CALL TO ORDER The meeting was called to order by Mayor Alton Porter at 6:02 p.m. Members of City Council Present: Mayor Alton Porter, Council members Tommy Moser, Louis Rigby, Barry Beasley, Mike Clausen, Georgia Malone, Mike Mosteit and Chuck Engelken. PRESENTATIONS I PROCLAMATIONS Mayor Porter presented a proclamation for the month of September as National Preparedness Month to Emergency Management Coordinator Jeff Suggs and Emergency Management Planner Sarah Moore. 5. Consent Agenda A. Consider approving Minutes of the Regular Meeting Public Hearing and Workshop Meeting of La Porte City Council held on August 27,2007 and Minutes of the Special Called Regular Meeting of the La Porte City Council held on August 28, 2007 and August 30, 2007. B. Council to consider approval or other action regarding an ordinance amending Chapter 6 of the code of ordinances of the City of La Porte by approving an alcohol permit for Mama Mia's Italian Restaurant. Council to consider approval or other action regarding an ordinance to continue, abolish, or modify the juvenile curfew ordinance D. Council to consider approval or other action approving a change of the second public hearing date of October 23, 2007 to October 22, 2007 for the proposed annexation of the Bayport and Battleground Industrial Districts F. Council to consider approval or other action regarding an ordinance approving and authorizing an agreement between the City of La Porte and D& W Contractors, INC. for paving and extension of North 7th Street appropriating $94, 420.00 Motion was made by Council member Beasley to approve the consent agenda as presented with the exception of item C which was pulled for a separate vote. Assistant City Attorney read: ORDINANCE 93-1887 - AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, TEXAS, BY ADDING A NEW ARTICLE IV TO CHAPTER 13, RELATING TO THE ESTABLISHMENT OF DAY TIME JUVENILE CURFEW; CONTAINING FINDINGS AND OTHER PROVISIONS RELATING TO THE FOREGOING SUBJECT; DECLARING CERTAIN CONDUCT TO BE UNLAWFUL AND PROVIDING PENALTIES THEREFORE; PROVIDING A SEVERABILITY; PROVIDING A REPEALING CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Motion was made by Councilmember Clausen to continue the Ordinance as presented by Chief Reff. Second by Councilmember Malone. The motion carried. PETITIONS, REMONSTRANCES, COMMUNICATIONS, AND CITIZENS AND TAX P AYERS WISHING TO ADDRESS COUNCIL ON ANY ITEM POSTED ON THE AGENDA. Senator Mike Jackson- 435 Baywood Shoreacres, TX 77571- addressed Council about the flooding in La Porte, Pasadena, and Deer Park and advised his office is willing to assist in any way possible. Nathan Bretting- 11127 Skyview La Porte, TX 77571 - addressed Council about continued flooding in the Lomax area and requested assistance in resolving the issue. Jane Madded- 1106 Maple Creek La Porte, TX 77571 addressed Council about the flooding in her Creekmont Subdivision. Doug Bryant- 10908 Spruce Dr. South La Porte, TX 77571 addressed Council about the flooding issues in Fairmont Park East subdivision. Lola Haygood- 811 Mossy Drive La Porte, TX 77571 did not speak but is concerned with the flooding Battleground Estate Subdivision. James Haygood- 1314 Canyon Springs La Porte, TX 77571 addressed Council about the flooding in his Creekmont Subdivision. Barbara Norwine- 202 S. Lobit La Porte, TX 77571 addressed Council about the flooding in her neighborhood and informed Council that the lack of mowing the ditches is the cause of the flooding. Ms. Norwine provided photos for Council to view. Jimmy Marr- 1117 Willow Creek La Porte, TX 77571 addressed Council about his concern of the flooding in La Porte and individuals building up their property with dirt to avoid flooding. Mr Marr was fortunate not to receive water in his home. Bill Corley- 3806 Tarpon Ln. La Porte, TX 77571 addressed Council about the recent flooding/drainage issue in the Bay Colony subdivision. Trent Wise- 425 Spencer Landing West La Porte, TX 77571 addressed Council in behalf of the Spencer Landing Home Owners Association as President. Mr. Wise and the homeowners are concerned drainage and lack of maintenance of the ditches that creates high water during ram. James Stout - 630 N. 13th La Porte, TX. 77571 - addressed Council about the water in his home (and the neighborhood) during the