer Pediatric students.
D. Mayor Porter recognized retiree David Darby.
Mrs. Beth Darby accompanied Mr. Darby in receiving the recognition.

E. Mayor Porter and City Manger Debra Feazelle recognized Lillian Lago — Rotary Exchange
Student.
Debra Dye and Richard Schiff accompanied Ms. Lago in receiving the recognition.
5. CONSENT AGENDA
A. Consider approving Minutes of the Regular Meeting, Public Hearing and Workshop Meeting
held on August 22, 2005.
B. Council to consider approval or other action regarding a resolution nominating Bill Harry to
serve as a member of the Board of Directors of Harris County Appraisal District.
C. Council to consider approval or other action regarding a legislation designating the
representative for Houston — Galveston Area Council for 2006 Assembly and Board of Directors.
D. Council to consider approval or other action regarding adopting the National Incident
Management System for first responders and emergency operation staff.
E. Council to consider approval or other action regarding an Interlocal Agreement for Water Meter
Change- out & Retrofit Program and New Meter Supply.
F. Council to consider approval or other action regarding purchase of Acronis True Image Server
Software.
G. Council to consider approval or other action regarding purchase of anti -virus software from SHI-
Government Solutions.
H. Council to consider approval or other action regarding an ordinance accepting the Building
Codes Appeals Board recommendation and pass the ordinance adopting the local electrical
amendments with an implementation date of November 12, 2005.
I. Council to consider approval or other action regarding an ordinance authorizing the City
Manager to execute a Water Service Agreement with Baker Petrolite Corporation.
Council pulled items C,D,E and H for discussion.
Council member Mosteit noted on item C names needed to be designated and voted on.
It was noted on item D that it would be adopted as presented this evening and brought back to a
future meeting with minor grammatical changes.
Motion was made by Councilmember Rigby to accept itmes A. B, and D thru I on the consent
agenda Second by Councilmember Griffiths. The motion carried unanimously.

6. PETITIONS, REMONSTRANCES, COMMUNICATIONS, AND CITIZENS AND TAX PAYERS WISHING
TO ADDRESS COUNCIL ON ANY ITEM POSTED ON THE AGENDA
There were no citizens wishing to address Council.
7. Council to consider and take action on the PARS 457 Trust and authorize the City Manager to sign
contract.
Assistant Finance Director Michael Dolby presented summary and recommendation and answered
Council's questions.
Assistant City Attorney Clark Askins read Resolution 2005-17-WHEREAS IT IS DETERMINED TO BE IN
THE CITY'S BEST INTEREST AND ITS EMPLOYEES TO PROVIDE A QUALIFYING RETIREMENT
SYSTEM FOR ALL ITS EMPLOYEES NOT CURRENTLY ELIGIBLE FOR SUCH A QUALIFYING
RETIREMENT SYSTEM ("DEFERRED COMPENSATION FICA ALTERNATIVE PLAN"), THEREBY
MEETING THE REQUIREMENTS OF SECTION 11332 OF THE OMNIBUS BUDGET RECONCILIATION
ACT (OBRA 90) AND SECTION 3121(13)(7)(F) OF THE INTERNAL REVENUE CODE (IRC); AND
WHEREAS THE PUBLIC AGENCY RETRIEMENT SYSTEM (PARS) HAS MADE SUCH A SYSTEM
AVAILABLE TO THE CITY AND ITS ELIGIBLE EMPLOYEES AND QUALIFIES UNDER OBRA 90
SECTION 11332, IRC SECTIONS 3121(13)(7)(F) AND 457(B), AND MEETS THE MEANING OF THE TERM
"RETIREMENT SYSTEM" AS GIVEN BY SECTION 218(B)(4) OF THE FEDERAL SOCIAL SECRUTIY
ACT.
Motion was made by Councilmember Griffiths to approve Resolution 2005-17 as presented by Mr.
Dolby. Second by Council member Mosteit. The motion carried unanimously.

8. Council to consider approval or other action regarding resolution for acceptance of the appraisal roll
Assistant Finance Director Michael Dolby presented summary and recommendation and answered
Council's questions.
Assistant City Attorney Clark Askins read RESOLUTION 2005-13 A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF LA PORTE, TEXAS, ADOPTING THE 2005 APPRAISAL ROLL OF
THE HARRIS COUNTY APPRAISAL DISTRICT.
Motion was made by Councilmember Griffiths to approve Resolution 2005-13 as presented by Mr.
Dolby. Second by Council member Ebow. The motion carried unanimously.

