MINUTES OF REGULAR MEETING AND WORKSHOP MEETING
OF THE LA PORTE CITY COUNCIL
January 24, 2011
1. Call to order
The meeting was called to order by Mayor Rigby at 6:02 p.m.

2. The Invocation was given by Councilmember John Black
3. Councilmember Mike Clausen led the Pledge of Allegiance
Assistant City Attorney Clark Askins provided an update on the Port of Houston noise
violations as an Administrative Report item (see item 11) taken out of order.

A. Presentation: Mayor Rigby and Police Chief Ken Adcox presented Assistant Chief of
Police Ron Parker with a plaque in recognition of "Manager of the Year".
B. Presentation: Mayor Rigby, Purchasing Manager Susan Cream, Director of Finance
Michael Dolby presented Purchasing Buyer Jeana Masterson with a plaque in
recognition of "Employee of the 4th Quarter".
C. Presentation: Mayor Rigby and Emergency Management Coordinator Jeff Suggs
presented Emergency Management Planner Kristin Gauthier with a plaque in
recognition of "Employee of the Year".
D. Presentation: Councilman Engelken presented the City of La Porte with the Houston
Galveston Area Council Outstanding Parks and Natural Areas Award for the Sylvan
Beach Project.
E. Presentation: Mayor Rigby presented Director of Finance Michael Dolby and
Comptroller Phyllis Rinehart with the 2009 Certificate of Achievement Award for
Financial Reporting
F. Presentation: Mayor Rigby recognized the Retirement of Public Works Director Steve
Gillett.
G. Presentation: Mayor Rigby recognized the Retirement of City Secretary Martha Gillett.

Brad Paschal 712 S. Idaho La Porte, Texas addressed City Council in support of golf carts
driven within the City of La Porte.
Anthony Villarreal - 3903 Barracuda Ln. La Porte, Texas - addressed City Council
regarding the Port of Houston and the noise pollution ordinance.
Chuck Rosa - 812 S. Virginia La Porte, Texas - addressed City Council regarding the
property taxes in the City of La Porte.
Pamela Barrett - 311 S. Idaho La Porte, Texas - addressed City Council in support of the
use of golf carts within the City of La Porte.
Shawn Bradstreet - 3817 Aspen Dr. La Porte, Texas - addressed City Council in support
of golf carts driven within the City of La Porte.
Charles Montgomery - 2019 Laura Ln. La Porte, Texas - addressed City Council
regarding a resolution for opposing heavy haul corridors in the City of La Porte.
Suzan Rector - 3141 S. Broadway La Porte, Texas - addressed City Council regarding a
Dog Park and a new Animal Shelter in the City of La Porte.

Phillip Hoot - 927 Seabreeze La Porte, Texas - addressed City Council expressing his
support of selling the 912 West Main Building.
6. Consent agenda - Any item may be removed by a Councilperson for discussion.
A. Consider approval or other action of minutes of Regular Meeting and Workshop

B. Consider approval or other action awarding bid # 11010 for Office Supplies - S.
Cream.
C. Consider approval or other action awarding bid # 11011 for Golf Course Equipment -

D. Consider approval or other action calling a Public Hearing for Monday, February 14,
2011 at 6:00 p.m. on the two-year service plan and two-year budget plan for the La
Porte Fire Control, Prevention, and Emergency Medical Services District - D. Ladd
E. Consider approval or other action regarding an ordinance vacating, abandoning, and
closing the alley in Block 195, Town of La Porte, and authorize the execution and
delivery of a deed to the adjacent landowner (Ord. 3314) - 1. Tietjens

from the sale of excess detention capacity credits into the Park Zone #1 Escrow
account to fund improvements to the Brookglen Park Recreation Center and consider

$5,600.00 to complete Brookglen Park Recreation Center improvements as needed. -

Annual Election of the City of La Porte, Texas for May 14, 2011 and calling a run-off

