MINUTES OF REGULAR MEETING AND WORKSHOP MEETING
OF THE LA PORTE CITY COUNCIL
February 26, 2007
1. CALL TO ORDER
The meeting was called to order by Mayor Alton Porter at 6:00 p.m.
Members of City Council Present: Mayor Alton Porter, Mayor Pro-Tern Tommy Moser,
Councilmembers Chuck Engelken, Mike Clausen, Mike Mosteit and Louis Rigby.
Members of Council Absent: Councilmember Howard Ebow and Councilmember Barry
Beasley.
Staff Present: Interim City Manager John Joerns, City Secretary Martha Gillett, Assistant

3. Mayor Porter led the Pledge of Allegiance.
4. PRESENTATIONS / PROCLAMATIONS
A. Mayor Porter read Senate Proclamation No. 1258 - 2006 Municipal Excellence
award for Public Works.
B. Jeff Suggs, Ken Martin, and Bob McLaughlin presented discussion of the Dupont
Chemical Release on January 25,2007.
5. Consent Agenda
A. Consider approving Minutes of the Regular Meeting, Public Hearing and
Workshop Meeting held on February 12,2007.
B. Council to consider approval or other action regarding a resolution authorizing the
Battle of San Jacinto Triathlon and authorizing the City Manager to enter into an
City Council Regular and Workshop Meeting -February 26, 2007

agreement with Texas Department of Transportation for the temporary closure of
state rights-of-way
C. Council to consider approval or other action approving purchase of various
furniture, fixtures & equipment items through TXMAS State Contract for the new
police facility.
D. Council to consider approval or other action regarding the expenditure of Urban
Area Security Initative 06 grant funds in the amount of $257,731.99 to Motorola for
upgrading and expanding dispatch console and related equipment.
E. Council to consider approval or other action regarding an ordinance amending
Chapter 2, "Administration" Article II, "Finance", Division 2, "purchases and
contracts", Subdivision II, "Public Works contracts" by amending Section 2-106 of
the Code of Ordinances.
Councilmember Moser pulled item B for discussion. Mr. Moser requested staff
provide Council with a breakdown on the costs oflast year's Triathlon.
Motion was made by Council member Engelken to approve consent agenda as presented
Second by Council member Mosteit. Motion carried.

6. PETITIONS, REMONSTRANCES, COMMUNICATIONS, AND CITIZENS AND TAX
P AYERS WISHING TO ADDRESS COUNCIL ON ANY ITEM POSTED ON THE
AGENDA.
There were no citizens wishing to address City Council.
Mayor Porter requested Item 11 be taken out of order at this time. See below for
details.
7. Assistant Finance Director Michael Dolby provided council a report on 2006 Comprehensive
Annual Financial Report and Councilmember Engelken provided an overview of the Fiscal
Affairs Meeting..
8. Council to consider approval or other action regarding a resolution of the City Council of the
City of La Porte, Texas adopting a Legislative Omnibus for the 80th State Legislative
Session and provided staff with direction.
Interim City Manger John Joerns presented summary and recommendation and answered
Council's questions.
Assistant City Attorney Clark Askins read: RESOLUTION 2007-05 - A RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF LA PORT, TEXAS ADOPTING A

LEGISLATIVE OMNIBUS FOR THE 80TH STATE LEGISLATIVE SESSION FOR THE
PURPOSE OF DEFINING THE POSITION OF THE CITY OF LA PORTE.
Motion was made by Councilmember Moser to approve Resolution 2007-05 with Items A &
B as presented by MrJoerns. Second by Council member Mosteit. The motion carried
Ayes: Moser, Engelken, Mosteit, Clausen, Rigby and Porter.

