MINUTES OF A SPECIAL CALLED MEETING,
PUBLIC HEARING AND WORKSHOP MEETING
OF THE LA PORTE CITY COUNCIL
May 19, 2008
1. CALL TO ORDER
The meeting was called to order by Mayor Porter at 6:00 p.m.
Members of City Council Present: Mayor Porter, Mayor Pro-Tern Rigby, Council members
Tommy Moser, Mike Clausen, Mike Mosteit, Barry Beasley, John Black, Chuck Engelken,
Howard Ebow and Georgia Malone
Members of Council Absent: None.

A. Received a presentation from La Porte High School students Jack Swearingen
and Jonathan Mockmell on the recent China Mission trip.
B. Mayor Pro-Tern Rigby presented a proclamation for "La Porte High School Wind
Ensemble Day".
5. Council to consider approval or other action regarding an ordinance declaring the results
of the City of La Porte Election held on May 10, 2008.

Assistant City Attorney Clark Askins noted change to ordinance presented summary and
recommendations and answered Council's questions.
Assistant City Attorney read: ORDINANCE 3076- AN ORDINANCE DECLARING THE
RESULTS OF THE ELECTION HELD IN THE CITY OF LA PORTE ON MAY 10, 2008,
FOR THE ELECTION OF COUNCILPERSON AT LARGE, POSITION B,
COUNCILPERSON DISTRICT 1, AND COUNCILPERSON DISTRICT 6, FINDING
COMPLIANCE WITH THE OPEN MEETINGS LAW, AND PROVIDING AN EFFECTIVE
DATE HEREOF.
Motion was made by Councilmember Enqelken to approve Ordinance 3076 as presented
by Mr. Askins. Councilmember Beasley second. The motion carried.
6. Presiding Judge Denise Mitrano administered Oaths of Office to the newly appointed
Councilmember At Large B, Councilmember District 1 and Councilmember District 6 as
presented.
7. Mayor Porter presented an Appreciation Plaque to Councilman Beasley for his dedicated
service during the terms of office he held.
8. Consent Agenda
A. Consider approving Minutes of the Regular Meeting and Workshop of the La Porte
City Council held on April 28, 2008.
B. Council to consider approval or other action regarding an ordinance vacating,

Motion was made by Councilmember Riqby to approve the consent aqenda as presented.

A. Andrew Ortiz spoke on behalf of the La Porte Fire Department's 2008 Fill-the Boot
Campaign.

B. Leonard Zlomke was not present to speak.
C. Ed Matuszak spoke regarding Gateway Enhancements/Fac;ade Improvements.
D. Kathryn Aguilar, 3119 Fondren wants to see improvements in the Park area and
spoke about saving the Pavilion. She also suggested Main Street be geared
toward the citizens needs.
E. Phillip Hoot, 927 Seabreeze- Spoke against the Sylvan Beach Hotel Project; and
would like to see historical Downtown La Porte preserved.
F. Mark Follis, 831 S. 7th Street- Need to preserve historic value of Main Street.
10. Council to consider approval or other action regarding an ordinance appointing a member
of the City Council to serve as Mayor Pro- T em of the City of La Porte, for a term expiring
May 31, 2009. (Ord. 3078) - Mayor Porter
Assistant City Attorney Clark Askins read Ordinance 2008-3078, AN ORDINANCE
APPOINTING A MEMBER OF THE CITY COUNCIL TO SERVE AS MAYOR PRO-TEM
OF THE OF THE CITY OF LA PORTE, FOR THE TERM COMMENCING JUNE 1, 2008
AND EXPIRING MAY 31, 2009, FINDING COMPLIANCE WITH THE OPEN MEETINGS
LAW, PROVIDING AND EFFECTIVE DATE HEREOF.
Motion as made by Councilmember Ebow to approve Ordinance 3078, appointing Mike
Clausen as Mayor Pro-Tem. Councilmember Moser second. The motion carried.

11. Council to consider approval or other action of purchasing a Fire Pumper Truck.
Assistant Fire Chief Donald Ladd presented summary and recommendation and answered
Council's questions.
Motion was made by Councilmember Engelken to approve the purchase of the new Fire
Pumper Truck as recommended by Mr. Ladd. Mayor Pro-Tem Clausen second.
The motion carried.

