1. Call to order
The meeting was called to order by Mayor Beasley at 6:00 p.m.
Members of City Council Present: Mayor Barry Beasley, Mayor Pro-Tem Georgia Malone,

Chris Thomason of Audio Visual Technologies Group, Inc. provided Council with an
overview of the audio visual equipment recently installed in the Council Chambers.

Councilmember Mosteit had a question on item B.
Motion was made by Councilmember Engelken to approve the consent agenda with one
change to item B, by adding the sentence "Whereby in the event of inclement weather, the
contractor will remove all construction debris prior to rain to prevent flooding". A second
was made by Councilmember Clausen. Motion carried.

6. Petitions, Remonstrance's, Communications, Citizens and Tax Payers wishing to address

Michelle Cantu, 3327 E. Plantation - asked for an ordinance requiring fencing around
Mobile Homes Parks within the City.
Phillip Hoot, 927 Seabreeze - shared concerns with items 9 and 18 on agenda.
7. Council to consider approval or other action regarding an ordinance appointing members
of the Complete Count Committee (CCG) for the Census 2010 - (Ord. 3150) - T. Tietjens
Planning Director Tim Tietjens presented summary and recommendation and answered
Council's questions.
Councilmember Engelken suggested appointing Susan Robinson to the Complete Count
Committee.
Councilmember Mosteit suggested appointing Don Hill of Interfaith Council to the
Complete Count Committee.
Planning Director Tim Tietjens suggested Paula Swearingen of the Neighborhood Centers
and Marie Meehan of the Women's Shelter as potential appointees.

Mayor Pro Tem Malone read Ordinance 3150, AN ORDINANCE APPOINTING MEMBERS
OF THE COMPLETE COUNT COMMITTEE (CCC) FOR THE CENSUS 2010; FINDING
COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE
DATE HEREOF.
Motion was made by Councilmember Moser to approve Ordinance 3150 as presented by
Mr. Tietjens. A second was made by Councilmember Mosteit. The Motion carried.

8. Council to consider approval or other action authorizing the City Manager to execute a
second amendment to the City's agreement with Harris County for the Northside
Neighborhood Single-Family New Construction Project - (Ord. 3151) - T. Tietjens
Planning Director Tim Tietjens presented summary and recommendation and answered
Council's questions.
Mayor Pro Tem Malone read Ordinance 3151, AN ORDINANCE APPROVING AND
AUTHORIZING A SECOND AMENDMENT TO AN AGREEMENT BETWEEN THE CITY
OF LA PORTE AND HARRIS COUNTY, FOR THE NORTHSIDE NEIGHBORHOOD
SINGLE- FAMILY NEW CONSTRUCTION PROJECT, TO ALLOW FOR ADDITIONAL
MARKETING PROCEDURES AND INCREASE IN HOME GRANT FUNDS, FOR SUCH
PURPOSE, MAKING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE
SUBJECT, FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND
PROVIDING AND EFFECTIVE DATE HEREOF.
Motion was made by Councilmember Moser to approve Ordinance 3151 as presented by
Mr. Tietjens. A second was made by Councilmember Malone. The Motion carried.

9. Council to consider approval or other action authorizing payment of $72,621.00 for the
unpaid balance on underground storage tank removal at the Five Points site - D. Westbeld
City Manager Ron Bottoms presented overview and recommendation and answered
Council's questions.
Motion was made by Councilmember Engelken to approve the payment of $72,621.00 as
presented by Mr. Bottoms. A second was made by Councilmember Clausen. The Motion
carried.

10. Received monthly Drainage report form City Staff - S. Gillett
Public Works Director Steve Gillett provided a monthly Drainage Report.
11. Close Regular Meeting and open Workshop Meeting
Mayor Beasley Closed Regular Meeting at 6:43 p.m. and Opened workshop Meeting at
6:44 p.m.
Director of Planning Tim Tietjens discussed current livestock regulations.
Citizens Comments:
Nolen Allen, 1037 North "L" had a question on what is considered land as described in the
livestock ordinance, asked if buildings were included. He provided Council with a "draft"
ordinance that a few of the Lomax citizens are proposing: 1.) redefining "domestic
livestock", naming them "recreational livestock" for a better term 2.) that the ordinance only
effect large lot districts 3.) referencing animals being a health hazard, one or 20 animals
could be health hazard, depending on the breed. He provided a petition and a copy of the
"drafted" ordinance.
Council directed staff to move forward with an updated ordinance. Councilmember Mosteit
asked that issuing citations be placed on hold until the ordinance is amended.
Planning Director Tim Tietjens said that this issue would need to go to Planning and
Zoning Committee and then back to Council for approval.
12. Mayor Beasley Closed Workshop Meeting and reconvened Regular Meeting at 7:03 p.m.
13. Receive Report from the Drainage and Flooding Committee and La Porte Development
Corporation Board - Councilmember's Mosteit and Engelken
Committee member Mosteit provided a report from the Drainage and Flooding Committee,
reported that the next Drainage and Flooding Committee meeting will be on June 24th,
2009.
Councilmember Engelken suggested that the City schedule a meeting with Judge Emmett
and Commissioner from Harris County to take drainage concerns to the next level.
Board member Clausen provided a report from the La Porte Development Corporation
Board.