recent rain Mr. Stout informed Council he would provide assistance and information on getting the issue of flooding in La Porte resolved if needed. Muriel Trahan- 705 Willow Creek La Porte, Tx 77571 - addressed Council about the flooding in her Creekmont Subdivision and the lack of maintenance of the park. Ms. Trahan wanted Council to know she has received water in her home. Ian Home - 10829 Linwood La Porte, TX 77571 - addressed Council about the flooding his Fairmont Park East Subdivision and the effects of the citizens lives and the homes after being flooded during rain events. City Council Regular Meeting, Public Hearing and Workshop Meeting -September 10,2007 Page 4 Tina Nardo - 5214 Meadow Crest La Porte, Tx 77571 - addressed Council about the flooding at her home. Ms. Nardo wanted the City to do their part in providing/obtaining assistance for citizens that have flooded and does not have flood insurance. 7. Public Hearing - Council to consider recommendation of the Planning and Zoning Commission to approve special conditional use permit #SCU07-007 for a 1.478 acre tract of land located in the 500 block of North 8th Street Open Public Hearing - Mayor Porter opened the Public Hearing at 6:46 p.m. Planning Director Wayne Sabo presented summary and recommendation and answered Council's questions. Public Input: There was not any public input. Recommendation of Planning and Zoning - Council to approve special conditional use permit #SCU07-007 for a 1.478 acre tract ofland located in the 500 block of North 8th Street. The Public Hearing was closed at 6:49 p.rn. 8. Assistant City Attorney Clark Askins read: Ordinance 1501-Z5 CONSIDER APPROVAL OR OTHER ACTION REGARDING AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, CHAPTER 106, MORE COMMONLY REFERRED TO AS THE ZONING ORDINANCE OF THE CITY OF LA PORTE, BY GRANTING A SPECIAL CONDITIONAL USE PERMIT #SCU07-007 FOR THAT CERTAIN PARCEL OF LAND DESCRIBED AS FOLLOWS, TO-WIT: LOTS 1 THRU 16, BLOCK 101, TOWN OF LA PORTE, JOHNSON HUNTER SURVEY, ABSTRACT 35, LA PORTE, HARRIS COUNTY, TEXAS FOR THE PURPOSE OF DEVELOPING OFFICE/WAREHOUSE FACILITY IN A GENERAL COMMERCIAL (GC) ZONE; MAKING CERTAIN FINDINGS OF FACT RELATED TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Motion was made by Council member Beasley to approve ordinance 1501-Z5 as recommended by The Planning and Zoning Commission. Second by Council member Moser. The motion carried unanimously. Ayes: Rigby, Moser, Beasley, Clausen, Engelken, Mosteit, Malone and Porter. Nays: None Abstain: None Absent: Ebow 9. Chairman of the Fiscal Affairs Committee Engelken provided a report to City Council. 10. Close Regular Meeting and Open Workshop at 6:51p.m. Planning Director Wayne Sabo provided a presentation on DrainagelFlooding Issues. City Engineer Rodney Slaton also assisted in the presentation. City Council Regular Meeting, Public Hearing and Workshop Meeting -September 10, 2007 Page 5 Council discussed solutions and participation from the City, Harris County Precinct 2, Harris County Flood Control, Home Owners Associations and individual citizens to resolve the drainage and flooding issues within the City of La Porte and what could be done short term to assist in approving the current situations occurring. City Staff will address the comments from citizens made at this meeting and the August 27th City Council Meeting. A maintenance program is in place. Council advised the citizens to contact the city and let them know if they had received water in the homes in addition to requesting the Bayshore Sun and Houston Chronicle assist by writing an article in the papers. City Staff is coordinating with FEMA for assistance and will forward a list to Council of citizens reporting water in their homes during the rain events. Councilmember Mosteit inquired if staff had any efforts for maintenance on open ditches in the City of La Porte and would like more concentration on the FIOI Project that floods due to mats in the ditch causing clogging. Councilmember Moser stated he would like to see more efforts and resources looked into on mowing and cleaning ditches in the city. Councilmember Beasley requested staff reevaluate the three year storm event due to new development. Councilmember Engelken requested staff to provide more information to the citizens