SUMMARY & RECOMMENDATION
Alillual contract renewal between Dr. Oscar Boultinghouse and the City of La Porte to serve as medical director for
EMS.
Contract renewal period is October L 2009 through September 30. 2010.
Contract renewal fee is same as last year with no increase.
EMS medical directors are a covered party under the TML Incidental Medical Malpractice Liability Coverage plan.
Dr. Boultinghouse has been the EMS medical director for the City of La Porte for several years. He has done an
outstanding job in that capacity. His response to EMS needs are timely and of high quality.
Recommend that council approve contract.

CONTRACT FOR MEDICAL DIRECTOR
DEPARTMENT OF EMERGENCY MEDICAL SERVICES
CITY OF LA PORTE, TEXAS
This Contract entered into this the 1st day of October, 2009, by and between the
City of La Porte, Texas, a municipal corporation (hereinafter called "City") acting by and
through it's duly authorized City Manager, and Dr. Oscar Boultinghouse, M.D.,
(hereinafter sometimes called "Dr. Boultinghouse"),
WITNESSETH:
WHEREAS, there is a recognized need to provide high quality emergency
medical services and related medical care in the City of La Porte, Texas; and
WHEREAS, the City desires to provide medical direction for its Department of
Emergency Medical Services through the use of a licensed physician; and
WHEREAS, the City desires to contract with Dr. Boultinghouse to serve as
Medical Director for the Department of Emergency Medical Services of the City and Dr.
Boultinghouse is willing to serve as Medical Director under the terms and conditions
stated herein;
NOW, THEREFORE, in consideration ofthe premises, the agreements herein
contained and other and valuable consideration, receipt of which is hereby
acknowledged, the parties hereby agree as follows:

I.
MEDICAL DIRECTOR: Dr. Boultinghouse hereby contracts with the City
as an independent contractor to serve as Medical Director of the Department of the
Emergency Medical Services of the City (the "Medical Director") for the term stated
below.
II.
RESPONSIBILITIES AND AUTHORITY OF MEDICAL DIRECTOR:
The responsibilities and authority of the Medical Director shall be as follows:
A. General
(1) Ultimate responsibility for all medical issues concerning the City
Department of Emergency Medical Services.
(2) The authority to make decisions affecting all medical aspects of the City
Department of Emergency Medical Services.
(3) Being responsible to but not governed by the EMS Chief of the City of La
Porte.
(4) Inspect, evaluate and make recommendations regarding medical equipment
purchased by the City Department of Emergency Medical Services.
B. Education
Responsibility for developing, implementing and participating in continuing
education and recertification programs for paramedics employed by the City.
C. Evaluation
(1) Responsibility for devising a system of ongoing review and education of
paramedic services rendered by the City Department of Emergency
Medical Services and providing rapid feedback to the paramedics.

D. Personnel
(1) Ultimate responsibility for evaluating the competency of all paramedics
employed by the City. The Medical Director shall have the authority to
revoke any paramedics from their authorization to utilize
protocols/standing orders.
(2) All paramedics employed by the City must be cleared by the Medical
Director before being permitted to provide emergency medical services to
the public.
E. Community Liaison
(1) Provide liaison with the medical community; respond to questions from
physicians about the City Department of Emergency Medical Services.
(2) Provide public information as necessary about the medical aspects of
emergency medical services provided by the City Department of
Emergency Medical Services; respond to medical questions from the
media and the public.
(3) Make appearances as reasonably necessary to educate those using the
emergency medical system about its function.
F. Protocols/Standing Orders
Develop and revise standing orders to be used by paramedics in the field,
monitor their use and make adjustments based on experience with these
standing orders.
G. The Medical Director shall devote such of their time as is reasonably needed
to fulfill the responsibilities and duties of the Medical Director of the City
Department of Emergency Medical Services under the terms of this Contract.
It is understood that the Medical Director will continue to engage in private
medical practice while not performing duties under this Contract.

III.
Term - The term of this Contract shall be for a period commencing as the date
hereof and ending on the 30th day of September, 2010 or if sooner, with
the first to occur of the following:
A. The death of Dr. Boultinghouse; or
B. Thirty (30) days following written notice by the City or by Dr. Boultinghouse;
provided, however, that prior to any written notice of termination under this
Section 3B by the City because of dissatisfaction with Dr. Boultinghouse's
performance as Medical Director under this Contract, the City shall convene a
meeting pursuant to written notice to the Medical Director setting forth the
basis for such dissatisfaction. At the meeting, which shall be held no sooner
than fifteen (15) days following such written notice, the parties shall attempt to
resolve any disagreements and conflicts.
IV.
Insurance - Throughout the term of this Contract, the City shall provide the
Medical Director with a policy on the minimum limits of three million dollars
($3,000,000.00) per occurrence and six million dollars ($6,000,000.00) annual aggregate
which covers the performance of their administrative duties as Medical Director. The
insurance policy shall provide that the City and the Medical Director shall be given thirty
(30) days written notice prior to any cancellation of this insurance.
v.
Compensation - In consideration for rendering the services of Medical Director
under the terms of this Contract, the City shall pay aggregate compensation at a
twelve month rate of Nine Thousand Dollars ($9,000.00).

