INVOCATION — The invocation was given by Reverend Brian Christen, La Porte Community Church and pledges were led by Councilperson Brandon Lunsford. 3. PRESENTATIONS, PROCLAMATIONS, AND RECOGNITIONS a. Proclamation — Geneva Marnell Day [Mayor Louis R. Rigby] b. Proclamation — National Volunteer Week [Mayor Louis R. Rigby] c. CITIZEN COMMENT (Generally limited to five minutes per person; in accordance with state law, the time may be reduced if there is a high number of speakers or other considerations.) Brian Christen asked that the Texas pledge be posted, 5. CONSIDERATION OF COUNCILPERSON ABSENCES a. Presentation, discussion, and possible action to consider excusing the absence of Councilperson Brent McCaulley from the March 28, 2022, City Council meeting, in accordance with the City Council Attendance Policy. [Louis R. Rigby, Mayor] Councilperson Engelken moved to excuse the absence of Councilperson Brent McCaulley from the March 28, 2022, City Council meeting; the motion was seconded by Councilperson Bentley: the motion was adopted, 9-0. 6. CONSENT AGENDA (Approval of Consent Agenda items authorizes each to be implemented in accordance with staff recommendations provided. An item may be removed from the consent agenda and added to the Statutory Agenda for full discussion upon request by a member of the Council present at this meeting.) a. Approve minutes of the regular City Council meeting held on March 28, 2022. [Louis R. Rigby] b. Approve the Mayor to sign the General and No Litigation Certificate with Southeast Texas Housing Finance Corporation. [Corby Alexander, City Manager] c. Appoint Nancy Ojeda for the open District 6 position on the Planning and Zoning Commission. [Councilperson Robbie McLarrin] d. Approve the City Manager to execute the Shared Agency Agreement with Motorola for the City's Emergency Services CAD/RMS system. [Corby Alexander, City Manager] e. Adopt Ordinance 2022-3882 authorizing the sale of City -owned real property located at 506 Circle Drive and legally described as Lot 17 and the east half of Lot 18, Block 30, Beach Park Annex to the City La Porte, Harris County, Texas, and authorize the City Manager to execute a deed to the buyer for the subject property. Adopt Resolution 2022-02 authorizing approval of bid by BP Coastal Builders & Developers, LLC for the resale of tax delinquent property described as Lot 1, Block 249, of Town in La Porte, an Addition in Harris County, Texas. Adopt Resolution 2022-03 authorizing approval of bid by BP Coastal Builders & Developers, LLC for the resale of tax delinquent property described as Lots 29, 30, 31 & 32, Block 1156, of the Town of La Porte, in Harris County, Texas. Adopt Resolution 2022-04 authorizing approval of bid by BP Coastal Builders & Developers, LLC for the resale of tax delinquent property described as Lot 24, Block 29 of Beach Park Addition to Town of La Porte, an Addition in Harris County, Texas. Adopt Resolution 2022-05 authorizing approval of bid by BP Coastal Builders & Developers, LLC for the resale of tax delinquent property described as Lot 25, Block 39, of the Town of La Porte, in Harris County, Texas. Adopt Resolution 2022-06 authorizing approval of bid by BP Coastal Builders & Developers, LLC for the resale of tax delinquent property described as Lots 12 through 16, both Inclusive, Block 1105, in Townsite of La Porte, Harris County, Texas. Adopt Resolution 2022-07 authorizing approval of bid by Gus Brieden for the resale of tax delinquent property described as Lots 1 through 7, Block 413, La Porte, Harris County, Texas. Authorize the City Manager to execute a work authorization with Public Management, Inc. for Grant Administration Services associated with City of La Porte CDBG-MIT Contract No. 22-119-004-D374, in the amount of $320,000.00. [Ray Mayo, Director of Public Works] m. Award Bid #22012-Chlorine and Sulphur Dioxide Valve Replacement, to Chlorinator Maintenance Construction, Inc. in the amount of $61,000.00. [Ray Mayo, Director of Public Works] n. Award Bid # 22013 - Replacement of Centrifugal Blower at the Wastewater Treatment Plant, to Global Wet, LLC in the amount of $128,963.00. [Ray Mayo, Director of Public Works] o. Award Bid #22014 - South Spencer Highway Fence Project, to Fencecrete America Inc. and authorize the City Manager to execute a construction contract for a base bid amount of $638,178.00 and extra work items in the amount of $93,884.00, for a total authorization of $732,062.00. [Ray Mayo, Director of Public Works] Councilperson Garza pulled items c and o. Councilperson Bentley moved to approve the consent agenda, less items c and o: the motion was seconded by Councilperson Engelken: the motion was adopted, 9-0. Councilperson Bentley moved to appoint Nancy Oieda for the open District 6 position on the Planning and Zoning Commission: the motion was seconded by Councilperson McLarrin: the motion was adopted, 8-0, Councilperson Garza abstaining_ Councilperson Garza moved to cancel the 'socialist project'; the motion was not seconded and was not considered. Councilperson Bentley moved to award Bid #22014 - South Spencer Highway Fence Project, to Fencecrete America Inc. and authorize the City Manager to execute a construction contract for a base bid amount of $638,178.00 and extra work items in the amount of $93,884.00, for a total authorization of $732,062.00: the motion was seconded by Councilperson McCaullev. Councilperson Garza moved to amend the motion to require a sidewalk be constructed as originally designed: the amendment was not seconded and was not considered. The original main motion was adopted, B-1, Councilperson Garza voting against. 7. REPORTS a. Receive report of the Drainage and Flooding Committee meeting. [Mayor Pro Tern Martin, Chair] Mayor Pro Tern Martin received updates on current and potential projects and said the next meeting would be held May 9, 2022. 8. ADMINISTRATIVE REPORTS • Planning and Zoning Commission meeting, April 21, 2022 • La Porte Development Corporation Board meeting, April 25, 2022 • City Council meeting, April 25, 2022 City Manager Corby Alexander said there were no reports. 9. COUNCIL COMMENTS Hear announcements concerning matters appearing on the agenda; items of community interest; and/or inquiries of staff regarding specific factual information or existing policy from the Mayor, Councilpersons, and City staff, for which no formal action will be discussed or taken. Councilpersons congratulated those recognized earlier in the meeting and thanked Mrs. Marnell for her service. The Mayor asked Councilpersons to review the material for Judge Mitrano's review and provide it to HR in a timely manner. 10. EXECUTIVE SESSION a. Texas Government Code Section 551.072 - Deliberation regarding the purchase, exchange, lease, or value of real property. The City Council will meet in closed session with the City Manager and Assistant City Attorney to discuss the potential purchase of real property located in the City of La Porte. The Council convened in executive session at 6:40 p.m. 11. RECONVENE into open session and consider action, if any, on item(s) discussed in executive session. The Council reconvened into open session at 7:30 p.m. The Mayor announced the Council had
