Councilmember Mike Mosteit led the Pledge of Allegiance. 4. Presentations/ Proclamations Minutes of Regular Meeting and Workshop of the La Porte City Council held on July 27, 2009 Page 2 Mayor Beasley presented a proclamation for "St. John's Episcopal Church Day" (Mission on the Bay) to Father Mike Besson. Numerous members of the church were also in present to receive proclamation. Mayor Beasley and Councilmember Mosteit presented a proclamation for "George Watkins Day" to George Watkins. Commissioner Sylvia Garcia was to present a resolution to former Mayor Alton Porter for his contributions and leadership with the City of La Porte. Due to conflicts, this will be handled at a future Council Meeting. 5. Consent Agenda - Any item may be removed by a Council person for discussion A. Council to consider approval or other action regarding an ordinance vacating, abandoning, and closing that portion ot the Street "E" Right-ot-Way situated between Lot 1, Block 5 and Lot 2, Block 4 ot the Pine Bluff Subdivision (Ord. 3153) - T. Tietjens - This item was tabled from July 13, 2009 City Council Meeting. Planning Director Tim Tietjens presented summary and recommendation and answered Councils questions. Mayor Pro Tem Georgia Malone read Ordinance 3153, AN ORDINANCE VACATING, ABANDONING AND CLOSING A PORTION OF THE STREET "E" RIGHT-OF-WAY, PINE BLUFF SUBDIVISION, LA PORTE, HARRIS COUNTY, TEXAS, AUTHORIZING THE EXECUTION AND DELIVERY OF A DEED TO THE ADJOINING LANDOWNER, FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Motion was made by Councilmember Rigby to approve Ordinance 3153 as presented by Mr. Tietjens. A second was made by Councilmember Moser. Motion carried. Council to consider approval or other action regarding an ordinance and adding members to the Census Count Committee or other boards and commissions as desired (Ord. 3160)- Mayor Beasley. Mayor Beasley presented summary and recommendations and answered Councils' questions. Councilmember Moser suggested that Jesse Garcia be placed on the Complete Count Committee. Georgia Malone suggested Pauline Lewis be added to the Complete Count Minutes of Regular Meeting and Workshop of the La Porte City Council held on July 27,2009 Page 4 Committee. Mayor Beasley suggested that Henry Newsom be added to the Complete Count Committee. Planning Director Tim Tietjens suggested the following as ex-officio members of the Complete Count Committee: David Stall (Shoreacres), Ken Bays (Morgan's Point). Councilmember John Black suggested Rebecca Jones Jurtshuk to position 5 of the Main Street Advisory Board replacing Jerry Carpenter. Mayor Pro Tem Georgia Malone read ordinance 3160, AN ORDINANCE APPOINTING MEMBERS TO VARIOUS BOARDS, COMMISSIONS, AND COMMITTEES, OF THE CITY OF LA PORTE; PROVIDING A SEVERABILITY CLAUSE; CONTAINING A REPEALING CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Motion was made by Councilmember Moser to approve Ordinance 3160 as presented by Mr. Beasley adding the positions as noted above. A second was made by Councilmember Black. Motion carried. Main Street Advisory Board - Rebecca Jones Jurtshuk was appointed to position 5 on the Main Street Advisory Board. Civil Service Commission - Keith Trainer was reappointed to the Civil Service Commission. 9. Council to consider approval or other action regarding an ordinance amending the Employee Policy's Handbook, to revise employee sick leave policy - (Ord. 3161) - H. Weger Human Resource Manager Heather Weger presented summary and recommendations and answered Councils' questions. Mayor Pro-Tem Georgia Malone read Ordinance 3161, AN ORDINANCE AMENDING THE CITY OF LA PORTE EMPLOYEE POLICIES HANDBOOK BY REVISING EMPLOYEE SICK LEAVE POLICY; CONTAINING A REPEALING CLAUSE; CONTAINING A Minutes of Regular Meeting and Workshop of the La Porte City Council held on July 27,2009 Page 5 SEVERABILITY CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Council to consider approval or other action approving the recommended date of September 21, 2009 for Public Hearing on the City's FY 2009-2010 Proposed Budget - M. Dolby Director of Finance Michael Dolby presented summary and recommendations and answered Council's questions. Motion was made by Councilmember Engelken to approve the date of September 14, 2009 for the Public Hearing on the City's FY 2009-2010 Proposed Budget as presented by Mr. Dolby. Receive Staff report from Inspections Division - D. Wilmore Chief Building Official Debbie Wilmore presented staff report from the Inspections Division. 