VI.
Independent Contractor - This Contract shall not be construed as creating an
employer/employee relationship, a partnership, or a joint venture, since the intent is that
Dr. Boultinghouse shall be an independent contractor with the City. No party hereto shall
hold himself or itself out or act as an agent of any other party with respect to third parties
In any way.
VII.
Governing Law - This Contract shall be governed in accordance with the laws of
the State of Texas and shall be performable in Harris County, Texas.
IN WITNESS WHEREOF, Dr. Boultinghouse and the duly authorized
representative of the City of La Porte have executed this Contract as of the date and year
first above written.

OF IA PORTE AND DR. OSCAR BOULTINGHOUSE, M.D., TO SERVE AS MEDICAL
DIRECTOR OF THE DEPARTMENT OF EMERGENCY MEDICAL SERVICES OF THE
CITY OF IA PORTE, MAKING VARIOUS FINDINGS AND PROVISIONS REIATING
TO THE SUBJECT, FINDING COMPLIANCE WITH THE OPEN MEETINGS IAW, AND
PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1.
The City Council of the City of La Porte hereby
approves and authorizes the contract,
agreement,
or other
undertaking described in the title of this ordinance, a copy of
which is on file in the office of the City Secretary. The City
Manager is hereby authorized to execute such document and all
related documents on behalf of the City of La Porte. The City
Secretary is hereby authorized to attest to all such signatures and
to affix the seal of the City to all such documents.
Section 2.
The City Council of the City of La Porte
officially finds,
determines,
recites,
and declares that a
sufficient written notice of the date, hour, place, and subject of
this meeting of the City Council was posted at a place convenient
to the public at the City Hall of the City for the time required by
law preceding this meeting, as required by the Open Meetings Law,
Chapter 551, Texas Government Code; and that this meeting has been
open to the public as required by law at all times during which
this ordinance and the subject matter thereof has been discussed,
considered and formally acted upon. The City Council further
ratifies, approves and confirms such written notice and the
contents and posting thereof.

WHEREAS, injuries and deaths from traffic crashes bring loss and suffering to the
citizens of this community; and
WHEREAS, the cost of such injuries brings economic hardship to families; and
WHEREAS, the community's health care system and emergency response resources are
significantly impacted by injuries from traffic crashes; and
WHEREAS, research shows that using safety belts and child safety seats is still the
single most effective way to reduce injuries and save lives in traffic crashes; and
WHEREAS, research shows that when a driver is unbuckled, 70 percent of the time
children in that vehicle are also unbuckled; and
WHEREAS, in 2007 the National Highway Traffic Safety Administration estimated that
when safety belt use in Texas reaches 85 percent, each year 241 lives will be saved, 5,275
nonfatal injuries will be prevented and $392 million in economic savings to society will
result; and
WHEREAS, the "Click It or Ticket Texas" campaign includes intensified law
enforcement and public education designed to encourage and enhance the habitual use of
safety belts within the community.

repairs to Evelyn Kennedy Center. The funding will come from a transfer from the General Fund to move the
remaining monies from TML for Hurricane Ike Recovery. (The General Fund will not need to be amended for the

AN ORDINANCE APPROVING AN AMENDMENT TO THE BUDGET FOR THE CITY OF LA PORTE,
TEXAS, FOR THE PERIOD OF OCTOBER 1, 2008 THROUGH SEPTEMBER 30, 2009; FINDING THAT
ALL THINGS REQUISITE AND NECESSARY HAVE BEEN DONE IN PREPARATION AND
PRESENTMENT OF SAID BUDGET; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND
PROVIDING AN EFFECTIVE DATE HEREOF.
WHEREAS, the Charter of the City of La Porte, Texas, and the Statutes of the State of Texas, require that
an annual budget be prepared and presented to the City Council of the City of La Porte, Texas, prior to the
beginning of the fiscal year of said City, and that a public hearing be held prior to the adoption of said
Budget; and
WHEREAS, the Budget for the fiscal year October 1, 2008, through September 30, 2009, has heretofore
been presented to the City Council and due deliberation had thereon, was filed in the office of the City
Secretary on July 25, 2008, and a public hearing scheduled for August 25, 2008 was duly advertised and
held.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
SECTION 1: That the Budget for the City of La Porte, Texas, now before the said City Council for
consideration, a complete copy of which is on file with the City Secretary and a summary of which is
attached hereto by reference as Exhibit "A", is hereby amended as reflected on the amended budget
summary document, attached hereto by reference as Exhibit "B", as the Budget for the said City of La
Porte, Texas, for the period of October 1, 2008, through September 30, 2009.
SECTION 2: Be it FURTHER ORDAINED, that the said City Council finds that all things requisite and
necessary to the adoption of said Budget have been performed as required by charter or statute.
SECTION 3: The City Council officially finds, determines, recites and declares that a sufficient written