12. Public Hearing- Council to consider recommendation of Planning and Zoning Commission
to approve an ordinance amending Chapter 106 (Zoning) to add the maximum height
restriction for commercially zoned and high density residentially zoned properties when
adjacent to low density residentially zoned properties.
Open Public Hearing - Mayor Porter opened the Public Hearing at 7:29 p.m.
Planning Director Tim Teitjens presented summary and recommendation and answered
Council's questions.
Public Input - Phillip Hoot, 927 Seabreeze is against rezoning.
Lester Quinn, 1211 Bayshore Dr. is against rezoning.
Bobby Schlenk- 620 S. 4th is against rezoning.
Ed Matuszak, 10443 Catlett, is opposing the ordinance as written.
Ted Powell, 1700 Roscoe is against rezoning.
Ronda Lunsford, 201 E. Main St. is against rezoning.
Kathryn Aguilar, 3119 Fondren is against rezoning.
The Public Hearing was closed at 7:43 p.m.
Recommendation of Planning & Zoning Commission - City Council consider
approval of Ordinance amending Chapter 106 of the Code of Ordinances of the City of
La Porte by adding footnote #9 Sections 106-443, Table B, "Commercial area
Requirements", that the maximum allowable height for structures within commercially
zoned and high density residentially zoned properties when adjacent to low density
residentially zoned properties is 30 feet.
13. Council to consider approval or other action regarding Ordinance 1501-C6.

AMENDING THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, CHAPTER
106, MORE COMMONLY REFERRED TO AS THE ZONING ORDINANCE OF THE CITY
OF LA PORTE, BY AMENDING ARTICLE III. "DISTRICTS", DIVISION 3 "COMMERCIAL
DISTRICT REGULATIONS", SUBDIVISION I, "GENERALLY", BY ADDING FOOTNOTE
#9 TO SECTION 106-443, TABLE B. "COMMERCIAL AREA REQUIREMENTS",
PERTAINING TO MAXIMUM HEIGHT RESTRICTIONS FOR STRUCTURES LOCATED

14. Public Hearing - Council to consider approval of an ordinance relative to Standard of Care
for City of La Porte Parks & Recreational Camp programs.
Open Public Hearing - Mayor Porter opened the Public Hearing at 7:51 p.m.
Director of Parks & Recreation Stephen Barr presented summary and recommendation
and answered Council's questions.
Public Input: There were no citizens wishing to provide input.
The Public hearing was closed at 8:01 p.m.
Recommendation of the Parks & Recreation Department - City Council consider approval
of Ordinance relative to Standards of Care for City of La Porte Parks & Recreation
Department Recreational Camp Programs.
15. Council to consider approving or other action regarding Ordinance 3079.
Assistant City Attorney Clark Askins read: Ordinance 3079, AN ORDINANCE AMENDING
CHAPTER 50 "PARKS AND RECREATION" OF THE CODE OF THE ORDINANCES OF
THE CITY OF LA PORTE, TEXAS BY ADDING NEW SECTION 50-5, 'STANDARDS OF
CARE FOR CITY OF LA PORTE PARKS AND RECREATION DEPARTMENT
RECREATIONAL PROGRAMS AND CAMP PROGRAMS AT CITY FACIILlTIES;
CONTAINING A SEVERABILITY CLAUSE; CONTAINING AN OPEN MEETINGS
CLAUSE; AND PROVIDING AN EFFECTIVE DATE HEREOF;
Motion was made by Council member Moser to approve Ordinance 3079 as recommended
by the Parks and Recreation Department. Seconded by Councilmember Malone. The
motion carried.

16. Public Hearing- Council to consider approval or other action regarding Resolution adopting
the 2008 Update of the Year 2002 City of La Porte Parks, Trails and Open Space Master
Plan of the City of La Porte, Texas.
Open Public Hearing- Mayor Porter opened the Public Hearing at 8:03 p.m.
Parks & Recreation Director Stephen Barr presented summary and recommendation and
answered Council's questions.