14. City Manager Ron Bottoms provided Administrative Reports for the following:
City Manager Ron Bottoms reported on the new carpet that is being laid in the Council
Chambers and that the benches/ pews are in process of being re-upholstered.

Motion was made by Councilmember Mosteit to table this item approving the agreement
with Clark Condon and Associates for a Community Center in the amount of $40,000 and
approving the budget amendment in the amount of $40,000.00 for said purpose as
presented by Mr. Bottoms. A second was made by Councilmember Clausen. The Motion
carried.

SUMMARY & RECOMMENDATION
During the days following Hurricane Ike there were several generators available to power the
City's Waste Water Treatment Plant (WWTP). The WWTP does not have the electrical
switchgear to connect a generator in a timely and safe manner. State legislation in all likelihood
will require the City to install automatic electrical switchgear and possibly a generator at the
WWTP. The City directed the Engineer, PBS&J, to design switchgear to allow the Contractor
(CSA Construction) to submit a quote for a change order.
The Contractor has submitted a quote to the Engineer for an automatic transfer switch gear for
$210,679. The automatic feature would allow for automatic start of a generator if a pennanent
generator installation is done in the future.
In addition there are currently three (3) metered services at the WWTP. Reconfiguring the
service into the plant with the electric switchgear installation will eliminate one of the meter
services and eliminate the monthly charge of $1 05 for one service. There will be a one time
charge of approximately $4,000 from Center Point to reconfigure the electric service drops to the
WWTP.
Funds are available from cost savings during the WWTP expansion and Utility Line Relocation
Project for the Fainnont Parkway widening project.

· We have priced based on the switch being Iqcated in a different position than what is
shown on the drawing, due to existing conduit & equipment conflicts.
· We have included cost to demo both of the existing services orice power is switched
over to the new service.
· We have excluded any saw cutting J breaking out of concreteobstroctions.

· This proposal is based on a working schedule of 40 hours per week.

a firm price for acceptance within 30 calendar days.

Little Cedar Bayou WWTP, PBS&J designed and prepared electrical drawings for
Electrical Transfer Switch for Power Generators to be installed at the existing facility."
PBS&J recommends installation of the Transfer Switch at the existing facility for the
amount of$21O,679.00 by CSA Construction Company. Attached please find Neill
Associates, Inc. the Electrical Engineer's recommendation and Contract Change Order #3
for your review and approval.

TIle following are my recommendations on the above project subject project.
1. This setup will allow the plant to combine the existing (2) two service into (1) one service. When a
power outage occurs the service can be transferred and powercd (generator) from one (1) location
with the proper load shedding from Plant personnel.
2. Wc have (2) two switchboard schemcs. A 3 section setup and a 4 section set up. \'(Te recommend the 3
section line up. The 3 section will meet The NEC Code and will give adequate isolation to down
stream and the Utility loads.

The City went into an Agreement with Bay Area Houston Convention and Visitors Bureau (BAHCVB) in March
2006. Per Section IV their bylaws, City Council is to appoint three members to represent the City of La Porte. One
of the three shall be a hospitality industry professional. Each subsequent Director shall serve a three (3) year terms,
which will expire February 11,2011 or until their successors shall have been duly appointed and qualified.
As a result in the vacancy of City Representative 1, we request that Stacey Osborne be officially appointed as a
Director to the BAHCVB Board of Directors.

that a sufficient written notice of the date, hour, place and subject of this meeting of the
City Council was posted at a place convenient to the public at the City Hall of the City
for the time required by law preceding this meeting, as required by the Open Meetings
Law, Chapter 551, Texas Government Code; and that this meeting has been open to the
public as required by law at all times during which this ordinance and the subject matter
thereof has been discussed, considered and formally acted upon. The City Council further

During the recent council budget retreat, the council directed staff to pursue all of our options
regarding a community center. To this end, we have met with, and received a proposal from (see
attached), representatives with Clark Condon and Associates, who developed the County's
Sylvan Beach Park plan. The proposal calls for development options to include cost estimates. I
recommend utilizing the Hotel/Motel fund for the cost of these services.

