Askins, City Attorney; Officers Present: Lee Woodward, City Secretary The City Council of the City of La Porte met in a regular meeting on February 26, 2024, at the City Hall Council Chambers, 604 West Fairmont Parkway, La Porte, Texas, at 6:00 p.m. 1. CALL TO ORDER Mayor Rigby called the meeting to order at 6:00 p.m. 2. INVOCATION/PLEDGES INVOCATION - The invocation was given by Reverend Brian Christen, La Porte Community Church, and the pledges were led by Councilperson Rick Helton. 3. PRESENTATIONS, PROCLAMATIONS, AND RECOGNITIONS Employee Service Awards 4. CITIZEN COMMENT (Generally limited to rive minutes per person; in accordance with state law, the time may be reduced if there is a high number of speakers or other considerations.) There were no comments. Page 4 of 253 5. CONSENT AGENDA (Approval of Consent Agenda items authorizes each to be implemented in accordance with staff recommendations provided. An item may be removed from the Consent Agenda and added to the StatutoryAgenda for full discussion upon request by a member of the Council present at this meeting.) a. Approve the minutes of the February 12, 2024, regular City Council meeting. [Lee Woodward, City Secretary] b. Approve appointments of Officers Jeffrey Tippit and Emily Harness to the La Porte Police Department Police Reserve Force. [Bennie Boles, Acting Chief of Police] C. Authorize the City Manager to execute an interlocal agreement with the Texas Department of Transportation to share incident information on State Highway 225 and State Highway 146. [Bennie Boles, Acting Chief of Police] d. Main Street Alleys Project Award Bid 24008 "Main Street Alleys Asphalt Reconstruction and Overlay" to AAA Asphalt Paving Inc. and authorize the City Manager to execute a construction contract in the amount of $190,880.00, providing a construction contingency of $47,000.00 and geotechnical testing services for $10,000.00 for a total authorization of $247,880.00. Water and Sanitary Sewer Service Agreement Adopt Ordinance 2024-3970 authorizing the City Manager to execute a Water Service Agreement and a Sanitary Sewer Service Agreement between the City of La Porte, Texas, and North Bayport Industrial District II, Ltd. for its development at 9650 New Decade Drive, in the Bayport Industrial District. [Ray Mayo, Director of Public Works] Mayor Pro Tern Enoelken moved to adopt the Consent Aaenda� the motion was seconded by Councilperson Bentley: the motion was adopted 8-0 6. PUBLIC HEARINGS AND ASSOCIATED ORDINANCES a. SCUP 23-910000005- La Jet Porte The City Council will hold a public hearing to receive comments regarding a recommendation by the Planning and Zoning Commission to adopt Ordinance 2024-3969 amending the Code of Ordinances of the City of La Porte, Chapter 106 "Zoning" by granting Special Conditional Use Permit (SCUP) 23-91000005, to allow for the construction and operation of aircraft storage facilities, specifically one tee hangar (approximately 60' x 325') and four box hangars (approximately 70' x 70' each), within the Planned Unit Development (PUD) zoning district, on a 1.65acre lease space within the Page 5 of 253 approximately 300-acre La Porte Airport site, located at 10937 Spencer Highway, and legally described as Tract No. 1, Lease at La Porte Municipal Airport, FAA LID T-41, City of La Porte, Texas, being a part of Lots 1-3 and TR 4A, Block 1 and Lots 1-4 and TR 5, Block 2 (IMPS *0382340010010 Payne WJ), Harris County, Texas; followed by discussion and possible action to consider adopting Ordinance 2024- 3969 amending the Code of Ordinances of the City of La Porte, Chapter 106 "Zoning" by granting Special Conditional Use Permit (SCUP) 23- 91000005, to allow for the construction and operation of aircraft storage facilities, specifically one tee hangar (approximately 60' x 325') and four box hangars (approximately 70' x 70' each), within the Planned Unit Development (PUD) zoning district, on a 1.65-acre lease space within the approximately 300-acre La Porte Airport site, located at 10937 Spencer Highway, and legally described as Tract No. 1, Lease at La Porte Municipal Airport, FAA LID T-41, City of La Porte, Texas, being a part of Lots 1-3 and TR 4A, Block 1 and Lots 1-4 and TR 5, Block 2 (IMPS *0382340010010 Payne WJ), Harris County, Texas. [Teresa Evans, Director of Planning and Development] Mayor Rigby opened the public hearing at 6716 p.m. Teresa Evans provided an overview. Cheryl Christen spoke of her Flooding concerns. Mayor Rigby REPORTS a. Receive the La Porte Police Department annual racial profiling report in accordance with Article 2.132 (7) of the Texas Code of Criminal Procedure. [Bennie Boles, Acting Chief of Police] Acting Chief of Police Bennie Boles presented the report. b. Receive report of the February 26, 2024, La Porte Development Corporation Board of Directors meeting. [Mayor Pro Tern Engelken] Page 6 of 253 Mayor Pro Tem Engelken said the Board met and conducted a public hearing and approved a development grant for a project at 321 West Main, postponed consideration of an incentive grant for murals at 321 West Main, approved the second incentive payment for 508 West Main Street, received staff updates, and set the next meeting for March 25. 8. ADMINISTRATIVE REPORTS • City Council meeting, March 11, 2024 Mr. Alexander said there were no reports. 9. COUNCIL COMMENT Hear announcements concerning matters appearing on the agenda; items of community interest; and/or inquiries of staff regarding specific factual information or existing policy from the Mayor, Councilpersons, and City staff, for which no formal action will be discussed. Councilpersons congratulated and thanked the employees recognized for their years of service and shared the success of the Black History Month event at the Colored School on Saturday. 10.