9. Council to consider approval or other action regarding an ordinance establishing the tax rate for the
Fiscal Year 2005-06 at $0.71 cents per hundred dollar valuation.
Assistant Finance Director Michael Dolby presented summary and recommendation and answered
Council's questions.
Assistant City Attorney Clark Askins read ORDINANCE 2005-2838- AN ORDINANCE LEVYING
TAXES UPON TAXABLE PROPERTY LOCATED WITHIN AND SUBJECT TO TAXATION IN
THE CITY OF LA PORTE, TEXAS; MAKING APPROPRIATIONS FOR SUPPORT,
MAINTENANCE, AND IMPROVEMENT OF THE CITY GOVERNMENT OF SAID CITY OF LA
PORTE; FINDING THAT ALL REQUIRED NOTICES HAVE BEEN PUBLISHED AND ALL
REQUIRED HEARINGS HELD; CONTAINING A REPEALING CLAUSE; CONTAINING A
SEVERABILTY CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND
PROVIDING AN EFFECTIVE DATE HEREOF
Motion was made by Councilmember Clausen to approve Ordinance 2005-2838 as presented by Mr.
Dolby. Second by Council member Ebow. The motion carried unanimously.

10. Council to discuss appointing an official Voting Delegate and Alternate Delegate for the City of La
Porte at the National League of Cities Conference.
Motion was made by Councilmember Griffiths for Howard Ebow as delegate and Barry Beasley as
Alternate Delegate. Second by Louis Rigby. Motion carried unanimously.
Ayes: Engelken, Moser, Clausen, Griffiths, Mosteit, Rigby, Ebow, Beasley and Porter.
Nays: None
Abstain: None
11. Close Regular Meeting and Open Workshop at 7:07 p.m.
A. Council to receive report from City Manager on status of various control projects in La Porte and
provide direction.
It was noted this item is to be brought back to a future meeting and have Director Mike Talbot
present for discussions.
B. Council to receive presentation from Brian Sterling on GIS Website Application.
GIS Manager Brian Sterling provided Council with an overview and answered questions.
C. Council to discuss Boards and Commissions vacancies and provide staff with direction.

Council was provided a list of vacancies and citizens whose terms are expiring. They will be
prepared to make recommendations at a future meeting. Mayor Porter requested Council call
citizens to make sure they are willing to serve.
12. Close Workshop and reconvened Regular Meeting at 7:35 p.m.
13. Administrative Reports
City Manager Debra Feazelle reminded Council of the Elected Officials Appreciation Event, September
16, 2005 at Lakewood Yacht Club from 11:30 a.m. until 1:30 p.m., East Harris County "Swing Thing
2005 Golf Tournament, September 19, 2005 has been cancelled at Timber Creek Golf Club at noon,
Retirement Party honoring Genitha Smith (Public Works), September 23, 2005 at Evelyn Kennedy
Center from 6:00 p.m. until 10:00 p.m.
Ms. Feazelle introduced Cliff Meekins, Fire Marshal and Robert Swanagon H.R. Mnager.
Ms. Feazelle thank all those who worked on coordination the assistance to Katrina evacuees.
An update was provided on the recent PPG Explosion and Council requested staff have someone from
PPG present at the next meeting for discussions.
A report on computer difficulties was provided.
Ms. Feazelle noted there will be no land acquisition discussion during Executive Session this evening.
14. Council Comments
Moser, Beasley, Griffiths, Ebow, Engelken, Mosteit, Clausen, Rigby and Porter had comments..
Council Rigby requested the following be recorded in the minutes. He noted he was having difficulty
receiving information he requested. He has requested items 6 months ago, six weeks ago and two weeks
ago and has not yet received the information.

SUMMARY & RECOMMENDATION
Sealed Bids #05028 — Annual Medical Supplies were opened on August 8, 2005. Bid requests were mailed to
fifteen (15) vendors with six (6) returning bids, with one (1) no bid. None of the vendors bid on all items. Eight (8)
of the items tied for low bid. The tie was broken by a coin toss between the vendors to determine award of those
items. Per specifications, no less than five (5) items will be awarded to any one bidder.
Below is a list of the six (6) bidders offering low bid meeting specifications and the number of items and the total
amount to be awarded.