Public Input: Marlon Jackson, 10118 Roseberry Dr. wants to see the City have a larger
complex.
Kathryn Aguilar, looked at the Master Plan, noted a few items on the Bayfront. Wants to
see Sylvan Beach improved including a restroom facility.
Phillip Hoot- encouraged Council to pass the ordinance tonight.
The Public Hearing was closed at 8.27 p.m.
Recommendation of Parks and Recreation - City Council to approve adopting the 2008
Update of the Year 2002 City of La Porte Parks, Trails and Open Space Master Plan of the
City of La Porte.
17. Council to consider approval or other action regarding Resolution 2008-06.
Assistant City Attorney Clark Askins read: Resolution 2008-06 A RESOLUTION
ADOPTING THE 2008 UPDATE OF THE YEAR 2002 PARKS, TRAILS, AND OPEN
SPACE MASTER PLAN FOR THE CITY LA PORTE, TEXAS.
Motion was made by Council member Ebow to approve Resolution 2008-06 as
recommended by the Parks and Recreation Department. Seconded by Councilmember
Malone. The motion carried.

18. Public Hearing - Council to consider approval or other action on recommendation of
Planning & Zoning to approve (SCU#08-001) Special Use Conditional Use Permit for the
off-site parking for Pfeiffer & Sons, Ltd.

Planning Director Tim Teitjens presented summary and recommendation and answered
Council's questions.
Public Input: Un Pfeiffer encouraged Council to approve the Special Conditional Use
Permit.

PORTE, BY GRANTING A SPECIAL CONDITIONAL USE PERMIT #SCU08-001 FOR
THAT CERTAIN PARCEL OF LAND DESCRIBED AS FOLLOWS: TO-WIT: 2.29 ACRE,
LOTS 1-32 BLOCK 686, TOWN OF LA PORTE, JOHNSON HUNTER SURVEY,

Finance Director Mr. Dolby presented summary and recommendation and answered
Council's questions.
Councilmember Mosteit noted one property was not included in the agenda request

THE RESALE OF CERTAIN PROPERTY.
Motion was made by Councilmember Enqelken to approve Resolution 2008-07 as
recommended by Mr. Dolby. Second by Councilmember Mosteit. The motion carried.

21. Council to receive report on ISO Rating.
Assistant Fire Chief Donald Ladd provided a report on ISO rating.
The City's rating improved from a 4 to a 2. This is a very positive rating that will save
citizens on their yearly insurance costs.

22. Council to consider approval or other action regarding an ordinance amending
Organization and Procedures 0 for City council Meetings - (Ord. 2646-A) - Council
members Moser, Beasley and Rigby.
Assistant Clark Askins read Ordinance No. 2003- 2646-A, AN ORDINANCE
ESTABLISHING ORGANIZATION AND PROCEDURES FOR CITY COUNCIL MEETING;
FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; PROVIDING AN
EFFECTIVE DATE HEREOF;
Motion was made by Councilmember Ria by to approve Ordinance 2003-2646-A as
recommended by Mr. Askins. Second by Councilmember Black. The motion carried.

23. Council to consider approval or other action to award RFP #08508 - Real Estate Broker
Services - Rebid
Purchasing Manager Susan Kelley presented summary and recommendation and
answered Council's questions.
Council members commented on not having enough information.
Motion was made bv Councilmember Mosteit to award RFP #08508 Real Estate Broker
Services. Second by Councilmember Ebow. The motion carried.

24. Council received a presentation by the Economic Alliance Houston Port Region to review
submitted proposals for the Gateway Enhancements/Fagade Improvements for the City
owned 912 Main Street location and an update regarding the proposed gateway
Enhancements which will be presented in a public hearing as a proposed project for the La
Porte Economic Development Corporation as their meeting on June 9, 2008 - M. Porter
Jan Lawler presented the above presentation. It as the consensus to Council to follow the
traditional theme.
25. Chairman Mosteit provided an update from Drainage and Flooding Committee.
Chairman Engelken stated there was no report from the Fiscal Affairs Committee.
26. Mayor Porter closed Regular Meeting and opened Workshop at 9:32 p.m.