for assistance from the city on how to contact the Red Cross and/or FEMA if a rain event resulted in flooding. He would also like to see more public awareness about grass clippings being blown by blowers into storm sewers creating clogging. He also mentioned more maintenance need to be concentrated on cleaning storm sewers in the Brookglen Subdivision in addition to Harris County Flood Control assisting by cleaning their ditch in the Subdivision. Councilmember Mosteit proposed City Council form a Flooding and Drainage Committee to start addressing the issues and began obtaining assistance from Harris County Precinct 2 and Harris County Flood Control District. City Council wants to form a committee consisting of Councilmembers Clausen, Moser, Engelken and Mosteit. Alternate members will be appointed as well. Emergency Management Coordinator Jeff Suggs provided an overview on Disaster Assistance and advised individuals to go to the FEMA website and register or call 1-800- 621-FEMA if Tropical Storm Erin would be declared a disaster. Senior Project Coordinator John Randolph of Harris County Flood Control District informed Council he worked with city staff the day of and after Tropical Storm Erin collecting data on high water marks. A survey is being conducted and will be shared with Council after it comes back. Mr. Randolph advised he will continue to work with the city and staff to get the flooding/drainage issues resolved. Mayor Porter advised Mr. Randolph there is an issue with Harris County not mowing in the city. Mr. Randolph informed Council Harris County contracts mowing and requested City Council Regular Meeting, Public Hearing and Workshop Meeting -September 10, 2007 Page 6 citizens call 713-684-4000 to report maintenance problems. He will be working with staff to resolve issues. General Superintendent John Saavedra of Harris County Precinct 2 informed Council he is working with Interim City Manager John Joerns on the F101 Project and recognize it is a problem and will work with staff to resolve it. 11. Closed the Workshop meeting and reconvened Regular Meeting at 9:50 p.m. 12. Administrative Reports Interim City Manager John Joerns provided Council with the following Administrative Reports. The Heritage Society Fish Fry on September 12, 2007 at Sylvan Beach Pavilion, the FEMA Damage and Assessment Team Report and the Chamber of Commerce Annual Steak Cookout at DuPont Recreation Building on September 13,2007. 13. Council Comments Mosteit, Clausen, Rigby, Moser, Beasley, Ebow Malone, Engelken and Porter had comments. 14. Council to consider approval or other action regarding an ordinance appointing a City Manager of the City of La Porte. Assistant City Attorney Clark Askins read: Ordinance 3028 - AN ORDINANCE APPOINTING A CITY MANAGER OF THE CITY OF LA PORTE, APPROVING AND AUTHORIZING THE EXECUTION OF AN EMPLOYMENT AGREEMENT BETWEEN THE CITY OF LA PORTE AND THE CITY MANAGER OF THE CITY OF LA PORTE, City Council Regular Meeting, Public Hearing and Workshop Meeting -September 10, 2007 Page 7 MAKING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT, FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF Motion was made by Council member Rigby to approve ordinance 3028 as recommended by Mavor Porter appointing Ron Bottoms at City Manager. The City Secretary is hereby authorized to attest to all such signatures and to affix the seal of the City to all such documents. Section 2. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the city Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government Code; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 3. Gillett City Secretary APPROVED: ctd?dnr ~ Assistant City Attorney 2 EMERGENCY ASSISTANCE COMPACT STATE OF TEXAS -TY OF LA PORTE WHEREAS, the City of La Porte, Texas, having a principal address at 604 West Fairmont Pkwy., La Porte, TX 77571 ("La Porte") fmds it to be in its best interest to have mutual aid agreements and/or emergency assistance agreements with other local governmental bodies and private entities in the state and region, WHEREAS, the City of La Porte has determined that a portion of undeveloped land located at 190 1 Avenue H & 16th Street, La Porte, Texas 77571, more particularly shown and described as Tracts A, B, and C on "Exhibit A" attached hereto ("Emergency