Hello Ron,
As you know, we are working diligently to try to complete the work at Evelyn Kennedy, but it
doesn't appear that we will make the 30 September deadline. The estimates below are the amount
we think we will need to complete the project. We have a surplus of over $100k in our 4011
account that will fall to the bottom line (as excess Ike funds). I would like permission to carry this
$37.5k over so that we can complete the repairs without encumbering FY09-10 funds in the
process. We have substantially completed the other Ike repairs with the exception of the carpet for
RFC (purchase requisition issued) and the sign out front (09-10 budgeted item).

SUMMARY & RECOMMENDATION
The City of La Porte is building a bicycle-pedestrian trail along Fairrnont Parkway as a component of
the 2001 Bicycle Pedestrian Trail System Master Plan, as approved by City Council. The trail alignment will
require easements from various properties along the route, including one from the City of Pasadena.
The Interlocal Agreement being considered will allow the trail to be placed on City of Pasadena
property and will facilitate the building of the trail in the near future. The plans for the trail have been reviewed
by Pasadena and they are comfortable with the alignment.
Staff recommends approval of the Interlocal Agreement between the City of La Porte and the City of
Pasadena to be able to move forward with the trail installation. There are two more easements that will be
required before we can move forward with the installation but we expect to receive those momentarily. Once the
easements are in place we will be able to move forward toward providing this important component in the City's
Trail Master Plan.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The City Council hereby approves and authorizes the contract, agreement, or
other undertaking described in the title of this ordinance, a copy of which is on file in the office
of the City Secretary. The City Manager is hereby authorized to execute such document and all
related documents on behalf of the City of La Porte. The City Secretary is hereby authorized to
attest to all such signatures and to affix the seal of the City to all such documents.
Section 2. The City Council officially finds, determines, recites, and declares that a
sufficient written notice of the date, hour, place, and subject of this meeting of the City Council
was posted at a place convenient to the public at the City Hall of the City for the time required by
law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas
Government Code; and that this meeting has been open to the public as required by law at all
times during which this ordinance and the subject matter thereof has been discussed, considered
and formally acted upon. The City Council further ratifies, approves, and confirms such written
notice and the contents and posting thereof.