9. Council to consider approval or other action regarding a resolution supporting the
reinstatement of the Texas Department of Transportation's Statewide Transportation
Enhancement Program Funds.
Main Street Coordinator Debra Dye presented summary and recommendation and answered
Council's questions.
Assistant City Attorney Clark Askins read: RESOLUTION - 2007-06 A RESOLUTION
SUPPORTING THE REINSTATEMENT OF THE TEXAS DEPARTMENT OF
TRANSPORTATION'S STATEWIDE TRANSPORTATION ENHANCEMENT
PROGRAM FUNDS.
Motion was made by Councilmember Engelken to approve Resolution 2007-06 as presented
by Ms. DYe. Second by Council member Mosteit. The motion carried
Ayes: Moser, Engelken, Mosteit, Clausen, Rigby and Porter.
Nays: None
Abstain: None.
10. City Secretary Martha Gillett provided a report on election administration.
It was the consensus of Council for the City of La Porte to run its own election on May 12,
2007.
11. Consider approval or other action regarding an ordinance amending the code of ordinances
of the City of La Porte, chapter 106, more commonly referred to as the zoning ordinance of
the city of La Porte, by granting a special conditional use permit # scu07-001 for that certain
parcel of land described as follows, to wit: 1.93 acre tract of land being tr394a, La Porte
Outlots, Enoch Brinson survey, abstract 5, La Porte Harris County, Texas for the purpose of
FF A and 4-h projects in a large lot district (ll) zone - (Ord. 150 I-n5/# scu07 -001). This
items was previously tabled at the February 12, 2007 Council Meeting.
Planning Director Wayne Sabo presented summary and recommendation and answered
Council's questions.
Assistant City Attorney Clark Askins read: Ordinance 1501 N-5 AN ORDINANCE
AMENDING THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, CHAPTER
106, MORE COMMONLY REFERRED TO AS THE ZONING ORDINANCE OF THE
CITY OF LAPORTE, BY GRANTING A SPECIAL CONDITIONAL USE PERMIT
#SCU07-001 FOR THAT CERTAIN PARCEL OF LAND DESCRIBED AS FOLLOWS,
TO-WIT: 1.93 ACRE TRACT OF LAND BEING TR 394A, LA PORTE OUTLOTS,

Motion was made by Councilmember Clausen to table Ordinance 1501 N-5 as presented by
Mr. Sabo. Second by Council member Moser. The motion carried
Ayes: Moser, Engelken, Mosteit, Clausen, Rigby and Porter.

Abstain: None.
12. Susan Kelley provided Council a review draft request for proposal and offers for an
Executive Search Firm regarding selection of the City Manager.
Council directed staff to review proposals and make a recommendation to City Manager
Selection Committee for review. The committee would then make a recommendation to the
full Council. Mayor noted we need to appoint a City Manager Selection Committee at the
next City Council meeting.
13. Council to consider approval or other action regarding March City Council Meeting date.
Council will meet March 5, 2007 and March 19' 2007.
14. Close Regular Meeting and Open Workshop at 7:20 p.m.

A. Planning Director Wayne Sabo discussed Plaza Truck Stop at 9119 S.H. 225.
Council directed staff to bring back with more information.
B. Police Chief Richard Ref! discussed creation of an animal shelter advisory
committee.
Council directed staff to bring back an ordinance for consideration with an At- Large
position for a City Council member as representation.
Closed Workshop and reconvened Regular Meeting at 7:45 p.m.

SUMMARY & RECOMMENDATION
In the Council Meeting of February 26, 2007 a workshop was held to discuss the need for Council to appoint an
Animal Shelter Advisory Committee. Based on direction provided by the workshop the following ordinances are
submitted for approval.
Ordinance Number 2007 establishes an Animal Shelter Advisory Committee in accordance with Section
823.001 of the Texas Health and Safety Code. Ordinance Number 2004-2782-R amends the appointment ordinance
by addition Section 17, appointed new members to the Animal Shelter Advisory Committee.