Acreage") and owned by PPG Industries, Inc. ("PPG"), a Pennsylvania corporation having a corporate mailing address at One PPGPlace, Pittsburg, PA 15272 would provide a suitable location for a debris management site during periods of emergency, and PPG Industries, Inc. desires to lend its support to the City of La Porte during such periods of emergency, as available NOW, THEREFORE, in consideration of the above recitals and the covenants contained herein, the City of La Porte, Texas and PPG Industries, Inc. hereto agree as follows: 1. PPG hereby agrees to provide disaster assistance to La Porte, to the extent PPG is reasonably able to, which may be requested by La Porte during the existence of emergency conditions, including a natural disaster, as defined by Texas law. The assistance rendered shall consist of the right to utilize the Emergency Acreage owned by PPG for the purpose of the temporary placement and storage of non- hazardous (as defined in applicable Federal and Texas law) debris for such period of time as a declared emergency remains in effect, as set forth in Paragraph 2, below. 2. The right and privilege of the City of La Porte to utilize the Emergency Acreage under the terms of this agreement shall accrue, and all other provisions of this agreement shall be activated, during a declared state of emergency by the government of the City of La Porte, or by the State of Texas or the U. S. Government, when applicable to La Porte. 3. Personnel of the La Porte and contractors hired by La Porte shall remain employees or contractors of the City of La Porte, as the case may be, and at all times shall be under the direct control and supervision of La Porte or its designee. La Porte will also provide and be solely responsible for the payment of compensation and all other benefits, as applicable, to said employees and/or contractors. 4. La Porte or its designee will provide a list of employees, equipment and contractors upon request to PPG during an emergency period, to the extent it is reasonably able to do so. La Porte agrees to return all real or personal property of PPG used by La Porte to previous conditions after any emergency period as reasonably existed prior to such emergency, to the extent that is necessary, to include without limitation the repair or installation of pens, roads and fences to be 5 strand or 4 point American wire with poles every 10 feet and two stays between posts with gates as and where needed. La Porte agrees to abide by all rules and regulations set forth by federal and state agencies having jurisdiction over environmental operations. 5. La Porte will maintain workers compensation coverage for its employees and liability coverage for its -- vehicles and equipment. La Porte agrees to maintain adequate liability insurance for all other aspects of its operations, employees, and equipment, as required. 6. Neither party nor its officers nor employees rendering aid pursuant to this agreement shall be liable on account of any act or omission in good faith on the part of such party so engaged, or on account of the maintenance or use of any equipment or supplies in connection therewith. 7. Neither party to this agreement shall be liable for its failure or refusal to render aid pursuant to this agreement. Furthermore, both parties retain the right to withdraw any and all aid rendered upon direction of their respective designees. 8. La Porte, through its designee, in conjunction with PPG representatives, shall in their sole discretion determine the manner which emergency aid may be used. 9. This agreement shall continue in force and remain binding on each party until either party takes action to withdrawal therefrom. Such action shall not be effective until 30 days after notice thereof has been sent in writing to the other party. The applicant's reason for this request is to facilitate future expansion of Pfeiffer & Son, Ltd. at 116 N. 16th St. Upon review of the proposed closing, the Public Works Department has stated no objection to the closing. Additionally, each of the City's franchised utility companies (i.e. Centerpoint Energy, SBC & Comcast) have reviewed the closing and each company has submitted letters of no objection. In accordance with Section 62.35 of the Code of Ordinances, an independent appraisal has been conducted