RIGBY Mayor BRANDON LUNSFORD Councilperson At Large A BRENT McCAULLEY Cou ncilperson At Large B MANDI WILLIAMS Councilperson District 1 CHUCK ENGELKEN Councilperson District 2 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF LA PORTE MARCH 14, 2022 BILL BENTLEY Councilperson District 3 THOMAS GARZA Councilperson District 4 JAY MARTIN Mayor Pro Tern Councilperson District 5 ROBBIE McLARRIN Councilperson District 6 The City Council of the City of La Porte met in a regular meeting on Monday, March 14, 2022, at the City Hall Council Chambers, 604 West Fairmont Parkway, La Porte, Texas, at 6:00 p.m., with the following in attendance: Councilpersons present: Louis Rigby, Brandon Lunsford, Brent McCaulley, Chuck Engelken, Bill Bentley, Thomas Garza, Jay Martin, Robbie McLarrin Councilpersons attending remotely: None Councilpersons absent: Mandi Williams Council -appointed officers present: Corby Alexander, City Manager; Lee Woodward, City Secretary; Clark Askins, Assistant City Attorney CALL TO ORDER — Mayor Rigby called the meeting to order at 6:00 p.m. 2. INVOCATION — The invocation was given by Pastor Alan Neel, Life Community Church and pledges were led by Councilperson Thomas Garza. 3. CITIZEN COMMENT (Generally limited to five minutes per person; in accordance with state law, the time may be reduced if there is a high number of speakers or other considerations.) There were no citizen comments. 4. CONSENT AGENDA (Approval of Consent Agenda items authorizes each to be implemented in accordance with staff recommendations provided. An item may be removed from the consent agenda and added to the StatutoryAgenda for full discussion upon request by a memberof the Council present at this meeting.) a. Approve the minutes of the regular City Council meeting held on February 28, 2022. [Louis R. Rigby, Mayor] b. Approve the issuance of a pipeline permit to International Terminals Company, LLC for the construction of a 12" methanol pipeline within the City of La Porte. [Teresa Evans, Director of Planning and Development] c. Reject Bid #f22011- Inspections Division Mowing Services received from Gains Go Getters. [Teresa Evans, Director of Planning and Development] d. Presentation, discussion, and possible action to accept the Annual Comprehensive Financial Report for the City of La Porte Fiscal Year Ending September 30, 2021. [Michael Dolby, Finance Director] e. Approve the CIP purchase of the KFT Fire Training portable props, trailer and training. [Carl Holley, Fire Chief] f. Award Bid ##22001 to W.W. Payton Corporation and authorize the City Manager to execute a construction contract with W.W. Payton in the amount of $375,000.00 and approve a project contingency of 25,000.00, for a total authorization of $400,000.00 [Ray Mayo, Director of Public Works] Prior to the meeting, the City Manager requested item f be pulled and will be placed on a future agenda. Councilperson Garza pulled item c. Councilperson Bentley moved to approve items a, b, d, and e: the motion was seconded by Councilperson Engelken: the motion was adopted. 8-0. Councilperson Garza moved to reject Bid 22011 and direct the City Manager to redirect his staff to rebid the item: Mayor Pro Tern Martin seconded the motion: the motion was not adopted, 3-5, Mayor Pro Tern Martin and Councilpersons McLarrin and Garza voting in favor. Councilperson Bentley moved to reject Bid 22011, the motion was seconded by Councilperson McCaulley: the motion was adopted, 7-1, Councilperson Garza voting against. 5. STATUTORY AGENDA a. Accept proposal from Freese and Nichols, Inc. under RFP No. 22500 - Comprehensive Plan Update and authorize the City Manager to execute a professional services agreement with Freese and Nichols, Inc. to complete the City of La Porte's Comprehensive Plan update. [Teresa Evans, Director of Planning and Development] Councilperson Garza moved to direct staff to reject the proposal and conduct a plan review internally: the motion was not seconded and was not considered. Councilperson Bentley moved to accept the proposal from Freese and Nichols, Inc. under RFP No. 22500 — Comprehensive Plan Update and authorized the City Manager to execute a professional service agreement with Freese and Nichols, Inc. to complete the City of La Porte's Comprehensive Plan update; the motion was seconded by Councilperson McCaulley; the motion was adopted, 7- 1, Councilperson Garza voting against. 6. REPORTS a. Receive report of the Fiscal Affairs Committee meeting. [Councilperson Engelken] Councilperson Engelken said the Committee had accepted the Annual Comprehensive Financial Report. b. Receive report of the Drainage and Flooding Committee meeting. [Mayor Pro Tern Martin, Chair] Mayor Pro Tern Martin shared that the Committee had discussed ongoing activities with a representative of Harris County Flood Control District, received updates from Lorenzo Wingate, Assistant Director of Public Works, and set the next meeting for April 11. 7. ADMINISTRATIVE REPORTS • Planning and Zoning Commission meeting, March 17 • City Council meeting, March 28 • La Porte Development Corporation Board meeting, March 28 City Manager Corby Alexander said the cleanup of the gasoline spill was continuing and he would provide updates. 8. COUNCIL COMMENTS Hear announcements concerning matters appearing on the agenda; items of community interest; and/or inquiries of staff regarding specific factual information or existing policy from the Mayor, Councilpersons, and City staff, for which no formal action will be discussed or taken. Councilpersons asked whether the City could recoup costs if the gasoline event was due to negligence and City Manager Alexander said that although there had been such instances in the past, it was too soon to determine what would occur in this event; congratulated the Fire Department on their new truck and thanked them, the Police Department, and the Office of Emergency Management for their response to the gasoline spill; and expressed hope that the construction at Five Points is still on track.
