The City Council of the City of La Porte met in a regular meeting on Monday, November 14, 2022, at
the City Hall Council Chambers, 604 West Fairmont Parkway, La Porte, Texas, at 6:00 p.m., with the
following in attendance:
Councilpersons present: Louis Rigby, Brandon Lunsford, Brent McCaulley, Mandi Williams, Chuck
Engelken, Bill Bentley Rick Helton, Jay Martin, Robbie McLarrin
Councilpersons attending remotely: None
Councilpersons absent. None
Council -appointed officers present: Corby Alexander, City Manager; Lee Woodward, City Secretary;
Clark Askins, Assistant City Attorney
CALL TO ORDER — Mayor Rigby called the meeting to order at 6:00 p.m.
2. INVOCATION -- The invocation was given by Clark Askins, Assistant City Attorney, and pledges were
led by Councilperson Brandon Lunsford.
3. PRESENTATIONS, PROCLAMATIONS, AND RECOGNITIONS
a. Recognition of 2022 City University graduates. [Louis R. Rigby, Mayor]
Sixteen citizens, members of the seventh City University cohort, were recognized.
b. Proclamation in recognition of Municipal Court Week. [Louis R. Rigby, Mayor]
c. Recognition of City employees for years of service. [Louis R. Rigby, Mayor]
Denise Mitrano, Municipal Judge for 10 years; Tom Henderson, 25 years in the Fire Department

5. CONSENT AGENDA (Approval of Consent Agenda items authorizes each to be implemented in
accordance with staff recommendations provided. An item may be removed from the consent agenda
and added to the Statutory Agenda for full discussion upon request by a member of the Council present
at this meeting.)
a. Approve minutes of the October 24, 2022, regular City Council meeting and of the special
combined meeting of the Planning and Zoning Commission and the City Council held on

b. Authorize purchase of Neptune Technology Group, Inc. meters and parts from Core and
Main, Inc. of Houston, not to exceed budgeted amounts for FY 2023. [Michael Dolby, Finance
Director)
c. Award Bid #23002 'Annual Requirements Contract for Plastic Garbage Bags' to Houston
Poly Bag I, Ltd., for the base bid amount of $242,720.00 for annual requirements and

additional stock of 6000 rolls for $39,360.00, for a total amount of $282,080.00. [Ray Mayo,

d. Approve the FY 2022 audit/asset forfeiture report and associated financial records provided
by the La Porte Police Department, as required by Chapter 59 of the Texas Code of Criminal
Procedure. [Steve Deardorff, Chief of Police]
e. Approval of $86,321.20 for expenses associated with the operation and administration of
the Senior Nutrition Program at the Norman Malone Senior Center for Fiscal year 2022 -
2023. [Tim Miller, Parks and Recreation Director]
Mayor Pro Tern Engelken moved to approve the consent agenda: the motion was seconded by
Councilperson Bentley: the motion was adopted. 9-0.
6. STATUTORY AGENDA
a. Presentation, discussion, and possible action to address merit -based adjustments for the
positions of City Manager, City Secretary, and Municipal Court Judge for the 2023 fiscal
year. [Louis R. Rigby, Mayor]
Councilperson Martin moved to suspend merit -based adjustments for the positions of City
Manager, City Secretary, and Municipal Court Judge for the 2023 fiscal year: the motion was
seconded by Mayor Pro Tern Engelken: the motion was adopted. 9-0.
b. Presentation, discussion, and possible action on recommendation from the Chapter 172
Employee and Retiree Insurance and Benefits Board to authorize the City Manager to
execute an agreement for Stop Loss insurance coverage, as part of the City of La Porte
health insurance plan, for the 2023 plan year. [Matt Hartlieb, HR Manager]
Mayor Pro Tem Engelken moved to accept recommendation from the Chapter 172 Employee and
Retiree Insurance and Benefits Board to authorize the City Manager to execute an agreement for
Stop Loss insurance coverage, as part of the City of La Porte health insurance plan. for the 2023
plan year, provided by Unum/Stealth Partner Group: the motion was seconded by Councilperson
Bentley: the motion was adopted. 9-0.
7. PUBLIC HEARINGS AND ASSOCIATED ORDINANCES
a. The City Council will hold a public hearing to receive comments on the recommendation of
the Dangerous Buildings Inspections Board for condemnation of eight (8)
dangerous/substandard structures located at 742 S. Blackwell St.; 9306 Carlow Ln.; 3217
Clarksville St.; 914 S. Broadway St.; 122 S. 161" St.; 3317 Bernard St.; and 2410 Sens Rd./0
Sens Rd. [Curtis Tarver, Deputy Building Official]
Mayor Rigby opened the public hearing at 6:40 p.m. Curtis Tarver, Deputy Building Official,
provided a presentation. He said staff recommended that no action be taken on 122 S. 16t' until
the outcome of the probate process was known. The City Manager was asked to determine if taxes
were current on any of the property
Leo Longoria spoke on behalf of Charlie Aguilar, who is closing on 914 S. Broadway tomorrow and
intends to develop residential and commercial entities at the location. Mr. Longoria said he believed
documentation could be presented to the City within 30 days. Matt Daeumer, Assistant City
Manager, said he had met with Mr. Aguilar, who believed he could possibly complete the project in
about 120 days.
Charles Patrick Hale, Jr. said he had inherited 3217 Clarksville after the death of his father and
inquired about the voluntary consent process and asked for a 180-day postponement.
Mayor Rigby closed the public hearing at 7:05 p.m.

