CALL TO ORDER Mayor Rigby called the meeting to order at 6:02 p.m. Members of Council present: Councilmembers Kaminski, Clausen, Mosteit, Leonard, Moser and Martin. Absent: Councilmembers Engelken and Zemanek. Also present were City Secretary Patrice Fogarty, City Manager Corby Alexander, and Assistant City Attorney Clark Askins. 2. INVOCATION - The invocation was given by Brian Christen, La Porte Community Church. 3. PLEDGE OF ALLEGIANCE - The Pledge of Allegiance was led by Councilmember Tommy Moser. 4. PRESENTATIONS, PROCLAMATIONS, and RECOGNITIONS (a) Proclamation — National Public Safety — Telecommunications Week — Mayor Rigby Mayor Rigby presented the National Public Safety — Telecommunications Week proclamation to Police Chief Ken Adcox. (b) Proclamation — La Porte Livestock Show and Rodeo Association Days — Mayor Rigby There was no one present to receive the La Porte Livestock Show and Rodeo Association Days proclamation. (c) Proclamation — La Porte Special Olympics Shrimp Boil Day — Mayor Rigby Mayor Rigby presented the La Porte Special Olympics Shrimp Boil Day proclamation to the Red Suspenders Senior Group. The 5. PUBLIC COMMENTS (Limited to five minutes per person.) There were no public comments. 6. CONSENT AGENDA (All consent agenda items are considered routine by City Council and will be enacted by one motion. There will be no separate discussion of these items unless a Councilmember requests an item be removed and considered separately.) (a) Consider approval or other action regarding the minutes of the regular city council meeting held March 10, 2014 — P. Fogarty (b) Consider approval or other action adopting an ordinance declaring the candidates for Councilperson At Large-B and Councilperson District 6 unopposed; declaring Dottie Kaminski, candidate for Councilperson At Large-B, elected; declaring Mike Clausen, Page 1 of 4 March 24, 2014, Council Meeting Minutes candidate for Councilperson District 6 elected, and cancelling these two races at the May 10, 2014, general election - P. Fogarty (c) Consider approval or other action regarding an ordinance vacating, abandoning and closing the alley in Block 644, La Porte, the N. 17th St. Right -of -Way between Blocks 643 & 644, La Porte and the W. Madison St. Right -of -Way from N. 16th St. to 296' West — T. Tietjens (d) Consider approval or other action authorizing an expenditure of $40,000.00 by La Porte Development Corporation for an incentive grant to Rob Johnson Interests for a new retail development — S. Livingston Regarding Item 6d, Mayor Rigby questioned if the item had been approved by the La Porte Development Corporation Board. City Manager Corby Alexander answered yes. Councilmember Mosteit moved to approve the Consent Agenda pursuant to staff recommendations. Councilmember Leonard seconded. MOTION PASSED. Ayes: Mayor Rigby, Councilmembers Clausen, Kaminski, Leonard, Mosteit, Moser and Martin Nays: None Absent: Councilmembers Engelken and Zemanek Prior to Council vote, Assistant City Attorney Clark Askins read the caption of the following ordinance: Ordinance 2014-3513 : AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS, DELCARING THE CANDIDATE FOR COUNCILPERSON AT LARGE POSITION B, DOTTIE KAMINSKI, AND THE CANDIDATE FOR COUNCILPERSON DISTRICT 6, MIKE CLAUSEN, UNOPPOSED; DECLARING DOTTIE KAMINKSI, CANDIDATE FOR COUNCILPERSON AT LARGE POSITION B AND MIKE CLAUSEN, CANDIDATE FOR COUNCILPERSON DISTRICT 6 ELECTED; CANCELLING THE ELECTION FOR COUNCILPERSON AT LARGE POSITION B AND COUNCILPERSON DISTRICT 6; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES INCONSISTENT OR IN CONFLICT HEREWITH; CONTAINING A SEVERABILITY CLAUSE; CONTAINING AN OPEN MEETINGS CLAUSE AND PROVIDING AN EFFECTIVE DATE. Ordinance 2014-3514: AN ORDINANCE VACATING, ABANDONING AND CLOSING THE ALLEY IN BLOCK 644, LA PORTE, THE NORTH 17T" STREET RIGHT-OF-WAY BETWEEN BLOCKS 643 AND 644, LA PORTE, AND THE WEST MADISON STREET RIGHT-OF-WAY FROM NORTH 16T" STREET TO THE PROJECTED CENTERLINE OF THE NORTH 17T" STREET RIGHT-OF-WAY; AUTHORIZING THE EXECUTION AND DELIVERY OF A DEED TO THE ADJOINING LANDOWNER, FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. 7. AUTHORIZATIONS (a) Consider approval or other action regarding a Bond Ordinance; authorizing the City Manager to execute the Bond Purchase Agreement and receive Plan of Finance — M. Dolby Finance Director Michael Dolby, the City's Financial Advisors and Bond Attorneys presented a summary. Councilmember Leonard moved to approve a Bond Ordinance authorizing the City Manager to execute the Bond Purchase Agreement and receive Plan of Finance. Councilmember Kaminski seconded. MOTION PASSED. Ayes: Mayor Rigby, Councilmembers Moser, Leonard, Clausen, Kaminski, Mosteit and Martin Nays: None Absent: Councilmembers Engelken and Zemanek Assistant City Attorney Clark Askins read the caption of Ordinance 2014-3515: ORDINANCE AUTHORIZING AND ORDERING THE ISSUANCE, SALE AND DELIVERY OF CITY OF LA PORTE, TEXAS GENERAL Page 2 of 4 March 24, 2014, Council Meeting Minutes OBLIGATION REFUNDING BONDS, SERIES 2014, IN AN AGGREGATE PRINCIPAL AMOUNT NOT TO EXCEED $10 MILLION; DELEGATING TO AUTHORIZED REPRESENTATIVES THE AUTHORITY TO APPROVE THE AMOUNT, INTEREST RATES, PRICE AND TERMS THEROF AND CERTAIN OTHER PROCEDURES AND PROVISIONS RELATED THERETO; AUTHORIZING THE REDEMPTION PRIOR TO MATURITY OF CERTAIN OUTSTANDING OBLIGATIONS; AND MAKING OTHER PROVISIONS REGARDING SUCH BONDS AND MATTER INCIDENT THERETO. 