The total amount reflects a thirteen percent (131/6) increase over current pricing.
Staff Recommendation:
Approve the low bidder, meeting specifications for each line item be awarded the bid for that item. In the event that
a vendor cannot supply that item when requested then the next lowest bidder, meeting specifications would become
the bidder of choice.
Action Required by Council: Award Bid # 05028 — Annual Medical Supplies by line item as
described above, in the amount of $50,577.87.

SUMMARY & RECOMMENDATION
U.S. Communities is a Purchasing Cooperative that provides public agencies the opportunity to comply with state bidding
requirements, by utilizing their bidding process. City staff has researched various cooperative agencies and finds U.S.
Communities currently provides the best avenue for the lease of copiers.
Currently, the City is leasing eight Ricoh copiers from Digitex Corporation. Staff is pleased with the performance of the
Ricoh machines and especially satisfied with the service provided by Digitex Corp. In order to standardize all City
copiers, staff recommends using the U.S. Communities contract and leasing the copiers from Digitex Corp.
U.S. Communities complies with state regulations when bidding the products and provides multiple options, allowing the
best "fit" for each department according to their needs. Staff requests an interlocal agreement with U.S. Communities for
the procurement of miscellaneous items. There are no fees in association with using this cooperative agency.
The attached spreadsheet itemizes each copier, current lease, proposed lease, savings, cost per copy including supplies and
the total cost per month for each machine. Police CID is currently using an old copier that needs replacing. That copier
has been added to the eight machines to be replaced.
All departments, with the exception of the Fire Department, kept equivalent equipment or downgraded to a lesser speed.
The Fire Department and Emergency Management Coordinator upgraded to a color copier with fax and scan capabilities.
The color will allow them to produce quality color pamphlets and brochures previously sourced out at additional fees.
The new contract represents a seven percent (7%) decrease below current pricing. Sufficient funds have been budgeted by
each division for their copier fees. The agreement is for a 36-month period.
Staff Recommendation:
Staff recommends utilizing U.S. Communities_ Purchasing Cooperative for lease of copiers per the attached spreadsheet.
Action Required by Council:
Approve Interlocal Agreement with U.S. Communities and award copiers in the amount of $33.089.28.

MASTER INTERGOVERNMENTAL COOPERATIVE PURCHASING AGREEMENT
This agreement is made between certain government agencies that execute a Lead Public Agency
Certificate ("Lead Public Agencies") to be appended and made a part hereof and other government agencies
("Participating Public Agencies") that agree to terms and conditions hereof through U.S. Communities registration
to be appended and made a part hereof.
RECITALS
WHEREAS, after a competitive bidding and selection process by Lead Public Agencies, a number of Vendors
have entered into Master Agreements to provide a variety of goods, products and services based on national volumes
(herein "Products");
WHEREAS, Master Agreements are made available by Lead Public Agencies through U.S. Communities and
provide that Participating Public Agencies may purchase Products on the same terms, conditions and pricing as the
Lead Public Agency, subject to any applicable local purchasing ordinances and the laws of the State of purchase;
WHEREAS, the part16 desire to comply with the requirements and formalities of the Intergovernmental
Cooperation Act as may be applicable to the laws of the State of purchase;
WHEREAS, the parties hereto desire to conserve resources and reduce procurement cost;
WHEREAS, the parties hereto desire to improve the efficiency, effectiveness and economy of the procurement of
necessary Products;
NOW, THEREFORE, in consideration of the mutual promises contained in this agreement, and of the mutual
benefits to result, the parties agree as follows:
1. That each party will facilitate the cooperative procurement of Products.
2. That the procurement of Products subject to this agreement shall be conducted in accordance with and subject to
the relevant statutes, ordinances, rules and regulations that govern each parry's procurement practices.
3. That the cooperative use of bids obtained by a party to this agreement shall be in accordance with the terms and
conditions of the bid, except as modification of those terms and conditions is otherwise allowed or required by
applicable law.
4. That the Lead Public Agencies will make available, upon reasonable request and subject to convenience,
information which may assist in improving the effectiveness, efficiency and economy of Participating Public
Agencies procurement of Products.
5. That a procuring party will make timely payments to the Vendor for Products received in accordance with the
terms and conditions of the procurement. Payment for Products and inspections and acceptance of Products ordered
by the procuring party shall be the exclusive obligation of such procuring party. Disputes between procuring party and
Vendor are to be resolved in accord with the law and venue rules of the State of purchase.
6. The procuring party shall not use this agreement as a method for obtaining additional concessions or reduced
prices for similar products or services.'
7. The procuring party shall be responsible for the ordering of Products under this agreement. A non -procuring
party shall not be liable in any fashion for any violation by a procuring party, and the procuring party shall hold non -
procuring party harmless from any liability that may arise from action or inaction of the procuring party.
8. The exercise of any rights or remedies by the procuring party shall be the exclusive obligation of such procuring
party.
9. This agreement shall remain in effect until termination by a party giving 30 days written notice to U.S.
Communities at 2175 N. California Blvd., Suite 550, Walnut Creek, CA 94596.
10. This agreement shall take effect after execution of the Lead Public Agency Certificate or Participating Public
Agency Registration, as applicable.

