MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF LA PORTE
FEBRUARY 24, 2014
The City Council of the City of La Porte met in a regular meeting on Monday, February 24, 2014, at the
City Hall Council Chambers, 604 West Fairmont Parkway, La Porte, Texas, at 6:00 p.m. to consider the
following items of business:
1. CALL TO ORDER
Mayor Rigby called the meeting to order at 6:00 p.m. Members of Council present:
Councilmembers Engelken, Zemanek, Kaminski, Clausen, Mosteit, Moser and Martin. Absent:
Councilmember Leonard. Also present were City Secretary Patrice Fogarty, City Manager Corby
Alexander, and Assistant City Attorney Clark Askins.
2. INVOCATION - The invocation was given by Councilmember Jay Martin.
3. PLEDGE OF ALLEGIANCE - The Pledge of Allegiance was led by Councilmember Mike Clausen.
4. PUBLIC COMMENTS (Limited to five minutes per person.)
There were no public comments.
6. CONSENT AGENDA (All consent agenda items are considered routine by City Council and will be enacted
by one motion. There will be no separate discussion of these items unless a Councilmember requests an
item be removed and considered separately.)
(a) Consider approval or other action regarding the minutes of the regular city council meeting
held February 10, 2014 — P. Fogarty
(b) Consider approval or other action authorizing the City Manager to execute an Interlocal
Water Service Agreement and an Interlocal Sanitary Sewer Service Agreement with San
Jacinto College District for its proposed Maritime Campus — T. Tietjens
(c) Consider approval or other action awarding Bid #14014 for Little Cedar Bayou Golf Course
Pump Station Irrigation System — A. Osmond
Councilmember Engelken moved to approve the Consent Agenda pursuant to staff
recommendations. Councilmember Mosteit seconded. MOTION PASSED.

Zemanek, Mosteit, Moser and Martin

6. AUTHORIZATIONS
(a) Consider action regarding Bid # 14016 for Fairmont Park Pool Building — S. Barr
Parks and Recreation Director Stephen Barr presented a summary.

Councilmember Moser signed a conflict of interest affidavit and did not participate in the discussion
or vote.
Councilmember Zemanek questioned if the project was over budget or was the cost
underestimated. Parks and Recreation Director Stephen Barr responded the cost of the projected
was underestimated. Councilmember Zemanek commented he would like to see the City go
forward with a nice building and not a prefabricated building.
Councilmember Clausen was in agreement with Councilmember Zemanek.
Mayor Rigby questioned City Manager Corby Alexander if the City would be going through the
same issue as with the Animal Shelter with future projects — as in staff estimates being much lower
than actual bids. Mr. Alexander responded no, City Staff met this morning to discuss terms of
putting a system in place for assistance before committing to a budget number and before City
Council commits to doing a project. Mr_ Alexander also added one of the cost amounts before
Council for consideration is because he believes staff has an obligation to bring something forward
to Council that is within the budget.
Councilmember Clausen moved to award the bid as submitted with a total of $277,195.00.
Councilmember Kaminski seconded. MOTION PASSED.

(b) Consider approval or other action authorizing the City Manager to execute an Interlocal
Agreement between Harris County and the City of La Porte allowing Harris County to design
and construct the relocation of certain City water and sewer facilities along Sens Road for
the construction of the Sens Road (Spencer Highway to Highway 225) improvements — D.

Public Works Director Dave Mick presented a summary.
Councilmember Moser questioned Public Works Director Dave Mick if the utilities had already been
relocated as he understood them to have been. Mr. Mick responded yes, the main line facilities,
sanitary sewer, and water main were moved and upsized in the process; but this item is for the
water services and getting them to the correct grade.
Councilmember Mosteit moved to authorize the City Manager to execute an Interocal Agreement
between Harris County and the City of La Porte allowing Hams County to design and construct the
relocation of certain City water and sewer facilities along Sens Road for the construction of the
Sens Road (Spencer Highway to Highway 225) improvements. Councilmember Zemanek
seconded. MOTION PASSED.

7. REPORTS
(a) Receive 2013 City of La Porte Police Department Racial Profiling Report— K. Adcox
Chief of Police Ken Adcox provided the 2013 City of La Porte Police Department Racial Profiling
Report.