Re: Sylvan Beach Community Center Conceptual Design
Dear Mr. Bottoms:
We are pleased to make this proposal for landscape architectural design associated
with the Sylvan Beach Park, particularly, a design for a new community center. For
the purposes of this proposal, you will be referred to as the Client and Clark Condon
Associates, Inc. as the Landscape Architect.
SCOPE OF WORK - Our firm along with an architecture sub-consultant will prepare
site planning options that will accommodate a new community center. The plans will
keep in mind the previous Master Plan prepared for Harris County Precinct Two. It is
our intent to maintain the overall concepts and ideas generated in the Master Plan, but
not to be limited by the specific site plan. In addition to the site planning exercise, we
will explore several optional locations for a new community center along with site plans
that relate to the various locations. The steps to accomplish this work are outlined
below:
PART I
1. Review any previously prepared studies for the site, in addition to proposed
plans for downtown revitalization project, improvements to San Jacinto Street
and how those projects may relate to Sylvan Beach.
2. Prepare a site analysis of the site (including recently purchased lands) that will
outline opportunities and constraints of the site and the immediate surrounding
areas. The plan will also illustrate proposed beach enhancement project.
3. At this point the consultant team will prepare a series of plans that illustrate
options for a community center location and general footprint. The plans will be
schematic in nature and will indicate general improvements, such as drives,
parking, and aspects from park master plan as appropriate. We expect 5 or 6
options at this level of development.
4. Following review of initial site plans with the client, the consultant team will
refine the ideas and develop 2 to 3 options with more detail and suitable for

presentations to stakeholders (stakeholder meetings estimated at 4 for the
purposes of this proposal). Included in this will be review meetings with
Commissioner Garcia and Precinct Two staff.
5. The goal for this part of the scope is to define the general square footage of a
community center, the program and the location of the community center and
related site amenities. The graphics will be in plan format for this Part I of the
scope.
PART II
1. Following completion of Part I and finalization of 1 to 2 options, the team will
develop preliminary floor plans and elevations for a community center and
other key site amenities as appropriate to explain the overall intent of the
design. Graphics for this aspect of the scope will be in rendered plans,
sketches and elevations drawings.
2. The consultant team will prepare cost estimates for a community center and
related amenities.
3. Professional 3 0 renderings will be offered as an optional service under the fee
section.
SCHEDULE - Part I and Part II will be completed within 6 weeks of Notice to Proceed.
FEE - The total fee for this project will be billed hourly to a maximum based upon the
estimated time for professional services, plus reimbursable expenses.

REIMBURSABLE EXPENSES - The Client shall pay the Landscape Architect for the
cost of out of town travel expenses, mileage, printing, and other directly related costs.

TERMINATION - If the Client should decide to terminate this Agreement, he shall give
Clark Condon Associates seven (7) days written notice and shall pay for all services
rendered to the date of termination. Clark Condon Associates, Inc. reserves the right
to terminate this contract upon fifteen (15) days notice if any amount billed to client is
sixty days past due.

Highlight Memo on Inspection Division Activities
On a daily basis, Inspection Division personnel perform duties that involve enforcement of
multiple city codes and ordinances. Whenever possible, staff offers alternatives; however, in
some cases their proposal is not allowed and staff must advise them accordingly.
The Mayor has asked that we provide Council with examples where staff has spent extra time
helping our customers resolve an issue. Please see the following.
Staff continues to work with citizens dealing with the aftermath of Hurricane lke. As of
OS/29/09, we have (35) substantially damaged (SD) homes and (479) non-substantially
damaged (NSD) homes. We have worked diligently to assist residents and have received very
positive comments from those individuals.

ordinance shall, for any reasons, be held invalid, such invalidity
shall not affect the remaining portions of this ordinance, and it
is hereby declared to be the intention of this City Council to
have passed each section, sentence, phrase or clause, or part
thereof, irrespective of the fact that any other section,
sentence, phrase or clause, or part thereof, may be declared
invalid.
Section 18. All ordinances or parts of ordinances in
conflict herewith are repealed to the extent of such conflict
only.
Section 19. The City Council officially finds, determines,
recites, and declares that a sufficient written notice of the
date, hour, place and subject of this meeting of the City Council
was posted at a place convenient to the public at the City Hall of
the City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Chapter 551, Texas Government
Code; and that this meeting has been open to the public as
required by law at all times during which this ordinance and the
subject matter thereof has been discussed, considered and formally
acted upon. The City Council further ratifies, approves and
confirms such written notice and the contents and posting thereof.