12. Mayor Beasley closed Regular meeting and opened Workshop meeting at 7:35 p.m. A. Discuss Hotel/Motel Issues - T. Tietjens Director of Planning Tim Tietjens led the discussion on hotel and motel sites. The following outlines the discussion: Consider limiting the space where hotels and motels could be built. Consider how close they should be built to residences and schools. Background checks should be done regarding the quality of the hotel chain. Height distance should be checked. Determine if hotels/motels should be clustered in one area of town. Consider the future needs of the city as it relates to the economy. Consider commercial code for this type of building. Joerns Assistant City Manager John Joerns led the discussion of contractors asking if the city had a project of allowing contractors to bid on city excavation projects Council directed staff to continue to move forward with this project. C. Rail Road Infrastructure -Will send a letter of support for Council to sign once we receive. 13. Mayor Beasley closed Workshop meeting and reconvened Regular Meeting at 7:27 p.m. 14. The purpose of this public hearing is to receive property owner, citizen and staff comments as to why the structure should or should not be condemned and demolished. Following the close of the hearing, Council will be asked to consider condemnation of each structure that does not have a signed Voluntary Consent to Demolish form. Of the nine structures before Council, staff has secured (5) voluntary consents which leaves (4) locations for Council consideration. On July 14th, a contractor obtained a repair permit for 704 S. Holmes Street and started repairs. Staff recommends tabling this structure for 60- days to ensure follow-thru and completion by the owners. On 401 N. 6th Street, a family member is currently working on transferring the ownership from her parents name to her name. Once the transfer is complete, she plans to apply to Harris County for a home repair loan. We suggest this structure be tabled for 6O-days to see if that individual is able to complete the two processes. The Board recommends passage of tbe condemnation ordinances on 201 Garfield Street and 207 East "A" Street and tabling of 704 S. Holmes & 401 N. 6th. Whenever any building or structure, because of obsolescence, dilapidated condition, deterioration, damage, inadequate exits, lack of sufficient fire-resistive construction, faulty electric wiring, gas connections, or heating apparatus or other cause, is determined by the Board to be a fire hazard; B. Dangerous or substandard electrical, plumbing, or mechanical installations. A building or structure shall be considered dangerous or substandard whenever it is determined by the Board, that any or all of the following is applicable: 1. Whenever any protective or safety device specified in The Electrical Code and of this title is not provided or is inoperative, defective, dilapidated, or deteriorated so as to threaten to function as originally intended; fail or bel 2. Whenever any installation or any portion thereof because of (a) dilapidation, deterioration, or decay; (b) faulty construction; (c) obsolescence; (d) inadequate maintenance, which in relation to existing use constitutes a hazard to life, health, property or safety; 3. Whenever any installation or any portion thereof which is damaged by fire, wind, earthquake, flood or any other cause so as to constitute a potential hazard to life, health, property or safety; bel 4. Whenever any installation or any portion thereof was constructed, installed, altered or maintained in violation of the building code and/or fire code so as to constitute a potential hazard to life, health, property or safety. FINDINGS AND CONCLUSIONS OF THE BOARD OF INSPECTION: SELECT OPTION #: 1. (REPAIRABLE-RESIDENTIAL) IN ACCORDANCE WITH THE CITY'S DANGEROUS BUILDING REGULATIONS. THE 2006 INTERNATIONAL RESIDENTIAL CODE AND THE 2008 NATIONAL ELECTRICAL CODE. AS ADOPTED. AMENDED AND ENACTED BY CITY ORDINANCES #04-2700. #96-2700-K AND #96-2079-L. USING THE REGULATIONS AND CODE AS ITS GUIDE. IT IS THE OPINION OF THE DANGEROUS BUILDING INSPECTION BOARD THAT THIS BUILDING IS IN FACT DANGEROUS. BUT STILL REPAIRABLE. Such report shall state the circumstances and the condition of the building(s) upon which such conclusion was based. The report shall be filed in all cases no matter what conclusion is stated by the Board; and WHEREAS, it has heretofore come to the attention of the Board that the building(s) located on Blk 91; Lots 17. 