Sealed bids #06001 — Heavy Trucks were opened and read on September 12, 2005. Bid requests were
mailed to eleven (11) vendors with three (3) returning bids. Both vehicles are replacements of existing
equipment, and are Funded through the Motor Pool Replacement Fund.

On Saturday, September 10, 2005, a receiver containing miscellaneous chlorofomates at the PPG
plant in LaPorte over -pressurized, resulting in releases of certain compounds to the environment.
The release began at approximately 13:30 and continued for approximately 45 minutes.

RE: Market Value Research Report Study regarding estimated market values
of various tracts of land for the proposed park expansion study, City of La
Porte, Harris County, Texas.
Dear Steve:
In accordance with your request, I have researched comparable sales and
listings in the La Porte area for use in preparing a market value study on
values of unimproved tracts of land. As we had discussed earlier, the basic
size range anticipated for these future park sites between 5 to 15 acres with
locations off of the major roadways.
Per our agreement, the data and limited analysis is presented in a very brief
discussion/memo format and the report does deviate from the USPAP as
permitted upon agreement between client and appraiser.
The data and conclusions gathered by my investigation is from source.9
believed reliable and true. In preparing this letter of opinion, a study of
comparable sales, listings and other related market data was performed.
It should clearly be understood that this letter report only constitutes only a
limited analysis and statement of the estimated value ranges for certain
general areas of a neighborhood and that does not presume to be the complete
analysis of a certain tract(s) nor a complete appraisal and is subject to the
preparation of a more formal study which can be ordered by the client at a
future date.

The intended user of this appraisal is the City of La Porte only. The intended
use is to determine an estimated market value range for at least six (6) of the
original 13 pre -defined zones in the city limits of La Porte. (see addenda for
zone map).
Given the scope of analyzing such a large market area and large amount of.
variances in such a market, I have made the following assumptions with
respect to some of the site characteristics of the potential park site.
- Reasonable access from dedicated public roadways
- No adverse deed restrictions and/or easements.
ZO E 1
The unit market values in this "zone" appear to vary generally from +-$0.25
PSF to over $1.00 PSF for larger parcels. This zone is located south of Spencer
and north of Fairmont Parkway on the most westerly end of La Porte City
limits as it transitions into Pasadena. Prime thoroughfare locations in this
zone tend to be more valuable here due to Spencer Highway and Fairmont
Parkway locations and the interior areas are either undeveloped tracts of land
or residential subdivisions. Sale 1 is located in the this zone with Sale 10
located just west of Zone 1 but is considered comparable. Average market
value for this zone is $0.77 PSF.
ZONE 3
The unit market values in this "zone" which were identified ranged from +-
$0.22 PSF to over $0.44 PSF. This zone is generally located north of Spencer
and south of North "P" Street in the westerly end of La Porte City limits as it
transitions into Deer Park. Prime thoroughfare locations in this zone tend to
be more valuable here due to Spencer and Fairmont addresses with interior
streets such as North "P" and North "L" Street typically having residential
uses located in a few existing planned subdivisions or larger tracts of 1 to 5+
acres. There are some special purpose use noted in this zone such as the La
Porte Airport. Sales 2, 3, 4 and 5 are located in the this zone with unit values

