OF THE LA PORTE CITY COUNCIL
October 3, 2005
1. CALL TO ORDER
The meeting was called to order by Mayor Alton Porter at 6:00 p.m.
Members of City Council Present: Mayor Alton Porter, Councilmembers Chuck Engelken, Tommy Moser, Mike
Clausen, Peter Griffiths, Barry Beasley and Louis Rigby.
Members of Council Absent: Councilmember Ebow and Councilmember Mosteit. .
Members of City Executive Staff and City Employees Present: City Manager Debra Feazelle, Assistant City
Manager John Joerns, Assistant City Attorney Clark Askins, City Secretary Martha Gillett, Public Works Director
Steve Gillett, Assistant City Secretary Sharon Harris, Director of Planning Wayne Sabo, Purchasing Agent Susan

A. Mayor Porter recognized retiree Josie Ramirez. Director of Parks and Recreation, Stephen Barr,
and Sr. Services Superintendent Karen Beerman and Josie's family members joined Mayor in
the recognition.
B. Mayor Porter recognized retiree Genitha Smith. Director of Public Works Steve Gillett and
Secretary Gina Ford joined Mayor in the recognition.
5. CONSENT AGENDA
A. Consider approving Minutes of the Regular Meeting and Workshop Meeting held on September
12,2005.
B. Council to consider awarding a bid for Annual Medical Supplies.
C. Council to consider approval or other action regarding an Interlocal Agreement with U.S.
Communities and award copiers in the amount of$33.089.28.
D. Council to consider awarding bids for two (2) twenty-five yard garbage trucks to Grande Truck
Center of San Antonio for a net amount of$190, 250.
E. Council to consider approval or other action regarding a resolution declaring public interest in
acquiring property as described.

into an Industrial District Agreement and an ordinance authorizing the City to execute a Water

G. Council to consider approval or other action regarding an ordinance authorizing Happy Cajun's
application for a wine and beer alcohol permit.
Councilmember Rigby requested to discuss item C and vote on item E separately.
Motion was made by Councilmember Rigby to approve the consent agenda and discuss item E. and
vote on separately. Second by Councilmember Griffiths.

Item E was discussed and it was determined the Resolution was incomplete.
Motion was made by Councilmember Moser to table this item E. Second by Councilmember
Engelken. The motion carried unanimously.

6. PETITIONS, REMONSTRANCES, COMMUNICATIONS, AND CITIZENS AND TAX PAYERS WISHING
TO ADDRESS COUNCIL ON ANY ITEM POSTED ON THE AGENDA
Dr. Bobbye Worsham addressed Council expressing thanks for the Canada Road Project.
7. Council to consider approval or other action regarding an ordinance approving Master Agreement with
C. Berdon Lawrence and authorizing the City Manager to execute the Agreement.
Assistant City Manager John Joerns presented summary and recommendation and answered Council's
questions.
Assistant City Attorney Clark Askins read ORDINANCE 2846- AN ORDINANCE APPROVING AND
AUTHORIZING A MASTER AGREEMENT BY AND AMONG THE CITY OF LA PORTE, C.
BERDON LAWRENCE, AND LA PORTE VISTA BA YWOOD, LTD.; MAKING VARIOUS
FINDINGS AND PROVISIONS RELATING TO THE SUBJECT; FINDING COMPLIANCE WITH
THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTNE DATE HEREOF.
Motion was made by Council member Griffiths to approve Ordinance 2846 as presented by Mr. Joerns.
Second by Council member Moser. The motion carried unanimously.

1218 and 1255, a portion of the Park Avenue ROWand the alleys of Blocks 1218 and 1255.

questions.
Assistant City Attorney Clark Askins read RESOLUTION 2005-19 - A RESOLUTION
ESTABLISHING THE POLICY OF THE CITY COUNCIL OF THE CITY OF LA PORTE
CONCERNING AN ORDINANCE VACATING, ABANDONING AND CLOSING A PORTION OF
THE SOUTH "R" STREET RIGHT-OF-WAY BETWEEN BLOCKS 1218 AND 1255, TOWN OF LA
PORTE, HARRIS COUNTY, TEXAS; AN ORDINANCE VACATING, ABANDONING AND
CLOSING A PORTION OF THE PARK AVENUE RIGHT-OF-WAY; AND AN ORDINANCE
VACATING ABANDONING AND CLOSING THE ALLEYS IN BLOCK 1218 AND 1255, TOWN

AUTHORIZING AN AGREEMENT BETWEEN THE CITY OF LA PORTE AND THE BUXTON
COMPANY, ("CONTRACTOR"), FOR AN ECONOMIC DEVELOPMENT STUDY FOCUSING ON
RETAIL OPPORTUNITIES; APPROPRIATING $63,000.00 PLUS A CONTINGENCY OF $7,000.00
TO FUND SAID CONTRACT; MAKING VARIOUS FINDINGS AND PROVISIONS RELATING
TO THE SUBJECT, FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND
PROVIDING AN EFFECTIVE DATE HEREOF.
Motion was made bv Councilmember Griffiths to approve Ordinance 2847 as oresented by Mr. Joerns.