A. Council discussed signage under Texas Penal Code Section 30.06 Trespass by
Holder of License to Carry Concealed Handgun for posting at the entrances of City
Hall.
Assistant Chief Parker discussed signage under Texas Penal Code Section 30.06

B. Receive an update on Capital Improvement items for Public Works Department.
Director of Public Works Steve Gillett provided an update on Capital
Improvements for Public Works Department.
27. Mayor Porter closed Workshop meeting and reconvened Regular meeting at 9:52 p.m.

SUMMARY & RECOMMENDATION
The City has received an application from Mr. Bobby Schlenk to vacate, abandon and close the
alley in Block 414, Town of La Porte (4,123 sq. ft.). The applicant desires to close the subject
alley in order to create a single economic unit of land to facilitate future development.
City Staff and the City's franchised utility companies (i.e. Centerpoint Energy, AT&T & Comcast)
have each reviewed the request and have expressed no objection to closing the alley.
In accordance with Section 62.35 of the Code of Ordinances, Staff has ordered an independent
appraisal of the alley in Block 643, La Porte. Fair market value has been assessed at $0.95 per
square foot for which the City has subsequently received payment from the applicant in the amount
of$2,937.63 (75% of Fair Market Value per the ordinance).
Recommendation:
Staff recommends vacating, abandoning, and closing the alley in Block 414, Town of La Porte as
requested by the applicant.

AN ORDINANCE VACATING, ABANDONING AND CLOSING THE ALLEY IN BLOCK
414, TOWN OF LA PORTE, HARRIS COUNTY, TEXAS, AUTHORIZ ING THE
EXECUTION AND DELIVERY OF A DEED TO THE ADJOINING LANDOWNER,
FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW, AND PROVIDING AN
EFFECTIVE DATE HEREOF.
WHEREAS, the City Council of the city of La Porte has been
requested by the record owner of all of the property abutting the
hereinafter described alley in Block 414, Town of La Porte, Harris
County, Texas, to vacate, abandon, and permanently close the
hereinafter described alley in Block 414, Town of La Porte, Harris
County, Texas; and
WHEREAS, the city Council of the City of La Porte has
determined and does hereby find, determine and declare that the
hereinafter described alley in Block 414, Town of La Porte, Harris
County, Texas, is not suitable, needed, or beneficial to the public
as a public road, street, or alley, and the closing of the
hereinafter described alley in Block 414, Town of La Porte, Harris
County, Texas, is for the protection of the public and for the
public interest and benefit, and that the hereinafter described
alley in Block 414, Town of La Porte, Harris County, Texas, should
be vacated, abandoned, and permanently closed.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:

WHEREAS, SHOREACRES is in the need of certain governmental services for the benefit of
the people and property within its city limits, and
WHEREAS, LA PORTE is able and willing to provide said governmental services to CITY,
upon the tenus, conditions, and covenants herein contained:
NOW, THEREFORE, pursuant to the authority granted by Chapter 791, "Inter10cal
Cooperation Contracts", Texas Government Code, and in consideration of the mutual covenants,
agreements, and benefits to both cities, it is hereby agreed as follows:
A. GENERAL PROVISIONS

approved by LA PORTE for same services rendered to residents of La Porte, including but not limited
to daily impound fees, feeding, and euthanasia; SHORBACRES paying such amount as may be

outstanding and unpaid by the dog owner or other who may claim the dog, if any. LA PORTE agrees
not to release dogs impounded by SHOREACRES without receiving payment in full for all services
rendered by LA PORTE from the dog owner or other who may claim the dog.
The total of such unpaid charges are to be paid in full by SHOREACRES to LA PORTE, on or
before thirty days following invoice by LA PORTE for Service rendered. Payments by
SHOREACRES shall be made from current revenues available to SHOREACRES.