INTERLOCAL AGREEMENT
THE STATE OF TEXAS ~
~
COUNTY OF HARRIS ~
An interlocal agreement between the City of La Porte, Texas and the City of Pasadena, Texas
WHEREAS, it is to the mutual benefit of the City of Pasadena and the City of La Porte for the
construction of a public walking and jogging, Hike and Bike Trail, approximately ten (10) feet in width,
along the North boundary line of the City of Pasadena 99.999 acre tract located on Fairmont Parkway as
shown in Exhibit "A" attached hereto, hereinafter called the "Trail;" and
WHEREAS, the City of La Porte will construct and maintain the Trail if the City of Pasadena will
permit the construction within a dedicated easement located on the property owned by the City of
Pasadena.
NOW, THEREFORE, in consideration of the mutual covenants, agreements and benefits to both
parties, it is agreed as follows:
I.
The City of La Porte will prepare, or cause to be prepared, detailed plans and specifications for
the Trail and submit the same to the City of Pasadena for approval.
II.
After the approval of the plans and specifications by the City of Pasadena, the City of La Porte
shall commence to construct the Trail in accordance with the plans and specifications approved by the
City of Pasadena and in accordance with this agreement and applicable law. The City of La Porte will
construct the Trail in a manner as not to interfere with the City of Pasadena's use of the property, over
and across which the Trail is located, for any purpose. The City of La Porte shall administer
construction, construction bidding and perform construction inspection, materials testing, and surveying
for the Trail. The City of Pasadena may, but is not required to, perform construction inspection and
examine all results of the material tests for the Trail. If any conflict arises between the plans and
specifications and the provisions of this agreement, the agreement is controlling and binding upon the
parties hereto.
EXHIBIT "1"
/II.
The City of Pasadena authorizes the City of laPorte to use the described easement located on
the North boundary line of the City of Pasadena's 99.999 acre tract located on Fairmont Parkway, as
more particularly described on Exhibit "A" attached hereto and incorporated herein for all purposes, for
the purpose of constructing and maintaining the Trail. The City of Pasadena's authorization of the City of
LaPorte's use of the property is conditioned on the fulfillment of the City of laPorte's obligation herein.
If any portion of the City of Pasadena's property, on which the Trail is to be constructed or maintained,
is subject to any permits, wetland mitigation requirements, pipeline adjustments, consent, approvals, or
other matters, in which the County or the Harris County Flood Control District may be involved, then this
Agreement is subject to those permits and other matters, and the City of LaPorte will obtain the consent
and approvals from said third parties prior to undertaking the construction of the Trail on approvals,
then this agreement is of no force and effect.
IV.
Subject to the terms of paragraph XI hereof, the term of this agreement shall commence on the
date of the execution of this agreement and end on twenty-five (25) years from the date of the
execution of this agreement by the last party to execute the same, provided however that such
agreement shall be automatically extended for successive periods of one year thereafter unless either
party sends written notice of their intent to cancel in accordance with this agreement.
V.
During the term of this agreement, the City of LaPorte will not take any action that interferes
with the use of the Trail by the general public for walking and jogging purposes.
VI.
Within ninety (90) days following the completion of the construction of the Trail, the City of
LaPorte will deliver record drawings of such construction to the City of Pasadena. To the extent that the
City of LaPorte funds are available, the City of LaPorte shall maintain, or cause to be maintained, the
Trail during the term of the Agreement. The City of laPorte's maintenance duties shall include, but not
be limited to, the repair of the pavement on the Trail caused by ordinary wear and tear, mowing, edging,
trimming and picking up of trash, paper and debris on the Trail and the ground located within ten feet of
either side of the Trail, at least once every two months or other frequency determined by the City of
Pasadena. The City of LaPorte shall install and maintain, or cause to be installed and maintained,
appropriate traffic control signs and devices, lighting apparatus and all other appurtenances along the
Trail that are deemed necessary or proper by the City of LaPorte for the safety of the users of the Trail.
The City of Pasadena shall have no duty whatsoever to maintain the Trail after construction.
VII.
The City of LaPorte shall not cause any waste upon the Trail and shall not cut or damage any
tree or trees on the City of Pasadena's lands over six inches in diameter, as measured twelve inches
above grolJnd level, without prior written consent of the City of Pasadena.
VIII.
For purposes of this Agreement, the City of laPorte's right to use and enjoyment of the Trail for
the purpose herein stated is expressly limited to the City of Pasadena's right, title and interest in and to
the City of Pasadena's lands, and the City of Pasadena makes no representation or warranty as to its
right, title or interest in and to said lands.
IX.
The City of Pasadena makes no representation that the City of Pasadena's property on which the
Trail is to be constructed, including, but not limited to, its grade and drainage, is suitable for the City of
LaPorte's intended purposes. The City of Pasadena makes no representation as to the presence or
absence of depressions on the property, or the stability or suitability of the soils for the City of LaPorte's
intended purpose.
x.
The City of Pasadena hereby expressly reserves to itself, its officers, employees, agents, and
contractors, the right to enter upon the Trail on the City of Pasadena's lands at any time for any purpose
necessary or convenient to access our land, to remove portions of the Trail and not permit the City of
LaPorte to rebuild the same, and to make such other use of said Trail as City of Pasadena deems
necessary or desirable in connection with any purpose, and the City of LaPorte shall have no claim for
damages of any character on account thereof against the City of Pasadena, or any officer, employee,
agent or contractor thereof. The City of Pasadena has no responsibility to replace or repair any portion
of the Trail that is damaged in the course of making improvements to our land.
The City of Pasadena will notify the City of LaPorte in writing thirty (30) days prior to the
commencement of any such work on its property on which the trail is located and the City of LaPorte
has the option, but not the obligation, to monitor and inspect the progress of such work from time to
time as it sees fit.
In the event the City of Pasadena's work may require removal of a portion of the trail, the City of
Pasadena shall notify the City of LaPorte in writing sixty (60) days in advance of the commencement of
such work. The City of LaPorte shall have thirty (30) days from the date of such notification to remove
any and all trail materials and/or related equipment and materials from that portion of the trail on
which the work is to be done.
The sole remedy of the City of LaPorte for failure of the City of Pasadena to give the notice
provided herein is termination of this Agreement.
likewise, if the Trail, or other structures appurtenant thereto, is damaged by the City of
Pasadena during road or drainage activities, the City of Pasadena reserves the right not to allow the City
of laPorte to rebuild the Trail or replace structures appurtenant thereof if to do so would impede the
City of Pasadena's use of the property, on which the Trail is located, for road or drainage purposes. In
this event, the City of Pasadena will permit the City of LaPorte, to the extent physically possible and
allowed by law, to relocate and rebuild the trail on other City of Pasadena property so as to connect
with the remainder of the trail in a continuous, non-interrupted fashion.
If any portion of the Trail, constructed or maintained by the City of LaPorte pursuant to this
Agreement, is damaged, other than through the sole fault of the City of Pasadena, the City of LaPorte, to
the extent permitted by law, will promptly repair said damage. The City of LaPorte shall notify the City of
Pasadena Director of Public Works and the Parks Director in writing of any such proposed repairs or
replacements to the Trail. The City of LaPorte shall not perform such repairs or replacements to the Trail
until they are approved in advance by the City of Pasadena Director of Public Works and the Parks
Director in writing.
XI.
During and after construction of the Trail, and during the term of this agreement, the City of
Pasadena may place one or more signs along the Trail indicating that the Trail is a joint project of the
City of Pasadena and the City of LaPorte, and that the Trail is available to the general public.
XII.
Subject Paragraph XI above, the City of LaPorte will have the exclusive control and supervision of
the Trail during the term of this agreement. The City of Pasadena has no obligation to inspect the Trail,
to determine whether the same is safe, nor to give notice to the users of the Trail that the Trail is
unsafe.
XIII.
The Trail is open to the use of the general public. No fee or charge shall be imposed for use
thereof.
XIV.
It is not the City of LaPorte's or the City of Pasadena's intent to designate any part of the
property on which the Trail may be constructed as a recreational area for the purposes of TEX. PARKS &
WILD. CODE ANN. ~ 26.001 (Vernon 2002) and all amendments thereto, or to dedicate any part of such
property as a park for the purposes of Chapter 317, TEX. LOC. GOV'T CODE ANN. (Vernon 1999 & Supp.
2002) and all amendments thereto.
xv.
Any notice required or permitted to be given to the City of Pasadena by the City of LaPorte
hereunder may be given by certified or registered United States Mail, postage prepaid return receipt
requested, addressed to City of La Porte, TX, Attention: Parks Director. Any notice required or
permitted to be given to the City by the County hereunder may be given by certified or registered
United States Mail, postage prepaid, return receipt requested, addressed to the City of Pasadena, P.O.
Box 672, Pasadena, TX 77501, Attention: Director of Parks and Recreation. Notices shall be considered
exercised and completed upon deposit of the notice in the United States mail as aforesaid.
XVI.
In performing its obligations to be performed under this Agreement, the City of LaPorte shall
comply with all applicable federal, state, municipal and local laws, rules, ordinances and regulations,
including, but not limited to, the Americans with Disabilities Act and the Texas Architectural Barriers Act.
XVII.
The City of LaPorte shall cause to be inserted in the construction contract a statement that the
contractor shall save and hold harmless the City of LaPorte and City of Pasadena and their employees,
officers and agents from all suits, actions, and claims of any character brought on account of any injuries
or damages sustained by any person or property in consequence of any neglect or alleged neglect in
safeguarding the work or through the use of unacceptable materials in the construction of the Trail, or
on account of any act or omission by the contractor.
XVIII.
To the extent that the Trail is located within the City of Pasadena's property, the City of LaPorte
will require that the construction contractor's insurance policies name the City of Pasadena, as well as
the City of LaPorte, as an additional insured. Such insurance policies shall include not less than the
following minimum coverage:
1. Workers Compensation in the amount required by law
2. Comprehensive General Liability Insurance for bodily injury and property damage, including
inverse condemnation, with a combined single limit of not less than $1,000,000 per occurrence.
3. Comprehensive Automobile Liability Insurance, including owned and non-owned vehicles used
for the construction of the Trail, with bodily injury and property damage with a combined single
limit of not less than $1,000,000 combined single limit per occurrence.
City of LaPorte may require insurance in excess of the amounts or coverages set out above as it deems
necessary.
XIX.
IN ADDITION, IN THE EVENT THE CITY OF LAPORTE'S USE OF THE CITY OF PASADENA'S REAL PROPERTY
CAUSES THE CITY OF PASADENA'S TITLE TO ANY PORTION OF SUCH PROPERTY TO REVERT TO THE
GRANTOR, OR GRANTOR'S HEIRS, SUCCESSORS OR ASSIGNS, THE CITY WILL REACQUIRE, IN THE NAME
OF THE CITY, SUBJECT TO THE RIGHT OF THE CITY TO USE SUCH PROPERTY FOR A HIKE AND BIKE TRAIL
AND APPURTENANCES THERETO, THE SAME PROPERTY INTEREST THE CITY OF PASADENA HAD OWNED
PRIOR TO THE REVERSION OF THE TITLE.
XX.
This instrument contains the entire agreement between the parties relating to the rights herein
granted and the obligations herein assumed. Any modifications concerning this instrument shall be of no
force and effect excepting a subsequent modification in writing, signed by all parties hereto.
IN TESTIMONY OF WHICH, this agreement has been executed in duplicate counterparts, each to
have the force and effect of an original as follows:
(a) It has been executed on behalf of the City of Pasadena on the _ day of
2009, by its Mayor, and attested by its City Secretary, pursuant to an ordinance of the City Council of the
City of Pasadena authorizing such execution; and
(b) It has been executed on behalf of the City on the _ day of ,2009. by its
Mayor, and attested by its City Secretary, pursuant to an ordinance of the City Council of the City of La
Porte authorizing such execution.