11. Council to discuss appointing an official Voting Delegate and Alternate Delegate for the City of La
Porte at the National League of Cities Conference.
Motion was made bv Council member Engelken for Mike Mosteit to serve as delegate and
Councilmember Ebow to serve as Alternate Delegate. Second by Griffiths. Motion carried
unanimously.

ADDENDUM ITEM
Council to consider approval or other action regarding a resolution calling for legislative review and necessary
revisions of emergency evacuation procedures and policies prompted by Hurricane Rita impacting the upper
Texas Gulf Coast and inland communities along the designation evacuation routes
City Manager Debra Feazelle presented summary and recommendation and answered Council's
questions.
Assistant City Attorney Clark Askins read RESOLUTION 2005-20- A RESOLUTION CALLING FOR
LEGISLATIVE REVIEW AND NECESSARY REVISIONS OF EMERGENCY EVACUATION
PROCEDURES AND POLICIES PROMPTED BY HURRICANE RITA IMP ACTING THE UPPER
TEXAS COAST AND INLAND COMMUNITIES ALONG THE DESIGNATION EVACUATION

Motion was made by Councilmember Engelken to approve Resolution 2005-20 as presented bv Ms.

12. Close Regular Meeting and Open Workshop at 7:07 p.m.
A. Jeff Suggs and representatives for PPG discussed Discuss Emergency Notification and PPG
Incident.
Braun Thompson, Safety and Health Director ofPPG and Plant Manager Tom Norbitt provided
City Council with an overview ofthe incident.
Council was advised the incident was caused by iron contamination to the vessel. PPG has
researched and analyzed the incident and have altered their plan to notify the City of La Porte as
soon a problem is evident. The further noted they would communicate with the City of La Porte
Fire Department immediately in the future. The Fire Department will be included in future
meetings at PPG. PPG provided Council a report on the release.
B. Council received report from Director of Parks & Recreation Stephen Barr on future Park
Development Fees for La Porte.
Mr. Barr provided Council with additional survey information.
Council directed staff to move forward.
13. Close Workshop and reconvened Regular Meeting at 8:03 p.m.
14. Administrative Reports
City Manager Debra Feazelle provided an oral report on Hurricane Rita more to follow and reminded
Council of the Neighborhood Centers Banquet, October 6,2005, at the Houston Yacht Club at 6:30
p.m., The Salute to Industry (Albemarle) Golf Tournament, October 12,2005, at Bay Forest Golf
Course at 8:00 a.m. and Salute to Industry (Albemarle) Banquet, October 13,2005 at Sylvan Beach
Pavilion at 6:30 p.m.
Ms. Feazelle reported Chief Reff advised her Saturday evening that Ms. Delia Claus passed away.
Lastly, she publicly apologized to Louis Rigby for recent communications breakdowns from staff that he
reported at the last Council meeting. (See attached report)

Response to Public Note
At the last City Council Meeting, Councilman Louis Rigby asked City Secretary to note for the record that
he had not received information requested from staff; specifically: 5 months ago, 6 week~ ago, 2 weeks
ago. Although I have spoken to Councilman Rigby and followed up on his concerns, the City Secretary
should document the response.
First, I'd like to publicly apologize for any confusion and miscommunication on my part. This was not
intentional and we try to be very responsive.
Item 1 - Question to John Joerns (actually 2 questions), one was responded to the next day; the other
item was not responded to regarding a planning' issue. Staff error, we will try to do better. We are human
and not perfect. Sorry.
Item 2 - Question to Debra Feazelle regarding health insurance. I requested consultant to get
information. Since we were in the middle of budget and not reviewing health plans for '06 until October,
my fault for assuming the information could be compiled and presented in October. Sorry again.
Item 3 - Question to Martha Gillett for information from Cynthia Alexander regarding HR Manager;
request for evaluation forms from interviews. Cynthia Alexander compiled and copied to Martha Gillett for
distribution to City Council. Councilman Rigby called Martha Gillett a,nd asked for information and she
stated to him that she put in Council's boxes. Councilman Rigby asked Martha to read to him. According
to Martha, she got to a page she had trouble reading, so requested a better copy from Cynthia Alexander.
Cynthia's secretary was on vacation; trouble locating file; other delays; did not recognize as priority.
Sorry once again.
None of the above incidents were intended to withhold information. My policy is always to respond as
soon as possible to requests. We should have good follow-up systems. but do make mistakes. We do
sometimes not respond as soon as desired due to other issues and the handling of requests in the order
received. Sometimes requests "pile-up,n but we work as quickly as possible to resolve all questions and
concerns. This continues to be our #1 objective to give excellent customer service to our citizens and
Council.
Finally, please note the last few weeks before this Council Meeting we were diligently working on EOC
responses to the Katrina evacuees and current items were also delayed due to emergency issues.
Please do not hesitate to call me if any of you have problems we are not addressing.