ORDINANCE NO. 2007- ~t:j7L
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LA PORTE
ESTABLISHING AN ANIMAL SHELTER ADVISORY COMMITTEE IN ACCORDANCE
WITH CHAPTER 823 OF THE TEXAS HEALTH AND SAFETY CODE; CONTAINING A
SEVERABILITY CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS
LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. As required by Section 823.005 of the Texas Health
and Safety Code, the City Council of the City of La Porte does
hereby establish an Animal Shelter Advisory Committee, to be
composed of no less than five (5) members who shall serve without
term and at the pleasure of City Council, and which positions
shall be comprised of 1) the Chief of the La Porte Rabies Control
Authority, or his designee; 2) a state certified Animal Control
officer employed with the City of La Porte and whose duties
include the daily operation of the La Porte animal shelter; 3) a
veterinarian; 4)
a representative from an animal welfare
organization; and 5) a member of the La Porte City Council. The
Animal Control Advisory Committee established herein shall meet at
least three times within each calendar year.
Section 2. All ordinances or parts of ordinances in conflict
herewith are hereby repealed to the extent of such conflict only.
Section 3. If any section, sentence, phrase, clause, or any
part of any section, sentence, phrase, or clause, of this
Ordinance shall, for any reason, be held invalid, such invalidity

shall not affect the remaining portions of this Ordinance, and it
is hereby declared to be the intention of this City Council to
have passed each section, sentence, phrase, or clause, or part
thereof, irrespective of the fact that any other section,
sentence, phrase, or clause, or part thereof, may be declared
invalid.
Section 4.
The City Council officially finds, determines,
recites, and declares that a sufficient written notice of the
date, hour, place and subject of this meeting of the City Council
was posted at a place convenient to the public at the City Hall of
the City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Chapter 551, Texas Government
Code; and that this meeting has been open to the public as
required by law at all times during which this ordinance and the
subject matter thereof has been discussed, considered and formally
acted upon.
The City Council further ratifies, approves and
confirms such written notice and the contents and posting thereof.
Section 5. This Ordinance shall be effective upon its passage
and approval.

The City Council of the City of La Porte hereby designates
George W. Maltsberger, of Position 5, to serve as Chairman of the
Zoning Board of Adjustment until the expiration of the member's
term of appointment as designated in this section, or until their
successor shall have been duly appointed and qualified.
Section 15. The City Council of the City of La Porte hereby
appoints the following named persons, all of whom are resident
electors of the City of La Porte or non-resident individuals
owning or operating a business within the City of La Porte, duly
verified by proof of an applicable tax statement or utility
account for such business, and each of whom the City Council deems
competent to serve on such Board by virtue of their experience and
training in matters pertaining to building construction, and none
of whom are employed by the City of La Porte, to serve as members
of the Building Codes Appeals Board for terms expiring on August
31st of the year indicated, or until their successors shall have
been duly appointed and qualified:

Section 16. The City Council of the City of La Porte hereby

of Trustees, to serve without term or until his successor shall

Section 18.
If any section, sentence, phrase, clause or any
part of any section, sentence, phrase, or clause, of this
ordinance shall, for any reasons, be held invalid, such invalidity
shall not affect the remaining portions of this ordinance, and it
is hereby declared to be the intention of this City Council to
have passed each section, sentence, phrase or clause, or part
thereof, irrespective of the fact that any other section,

sentence, phrase or clause, or part thereof, may be declared
invalid.
Section 19.
All ordinances or parts of ordinances in
conflict herewith are repealed to the extent of such conflict
only.
Section 20.
The City Council officially finds, determines,
reci tes, and declares that a sufficient written notice of the
date, hour, place and subject of this meeting of the City Council
was posted at a place convenient to the public at the City Hall of
the City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Chapter 551, Texas Government
Code; and that this meeting has been open to the public as
required by law at all times during which this ordinance and the
subject matter thereof has been discussed, considered and formally
acted upon.
The City Council further ratifies, approves and
confirms such written notice and the contents and posting thereof.
Section 21. This Ordinance shall be effective from and after
its passage and approval, and it is so ordered.
