RIGBY Mayor BRANDON LUNSFORD Councilperson At Large A BRE NT M cCAULLEY Councilperson At Large B MANDI WILLIAMS Councilperson District 1 CHUCK ENGELKEN Mayor Pro Tem Councilperson District 2 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF LA PORTE OCTOBER 10, 2022 BILL BENTLEY Councilperson District 3 RICK HELTON Councilperson District 4 JAY MARTIN Councilperson District 5 ROBBIE McLARRIN Councilperson District 6 The City Council of the City of La Porte met in a regular meeting on Monday, October 10, 2022, at the City Hall Council Chambers, 604 West Fairmont Parkway, La Porte, Texas, at 6:00 p.m., with the following in attendance: Councilpersons present: Louis Rigby, Brent McCaulley, Mandi Williams, Chuck Engelken, Bill Bentley Rick Helton, Jay Martin, Robbie McLarrin Councilpersons attending remotely: None Councilpersons absent: Brandon Lunsford Council -appointed officers present: Corby Alexander, City Manager; Lee Woodward, City Secretary; Clark Askins, Assistant City Attorney CALL TO ORDER — Mayor Rigby called the meeting to order at 6:00 p.m. 2. INVOCATION —The invocation was given by Rev. Brian Christen, La Porte Community Church, and pledges were led by Mayor Pro Tern Engelken. 3. PRESENTATIONS, PROCLAMATIONS, AND RECOGNITIONS a. Proclamation in recognition of Fire Prevention Week. [Louis R. Rigby, Mayor] b. Proclamation in recognition of Domestic Violence Month. [Louis R. Rigby, Mayor] c. Receive annual presentation of the La Porte-Bayshore Chamber of Commerce from Jeff Martin, President, La Porte-Bayshore Chamber of Commerce. [Matt Daeumer, Assistant City Manager] 4. CITIZEN COMMENT (Generally limited to five minutes per person; in accordance with state law, the time may be reduced if there is a high number of speakers or other considerations.) Ryan Mathis spoke on the item regarding public notice requirements, asking that consideration be given to include all street and alley closures. He also asked for regular mowing of an alley near his home. 5. CONSENT AGENDA (Approval of Consent Agenda items authorizes each to be implemented in accordance with staff recommendations provided. An item may be removed from the consent agenda and added to the Statutory Agenda for full discussion upon request by a member of the Council present at this meeting.) a. Approval of the minutes of the September 26, 2022, City Council meeting. [Louis R. Rigby, Mayor] b. Approval of the Mayor's nomination and appointment of David Janda as the chair of the Tax Increment Reinvestment Zone #1 (TIRZ) Board of Directors through May 2023, pursuant to the provisions of Ordinance 1999-2325 (Section 3. Approve Fiscal Year 2022-2023 vehicle and equipment replacement purchases from Texas BuyBoard, TIPS and Sourcewell cooperative purchasing programs, totaling $1,342,772.76. [Ray Mayo, Director of Public Works] d. Authorize the Mayor to execute an agreement between the City of La Porte and the La Porte- Bayshore Chamber of Commerce for general promotional, solicitation, special programs and tourist advertising of the City of La Porte, in the annual amount of $200,000.00, for a term of three (3) years beginning on October 1, 2022, and expiring on September 30, 2026. Approve an incentive agreement between the La Porte Development Corporation and R Favorite Things, LLC, in connection with a project of the La Porte Development Corporation for infrastructure and site improvements at 114 W. Main Street in La Porte, Texas, in an amount not to exceed $390,600.00 [Mat Daeumer, Assistant City Manager] f. Appoint Frank Nance to Alternate Position 1 on the La Porte Zoning Board of Adjustment. [Councilperson Helton] g. Appoint Jon Willis to Alternate Position 2 on the La Porte Zoning Board of Adjustment. [Councilperson Martin] Mayor Rigby announced that item d would be pulled and handled separately. Mayor Pro Tern Engelken moved to approve the consent agenda items a through c, and a throughci the motion was seconded by Councilperson Bentley: the motion was adopted. 8-0. (Councilperson Martin had signed a conflict of interest affidavit and did not participate in the deliberation or vote on item d.) Mayor Pro Tem Engelken moved to authorize the Mayor to execute an agreement between the City of La Porte and the La Porte-Bayshore Chamber of Commerce for generalpromotional, solicitation, special programs and tourist advertising of the City of La Porte, in the annual amount of $200,000.00, for a term of three (3) years beginning on October 1, 2022, and expiring on September 30, 2025: the motion was seconded by Councilpersons McCaulley and Bentley: the motion was adopted, 7-0. 6. STATUTORY AGENDA a. Presentation, discussion, and possible direction on expansion of the public notice requirements from 200 feet to 1000 feet in the City of La Porte Code of Ordinances, Chapter 106. [Councilpersons Helton, Williams, and Lunsford] Mayor Rigby noted that approval of the item would send it to the Planning and Zoning Commission and that it would then come again before the City Council. Mayor Pro Tern Engelken moved to send the consideration of a change to Chapter 106 of the Code of Ordinances for an increase from 200 feet to 1000 feet to the Planning and Zoning Commission; the motion was seconded by Councilperson Helton: the motion_ was adopted, 8-0. 7. REPORTS a. Receive report of the New City Hall Ad Hoc Committee meeting. [Councilperson McCaulley] Councilperson McCaulley announced the Committee met and reviewed proposals for a new city hall. b. Receive report of the Drainage and Flooding Committee meeting. [Councilperson Martin] Councilperson Martin announced the Committee and received updates from the Harris County Flood Control District and had set the next meeting for November 14, 2022. 8. ADMINISTRATIVE REPORTS • La Porte Planning and Zoning Commission meeting, October 13 • La Porte Development Corporation Board meeting, October 24 • City Council meeting, October 24 Page 2 of 3 October 10, 2022, City Council Meeting Minutes The City Manager said there were no reports. 9. COUNCIL COMMENT Hear announcements concerning matters appearing on the agenda; items of community interest; and/or inquiries of staff regarding specific factual information or existing policy from the Mayor, Councilpersons, and City staff, for which no formal action will be discussed or taken. Councilpersons congratulated the Fire Department and Shaye Lister and the Police Department and thanked them for all they do; thanked the Chamber of Commerce for all they do; thanked Kayla Baez, Mason Peres, and the Chamber for the Kids Rodeo last weekend; and noted the Mayor and Councilpersons Bentley, McCaulley, and Martin attended the Texas Municipal League Annual Conference las-week and encountered many good things to consider for the community.