PROCEDURE FOR
RECRUITMENT, APPOINTMENT AND NOTIFICATION PROCESS
THE CITY COUNCIL OF THE CITY OF LA PORTE WILL MAKE
APPOINTMENTS FOR TERMS EXPIRING ON AUGUST 30m OF THE YEAR
INDICATED.
SCHEDULEIPROCEDURES:
APRIL
· Boards and Commissions Handbook and application form is updated and printed
by the City Secretary.
· A memorandum is sent by the City Secretary to each department inquiring as to
whether or not there have been any attendance problems with members of a
committee, board or commission member.
MAY/JUNE - (The annual appointment process will not begin until all Council
members have been elected in the General and Run-Off Elections)
· Mayor and City Secretary will meet with any newly elected Council Members and
explain the boards and commissions process.
· The City Secretary will provide City Council with list of all current and members .
whose terms of appointment are expiring on August 30. The list will indicate
vacancies, applicants eligible for reappointment, single member district
appointments, and appointments made by the entire body of City Council.
· Current appointees whose terms of appointment expire in August are identified.
· The City Secretary will inform City Council of attendance problems of any
committee, board or commission member.
· The City Secretary will forward City Council members a copy of any applications
received by citizens since the last appointment process. The type of board,
committee or commission the citizen is requesting to serve on is noted on the
application.
· Enabling ordinances will also be forwarded to City Council as needed.

. Information is shared with staff members serving as liaisons to a committee,
board or commission member.
. Mayor and Council will provide the City Secretary with direction on whether
application forms and a handbook need to be mailed to any citizens or
organizations. Applications will only need to be mailed if recruitment is needed
to fill positions. Applications must be returned- to the City Secretary by the last
day of July 5 in order for copies to be placed in the agenda packet for the July
Workshop Meeting to be held the last meeting in July. The citizen submitting the
application retains the handbook for future use.
. City Council Members will contact any individuals they want to serve another
term, or direct the City Secretary to handle. Confirmation will be made as to
whether or not the citizen is willing to serve another term. If no application is on
file, the citizen must be provided with a handbook and application. The
application must be returned to the City Secretary's Office by July 5 in order to be
placed in the agenda packet for the July Workshop Meeting.
. City Council Members wishing to replace a board member will contact the
prospective new member to inquire if they would like to serve, or direct the City
Secretary to handle. If the citizen agrees to serve, the City Secretary will send
them a handbook and application form. The citizen must return the application
form if one is not already on file. In addition, the City Council member will
contact the current member to inform them they are considering a replacement for
their position and thank them for the time they served, or direct the City Secretary
to handle. By July 5, City Council will confirm with the City Secretary, which
members they are considering for reappointed for another term, and the name of
any new members and the position in which they are being considered for.
· Each June the City Secretary will remind the Mayor of the July Workshop
Meeting and confirm the date.
JULY
· City Council holds a workshop meeting in open session to discuss upcoming
appointments.
AUGUST
· Mayor will introduce an Ordinance and facilitate the appointment process at the
meeting. The City Secretary provides assistance as needed. An Ordinance will
be presented to City Council seeking approval to appoint or reappoint members
for a term expiring on August 30 of the year indicated.

. Once the Ordinance is adopted, the <:;ity Secretary shall send thank you letters to
citizens completing service on boards. Acknowledgement letters are sent to those
citizens not selected requesting them to apply again next year.
. Letters of appointment and reappointment will be sent to appointees with
appropriate ordinance.
. A new directory of City Council appointed boards, committees and commissions
is prepared and published as soon as possible after the appointment process is
completed.
· City Secretary contacts new members to offer information regarding conduct of
meetings, parliamentary procedures, and to answer any questions the new member
may have.
· Applications are considered current for one year. Vacancies will be considered
throughout the year if needed due to terminations or resignations

LA PORTE AREA WATER AUTHORITY
Purpose:
The La Porte Area Water Authority was created in 1981 by the State Legislature. The
legislation granted the Authority rights and powers related to acquisition of water supplies
and the collection/treatment of wastes. The early mission of the Authority was to secure
surface water to entities contracting with the Authority. The Authority may purchase,
construct, lease or otherwise acquire property and facilities relating to their mission. They
may contract with persons, corporations, municipal corporation and political subdivisions of
the State with the approval of the City Council.

