The City Council of the City of La Porte met in a regular meeting on Monday, December 12, 2022, at
the City Hall Council Chambers, 604 West Fairmont Parkway, La Porte, Texas, at 6:00 p.m., with the
following in attendance:
Councilpersons present: Louis Rigby, Brandon Lunsford, Brent McCaulley, Mandi Williams, Chuck
Engelken, Bill Bentley Rick Helton, Jay Martin, Robbie McLarrin
Councilpersons attending remotely: None
Councilpersons absent: None
Council -appointed officers present: Corby Alexander, City Manager; Lee Woodward, City Secretary;
Clark Askins, Assistant City Attorney
CALL TO ORDER — Mayor Rigby called the meeting to order at 6:00 p.m.
2. INVOCATION — The invocation was given by Pastor Philip Dunn, Lighthouse Baptist Church, and
pledges were led by Councilperson Brent McCaulley.
3. PRESENTATIONS, PROCLAMATIONS, AND RECOGNITIONS
a. Recognition of the La Porte Bulldogs Junior Varsity team win at the Youth Football and
Cheer Federation of America, Inc.'s Bayou City Bowl. [Louis R. Rigby, Mayor]
b. Recognition of City employees for years of service. [Louis R. Rigby, Mayor]
4. CITIZEN COMMENT (Generally limited to five minutes per person; in accordance with state law, the
time may be reduced if there is a high number of speakers or other considerations.)
David Janda thanked the Council for reviewing regulations concerning smoke and vape shops and the
consideration of an update, and also congratulated the Bulldogs.
5. CONSENT AGENDA (Approval of Consent Agenda items authorizes each to be implemented in
accordance with staff recommendations provided. An item may be removed from the consent agenda
and added to the Statutory Agenda forfull discussion upon request by a memberof the Council present
at this meeting.)
a. Approval of the minutes of the November 14, 2022, City Council meeting. [Louis R. Rigby,

b. Adopt Resolution 2022-22 authorizing the City Manager to execute the Texas Department of
Transportation Impaired Driving Mobilization (IDM) grant award and other documents for
the TXDOT IDM Selective Traffic Enforcement Program (STEP) Grant. [Steve Deardorff,
Chief of Police]
c. Approve rollover of requested encumbrances from City of La Porte, Texas, Fiscal Year 2022
budgetto City of La Porte, Texas, Fiscal Year 2023 budget. [Michael Dolby, Finance Director]
d. Award bid #23004'Annual Requirements Contract for Mowing Services' and authorize the
City Manager to execute a potential two (2) year and nine (9) month agreement with
NeoGlobal Enterprises, LLC dibla Horticare Landscape Management, for mowing of various
City properties, not to exceed the annual budgeted amount. [Tim Miller, Director of Parks
and Recreation]
e. Adopt Resolution 2022-23 in support of the Texas Municipal League Legislative Proposed
Program for the 2023 legislative session. [Louis R. Rigby, Mayor]
f. Authorize the City Manager to execute a renewal agreement with CentralSquare
Technologies, Inc. for the ONESolution Enterprise Resource Planning (ERP) system
software in the amount of $207,900.00 [Matt Daeumer, Assistant City Manager]
g. Approve the purchases of replacement vehicles and equipment through TIPS Cooperative
Purchasing Program contract #20026, and BuyBoard contracts #601-19 and #603-20, in
connection with Fiscal Year 2022-2023 Vehicle Replacement Program. [Ray Mayo, Director
of Public Works]
h. Reject the single bid received in response to City of La Porte Bid #23010 'Main Sewer
Rehabilitation'. [Ray Mayo, Director of Public Works]
i. Adopt Ordinance 2022-3908 for the purpose of vacating, abandoning, and closing a portion
of alleyway located southeast of Lot 20 in Block 186, Town of La Porte, north of E. Main St.
and directly west of the previously closed Ohio St. right-of-way, and authorizing execution
and delivery of a deed to adjoining landowner. [Teresa Evans, Planning & Development

