Call to order The meeting was called to order by Mayor Pro-Tem Daryl Leonard at 6:00 p.m. Members of City Council Present: Councilmembers Tommy Moser, John Zemanek, Mike Clausen, Chuck Engelken, John Black, Jay Martin, Mayor Rigby and Mayor Pro-Tem Daryl Leonard Members of Council Absent: Mike Mosteit Members of City Executive Staff and City Employees Present: City Manager's Office: Ron Bottoms, John Joerns and Melisa Boaze Legal: Clark Askins City Secretary's Office: Martha Gillett, Bonnie Garrison, Robin Eldridge and Sharon Harris Planning: Tim Tietjens and Brian Sterling Police Department: Chief Ken Adcox and Chris Paige Parks and Recreation: Marlene Rigby Public Works: Steve Gillett Fire: Mike Boaze Court: Judge Mitrano Others Present: Sue Stout of the Bayshore Sun, Stephen Schonauer, Lou Ann Martin, Doug Martin, Mark Follis, Phillip Hoot, Mr. and Mrs. Rosa, Rob Servis of Judge Emmett's Office, Norma Elliott, Dottie Kaminski, Leslie and Rick Guzman, Gail, Jeff, Pat and Josh Martin. 2. The Invocation was given by Assistant City Attorney Clark Askins. 3. Councilman Mike Clausen led the Pledge of Allegiance. 4. Presentations/Proclamations There were no presentations or proclamations presented. 5. Consider approval or other action regarding an ordinance declaring the results of the City of La Porte Special Called Election held on August 28,2010, for Mayor and Councilperson - District 5 - (Ord. 3269) - C. Askins Assistant City Attorney Clark Askins presented summary and recommendation and answered Councils' questions. Minutes of Special Called Regular Meeting of La Porte City Council on September 7, 2010 2 Assistant City Attorney Clark Askins read Ordinance 3269, AN ORDINANCE DECLARING THE RESULTS OF THE SPECIAL ELECTION HELD IN THE CITY OF LA PORTE ON AUGUST 28, 2010 FOR THE ELECTION OF A MAYOR, AND COUNCILPERSON DISTRICT 5, FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW, AND PROVIDING AN EFFECTIVE DATE HEREOF. Motion was made by Councilmember Moser to approve Ordinance 3269 as presented by Mr. Askins. Second by Councilmember Enqelken. Motion carried. Ayes: Engelken, Rigby, Moser, Zemanek, Clausen, Black, and Mayor Pro-Tem Leonard Nays: None Abstain: None Absent: None 6 Judge Mitrano administered Oath of Office and presentation of Certificate of Election to newly appointed Mayor Louis Rigby and District 5 Councilmember Jay Martin. 7. Petitions, Remonstrance's, Communications, Citizens and Tax Payers wishing to address Council on any item posted on the agenda (Limited to five minutes) Phillip Hoot - Congratulated the newly elected Mayor and Councilmember District 5. 8. Council Comments: Clausen, Martin, Moser, Black, Zemanek, Leonard, Engelken, and Mayor Rigby A. Matters appearing on agenda B. Recognition of community members, city employees, and upcoming events C. Inquiry of staff regarding specific factual information or existing policy 9. Executive Session - pursuant to provision of the Open Meeting Law, Chapter 551, Texas Government Code, Sections 551.071 through 551.076, 551.087 (consultation with attorney, deliberation regarding real property, deliberation regarding prospective gift or donation personnel matters, deliberation regarding security devices, or excluding a witness during examination of another witness in an investigation , deliberation regarding economic development negotiations) 10. Considerations and possible action on items considered in executive session. There was not executive session held. 11.