18. La Porte. which is further described as 401 N 6th Street. Harris County, Texas, has, for the reason of neglect or misuse, been allowed to deteriorate into a /' Ordinance No. 2009- 31 (p~ Page 2 condition of decay or partial ruin or has become a public nuisance or hazard, as defined in Section 82-473 of the Code of Ordinances of the City of La Porte; and WHEREAS, said Board has heretofore made and filed its written report, June 26, 2009 finding said building to be in fact a dangerous building; WHEREAS, City Council received such report, and ordered notice to the record owner(s) of said property, George Eugene Riley, whose address is 904 S Kansas S1.: La Porte, TX 77571- 5808 and Eugenia Mae Riley c/o George Eugene Riley, whose address is 904 S Kansas S1.: La Porte, TX 77571-5808, that a hearing as provided in Section 82-477 of said Ordinance would be held at 6:00 PM on August 10,2009 at 604 W. Fairmont Parkway, at the Council Chambers, City Hall, City of La Porte, Texas, at which time the Council would hear evidence for and against the conclusions of the Board; WHEREAS, the City Secretary has heretofore served notice of said hearing upon said owner(s), by registered mail, return receipt requested, which notices were "undelivered", Post Office attempted (2) deliveries by 7-22-09 (George E. Riley), a date more than ten (10) days before the date set for said hearing; WHEREAS, at said date, time, and place, City Council met in regular session to conduct such public hearing, at which time evidence was presented both for and against the conclusions of the Board; WHEREAS, City Council, after due deliberation, and within fifteen (15) days after the termination of the hearing, is required to make its decision in writing and enter its order; and WHEREAS, City Council entered its order on August 10, 2009 a day which is within fifteen (15) days after the termination of the hearing; NOW THEREFORE: Ordinance No. 2009- 3/ ~ Page 3 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. This Ordinance contains the Findings of Fact, Conclusions of Law, and orders of the City Council of the City of La Porte, based upon the evidence presented at said hearing. Section 2. Based on the evidence presented at said hearing, the City Council hereby adopts the attached report of the Board, in full, and incorporates such by reference herein as fully as though set out herein. Section 3. The City Council hereby finds, determines and declares such building(s) to be a nuisance, and orders such building( s) condemned. Section 4. The City Council hereby finds, determines and declares that George Eugene Riley, who resides at 904 S Kansas St.; La Porte. TX 77571-5808 and Eugenia Mae Riley c/o George Eugene Riley, who resides at 904 S Kansas St.; La Porte. TX 77571-5808 and are the record owner(s) of the property on which this building is situated, and that as such record owner(s), the said George Eugene Riley and Eugenia Mae Riley c/o George Eugene Riley have been duly and legally notified of those proceedings. Section 5. The City Council hereby orders the said George Eugene Riley and Eugenia Mae Riley c/o George Eugene Riley to entirely remove or tear down such building(s), and further orders the said George Eugene Riley and Eugenia Mae Riley c/o George Eugene Riley to commence such removal within ten (10) days from the effective date of this Ordinance, and to complete said removal or demolition within thirty (30) days from the effective date of this ordinance. Section 6. The City Council hereby orders the Board of the City of La Porte to cause a notice of the dangerous, unsanitary condition of the building(s) to be affixed in one or more conspicuous places on the exterior of the building(s), which notice or notices shall not be removed or defaced by any person, under penalty of law. Section 7. The City Council hereby orders the City Secretary to forward a certified copy of this Ordinance, to the record owner(s) of said property, the