SUMMARY & RECOMMENDATION
A trash truck with hydraulic brush loader was budgeted in the 04-05 fiscal year and awarded to
Monument Chevrolet on December 13,2004. This truck was scheduled for delivery May of2005.
Since July 2005, staff contacted Monument Chevrolet, multiple times, to expedite delivery of the truck.
Wednesday, September 21 S\ a representative from Monument delivered a letter stating the truck could not
meet all specifications; therefore, they would not resolve any problems. Staff met, and in anticipation of
Rita, agreed to accept the truck as is ~d settle discrepancies at a later date. The representative stated he
would contact his General Mana!er as soon as he returned to Monument and notify us of their decision.
Monday morning, September 26 , staff contacted Monument Chevrolet and was informed the truck had
been sold.
Staff researched several resources and obtained the best pricing and delivery through Houston-Galveston
Area Council (HGAC). Anticipated delivery is mid-November.
Staff received quotes, which include HGAC fees, as follows:
Rush Truck Center Cab & Chassis $52,823.00
HeilofTexas Dump Body & Brush Loader $45.677.00
$98,500.00
Funds were budgeted and are available in the 04-05 fiscal year. The additional $3,049 is available from
other heavy equipment, purchased under budget.

Approve purchase of trash truck and dump body with brush loader, per HGAC Interlocal Agreement, as
listed above.

Subject: FYI Trash truc~
On December 13, 2004, Council awarded the purchase of a trash truck wi brush loader to
Monument Chevrolet. A PO was faxed on December 15, 2004. Stated delivery time was 120
days.
Beginning July 19, 2005, Purchasing began contacting Monument Chevrolet, requesting
status and estimated delivery date. The truck was finally delivered in September, 2005, but
rejected by Lee Allen. The cab was to be painted blue and arrived white. On September 21,
2005, Charles Langridge, our sales representative with Monument Chevrolet, delivered a
letter stating Monument would not paint the truck because it would be cost prohibitive to
disassemble the body and paint the cab. Mr. Langridge was in a hurry and stated, due to the
hurricane, they were closing within one hour. I asked him to talk with Lee Allen before he
left. Lee and I agreed to accept the truck,as is, and worry about color at a later date. I
even suggested we could send a driver with Mr. Langridge to bring the truck back to the City
of La Porte. Mr. Langridge said he had to hurry, but would discuss with the General
Manager, upon his return to Monument.
Due to hurricane readiness, no calls were made that day. On Monday, September 26th, I
contacted Mr. Langridge concerning the status of the trash truck. He regretfully stated the
truck had been sold by the General Manager and was no longer at their site.
Upon receiving the news, Steve Gillett requested I find a truck, immediately. Since Monday,
Lee and I have been calling truck vendors and searching the Internet looking for a truck. To
date, one has not been found.
The Uniform Commercial Code considers this a breach of contract. Our remedies include
finding another trash truck that is comparable and billing any overage/difference to
Monument Chevrolet. .

NEW POLICE FACILITY
PROGRESS REPORT
OCTOBER 10, 2005
Qualification Statements were received for the designlbuild of the new police facility on
August 2,2005. Eleven (11) Statements were received, ranked and the top five (5)
respondents were selected to submit proposals for the Project. Three (3) proposals were
received on September 2,2005. The proposals were ranked according to the published
criteria, and the best value, which was also the lowest cost proposal, was submitted by
Hale-Mills Construction, Ltd. in the amount of $8,719,315. Second and third-ranked
proposals were submitted by 3D/International, Inc. ($9,655,003) and Satterfield &
Pontikes Construction, Inc. ($10,096,834).
Review of all three proposals revealed that not all items specified were clearly identified
and priced. Additionally, the top proposal from Hale-Mills qualified their estimate to
revise the price after design was 40% complete. In order to answer these questions, a
meeting was held with the City, the Program Manager (Huitt-Zollars) and Hale-Mills.
Questionable costs and conditions were identified, in writing, to be discussed at the
meeting. Hale-mills admitted they had left off several key items in the estimate, and
submitted a revised cost of $9,044,3 15, an increase of $325,000 for four (4) items related
to cabling of the communications and security systems. Additionally, furnishings
(furniture and office equipment) was not included in the proposal. In fact, none of the
three (3) proposals including furnishings. Hale-Mills proposed to include a furniture
allowance, at a not to exceed cost of $650,000, which would be used as needed for the
furnishing of the facility. This allowance would be approved by the City. This would
bring the total cost to a not-to-exceed price of $9,694,315. Finally, Hale-Mills agreed to
a firm-cost contract with no future escalation.
The total revised estimated cost (less furniture allowance) is $9,044,315. The next low
proposal from 3D/I was $9,655,000 (without furniture allowance). The city and the
contractor agreed to the revised costs, and a contract is in the process of being prepared
for consideration by the City Council.
With the recent hurricane activity, the design wind loading of the building is under
reconsideration. The specifications call for a design of 120 mph (Category 3). It has
been suggested that the design be increased to accommodate a Category 4 storm (150
mph). Preliminary discussions with the contractor indicate approximately 10% increase
in building costs. The costs will be quantified and presented to Council for consideration.
The original schedule for consideration by Council was September 26,2005. The
discussion regarding the contract delayed the date to October 10, 2005. With the recent
hurricane activity, and the need to consider increasing the design wind loading of the
building to 150 mph, it is now estimated that the contract will be presented to City
Council on October 24, 2005.