regarding Special Conditional Use Permit Request #SCU09-003. The request, submitted by Mr. Hans van Esch, seeks approval of
a Special Conditional Use Permit (SCUP) to allow consulting inspection services in an accessory structure (6,000 sq.ft.) detached
to a single-family house on 5.89 acres ofland located at 803 McCabe Road. The property is zoned Planned Unit Development.
Several years ago, a SCUP was issued to build a house and an oversized garage at this location. The Zoning Board of
Adjustment granted a variance for an accessory structure in excess of2,000 sq.ft. permitted for large lots. The accessory
structure is located at least 30' behind the primary structure, as required by the Code of Ordinances. A tree line has been
preserved for at least 100' from the east & west sides and over 150' from the rear property line, abutting Shady River Subdivision
to the south as stated in the previous SCUP.
The applicant's business consists of assessing/testing small turbine components. 2/3 of the assessments will be performed at
client sites, while 1/3 will be on subject property. The process is noise-free and involves inspection using microscopes. The
components are mailed to the applicant's home and assessed in the existing accessory structure by the family. If demand
increases, the applicant may bring on one part-time assistant for this home occupation type business.
Thirteen (13) notices of public hearing were mailed to neighboring property owners. No response was received from the mailout.
The Planning & Zoning Commission, by unanimous vote, recommends City Council approval of Special Conditional Use Permit
#SCU09-003 with the following conditions:
1. Retain 100' setback from the east, west and south property line adjacent to residential for buffering purposes with all other
setbacks as required.
2. There shall be no change in the outside appearance of the building or premises and all performance has to be residential in nature.
3. No sign or display visible from the exterior of the dwelling shall be allowed.
4. There shall be no outside storage of any kind within the required setback areas and any other easements at site.
5. The facility shall operate as per noise regulations in Section 106-521 (g), Code of Ordinances. Any construction or equipment
use in the rear yard setback shall not be allowed.
6. Hours of operation shall be between 7 am to 7 pm.
7. Number of employees shall be limited to one person other than members of the family residing in the premises.
8. No traffic shall be generated by such use in greater volumes than would normally be expected for residential use.
9. All outdoor lighting shall be hooded and arranged to deflect lights away from the nearby residential properties in
compliance with Section 106-521(a) of the Code of Ordinances.
10. Assure that the accessory structure is not visible from the neighboring residential properties to the south.
11. Ensure that tree line will be preserved for at least 100' from the side and 150' from the rear property line.
12. The roofed-over structures on the property do not accumulatively exceed the maximum forty percent (40%) lot coverage.
13. Any additional development at site shall be subject to filing a new application for Special Conditional Use Permit.
14. The Developer shall comply with all applicable laws and ordinances of the City and the State of Texas.