8. DISCUSSION OR OTHER ACTION (a) Discussion or other action regarding the Council -appointed committee for the Truck Study — C. Alexander City Manager Corby Alexander presented a summary for establishing the Council -appointed committee for the Truck Study. There will be representatives from the business side, the trucking side, and the citizen side. Mayor Rigby advised the following have been nominated for the Truck Study Committee. Councilmember Mosteit nominated Charles Montgomery for the citizen side. Councilmember Engelken nominated Richard Warren for the citizen side. Councilmember Martin nominated David Brady for the business side and Jess Steger for the citizen side. Councilmember Clausen nominated Larry Stockham for the citizen side. Councilmember Zemanek nominated John Kling for the citizen side. Mayor Rigby recommended Philip Dunn as a possible member if he is available to serve due to several engagements already on his calendar during the month of April. Councilmember Kaminski nominated Phil Steelman for the trucking side and Maggie Anderson for the business side. Councilmember Moser nominated Mark Follis for the citizen side. Councilmember Martin advised staff he would like to see the role of the committee established in writing. 9. REPORTS (a) Receive report of La Porte Development Corporation Board — Councilmember Engelken Councilmember Clausen reported the La Porte Development Corporation Board discussed Workforce Development Programs, approved an incentive grant to Rob Johnson Interests for a new retail development, and the next meeting is scheduled for April 14, 2014. (b) Receive Delinquent Tax Report — T. Leach Assistant City Manager Traci Leach provided the Delinquent Tax Report. Council directed staff to place future Delinquent Tax Reports on agendas once a quarter . 10. ADMINISTRATIVE REPORTS (a) Receive report from City Manager • City Council Meeting, Monday, April 14, 2014 • Fiscal Affairs Committee Meeting, Monday, April 28, 2014 • City Council Meeting, Monday, April 28, 2014 • Recognition — Councilmember Dottie Kaminski — Finalist for Public Official of the Year Page 3 of 4 March 24, 2014, Council Meeting Minutes City Manager Corby Alexander honored and congratulated Councilmember Kaminski for being a finalist for Public Official of the Year. Councilmember Kaminski was also presented with flowers. 11. COUNCIL COMMENTS regarding matters appearing on the agenda; recognition of community members, city employees, and upcoming events; inquiry of staff regarding specific factual information or existing policies — Councilmembers Clausen, Martin, Moser, Kaminski, Zemanek, Leonard, Engelken, Mosteit and Mayor Rigby. Councilmember Moser congratulated Councilmember Kaminski for being a finalist for Public Official of the Year; Councilmember Kaminski commented it was an honor to be a finalist for Public Official of the Year and advised everyone of the Food Drive to be held on the Northside this coming Saturday; Councilmember Leonard congratulated Councilmember Kaminski for being a finalist for Public Official of the Year and thanked the Red Suspenders Senior Group for the support throughout the years; Councilmember Mosteit congratulated the Police Department and the Red Suspenders Senior Group for receiving proclamations, congratulated Councilmember Kaminski for being a finalist for Public Official of the Year, and congratulated Councilmembers Clausen and Kaminski for being unopposed and declared re-elected; Councilmember Clausen congratulated Councilmember Kaminski for being a finalist for Public Official of the Year; thanked the Red Suspenders Senior Group and congratulated Emergency Management Coordinator Jeff Suggs for receiving his certification as a Certified Emergency Manager; Councilmember Martin congratulated Councilmember Kaminski for being a finalist for Public Official of the Year, thanked Finance Director Michael Dolby and the Finance Department for saving the City a significant amount of money and commented the Senior Center has a great program and Mayor Rigby congratulated Councilmember Kaminski for being a finalist for Public Official of the Year, thanked the dispatchers for doing such wonderful jobs, thanked the Red Suspenders Senior Group for starting the program eight years ago, commented the Battleship 100th Anniversary was a very touching event. 12. ADJOURN There being no further business, Councilmember Mosteit moved to adjourn the meeting at 6:37 p.m. Councilmember Leonard seconded. MOTION PASSED.