Per Artides of I ncorporaion a1d the Bylavvs of the La Porte Redevelopment Authority, CIl
CWOintment of a DirErlor to the Reinvestment Zone#1, City of La Porte, Tex:as
constitutes CIl ~intment to 93Ve as a Director of the La Porte Redevelopmalt
Authority.
DirErlors of the Authority shall be cwointed by the Mayor of the City with the consent
a1d ~roval of the City Council CIld shall be the s:me perS)ns ~inted to the
corresponding position of the Boa-d of the La Porte Reinvestment Zone.
Ecdl taxing unit ~pointment as a Director to the La Porte Reinvestment Zone shall a1S)
constitute a nomination of such perS)n to the Redevelopment Authority.
The term of EBf1 Redevelopment Authority position shall be coterminous with the
corresponding position on the Boa-d of the La Porte Reinvestment Zone.
The Mayor of the City shall always cwoint the Chairrrm of the Redevelopment Boa-d for
the term designcted by the City.

BOARDS, COMMITTEES AND COMMISSIONS SCHEDULE AND
PROCEDURE FOR
RE.CRillTMENT, APPOINTMENT AND NOTIFICATION PROCESS
THE CITY COUNCIL OF THE CITY OF LA PORTE WILL MAKE
APPOINTMENTS FOR TERMS EXPIRING ON AUGUST 30TH OF THE YEAR
INDICATED.
SCHEDULEIPROCEDURES:
APRIL
· Boards and Commissions Handbook and application form is updated and printed
by the City Secretary.
· A memorandum is sent by the City Secretary to each dep~ent inquiring as to
whether or not there have been any attendance problems with members of a
committee, board or commission member.
MAY/JUNE - (The annual appointment process will not begin until all Council
members have been elected in the General and Run-Off Elections)
· Mayor and City Secretary will meet with any newly elected Council Members and
explain the boards and commissions process.
· The City Secretary will provide City Council with list of all current and members
whose terms of appointment are expiring on August 3 O. The list will indicate
vacancies, applicants eligible for reappointment, single member district
appointments. and appointments made by the entire body of City Council.
· Current appointees whose terms of appointment expire in August are identified.
· The City Secretary will inform City Council of attendance problems of any
committee, board or commission member.
· The City Secretary will forward City Council members a copy of any applications
received by citizens since the last appointment process. The type of board,
committee or commission the citizen is requesting to serve on is noted on the
application.
· Enabling ordinances will also be forwarded to City Council as needed.

· Information is shared with staff members serving as liaisons to a committee,
board or commission member.
· Mayor and Council will provide the City Secretary with direction on whether
application forms and a handbook need to be mailed to any citizens or
organizations. Applications will only need to be mailed if recruitment is needed
to fill positions. Applications must be returned-to the City Secretary by the last
day of July 5 in order for copies to be placed in the agenda packet for the July
Workshop Meeting to be held the last meeting in July. The citizen submitting the
application retains the handbook for future use.
· City Council Members will contact any individuals they want to serve another
term, or direct the City Secretary to handle. CQnfinn~tion will be made as to
whether or not the citizen.is willing to serve another term. If no application is on
file, the citizen must be provided with a handbook and application. The
application must be returned to the City Secretary's Offic~ by July 5 in order to be
placed in the agenda packet for the July Workshop Meetirig.
· City Council Members wishing to replace a board member will contact the
prospective new member to inquire if they would like to serve, or direct the City
Secretary to handle. If the citizen agrees to serve, the City Secretary will send
them a handbook and application form. The citizen must return the application
fonn if one is not already on file. In addition, the City Council member will
contact the current member to inform them they are considering a replacement for
their position_ and thank them for the time they served, or direct the City Secretary
to handle. By July 5, City Council will confirm with the City Secretary, which
members they are considering for reappointed for another term, and the name of
any new members and the position in which they are being considered for.
· Each June the City Secretary will remind the Mayor of the July Workshop
Meeting and confrnn the date.
JULY
· City Council holds a workshop meeting in open session to discuss upcoming
appointments.
AUGUST
· Mayor will introduce an Ordinance and facilitate the appointment process at the
meeting. The City Secretary provides assistance as needed. An Ordinance will
be presented to City Council seeking approval to appoint or reappoint members
for a term expiring on August 30 of the year indicated.

· Once the Ordinance is adopted, the (:ity Secretary shall send thank you letters to
citizens completing service on boards. Acknowledgement letters are sent to those
citizens not selected requesting them to apply again next year.
· Letters of appointment and reappointment will be sent to appointees with
appropriate ordinance.
· A new directory of City Council appointed boards, committees and commissions
is prepared and published as soon as possible after the appointment process is
completed.
· City Secretary contacts new members to offer information regardingcpnduct of
meetings, parliamentary procedures, and to answer any questions the new member
may have.
· Applications are considered current for one year. Vacancies will be considered
through?ut the year if needed due to ~enninations or resignations