condemnation of dangerous/substandard structures located at 2410 Sens Rd. and 0 Sens
Rd., La Porte, Texas. [Curtis Tarver, Deputy Building Official]
Mayor Pro Tern Engelken moved to adopt Ordinance 2022-3900 ordering the condemnation of
dangerous/substandard structures located at 2410 Sens Rd. and 0 Sens Rd., La Porte. Texas, the
motion was seconded by Councilperson Bentley: the motion was adopted, 9-0.
C. Consideration and possible action to adopt Ordinance 2022-3901 ordering the
condemnation of dangerous/substandard structures located at 742 S. Blackwell, La Porte,
Texas. [Curtis Tarver, Deputy Building Official]
Mayor Pro Tern Engelken moved to adopt Ordinance 2022-3901 ordering the condemnation of
dangerous/substandard structures located at 742 S. Blackwell, La Porte. Texas: the motion was
seconded by Councilperson Bentley: the motion was adopted, 9-0.
d. Consideration and possible action to adopt Ordinance 2022-3902 ordering the
condemnation of dangerous/substandard structures located at 9306 Carlow Ln, La Porte,
Texas. [Curtis Tarver, Deputy Building Official]
Councilperson Helton moved to postpone consideration of Ordinance 2022-3902 ordering the
condemnation of dangerous/substandard structures located at 9306 Carlow Ln, La Porte, Texas,
until staff attempts to make contact with the peoele living on the property: the motion was seconded
by Councilperson McCaulley: the motion was adopted, 9-0.
e. Consideration and possible action to adopt Ordinance 2022-3903 ordering the
condemnation of dangerous/substandard structures located at 122 S. 16t' Street, La Porte,
Texas. [Curtis Tarver, Deputy Building Official]
Mayor Pro Tern Engelken moved that no action be taken on 122 S. 16t" for sixty days: the motion
was seconded by Councilperson Bentley: the motion was adopted. 9-0.
f. Consideration and possible action to adopt Ordinance 2022-3904 ordering the
condemnation of dangerous/substandard structures located at 3217 Clarksville, La Porte,
Texas. [Curtis Tarver, Deputy Building Official]
Mayor Pro Tern Engelken moved that no action be taken on 3217 Clarksville, La Porte, Texas, for
six months: the motion was seconded by Councilperson Bentley, the motion was adopted. 9-0.
g. Consideration and possible action to adopt Ordinance 2022-3905 ordering the
condemnation of dangerous/substandard structures located at 3317 Bernard, La Porte,
Texas. [Richard Glass, Building Official]
Mayor Pro Tern Engelken moved to adopt Ordinance 2022-3905 ordering the condemnation of
dangerous/substandard structures located at 3317 Bernard, La Porte. Texas: the motion was
seconded by Councilperson Bentley: the motion was adopted. 9-0.
h. Consideration and possible action to adopt Ordinance 2022-3906 ordering the
condemnation of dangerous/substandard structures located at 914 S. Broadway St., La
Porte, Texas. [Curtis Tarver, Deputy Building Official]
Mayor Pro Tern Engelken moved to postpone consideration of Ordinance 2022-3906 ordering the
condemnation of dangerous/substandard structures located at 914 S. Broadway St., La Porte.
Texas, for sixty days: the motion was seconded by Councilperson Williams: the motion was
adopted. 9-0.

8. REPORTS
a. Present 411 Quarter CIP Report to City Council. [Matt Daeumer, Assistant City Manager]
Mr. Daeumer offered a presentation. Councilperson Martin asked Mr. Daeumer to consider options
to spend down some of the funds in GEN675 Community Coop Projects for the next fiscal year,
including considering increasing the City incentive match to $10,000. Mr. Daeumer agreed to bring
proposed changes to the Council.
b. Present annual review of the City of La Porte Investment Policy. [Shelley Wolny, Assistant
Finance Director]
Mrs. Wolny presented the report and noted no changes were recommended.
c. Receive report of the Fiscal Affairs Committee meeting. [Mayor Pro Tern Engelken]
Mayor Pro Tern Engelken reported the Committee met and reviewed purchasing card expenditures,
heard the favorable investment report, and considered the Investment Policy.
d. Receive report of the Drainage and Flooding Committee meeting. [Councilperson Martin]
Councilperson Martin reported the Committee met, received updates and discussed drainage
projects, and set the next meeting for January 9, 2023.
9. ADMINISTRATIVE REPORTS
• City Council meeting, December 12
• Planning and Zoning Commission meeting, November 15
The City Manager said there were no reports.
10. COUNCIL COMMENT Hear announcements concerning matters appearing on the agenda; items
of community interest; and/or inquiries of staff regarding specific factual information or existing
policy from the Mayor, Councilpersons, and City staff, for which no formal action will be
discussed or taken.
Councilpersons congratulated graduates of City University, Sgt. Novosad, service award recipients,
and Municipal Court staff; expressed their appreciation of the CIP report and Public Works for their
work on City projects; wished all a happy and safe Thanksgiving; recognized the Court's Active Shooter
training; welcpTed Ray Mayo back; and thanked veterans for their service.