said George Eugene Riley and Eugenia Mae Riley c/o George Eugene Riley. by registered mail, return receipt requested. Section 8. Should the said George Eugene Riley and Eugenia Mae Riley c/o George Eugene Riley not comply with the orders contained in this Ordinance relating to the removal or -- Ordinance No. 2009- ~I (p :> Page 4 demolition of such building(s) within thirty (30) days after hereof, then the Board of the City of La Porte shall enter upon the said premises with such assistance as it may deem necessary, and cause the said building(s) to be removed or demolished without delay, and the expenses of such procedure shall be charged against the said George Eugene Riley and Eugenia Mae Rilev c/o George Eugene Rilev, record owner(s) of said property, and shall thereupon become a valid and enforceable personal obligation of said owner of such premises, and the said Board shall carefully compute the cost of such removal or demolition, which cost shall be hereafter assessed against the land occupied by such building(s), and made lien thereon. The City Council officially finds, determines, and recites and declares that a sufficient written notice of the date, hour, place and subject ofthis meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government Code; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. Whenever any portion or member or appurtenance thereof is likely to fail, or to become detached or dislodged, or to collapse and thereby injure persons or damage property; o 4. Whenever the building or structure, or any portion thereof, because of ( a) dilapidation, deterioration, or decay; (b) faulty construction; (c) the removal, movement or instability of any portion of the ground necessary for the purpose of supporting the building; (d) the deterioration, decay, or inadequacy of its foundation, or (e) any other cause, is likely to partially or completely collapse; I{] 5. Whenever the building or structure has been so damaged by fire, wind, earthquake, or flood, or has become so dilapidated or deteriorated as to become (a) a public nuisance, (b) a harbor for vagrants, or as to (c) enable persons to resort thereto for the purpose of committing unlawful acts; o 7. Whenever a building or structure, used or intended to be used for dwelling purposes, because of inadequate maintenance, dilapidation, decay, damage, faulty construction or arrangement, inadequate light, air, or sanitation facilities, or otherwise, is determined by the Board to be unsanitary, unfit for human habitation or in such a condition that is likely to cause sickness or disease; I;Z] 8. Whenever any building or structure, because of obsolescence, dilapidated condition, deterioration, damage, inadequate exits, lack of sufficient fire-resistive construction, faulty electric wiring, gas connections, or heating apparatus or other cause, is determined by the Board to be a fire hazard; B. Dangerous or substandard electrical, plumbing, or mechanical installations. A building or structure shall be considered dangerous or substandard whenever it is determined by the Board, that any or all of the following is applicable: iii 1. Whenever any protective or safety device specified in The Electrical Code and of this title is not provided or is inoperative, defective, dilapidated, or deteriorated so as to threaten to function as originally intended; fail or b2J 2. Whenever any installation or any portion thereof because of (a) dilapidation, deterioration, or decay; (b) faulty construction; (c) obsolescence; (d) inadequate maintenance, which in relation to existing use constitutes a hazard to life, health, property or safety; '~ iii 3. Whenever any installation or any portion thereof which is damaged by fire, wind, earthquake, flood or any other cause so as to constitute a potential hazard to life, health, property or safety; b2J 4. Fairmont Park West. Brookglen and Fairmont Park East. Design is 95% complete. Staffis currently reviewing plans and identifying needed easements for construction. Affected property owners have been notified by letter of the easement requests, and need for acquisition. Survey of required easements will begin after initial contact with residents. A town hall meeting of affected property owners was held on July 28,2009, to explain the need for easements and to answer questions about