of $0.34, $0.60, $0.44, and 0.26 PSF with an average of $0.40 PSF for Zone 3.
ZONE 5
Zone 5 is located due east of Zone 3 just west of Sens Road and north of State
Highway 225. The unit market values identified in this "zone" appear to vary ;
generally from +-$0.25 PSF to over $10.00 PSF for tracts located on the major
commercial roadways. larger parcels. This zone is located north of Spencer
and south of State Highway 225 and west of Sens Road. It is considered to be
generally located in the central area of La Porte City limits. It is characterized
by having frontage on major city thoroughfares such as State Highway 225 as
well as Spencer Highway (aka West Main). Sens Road is primary north/south
road in this zone. Sens Road is primary north/south road in this zone. Sales
9, 11, & 16 were located in the this zone. The unit values for these sales were
as follows Sale 9- $0.30 PSF, Sale 11 - $0.26 PSF and Sale 16 -$1.26 PSF. The
average for Zone 5 was $0.61 PSF.
ZONE 6
This zone is located on the southerly end of La Porte city limits and lies south
of Zone 5. This zone lies north of the Bayport Industrial District. Uses in this
zone are primarily residential uses located along its west boundary and heavy
commercial to industrial uses located on its eastern boundary towards State
Highway 146 and Bay Area Blvd. Sales identified in this "zone" were as
follows, Sale 7-$1.35 PSF and Sale 8 - $1.79 PSF. These sales were located on
Fairmont Parkway which is a primary throughfare. Sale 12 is located in Zone
1 but was considered comparable to Zone 6 in terms of it use profile. Sale 12 tr
had a unit value of $0.39 PSF. The average for the sales identified with this
zone (including Sale 12) is $1.14 PSF.
ZONE 7
This zone is located south of Spencer Highway and north of Fairmont Parkway
on the most westerly end of La Porte City limits as it transitions into
Pasadena. Sens Road and State Highway 146 are primary north/south
roadways in this zone. Property usage is primarily commercial and industrial
along State Highway 225 and State Highway 146 with limited single family
residential uses located on the interior secondary roadways typically located

in a small area on the southeast corner of the identified zone. In terms of
sales, Sale 15 was located in this zone and had a sales price of 0.96 PSF. Also,
Sale 14- $3.75 PSF and Sale 18 - $0.67 PSF which were located in Zone 11
were considered to be comparable to Zone 7.

ZONE 9
Zone 9 is located in the southeasterly regions of La Porte. This zone is located
west of Galveston Bay, south of Fairmont Parkway north of McCabe Road and
east of State Highway 146. Property usage in this zone is primarily residential
with some commercial usage along South Broadway and State Highway 146.
Some special purpose uses in this zone included a golf course as well as
Galveston Bay frontage. The unit market values identified in this "zone" were
Sale 13 at $1.14 PSF and Sale 19 at $1.27 PSF. Sale 20 was located just north
of this zone in Zone 10 and were considered comparable. These tracts had unit.

values of $2.11 PSF and was a pending sale.
Cam*aiaw. This limited scope study involved the review of comparable land
sales in the overall La Porte area marketplace. The majority of the sales noted
in this analysis were generally under 10 acres in size. Naturally the sales
located on the major roadways had higher unit prices than interior roadways
and these sales were used as upper market indicators. Per our discussions, it
is assumed that some of these potential size would be obtained from project
developers who have sites which lend themselves to park sites or other
"institutional" uses which might augment their particular development plan.
It is assumed that these potential "institutional" sites would have reasonable
access, frontage, shape and existing utility infrastructure aspects in place.

The Scope of the activities undertaken by the appraiser to complete this
report included a person inspection of the subject property and the subject
neighborhood. The market data utilized in this report has been derived from
a search of market data sources such as commercial data sources such as
REVAC, MLS, Harris County deed records, conversations with local brokers
Iand agents, appraisers and other sources of local information and data as
well. as other familiar with the subject property. The value estimate in this
report is based on a review -and analysis of the data presented and a review of
the three (3) approaches to value of which only the Direct Sales Approach
was used. The values noted in this limited scope assignment was not based
on a requested minimum valuation, a specific valuation, or the approval of a
loan.