If construction is terminated after completion of any stage and there is ample evidence that further development is
not contemplated, the ordinance establishing such special conditional use permit may be rescinded by the City
Council, upon its own motion or upon the recommendation of the Planning and Zoning Commission of the City of La
Porte, and the previous zoning of the entire tract shall be in full effect on the portion which is undeveloped.

Attached is a third amendment to the City's agreement with Harris County for the Northside
Neighborhood Single-Family New Construction Project. This amendment increases the project budget by
$41,000 to allow for additional financial assistance to eligible Down Payment Assistance homebuyers for
the remaining four (4) single-family unsold homes located at 211 North Isl; 207 and 216 North 2nd; and
224 North 6th Streets. The stated amount represents an additional $10,000 for each of the four homes and

EXECUTIVE SUMMARY
THIRD AMENDMENT TO AGREEMENT
October 13, 2009
On August 22, 2006, Commissioners Court approved an agreement between Harris County and The City of La
Porte utilizing $457,300.00 in HOME Investment Partnership (HOME) Program, funds for the Northside
Neighborhood Single - Fancily New Construction Project. The project consists of five (5) single- family homes
for low - and very low- income citizens located at 211 North 1 Street, 207 and 216 North 2 thi Street, and 210 and
224 North 6 Street in the City of La Porte, Harris County, Texas, in Precinct Two.
On March 4, 2008, Commissioners Court approved the First Amendment to the Agreement to reduce the
amount of required match provided by the City of La Porte by $12,500.00 which allowed the City to retain
marketing and listing services.
On July 14, 2009, Commissioners Court approved the Second Amendment to the Agreement to increase HOME
funds in the amount of $11,820.00 for partial funding of closing costs incurred from the sale of the houses for a
total of $469,120:00 in HOME funds. The City of La Porte increased their match by $7,880.00 to cover a
portion of the closing costs expenses for a total match of $109,705.00.
The Harris County Community Services Department (CSD) and The City of La Porte now desire to amend the
August 22, 2006 agreement to provide $40,000.00 in Tax Increment Reinvestment Zone (TIRZ) funds for a
total Budget of $510,120.00 to provide additional down payment assistance to eligible homebuyers. The use of
TIRZ funds is in accordance with the teGuidelines for Expenditure of TIRZ - Generated Affordable Housing
Funds" as amended and approved by Commissioners Court on September 14, 2004.
CSD requests approval of the following:
• Allocation of $40,000.00 grant in TIRZ Affordable Housing Set-Aside Funds to provide additional
down payment assistance for eligible homebuyers participating in the City of La Porte's Northside
Neighborhood Single- Family Housing Project. The subject project is located in the City of La Porte,
Harris County, Texas, in Precinct Two.
• Approval of the attached Third Amendment to the Agreement, prepared by the County Attorney,
between Harris County and The City of La Porte, for the use of TIRZ funds for the Project.
• Auditor's Office to transfer the funds from the TIRZ Affordable Housing Increment Fund, and the
Treasurer's Office to release payment to Barris County Community Services Department for
disbursement in accordance with the Amendment.