of the North 14th Street Right-of-Way which contains a total of 24,000 square feet. The resulting fair market value ofthe right-of-way has been assessed at $0.75 per square foot. The City has subsequently received payment from the applicant in the amount of $13,500 (75% of fair market value per the ordinance) from the applicant for the closing. Recommendation: It is Staff's recommendation that Council authorize vacating, abandoning, and closing the North 14th Street Right-Of-Ways between West Polk Street and West Adams Street as petitioned by the applicant. Section 26.04 of the State Property Tax Code requires the submission of the Appraisal Roll to the Governing Body. The 2007 Certified Tax Roll for the City of La Porte, as received from the Harris County Appraisal District (HCAD), shows a total appraised value of $2,019,627,791 and a total taxable value of $1,633,072,289. The budget was based on certified to date values as of 5/18/07, which showed a total taxable value of $1,788,617,086. The preliminary roll received in May showed a total taxable value of$I,664,966,752. The certified roll is 1.9% less than the preliminary roll and 9.5% less than the certified to date roll which was used to build the budget. As you are aware, while the Tax Code provides for approval of the appraisal records to occur on July 20, it also stipulates that the ARB cannot approve the records until no more than 5% of the total appraised value in the district remains under protest. This year we received over 334,000 value protests-a substantial increase over prior years. Approved & Certified Accounts As was the case in prior years, "approved" accounts on your certified roll include those on which no protest was filed, those on which a late protest was filed "without good cause" as determined by the ARB, and those on which a timely filed or "good cause" late protest has been determined or dismissed due to failure to appear for the protest hearing. Uncertified Accounts Your certified roll does not include the value of accounts still under protest; accounts on which the valuation is incomplete and notices have not been mailed; and properties which are either ready to notice or have been noticed and on which the 30-day protest period has not elapsed. As required by law, estimated values applicable to these accounts are summarized in the enclosed reports. Final certified values for properties in these categories will be included in later supplemental rolls. Other Information Also included in your certification packet is a sheet titled "WHERE TO FIND." This sheet notes where to find information you will need to calculate your effective and rollback tax rates. The last page of your "CERTIFIED TO DATE" report includes a summary of average residential values in your unit, which is information required for your tax rate hearing notices. Please review the homestead exemption data in your printouts to ensure that we used the most current information on your exemption rates. Also, remember that homestead exemptions may be claimed up to one year after the delinquency date for the taxes on the homestead. ORDINANCE NO. 07-3032 AN ORDINANCE AMENDING CHAPTER 50 "PARKS AND RECREATION" OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, TEXAS BY ADDING NEW SECTION 50-4, "USE OF TOBACCO PRODUCTS ON ATHLETIC PLAY FIELDS AND RECREATIONAL VENUES", AND PROHIBITING THE USE OF TOBACCO PRODUCTS ON CITY-OWNED ATHLETIC PLAY FIELDS OR RECREATIONAL VENUES, INCLUDING ADJACENT SPECTATOR AREAS, WHILE BEING USED FOR ORGANIZED YOUTH ATHLETIC EVENTS OR RECREATIONAL ACTIVITIES; PROVIDING FOR A PENALTY NOT TO EXCEED $500 FOR EACH OFFENSE; PROVIDING A SEVERABLITY CLAUSE; CONTAINING AN OPEN MEETINGS CLAUSE; PROVIDING FOR THE PUBLICATION OF THE CAPTION HEREOF; AND PROVIDING AN EFFECTIVE DATE HEREOF; BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LA PORTE: Section 1. Use of Tobacco Products on Athletic Play Fields and Recreational Venues (a) The following words or terms when used in this section shall have the following meanings, unless the context clearly indicates otherwise: (l)Parks. A park, conservation area, playground, beach, recreation center or other area in the City owned, leased or used, wholly or in part, by the City for such purposes or which is designated by the City Council as a