Overview
The City of La Porte adopted a Development Ordinance (#1444) in 1985, with a park
dedication provision (Section 12.00 — 12.10), requiring developers to give the city land
or money to ensure adequate parkland in newly developed neighborhoods. Under the
current Development Ordinance, a subdivision developer in La Porte is required to
provide 1 acre per 160 dwelling units, or $175 cash per dwelling unit, to the City. The
City has the right to reject an offer of land, and insist on the cash, should the subdivision
possess adequate park property. When it was implemented, the intent of this provision
was to ensure that citizens have access to open space as the City continues to grow.
Parks in neighborhoods add social and recreational opportunities, while incorporating
aesthetics within the community. Over time it has become evident that our ordinance is
relatively weak and does not cover the cost of acquiring and developing future parkland
to meet the needs of our future neighborhoods.
Current Status
Most cities in Texas base their parkland dedication fees on the concept that the fee
should cover the cost of acquiring and developing enough land for a park to service the
new subdivision. A fee based on residential land costs and development costs of would
be appropriate for implementation to developers to cover the cost for park development
for future subdivisions. Survey results of cities in the area with similar sections (or
separate ordinances) in place; indicate an average range of between $250 and $600
per dwelling, but a number of cities have recently increased their development fees
comparable to our proposal. The maximum per unit fee in Texas at present is the City of
Colleyville, at $1,260 per dwelling . A strong dedication ordinance sends the message
that neighborhood residents should pay for neighborhood services, such as parks,
including land and development costs, for their neighborhoods. In other words, the
burden of providing new park services should fall primarily on new residents, while
existing residents pay for maintenance, upgrades of neighborhood parks, and new park
facilities that serve the entire city.
As our ordinance currently stands, fulfilling the dedication requirements allows our entity
to acquire in some cases, but certainly does not cover the costs to acquire and develop
needed park property. If the City already owns a parcel of land, then the existing
ordinance will generate revenue toward development of the property. However, the
optimum dedication does not generate enough revenue for our entity to purchase land
and fully develop the property. A good example of this is the recent Spencer Landing
subdivision where money collected in park development fees was insufficient to provide
both park land and development. Staff is recommending that, if City Council agrees, a
revision of the Development Ordinances to provide a substantial increase in the
ordinance park dedication fee to meet future neighborhood parkland acquisition and
development is in order.

Proposed Change
Based on research of other Texas cities, combined with information provided by the La
Porte 2001 Parks Open Space and Trails Master Plan, staff has proposed the following
changes to the Development Ordinance. These changes are based on the court -proven
College Station model for fee determination (see the attached Worksheets). These
options would allow a developer to choose the most advantageous method of payment,
based on land availability, cost, and other factors:
Developer meets land dedication requirements (1 acre per 63 dwelling
units), and cash ($478 per dwelling unit) for park development. The City
would take the revenues generated and use to develop the park, and
accept the cost of future maintenance and improvements as needed.
2. Developer meets land dedication requirements (1 acre per 63 dwelling
units), and constructs the neighborhood park per City standards) in lieu of
a park development fee. In this case, the City would receive no revenue
and would accept the future maintenance costs of the property as City
property.
3. Developer provides cash for acquisition ($720 per dwelling unit) and
development ($478 per dwelling unit), for a total of $1,198 per dwelling
unit. The City would then purchase and develop the park and accept
future maintenance costs entailed.
Summary
The proposal should meet our current needs but does not provide for future increases in
land and development costs. Staff recommendation is to establish a review process on
a three year cycle to pick up inflationary or deflationary changes in the land market or
cost of development. After City Council provides direction I will discuss the project with
Mr. Armstrong and have him prepare the necessary Ordinance changes (#1444-C). I
will be happy to answer any questions you may have regarding these issues.

12.00 OPEN SPACE WITHIN SUBDIVISION AND DEVELOPMENTS
PARKS AND PARKLAND DEDICATION. SPECIAL USE SITES
12.01 GENERAL
Subdividers and developers shall provide for adequate
open space and recreational space in accordance with
the Comprehensive Plan of the City, and pursuant to
the requirements of this Ordinance.
12.02 DEDICATION OF PARKLAND REQUIRED
Whenever a Final Plat is filed of record with the
County Clerk of Harris County in accordance with the
provisions of this Ordinance, and whenever a Development
Site Plan is submitted and filed with the Approving
Authority of the City in accordance with the provisions of
this Ordinance for each development that contains more than
one residential dwelling unit, such plat or plan shall
contain a clear fee simple dedication of an area of land to
the City for park purposes, which area shall equal one acre
for each 3-6-0- j63 proposed dwelling units. Any proposed
sketch Plan, General Plan, Preliminary Plat, Final Plat or
Development Site Plan shall show the area proposed to

be dedicated for parkland under this Ordinance. Credit
shall be given for land dedicated within a development or
subdivision for Compensating Open Space on an acre per acre
basis. Credit shall be given for land dedicated within a