CITY OF LA PORTE FOR THE NORTHSIDE NEIGHBORHOOD SINGLE- FAIVHLY
NEW CONSTRUCTION PROJECT
RECITALS
WHEREAS, HARRIS COUNTY, a body corporate and politic under the laws of the State of Texas,
hereinafter referred to as °Grantee,' and the City of La Porte, a Texas body politic and corporate under the
laws of the State of Texas, herein called the " Subrecipienf , entered into an Agreement on August 22, 2006
to administer a HOME Investment Partnerships (HOME) Program project in a manner satisfactory to the
County and consistent with any standards required as a condition of providing these funds. Such project
includes the construction of five (5) single-family houses for very low and low- income families, which is
known as the Northside Neighborhood Single - Family New Construction Project (hereinafter, the 'Project,.
WHEREAS, on March 4, 20008 the Grantee and the Subreciplent amended said Agreement to revise the
budget by reducing the Subrecipient's required matching contribution by an amount of $12,500.00, and
WHEREAS, on July 14, 2009 the Grantee and the Subrecipient amended said Agreement to revise the
budget by specifying additional marketing procedures to be implemented and increase HOME funds in the
amount of $11,820.00 to cover a portion of closing cost expenses incurred from the sales of the houses,
and
WHEREAS, the Grantee and the Subrecipient now desire to amend said Agreement to provide Tax
Increment Reinvestment Zone (TIRZ) Program funds In the amount of $40,000.00 to provide down
payment assistance to eligible homebuyers.
NOW, THEREFORE, the Grantee and the Subrecipient do mutually agree as follows:
Exhibit A, Scope of Services, found at pages 23-25 of the Agreement, is replaced entirely. The amended
Scope of Services is attached hereto and shall be known as 'Exhibit A to the Third Amendment of the
Agreement'

Exhibit B, 'Budget," found at page 26 of the Agreement, is replaced entirely. The amended budget is
attached, hereto and shall be known as "Exhibit B to the Third Amendment of Agreement."
III.
In the event of any conflict between this Third Amendment to Agreement and the original Agreement, the
. terms of this Third Amendment shall govem. Ali other conditions between the parties shall remain in full
force and effect.

Exhibit A
APPLICATION
This Scope of Services is based on the proposal prepared and submitted by the Subrecipient
through the Harris County Community Services Department's (HCCSD) annual Request for
Proposal (RFP) process. However, in the event of any conflict between the proposal and any
provision contained herein, this Agreement shall control. In addition to the activities listed below,
the Subrecipient agrees to operate this Project in accordance with HOME requirements and all
other applicable Federal, state and local regulations.
11 PROJECT DESCRpTiON
The Subrecipient shall be responsible for implementing the Northside Neighborhood Single•Family
New Construction project during the term of this Agreement. The scope of the project Is to
construct five (5) single- family homes in the City of La Porte, Harris County, Texas. The
Subrecipient shall administer all activities in the provision of the aforementioned activities in
accordance with all applicable Federal, state, and local rules and regulations governing these
funds, and in a manner satisfactory to the Grantee.