LA PORTE will not be liable for loss or damage to person or property arising from or caused
by or resulting from alleged negligence of LA PORTE, its officers or employees or volunteers in
carrying out the terms of this agreement SHOREACRES agrees to indemnify, and save and hold LA
PORTE harmless, from any such claim for loss or damage by itself, or by any person, fIrm,
corporation, or association, in connection with this agreement.
lV.
Either party to this agreement may cancel by giving ninety (90) days notice to the other party.
Such notice will be effective as ofmidnight of the last day of the calendar month after the expiration of
such ninety (90) days notice.
v.
SHOREACRES personnel shall abide by ALL LA PORTE rules, regulations, and policies, as
they now exist, or may be amended hereafter, relating to the services rendered including the use of
facilities made available to the SHOREACRES under the temlS of this agreement.
B. DOG IMPOUND
I.
LA PORTE agrees to provide Dog Impound Services (Service) to City for Shore acres on a
space available basis. LA PORTE reserves the right to refuse the Service at any time during the
agreement to accommodate its own needs. SHOREACRES personnel shall deliver dogs for impound to
the LA PORTE facility during normal operation hours. Dogs delivered to LA PORTE for Service shall
be subject to the same rules, regulations, and policies, as they now exist, or may be amended hereafter,
relating to the dogs placed in the facility by LA PORTE.

ill 1983, the City acquired a 16'x 400' strip ofland along the west side of Lots 1-16, Block 830 for
the purpose of constructing a future sanitary sewer tnmk main extension. However, the sanitary
sewer main was ultimately constructed in the adjacent S. 14th Street Right-of-Way. Recently,
Charles Douglas Boyle, the original Grantor of the land, approached the City to buy back the 6,400
sq. ft. strip to unify his property with its original frontage to S. 14th Street (see Exhibit 3).
Staff conducted a review of Mr. Boyle's request and determined that the strip was of no future use
or benefrt to the City. Additionally, standard public bid procedures for the sale of the property may
be waived due to its irregular shape and that it lies wholly adjacent to Mr. Boyle's remaining
property in the block.
Staff ordered an appraisal of the subject strip (at Boyle' s expense) for which the fair market value
has been established at $1.75/sq. ft. Mr. Boyle has subsequently made payment to the City in the
amount of $11,200. A Special Warranty Deed for the conveyance of this property to Charles
Douglas Boyle and wife, Laura M. Boyle is included as Exhibit 2 of this packet.
Recommendation:
Staff recommends approving the sale of the above-descnbed property to Charles Boyle as it is of
no future use or benefit to the City of La Porte.

In June 2006, City Council passed Ordinance No. 2003-2665-A to waive development, permit, building, inspection
and parkland fees for certain non-profit corporations and/or City-initiated programs which provided housing for
low-income families.
Habitat for Humanity is requesting consideration from the City to participate as a non-profit by obtaining the
following properties for the construction of two single-family dwellings:
1. Block 63, Lots 19 & 20, Town of La Porte (Re: P220)
2. Block 66, Lots 5 & 6, Town of La Porte (Re: P222)
Given that Habitat is a non-profit organization; they are eligible for waiver of development fees per City ordinance.
During a previous workshop, Council agreed to review, on a case-by-case basis, requests for funding/participation
from Habitat for Humanity on a level similar to that for the HOME Grant Program. In a typical HOME Grant, the
City incurs expenses as a matching requirement. There is a 25% match required from the City for HOME Grant
funding.
The following is a comparison of the expenses incurred by the City for the current HOME Grant Project and the
request from Habitat for Humanity. The point of comparison is two homes constructed on City lots with associated
costs factored.

AIRPORT ADVISORY BOARD
The Airport Advisory Board advises the City Council on matters relating to the most
desirable and efficient operation of the City Municipal Airport. The Airport Advisory
Board shall review, from time to time, the City Airport Master Plan, and recommend
updating or revisions to such Airport Master Plan. The Board may also make
recommendations on such matters as rules and regulations for operations at the Municipal
Airport, and for any needed improvements to the facilities at the airport, including such
matters as navigational aids, ordinances, zoning requests, height restrictions, development,
as well as any other improvements which the board feels would enhance the utility of the
City Municipal Airport.