Councilmember Moser asked Chief of Police Adcox to explain the difference between racial
profiling and a good police officer. Mr. Adcox responded he believes it is a police officer performing
their duties in a non -biased manner and not targeting someone because of their race, ethnicity,
sexual preference, or any other thing of difference in human beings.
(b) Receive 2013 City of La Porte Police Department Annual Crime and Activity Report -- K.
Adcox
Chief of Police Ken Adcox provided the 2013 City of La Porte Police Department Annual Crime and
Activity Report and provided a PowerPoint Presentation.
Councilmember Moser requested a breakdown of where drugs are being found in a district — i.e.
whether in apartment complexes or residences and a list of self -initiated calls with the time of calls.
(c) Receive Delinquent Tax Report — T. Leach
Assistant City Manager Traci Leach provided the Delinquent Tax Report. There were no questions.
8. ADMINISTRATIVE REPORTS
(a) Receive report from City Manager
• Zoning Board of Adjustment Meeting, Thursday, February 27, 2014
• City Council Meeting, Monday, March 10, 2014
City Manager Corby Alexander advised three homes were sold on the Northside via the Harris
County Home Program; he showed two videos for commercials to be aired next week through
March 1 S"', highlighting spring events in La Porte and sent kudos to Public Relations and Marketing
Specialist Jaree Hefner for her work on the videos.
9. COUNCIL COMMENTS regarding matters appearing on the agenda; recognition of community
members, city employees, and upcoming events; inquiry of staff regarding specific factual
information or existing policies — Councilmembers Clausen, Martin, Moser, Kaminski, Zemanek,
Leonard, Engelken, Mosteit and Mayor Rigby.
Councilmember Martin congratulated Chief Adcox and the Police Department on the report and City
Manager Corby Alexander, Assistant City Manager Traci Leach and Public Relations and Marketing
Specialist Jaree Hefner on the two videos viewed by Council; Councilmember Moser commented
on the Food Drive held the past weekend with over 200 people who were distributed food;
Councilmember Kaminski thanked Chief Adcox for the reports, Jaree Hefner for her work on the
videos, and commented the Food Drive had a great turnout; Councilmember Zemanek recognized
and congratulated Councilmember Kaminski for being a finalist for Public Official of the Year and
wished her the best for winning the award at the luncheon to be held on March 7th; Councilmember
Engelken congratulated the Police Department and Jaree Hefner for her work on the videos;
Councilmember Mosteit reminded everyone of the Lomax Park Dedication this coming Saturday
and Mayor Rigby commented the ribbon cutting for Farrington Road was attended by Council and
sent kudos and appreciation to Hams County for their contributions.
10. EXECUTIVE SESSION: The City reserves the right to meet in closed session on any agenda item
should the need arise and if applicable pursuant to authorization by Title 5, Chapter 551, of the
Texas Government Code, including, but not limited to, the following:
Texas Government Code, Section 561.074 — Deliberations regarding Personnel Matters
concerning the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal
of a public officer or employee, unless the officer or employee requests a public hearing: Patrice
Fogarty, City Secretary and Corby Alexander, City Manager.
Texas Government Code, Section 551.072 — For the purpose of deliberation the purchase,
exchange, lease or value of real property: Former Texas Parks and Wildlife Building.

City Council recessed the regular Council meeting to convene an executive session at 6:48 p.m. to
deliberate the purchase, exchange, lease or value of real property: Former Texas Parks and Wildlife
Building. See action taken under Item 11, below.
City Council recessed the regular meeting to convene an executive session at 7:20 p.m. to
deliberate regarding Personnel Matters concerning the appointment, employment, evaluation,
reassignment, duties, discipline, or dismissal of a public officer or employee, unless the officer or
employee requests a public hearing: Patrice Fogarty, City Secretary and Corby Alexander, City
Manager. See action taken under Item 11, below.
11. RECONVENE into regular session and consider action, if any on item(s) discussed in executive
session.
Regarding the executive session pertaining to Section 551.072, deliberating the purchase,
exchange, lease or value of real property: Former Texas Parks and Wildlife Building, the regular
meeting was reconvened at 7:18 p.m. for action to be taken.
Councilmember Martin moved to authorize the sale price of $280,600.00 and authorize the City
Manager to sign the contract. Councilmember Zemanek seconded. MOTION PASSED.

Martin, Zemanek, Engeiken, and Clausen

Regarding the executive session pertaining to Section 551.074, evaluations of the city secretary
and city manager, the regular meeting was reconvened at 9:18 p.m. for action to be taken.
Councilmember Zemanek moved to increase City Secretary Patrice Fogarty's salary by
approximately 3.7% and to increase City Manager Corby Alexander salary by approximately 3.5%
and extend his contract until June 30, 2017. Councilmember Clausen seconded. MOTION
PASSED.

Martin, Zemanek, Engelken, and Clausen