ill. ACTIVITIES
The Subrecipient shall be responsible for the delivery of the activities to be performed under this
Agreement including, but not be limited to, the budget line Item categories listed in the budget
detail of Exhibit B and as detailed further below:
A. Site Control
Prior to commencement of construction, the Subrecipient shall provide copies of all closing
documents, including the recorded Deed of Trust, in the name of the Subrecipient, to evidence the '
purchase and transfer of ownership to the Subrecipient for approximately five (5) vacant lots of land
located in the City of La Porte, Harris County, Texas. Such land will be purchased at the
Subrecipient's sole expense prior to construction of the Project.
B. Construction
The Subrecipient shall construct five (5) affordable single- family homes at 211 North 1st, 207 and
216 North 2 and 210 and 224 North 6th Streets located in the City of La Porte, Harris County,
Texas.
C. Down Payment Assistance
The Grantee will provide up to $10,000.00 in additional financial assistance to eligible Down
Payment Assistance Program (DAP) homebuyers for the remaining four (4) single- family unsold
homes in the Northside Neighborhood Single- Family New Construction Project to be used for down
payment and closing cost assistance: 211 North 1st; 207 and 216 North 2 224 North 6 Streets.
Applications for down payment assistance will be processed by the Grantee following a preliminary
determination of eligibility of the applicant based upon the Letter of intent to Process Loan, Good
Faith Estimate and 1003 Uniform Residential Loan Application submitted by the mortgage lender,
pursuant to the regulations governing the HOME Program.
D. Marketing Program
The Subrecipient shall develop and adhere to a marketing plan to ensure the completion of the
process of finding buyers, building and selling of the homes during the Time of Performance
period. Marketing plan activities shall include but not be limited to contracting with a real estate
broker licensed in the State of Texas whose responsibilities will include conducting an open house
and listing the properties on the Multiple Listings Service as well as local publications.
The Subrecipient shall price each home in accordance with the maximum mortgage limits specified
in the FHA Loan 203(b) Program for the Houston/Harris County Metropolitan Service Area. The
Subrecipient shall refer all questions, inquiries, or requests for down payment assistance to
HCCSD staff.
E. Matching Funds Requirement
HOME Program funds used for Subrecipient construction activities are required to be matched
according to 24 C.F.R. § 92.218. Eligible forms of matching contributions must be met in
accordance with 24 C.F.R. § 92.220.
The Subreciptent`s required matching contribution for this Project shall equal no less than
$109.705.00.
F. Service Delivery Plan
The Subrecipient shall follow the detailed work plan summary below and Project timeline to ensure
completion of the Project within the Time of Performance period.

Qualifications (RFQ) process for qualified builders is posted. Pre - program
Contract survey with residents and community leaders begins.

February Five (5) building sites/lots are purchased by the Subrecipient. RFQ
2007 reviewed by the RFQ Committee and recommendation forwarded to
Subrecipient. Pre- program evaluation/survey with area residents and
community leaders is conducted. RFQ's are reviewed by community
leaders. The Subrecipient signs contract with consultant to assist with
marketing and application process with HCCSD
March The Subrecipient submits building plans for review and approval by
HCCEDD. Marketing efforts begin.
April After approval from HCCSD, the Subrecipient signs contract with winning
builder. "Interest" meeting event held. Partnering lending institutions are
identified. Possible applicants are directed to HCCEDD Lending Services
to be: in formal process.
May Application process through HCCSD Lending Services is ongoing.
Program marketing continues. The Subrecipient is advised of potential
homebuyers' applications. Partnering lending institutions begin processing
potential homebuyer applications.
July Processing of homebuyer applications continue. Lots are cleared, grubbed
and graded to standard. Program marketing continues.
August Qualified homebuyers are identified and approved for mortgage and down -
payment program. Construction begins on five (5)homes.
September Program applicants are certified by HCCSD according to HUD's HOME
guidelines. Construction continues while accounting for possible weather
delays.
October Construction of the homes and certification of applicants continue.
Replacement applicants are sought if required.
January 2008 Construction of the remaining three (3) homes and certification of
applicants continue. Replacement applicants are sought if required. __
March Construction of the first two (2) homes is completed. Certification of
homebuyer applicants continues. Replacement applicants are sought if
required.
May Program marketing and certification of homebuyer applicants continues.
Replacement applicants are sought if required.
June Program marketing and certification of homebuyer applicants continues.
Replacement applicants are sought if required.
July Closing occurs on one (1) home and the "Key Exchange" ceremony is
scheduled and advertised with the community leaders.
August Construction of the remaining three (3) homes and certification of
applicants continue. Replacement applicants are sought if required. •
September Construction of the remaining three (3) homes ends and program
and October evaluation begins.
November Final reports are submitted to HCCSD. Certification of applicants continue.

Highlight Memo on Inspection Division Activities
The following is our monthly report on some of the highlights of the Inspection Services
Division.
Staff assisted the owner of385 Myrtle Creek with a sign replacement.
. The business sign was damaged by Ike. Due to the age ofthe building a site plan was
not on file at the city and the owner did not have a survey to assist in the discussion.
. While typically locating property corners would suffice in ensuring proper placement,
longtime staff recalled a water line easement across the front of the property. Staff
was able to locate (2) adjoining development site plans that confirmed the easement.
. Utilizing that knowledge, staff was able to assist the owner in proper placement of the
new sign without an "accidental" encroachment into the city easement.
Also, we assisted an owner on replacement oftheir home at 10626 N. Avenue P Street.
. The owner lives on the property but wanted to replace their existing home with a state
certifIed modular home. The owner communicated with staff early and often and we
were able to place the home in a manner that allowed the individual to remain in their
current dwelling until they could move into the new dwelling.
. To avoid a zoning violation and allow the owner an easy move, staff utilized a letter of
agreement were the owner agreed to demolition their old home within (30) days of
occupancy of the new home. The project is underway and has gone smoothly.