CIVIL SERVICE COMMISSION
Purpose:
The Civil Service Commission was established in 1981, when the citizens voted to adopt the
State's Municipal Civil Service Law, as it applies to sworn police officers. In compliance
with State Law, the Commission adopted rules relating to the appointments and the
promotions of sworn police officers. Furthermore, the Civil Service Commission conducts

LAPORTE AREA WATER AUTHORITY
Purpose:
The La Porte Area Water Authority was created in 1981 by the State Legislature. The
legislation granted the Authority rights and powers related to acquisition of water supplies
and the collection/treatment of wastes. The early mission of the Authority was to secure
surface water to entities contracting with the Authority. The Authority may purchase,
construct, lease or otherwise acquire property and facilities relating to their mission. They
may contract with persons, corporations, municipal corporation and political subdivisions of
the State with the approval of the City Council.

Purpose: The corporation is organized under, and shall be governed by, the Development
Corporation Act of 1979, Article 5190.6, Section 4B, Vernons Annotated Texas Civil

above described projects.

Articles ofIncorporation and Bylaws Approved by Resolution 2000-19
Purpose: To fmance the development and redevelopment of unproductive, underdeveloped
or blighted areas within the City. Articles and Bylaws approved by Resolution 2000-19.
Per Articles of Incorporation and the Bylaws of the La Porte Redevelopment Authority, an
appointment of a Director to the Reinvestment Zone # 1, City of La Porte, Texas constitutes
an appointment to serve as a Director of the La Porte Redevelopment
Authority.
Directors of the Authority shall be appointed by the Mayor of the City with the consent and
approval of the City Council and shall be the same persons appointed to the corresponding
position of the Board of the La Porte Reinvestment Zone.
Each taxing unit appointment as a Director to the La Porte Reinvestment Zone shall also
constitute a nomination of such person to the Redevelopment Authority.
The term of each Redevelopment Authority position shall be coterminous with the
corresponding position on the Board of the La Porte Reinvestment Zone.
The Mayor of the City shall always appoint the Chairman of the Redevelopment Board for
the term designated by the City.

MAIN STREET ADVISORY BOARD MEMBERS
Purpose: The Texas Historical Commission manages the Texas Main Street program; the
City of La Porte has been selected as one of four 2005 Main Street Cities. As a participant
in the program we are required to establish a Main Street Advisory Board, whose role is to
help direct revitalization efforts and historic preservation in our historic downtown district,
and involves the community in these efforts. The Main Street Advisory Board will select
members and oversee four Main Street Committees to focus on downtown issues: Design,
Economic Restructuring, Promotions, and Organization.
Eligibility Requirements: Each Board Member should have or provide one or more of the
following:
. A demonstrated interest in the program's purpose and its goals.
. Specific experience in and/or knowledge of administration, fmance, program
development, advertising, public relations, downtown business activity,
communications, design or economic restructuring.
. Representation of a public or private organization in the community or a segment of
the community.
. 4-10 Hours of time per month to be dedicated to the Main Street Program.

ZONING BOARD OF ADJUSTMENT
Purpose:
The Board of Adjustment shall hear and decide appeals to any order, requirement, decision
or determination made by the Building Official related to the Zoning Ordinance. The Board
also hears and decides on special exceptions and variances as long as their action is not
contrary to public interest and is within the guidelines established by State Law and the

need to take should a chemical emergency arise. The LEPC and Emergency Management office has tried to work
with the Hotel owners and managers to help guide them in the protection of their guests. Weare falling short in this
area and need to take more action to communicate to visitors about their current surroundings and what to do in an
emergency.
After doing much research it has been found that no other city or county across America has such a requirement. We
would be the first at taking such a proactive step in protecting visitors in our City.

Section 1. That Chapter 34 "Environment", of the Code of
Ordinances of the City of La Porte, Texas is hereby amended by
amending Article II "Air Pollution", Division 2 "Smoking", Sees.
34-60-34-90, "Reserved", which said section shall read as
follows:

Section 2. That Chapter 34 "Environment" of the Code of
Ordinances of the City of La Porte, Texas is hereby amended by
adding new Division 3 "Shelter in Place Regulations", to Article
II "Air Pollution", which said Division shall read as follows:
"DIVISION 3. SHELTER IN PLACE REGULATIONS
Sec. 34 - 65. Posting of Shelter in Place Notices in Hotel and
Motel Rooms.
Every person owning, operating, managing or controlling any
hotel, as that terms is defined in Section 66-121 of this Code,
shall post or display in a conspicuous place on the inside of
the door of every private quarter made available to the public
in such facility, a written notice containing Shelter in Place
emergency procedure guidelines, as are promulgated by the
Shelter in Place
guidelines shall be made available in the Office of the
Emergency Management of the City of La Porte.
Sec. 34-66. Penalty for violation of division.
(a) A person who violates any provision of this division shall
be guilty of a class C misdemeanor and upon conviction shall be

Chapter 551, Texas Government Code; and that this meeting has
been open to the public as required by law at all times during
which this ordinance and the subj ect matter thereof has been
discussed, considered and formally acted upon. The City Council
further ratifies, approves and confirms such written notice and
the contents and posting thereof.
Section 5. Severabili ty. Should any section or part of this
ordinance be held unconstitutional, illegal, or invalid, or the
application to any person or circumstance for any reasons
thereof ineffective or inapplicable, such unconstitutionality,
illegality, invalidity, or ineffectiveness of such section or
part shall in no way affect, impair or invalidate the remaining
portions thereof; but as to such remaining portion or portions,
the same shall be and remain in full force and effect and to
this end the provisions of this ordinance are declared to be
severable.
Section 6. Effective Date. This Ordinance shall be effective
fourteen (14) days after its passage and approval. The City
Secretary shall give notice of the passage of this ordinance by
causing the caption hereof to be published in the
newspaper of the City of La Porte at least twice within
days after the passage of this ordinance, in accordance
provisions of Chapter 52, Texas Local Government Code,
City of La Porte Charter.

At their December 03, 2007 meeting, City Council held a workshop to discuss possible changes to weed height
regulations and mowing fees. Following Council's direction, Ordinance #2oo3-2623-A was prepared
(implementing the (6") height regulation and amended mowing fees) and presented at the January 14,2008 meeting.
The ordinance was passed by Council on that date and a copy is included with this packet.
A new workshop has been requested so staff has prepared this packet to assist Council in their review of existing
weed regulations and fees.

Section 1: That Chapter 34, "Environment," Article IV. "Unsanitary, Unsightly Conditions
on Private Premises," Section 34-126 "Definitions," of the Code of Ordinances, La Porte, Texas,
is hereby amended by adding definition for term "acreage" and amending the existing definitions
for the terms "lot or parcel of real estate" and "weeds", to be included in said section in proper
alphabetical sequence, and which definitions shall read as follows:
"Acreage means a tract of land that is in excess of three-quarters of an acre (32,670 sq. ft.) in
land area."
"Lot means a tract of land that is less than three-quarters of an acre (32,670 sq. ft.) in land area,
and includes, in addition to the ground within its boundaries, all ground lying and being adjacent
to and extending beyond the property line of such lot or parcel of real estate to the curb line of
adjacent streets, where a curbline has been established, and 14 feet beyond the property line
where no curbline has been established on adjacent streets; and, in all cases, to the center of all
adjacent alleys."
"Weeds means all rank and uncultivated vegetable growth or matter which has grown to more
than six inches (6") on lots and twelve inches (12") on acreage or which, regardless of height, is
liable to become an unwholesome or decaying mass or a breeding place for mosquitoes or
vermin. "