park. (2)Tobacco Product. Cigarette, cigar, cheroot, stogie, perique, granulated, plug cut, crimped cut, ready, rugged and other smoking tobacco; snuff, snuff flower, cavendish, plug and twist tobacco; fine cut and other chewing tobaccos; shorts, refuse scripts, clippings, cuttings, and sweepings of tobacco; and other kinds and forms of tobacco, prepared in such a manner as to be suitable for chewing, sniffing, or smoking in a pipe; rolling paper or other tobacco-related devices. (3)Tobacco Product Use. Smoking, chewing, snuffing or otherwise inhaling or ingesting any tobacco product. (4) Athletic Play Fields. A baseball field, softball field, soccer field that has been designed for regulation play or practice play at a park. (5) Ad Hoc Use of Park. Use of an undesignated area of a park (i.e. open space) for organized youth athletic practice use. (6) Recreation Venue. A facility occasionally used for youth sports or recreational events such as fishing and riding, either organized or non-organized; including the Lomax Arena, the Sylvan Beach Fishing Pier, the Seabreeze Fishing Pier, the Little Cedar Bayou Nature Trail and Bird-watching Stand, the San Jacinto Pool, the Little Cedar Bayou Wave Pool, the Northwest Pool, the Fairmont Pool, the Brookglen Pool and the La Porte Recreation & Fitness Center. (b) A person commits an offense if he or she uses tobacco products on City-owned athletic play fields or recreation venues, or ad hoc use of park, including their spectator areas, while the fields and venues and/or ad hoc areas are being used for organized youth athletic or recreational events, or where youths are present and are using said recreational venues independently of organized athletic or recreational activities. All such areas with the exception of ad hoc areas shall be posted by appropriate signs and markers as designated by the Director of Parks & Recreation. Page 1 of 3 (c) This Ordinance does not apply to the use of tobacco products in designated parking areas or motor vehicles parked on the premises of City-owned parks, conservation areas, open spaces and recreational facilities. This Ordinance does not apply to park open spaces, picnic areas, golf courses (except during organized youth sports event), and other passive recreational activities not directed for, or including youth. (d) Neither allegation nor evidence of a culpable mental state is required for the proof of an offense defined in this Section. (e) Any person, as defined in Section 1.07(27), Texas Penal Code, who shall violate any provision of this section shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a fine not to exceed Five Hundred Dollars ($500.00). Section 2. The average age at which people begin smoking is 13 years, and only 10 percent of tobacco users begin to do so after age 20 (TCC). In 2001 the State of Texas enacted law (Texas Education Code, Chapter 38.006) prolubiting smoking or use of tobacco products in schools, or at school-related and school sanctioned events. Here in La Porte we have several thousand children participating in organized youth sporting events at various City-owned facilities that are exposed to tobacco use on a regular basis. Although the La Porte Boys Baseball Association has a no-tobacco policy and has an agreement to use City of La Porte facilities, it has no real enforcement authority on city owned property other than association sanctions. These sanctions can apply to coaches and league members, but not to spectators. The proposed Ordinance would prolnbit the use of tobacco at the specific area( s) where the sports activity is taking place, but provide a marked spot such as a parking area away from the sports activity, for smoking or other tobacco use by spectators. This is somewhat the approach used by the LPISD at their events. For example, at Bulldog Stadium at halftime, you will see a fairly large number of spectators outside the fence on Texas Avenue, smoking. This approach would respect the right of people to smoke without influencing the youth participants or endangering them with second-hand smoke. Action Required by Council: Staff requests direction in review and modification of the proposed Draft Ordinance if Council desires, and proposes to bring the revised Ordinance back to the next COWlcil meeting for approval. yJf~?