Ordinance 3315 - AN ORDINANCE CALLING THE REGULAR ANNUAL ELECTION OF
THE CITY OF LA PORTE, CALLING A RUN-OFF ELECTION, IF NECESSARY,
DESIGNATING ELECTION PRECINCTS AND POLLING PLACES, PROVIDING FOR
THE USE OF VOTING MACHINES, APPOINTING ELECTION OFFICIALS, PROVIDING
FOR METHOD AND DATES OF EARLY VOTING, PROVIDING FOR AN EARLY VOTING
BALLOT BOARD, PROVIDING FOR RETURN AND CANVASS OF VOTES OF SAID
ELECTION, PROVIDING FOR NOTICE, PROVIDING FOR FILING DEADLINE AND
FILING FEES FOR CANDIDATES, PROVIDING A SAVINGS CLAUSE, FINDING
COMPLIANCE WITH THE OPEN MEETINGS LAW, AND PROVIDING AN EFFECTIVE
DATE HEREOF.
Motion was made by Councilmember Enqelken to approve the consent as presented.
Second by Councilmember Leonard. The motion carried unanimously.

Moser, Martin and Clausen.

7. Consider approval or other action regarding an ordinance appointing Patrice Fogarty City
Secretary of the City of La Porte, Texas for a term commencing February 28, 2011 (Ord.
3316) - R. Bottoms
City Manager Ron Bottoms presented summary and recommendation and answered
Councils' questions.
Assistant City Attorney Clark Askins read: Ordinance 3316 - AN ORDINANCE
APPOINTING PATRICE FOGARTY CITY SECRETARY OF THE CITY OF LA PORTE
,
FOR A TERM COMMENCING FEBRUARY 21, 2011, AND UNTIL HER SUCCESSOR
SHALL HAVE BEEN DULY APPOINTED AND QUALIFIED, PROVIDING A
SEVERABLlL Y CLAUSE, CONTAINING A REPEALING CLAUSE, FINDING
COMPLIANCE WITH THE OPEN MEETINGS LAW, PROVIDING AN EFFECTIVE DATE
HEREOF.
Motion was made by Council member Moser to amend ordinance 3316 appointinq Patrice
Foqarty City Secretary of the City of La Porte. for a term commencinq February 21. 2011
as presented by Mr. Bottoms. Second by Councilmember Zemanek. The motion carried
unanimously.
Ayes: Council members Zemanek, Black, Mosteit, Engelken, Leonard, Moser, Martin,
Clausen and Mayor Rigby.

8. Mayor Rigby closed Regular Meeting and opened Workshop Meeting at 7:15 p.m.
A. Discuss use of Golf Carts on the streets in the City of La Porte, Texas and provide
staff with direction - K. Adcox
Chief of Police Ken Adcox and Patrol Sergeant Rod Davis discussed the use of Golf Carts
on the streets in the City of La Porte, Texas.
City Council directed staff to get with a group of citizens on recommendations for a golf
cart ordinance and bring back as a workshop item.
B. Discuss 912 West Main Street Building and provide staff with direction. - Ron Bottoms
City Manager Ron Bottoms discussed the 912 West Main Building.
City Council directed staff to pursue the sale of the 912 West Main Street Building using a
local realtor and provide City Council with an appraised value of the property. City Staff
was also directed to provide Council with any possible lease or lease to purchase options
for their review.
9. Mayor Rigby closed the Workshop Meeting and opened the Regular Meeting at 8:11 p.m.
10. Receive monthly Inspections Report from Staff - D. Wilmore
Chief Building Official Debbie Wilmore provided the Inspections Report

Mayor Rigby requested Assistant City Secretary Sharon Harris to forward a copy of the
resolution passed by City Council opposing any legislation that increased the maximum
transport hauled over Texas highways.

13. Executive Session - pursuant to provision of the Open Meeting Law, Chapter 551 , Texas

donation personnel matters, deliberation regarding security devices, or excluding a
witness during examination of another witness in an investigation , deliberation regarding
economic development negotiations)