Section 2: That Chapter 34, "Environment," Article IV. "Unsanitary, Unsightly Conditions
on Private Premises," Section 34-127 "Enforcement of article", of the Code of Ordinances, La
Porte, Texas, is hereby amended to read as follows:
"Sec. 34-127. Enforcement of article.
The terms and conditions of this article shall be enforced by the director of planning or
his duly designated agents. It is unlawful and, unless otherwise declared in this chapter with
respect to particular offenses, it is a misdemeanor for any person to do any act forbidden or fail
to perform any act required in this article. Neither allegation nor evidence of a culpable mental
state is required for the proof of an offense defined in this chapter, during the prosecution of such
offenses in any criminal proceeding."
Section 3: That Chapter 34, "Environment," Article IV. "Unsanitary, Unsightly Conditions
on Private Premises," Section 34-128 "Prohibited Conditions Designated", of the Code of
Ordinances, La Porte, Texas, is hereby amended to read as follows:
"Sec. 34-128. Prohibited Conditions Designated.
The following specific acts and conditions are declared to constitute a public nuisance and are
hereby prohibited and made unlawful: .
(1) Weeds, brush, rubbish and all other objectionable, unsightly and insanitary matter of
whatever nature, covering or partly covering the surface of any portion of a lot, where
the lot is located within 150 feet of the property line of a residence or place of
business.
(2) Weeds, brush, rubbish and all other objectionable, unsightly and insanitary matter of
whatever nature, covering or partly covering the surface of acreage, on that portion of
the acreage situated within 150 feet of the property line of any residence or place of
business. However, in any case where the acreage is abutted by a residence or place
of business on more than one side of the acreage, the owner of the acreage shall be
responsible for maintaining the surface of every portion of the acreage as required by
this article, regardless of the size of the acreage.
(3) Any lot or parcel of real estate situated within the city which has the surface thereof
filled or partly filled with holes, or is in such condition that the lot or parcel holds or
is liable to hold stagnant water therein, or, from any other cause, is in such condition
as to be liable to cause disease, or produce, harbor or spread disease germs of any
nature or tend to render the surrounding atmosphere unhealthy, unwholesome or
obnoxious. "

Section 4: That Chapter 34, "Environment," Article IV. "Unsanitary, Unsightly Conditions
on Private Premises," Section 34-132 "Abatement by City - Generally," of the Code of
Ordinances, La Porte, Texas, is hereby amended to read as follows:
"Sec. 34-132. Abatement by City - Generally.
(a) In the event of the failure, refusal or neglect of the owner of any premises or property
to comply with a' notice given him pursuant to this article, it shall be the duty of the
director of planning or his duly designated agents to cause the weeds, brush, rubbish
or other insanitary matter or condition constituting a nuisance to be promptly and
summarily abated, in a reasonable and prudent manner at the expense of the city. The
director of planning or his duly designated agents shall carefully determine the cost of
such work done and shall charge such costs against the owner of such premises. Cost
shall be based upon the charges in amounts established by the city and listed in
Appendix A of this code.
(b) The city shall have the right to award any quantity of work authorized under this
section to a general contractor whose bid shall be accepted by the city council as the
lowest and best secured bid for doing the work mentioned in this section during a
stipulated time not to exceed one year."
Section 5: That Appendix A, "Fees," Chapter 34 "Environment," Article IV. "Unsanitary,
Unsightly Conditions on Private Premises," of the Code of Ordinances, La Porte, Texas, is
hereby amended to read as follows:
"(a) Abatement Charges

inconsistency and in all other respects this ordinance shall be cumulative of other ordinances
regulating and governing the subject matter covered by this ordinance.

Section 7: Should any section or part of this ordinance be held unconstitutional, illegal, or
invalid, or the application to any person or circumstance for any reasons thereof ineffective or
inapplicable, such unconstitutionalIty, illegality, invalidity, or ineffectiveness of such section or
part shall in no way affect, impair or invalidate the remaining portions thereof; but as to such
remaining portion or portions, the same shall be and remain in full force and effect and to this
end the provisions of this ordinance are declared to be severable.
Section 7. Any person, as defined in Section 1.07 (27), Texas Penal Code, who shall violate any
provision of this ordinance as codified in the Code of Ordinances herein, shall be deemed guilty
of a misdemeanor and upon conviction shall be punished by a fine not to exceed TWO
THOUSAND DOLLARS ($2000.00).
Section 8. The City Council officially finds, determines, recites and declares that a sufficient
written notice of the date, hour, place and subject of this meeting of the City Council is posted at
a place convenient to the public at the City Hall of the city for the time required by law
preceding this meeting, as required by Chapter 551, Tx. Gov't Code; and that this meeting has
been open to the public as required by law at all times during which this ordinance and the
subject matter thereof has been discussed, considered and formally acted upon. The City Council
further ratifies, approves and confirms such written notice and the contents and posting thereof