the acquisition process and what can be expected during construction. Only three (3) residents attended, representing two (2) easements. Staff plans to hold individual, on-site meetings with affected residents to accomplish the outreach effort. · Drainage Study of Brookglen and Fairmont Park East. The Consultant has presented a draft of the above referenced study to the Drainage and Flooding Committee on June 3, 2009, June 24, 2009 and July 29,2009 to present findings and recommend alternative solutions for consideration by the Committee and the City Council for future improvements. The Consultant reported that additional study had indicated that the recommended solution would possibly be a combination of two (2) alternatives. Also, the City Manager presented a draft CIP plan for the upcoming year to address drainage projects. Staff met with Precinct 2, Harris County Flood Control and Klotz personnel to discuss the possible reconnection of BIl2-00-00 with B109-00. Staff also requested that HCFCD to de-silt Channel A-104-1O-00 in the Bay Colony area and to install a pressure transducer at Spencer and B-1l2-00-00 north of Brookglen to more accurately portray the flood models. In-House Design and Construction ofproiects identified in the Drainage Master Plan. · Farrington at B 1 06-00-00. Design complete. Construction scheduled for August. · Valleybrook (Glen Meadows). Designed as a sheet flow path through property scheduled for Federal Buy-Out, the property owner has declined the buy-out, rendering the design moot. Staff is investigating alternative sheet flow alternatives. · Creekmont Park Outfall. Easement acquired from adjacent property owner and design completed. Construction began in late July and is 20% complete, with construction to be completed in mid to late August. In-House Design and Construction of City-initiated Proiects. · South La Porte Bay Outfalls. Drainage area mapped and potential outfalls identified along South Broadway south of Fairmont Parkway. Oakhurst Street selected as the initial project due to available ROW, central location and the shortest avenue to the Bay. Design is 90% complete. Expect to bid this Project in August. Additional potential outfalls have been identified. ROW investigations and possible easement acquisition will be undertaken in the next month, with design to follow. · South La Porte Drainage Maintenance Plan. The subdivisions along and east of South Broadway south of Fairmont Parkway will be surveyed and mapped, necessary improvements designed and constructed. This is an ongoing effort and will begin upon completion of South La Porte Bay Outfalls. In-House Drainage Maintenance Activities. · Bayside Terrace. Cleaning of ditches and resetting culverts is complete. Storm inlet box repairs and improvement is 80% complete. Final cleaning of culverts and underground system is scheduled to be completed in August. · Dwire and Bay Oaks. Cleaning of ditches and resetting culverts on east half of the area is complete. Cleaning of ditches and resetting culverts on eastern half of area is 85% complete. Expect to complete in mid-August. · Bay Colony. No additional work since last report. Expect to move to this area for extensive cleaning and culvert work after completion of Bays ide Terrace. · North and South Shady Lane. Staff met with Port of Houston (PHA) and Exxon Pipeline to discuss outfall and sheet flow from this area to the Bayport Ship Channel. PHA agreed to clean vegetation obstructing on outfall and the sheet flow into the Channel, as well as procedures to allow city crews future access to this area for maintenance. Staff will also re-inspect culverts and ditches to remove obstructions from silting and Hurricane Ike clean-up. This effort will follow completion of the Bay Colony area. · LobitlPHA Pre-check Facility. Staff met with PHA to discuss drainage obstructed by construction of sound wall on the south side of the Barbour's Cut Pre-check Facility. Preliminary agreement by PHA to reestablish drainage in existing drainage easement. Staff has also requested PHA to penetrate the sound wall with culverts (wall foundation is substantial). Future work is included in the upcoming CIP to redirect some storm water from this area to East Main, eventually outfalling into Bob's Gully in Morgan's Point. · Total Work completed in July.