12.03
DEDICATION OF PARKLAND LESS THAN ONE ACRE IN SIZE
PROHIBITED.
Notwithstanding Section 12.02 above, the City Council
hereby declares and finds that dedication and development
of an area smaller than one acre for public park purposes
is impractical, and not in furtherance of the objectives
established for open space and parks in the City's
Comprehensive Plan. Therefore, for Development Site Plans
or Final Plats that are filed for approval by the Approving
Authority in accordance with the provisions of this
Ordinance and include 1-6-G [63] proposed dwelling units or
less, the developer or subdivider shall be required to pay
the applicable cash in lieu of land amount set forth in
Section 12.05 B. rather than dedicate any land area to the
City. No subdivision Final Plat or Development Site Plan
containing a dedication of land for parks or open space to
the City less than one acre in size shall be approved.

12.04 DEDICATION OF PARKLAND LESS THAN 5 ACRES IN SIZE
Notwithstanding Section 12.02 above, in the case of
Development Site Plans or Final plats that are filed for
approval by the Approving Authority that include 800
proposed dwelling units or less, the Approving Authority
shall have the right to accept the dedication for approval
of the Development Site Plan or Final Plat, or to refuse
same, after consideration of the recommendation of the
Department regarding said proposed parkland dedication, and
to require the payment of cash in lieu of land in the
amount set forth in Section 12.05 B, if the Approving
Authority determines that sufficient park area is already
in the public domain (in accordance with the objectives
established for open space and parks set forth in City's
Comprehensive Plan) in the areas of the proposed
Development or Subdivision, or if the objectives of the
Comprehensive Plan regarding parks and open space would be
better served by expanding or improving existing parks or
open space areas.
12.05 MONEY IN LIEU OF LAND
Subject to veto of the Approving Authority, a
subdivider or developer responsible for parkland
dedication according to the terms of this Ordinance may
elect to meet the requirements

development or subdivision activity. If the City does

parkland dedications for that zone shall be in cash only
and calculated to reimburse the City's actual cost of

per acre of such land, and the actual cost of adjacent

12.07 SPECIAL USE SITES, COMPREHENSIVE PLAN CONSIDERATION
Land shown on the Comprehensive Plan as being suitable for
development of the City for a major recreational center,
school site, park or other public use shall be reserved for
a period of one year after the Preliminary Plan or
Development Site Plan is approved by the City if within
thirty days after such approval the City Council advises
the subdivider or developer of its intent to acquire the
land or of the intent of another governmental unity to
acquire the land, for purchase by the interested
governmental authority at the land's appraised value at the

time of purchase. A failure by the City Council to so
notify the Subdivider or Developer shall constitute a
waiver of the right to reserve the land. Any waiver of the
right to reserve the land shall no longer be effective if
the Preliminary Plat shall expire without adoption of a
Final Plat.
12.08 PARK ZONES
For purposes of this Ordinance, the Planning Commission,
upon recommendation of the Director and the Parks and
Recreation Department of the City, and in accordance with
the Comprehensive Plan of the City, shall promulgate an
official parks and recreational map of the City. The map
shall dl'6ate Park Zones, specifically designed to service a
majority of the residences within a convenient distance of
any park located or to be located within the zone.
Establishment of said zones shall be prima facie proof that
any park located therein is within a convenient distance
from any residence located within said zone.
12.09
CHARACTERISTICS OF PARKLAND DEDICATED
Any land dedicated to the city under this Ordinance must be
suitable for park and recreational use. Any areas of
unusual topography or slope which render said areas
unusable for organized recreational activities is generally