Mayor Pro Tern Engeiken moved to approve the consent agenda: the motion was seconded b
Counciloerson Bentlev: the motion was adopted. 9-0.
6. PUBLIC HEARINGS AND ASSOCIATED ORDINANCES
a. The City Council will hold a public hearing to receive comments regarding the
recommendation by the Planning and Zoning Commission to adopt Ordinance 2022-3907
amending the Code of Ordinances of the City of La Porte, Texas, Chapter 106 "Zoning" by
amending regulations related to deadlines for recommendations of the Planning and Zoning
Commission, shopping center off-street parking, gas station uses, tobaccolvape shop uses,
grid -scale battery energy storage uses in commercial and industrial zones, and setbacks
for swimming pools; followed by discussion and possible action to consider adopting
Ordinance 2022-3907 amending the Code of Ordinances of the City of La Porte, Texas,
Chapter 106 "Zoning" by amending regulations related to deadlines for recommendations
of the Planning and Zoning Commission, shopping center off-street parking, gas station
uses, tobaccolvape shop uses, grid -scale battery energy storage uses in commercial and
industrial zones, and setbacks for swimming pools. [Teresa Evans, Planning & Development

The Mayor opened the public hearing at 6:23 p.m. Pastor Phillip Dunn spoke against limitation of
legal businesses. The Mayor closed the public hearing at 6:47 p.m. Councilperson Martin moved
to adopt Ordinance 2022-3907 amending the Code of Ordinances of the City of La Porte, Texas,
Chapter 106 "Zoning" by amending regulations related to deadlines for recommendations of the
Planning and Zoning Commission, shopping center off-street parking, gas station uses,
tobaccolvape shop uses, grid -scale battery energy storage uses in commercial and industrial
zones, and setbacks for swimming pools; the motion was seconded by Mayor Pro Tern Engelken.
Councilperson Williams moved to consider the amendments individually: Councilperson McCauliev
seconded the motion: the motion to consider the amendments individually was adopted. 9-0.
Items in Ordinance Sections 1 (Ch. 106 Section 106-171), 2 (Ch. 106 Section 946). 3 (Ch. 106
Section 106-839), 4 (Ch. 106 Section 106-310 for Grid -Scale Battery Energy Storage), and 7 (Ch_.
106 Section 106-748) were adopted,_9-0.
Item in Ordinance Section 5 (Ch. 106 Section 106-310 for 44711 Gasoline Stations with
Convenience Stores) was adopted, 6-3, Councilpersons Helton, McCaulley, and Williams voting
against.
Item in Ordinance Section 6 (Ch. 106 Section 106-310 for 453991 Tobacco and Smokers' Supply
Stores and 453998 for All Other Miscellaneous -Store Retailers (except Tobacco, E-Cigarette and
Vape Stores) was adopted. 6-3, Councilpersons Williams. Bentley, and Helton voting against.
7. STATUTORY AGENDA
a. Presentation, discussion, and possible action to provide administrative staff with direction
concerning the Little Cedar Bayou Wave Pool Splash Pad project. [Tim Miller, Parks &
Recreation Director]
Mayor Pro Tern Engelken moved to give direction to accept option 2; the motion was seconded by
Councilperson Bentley: the motion was adopted. 9-0.

The City Manager reminded Council of the City Christmas party this Friday.
9. COUNCIL COMMENT Hear announcements concerning matters appearing on the agenda; items
of community interest; and/or inquiries of staff regarding specific factual information or existing
policy from the Mayor, Councilpersons, and City staff, for which no formal action will be
discussed or taken.
Councilpersons congratulated the Bulldogs, Nick Meekins, and Asst. Police Chief Doug Ditrich;
announced the Fencing Ad Hoc Committee had met and voted to open the application period for
January to March 2023; noted that the Mayor had presented a proclamation to Diane Sheridan, who
was retiring from the La Porte Citizens Advisory Committee after 25 years; shared that the East Harris
County Manufacturers' Association annual meeting, which was very interesting; regarding the Chapter
106 ordinance, noted that business owners can still open the types of businesses they wish to but will
have to come to the Planning and Zoning Commission and City Council; and wished all a Merry
Christmas and Happy New Year.
10. EXECUTIVE SESSION
a. Texas Government Code Sec. 551.071(1)(A) -Pending or Contemplated Litigation. The City
Council will meet in closed session with the City Manager and Assistant City Attorney to
discuss the status of City of La Porte vs. Darius Anthony Meza, Cause No. 2022-32341
[Clark Askins, Assistant City Attorney; Corby Alexander, City Manager]
b. Texas Government Code Section 551.072 - Deliberation regarding the purchase,
exchange, lease, or value of real property. The City Council will meet in closed session
with the City Manager and Assistant City Attorney to discuss the purchase of vacant real
property legally described as Block 1254, Town of La Porte, and located adjacent to the
Bay Forest Golf Course.
The Council adjourned into executive session at 7:15 p.m.
11. RECONVENE into open session and consider action, if any, on item(s) discussed in executive
session.