Overview
The City of La Porte adopted a Development Ordinance (#1444) in 1985, with a park
dedication provision (Section 12.00 — 12.10), requiring developers to give the city land
or money to ensure adequate parkland in newly developed neighborhoods. Under the
current Development Ordinance, a subdivision developer in La Porte is required to
provide 1 acre per 160 dwelling units, or $175 cash per dwelling unit, to the City. The
City has the right to reject an offer of land, and insist on the cash, should the subdivision
possess adequate park property. When it was implemented, the intent of this provision
was to ensure that citizens have access to open space as the City continues to grow.
Parks in neighborhoods add social and recreational opportunities, while incorporating
aesthetics within. the community. Over time it has become evident that our ordinance is
relatively weak and does not cover the cost of acquiring and developing future parkland
to meet the needs of our future neighborhoods.
Current Status
Most cities in Texas base their parkland dedication fees on the concept that the fee
should cover the cost of acquiring and developing enough land for a park to service the
new subdivision. A fee based on residential land costs and development costs of would
be appropriate for implementation to developers to cover the cost for park development
for future subdivisions. Survey results of cities in the area with similar sections (or
separate ordinances) in place; indicate an average range of between $250 and $600
per dwelling, but a number of cities have recently increased their development fees
comparable to our proposal. The maximum per unit fee in Texas at present is the City of
League City, at $1,500 per dwelling. A strong dedication ordinance sends the message
that neighborhood residents should pay for neighborhood services, such as parks,
including land and development costs, for their neighborhoods. In other words, the
burden of providing new park services should fall primarily on new residents, while
existing residents pay for maintenance,. upgrades of neighborhood parks, and .new park
facilities that serve the entire city.
As our ordinance currently stands, fulfilling the dedication requirements allows our entity
to acquire in some cases, but certainly does not cover the costs to acquire and develop
needed park property. If the City already owns a parcel of land, then the existing
ordinance will generate revenue toward development of the property. However, the
optimum dedication does not generate enough revenue for our entity to purchase land
and fully develop the property. A good example of this is the recent Spencer Landing
subdivision where money collected in park development fees was insufficient to provide
both park land and development. Staff is recommending that, if City Council agrees, a
revision of the Development Ordinances to provide a substantial increase in the
ordinance park dedication fee to meet future neighborhood parkland acquisition and
development is in order.
The intent is part of an effort to generate enough revenue to offset the cost of the
development of a neighborhood park. People move to La Porte for specific reasons, and
"quality of life" is a primary reason. Adequate park space is a fundamental service our
department must provide. Staff feels that having a specific fund with assets dedicated to
the total development of a park, as it becomes needed, is more reasonable than raising
taxes. We provide a lifestyle choice in our city for the citizen who desires to live here.
Their voices are unified and clear when they demand more parks and open space (see
the 2001 City of La Porte Park Master Plan).
Proposed Change
Based on research of other Texas cities, combined with information provided by the La
Porte 2001 Parks Open Space and Trails Master Plan, staff has proposed the following

changes to the Development Ordinance. These changes are based on the court -proven
College Station model for fee determination (see the attached Worksheets). These
options would allow a developer to choose the most advantageous method of payment,
based on land availability, cost, and other factors:
1. Developer meets land dedication requirements (1 acre per 63 dwelling
units), and cash ($478 per dwelling unit) for park development. The City
would take the revenues generated and use to develop the park, and
accept the cost of future maintenance and improvements as needed.
2. Developer meets land dedication requirements (1 acre per 63 dwelling
units), and constructs the neighborhood park per City standards) in lieu of
a park development fee. In this case, the City would receive no revenue
and would accept the future maintenance costs of the property as City
property.
3. Developer provides cash for acquisition ($720 per dwelling unit) and
development ($478 per dwelling unit), for a total of $1,198 per dwelling
unit. The City would then purchase and develop the park and accept
future maintenance costs entailed.
Summary
The proposal should meet our current needs but does not provide for future increases in
land and development costs. This proposal represents a very large increase (from $175
to $1,198 per dwelling unit) for area developers wanting to develop land in the city. In
addition, staff is recommending that infill units within existing communities such as old
La Porte also be required to pay the park development fee to assist in upgrading and
refurbishing existing parks and potential new parks in these established neighborhoods.
Staff recommendation is to establish a review process on a three year cycle to pick up
inflationary or deflationary changes in the land market or cost of development. After
City Council provides direction I will discuss the project with Mr. Armstrong and have
him prepare the necessary Ordinance changes (#1444-C). 1 will be happy to answer any
