Askins, City Attorney, Lee Woodward, City Secretary The City Council of the City of La Porte met in a regular meeting on September 23, 2024, at the City Hall Council Chambers, 604 West Fairmont Parkway, La Porte, Texas, at 6:00 p.m. t. CALL TO ORDER - Mayor Helton called the meeting to order at 6:02 p.m. 2. INVOCATION/PLEDGES - The invocation was given by Reverend Jackie King of Victory Tabernacle and the pledges were led by Ryder Greenawalt. 3. PRESENTATIONS, PROCLAMATIONS, AND RECOGNITIONS a. Recognition of Employees for Years of Service [Scott Pullig, Chief of Police] - Detective Jorge Saldivar - 10 years of service (not present) - Officer Tracy Phelan - 25 years of service b. Presentation on the Energy Transfer Pipeline Incident. [Johnny Morales, Emergency Management Coordinator] Emergency Management Coordinator Johnny Morales provided updates on Hurricane Beryl debris removal completion and the Energy Transfer/Deer Park Pipeline Fire. 4. CITIZEN COMMENT - (Generally limited to five minutes per person; in accordance with state law, the time may be reduced if there is a high number of speakers or other considerations.) Michael Stone said he was interested in purchasing the property on McCabe Road to be discussed in tonight's public hearing. 5. CONSENT AGENDA - (Approval of Consent Agenda items authorizes each to be implemented in accordance with staff recommendations provided. An item may be removed from the Consent Agenda and added to the Statutory Agenda for full discussion upon request by a member of the Council present at this meeting.) a. Approve the minutes of the September 9, 2024, regular City Council meeting. [Lee Woodward, City Secretary] b. Adopt Ordinance 2024-4005, appointing the Municipal Court Judge and Alternate Judges for the La Porte Municipal Court of Record. [Judge Janikka Bretton] c. Pipeline Permit- Altivia Specialty Chemicals -Approve issuance of a pipeline permit to Altivia Specialty Chemicals to install approximately 569.30 feet of a 6.625-inch wastewater pipeline within the City of La Porte, Texas. [Malik Michel, Engineering Manager] d. EMS equipment purchase from Stryker - Authorize the purchase of three (3) Lifepak 15 cardiac monitors for $131,675.31, one (1) Power Pro stretcher for $35,935.20, two (2) Power Pro bariatric upgrades for $8442.00, and one (1) Power Load assembly for $30,919.60, from Stryker for a total cost of $206,972.01. Certified Appraisal Roll -Adopt Resolution 2024-19 accepting the 2024 Harris County Appraisal Districts certified appraisal roll for property situated within the City of La Porte, Texas. Award Bid #24015 Water Treatment Plant Chemicals - Award Bid #24015 "Annual Requirements for Water Treatment Plant Chemicals" to PVS DX Inc., not to exceed annual budgeted amounts. [Ray Mayo, Director of Public Works] g. Award Bid #24014, Black Base and Type D Asphalt - Award Bid #24014 "Annual Requirements for Asphalt; Black Base and Type D" to American Materials not to exceed annual budgeted amounts. [Ray Mayo, Director of Public Works] h. La Porte Community Civic Club Harvest Banquet Sponsorship -Approve the request from the La Porte Community Civic Club for sponsorship of the 431d Annual Harvest Banquet in an amount up to $2,600.00. [Matt Daeumer, Assistant City Manager] Mayor Pro Tern Engelken moved to adopt the consent agenda the motion was seconded by Councilperson Bentley the motion was adopted 8-0 Following the adoption of the Consent Agenda, Mayor Helton swore in Municipal Judge Janikka Bratton. She was accompanied by her mother, Elaine Marshall, the Presiding Judge for the City of Houston. 6. PUBLIC HEARINGS AND ASSOCIATED ORDINANCES a. Ordinance 2024-4018 for SCUP 2024-0001 -The City Council will hold a public hearing to receive comments regarding a recommendation by the Planning and Zoning Commission to adopt Ordinance 2024-4018 amending the Code of Ordinances of the City of La Porte, Chapter 106 "Zoning" by granting Special Conditional Use Permit SCUP-2024-0001, a request by Michael Stonelapplicant on behalf of Richard and Kelli Lannie/owners, for approval of Special Conditional Use Permit (SCUP) SCUP-2024-0001, to allow for the development of a single-family home, on an 11.8acre tract of land in the Planned Unit Development (PUD) zoning district, located at 911 Mc Cabe Rd., La Porte, Texas, and legally described as Tract 5D, Abstract 30 W P Harris, Harris County, Texas; followed by discussion and possible action to consider adopting Ordinance 2024-4018 amending the Code of Ordinances of the City of La Porte, Chapter 106 "Zoning" by granting Special Conditional Use Permit SCUP-2024-0001, a request by Michael Stonelapplicant on behalf of Richard and Kelli Lannielowners, for approval of Special Conditional Use Permit (SCUP) SCUP-2024-0001, to allow for the development of a single- family home on an 11.8-acre tract of land in the Planned Unit Development (PUD) zoning district, located at 911 Mc Cabe Rd., La Porte, Texas, and legally described as Tract 5D, Abstract 30 W P Harris, Harris County, Texas. Mayor Helton closed the public hearing at 6:32 p.m. Councilperson Martin moved to adopt Ordinance 2024-4018 amending the Code 7. STATUTORY AGENDA a. Property Tax Rate - Presentation, discussion, and possible action to adopt Ordinance 2024-4020, setting the City of La Porte, Texas' ad valorem tax rate and levying taxes on taxable property located in the City of La Porte, Texas, for the 2024-25 Fiscal Year. [Michael Dolby, Finance Director] This item was pulled and not considered. b. Residential Generator Grant - Presentation, discussion, and possible direction for administrative staff on Residential Generator Grant Program. [Matt Daeumer, Assistant City Manager] Assistant City Manager Matt Daeumer provided a report. Councilperson Martin moved to Proceed with paving out the applicants that have been approved and move ahead to award additional applicants up to the amount budgeted the motion was seconded by Mayor Pro Tern Engelken c. Service Agreement for BodyWorn by Utility body cameras and Rockets for EMS - Authorize the City Manager to execute a Service Agreement between the City of La Porte, Texas, and BodyWorn by Utility for the body worn cameras and communication equipment package, under BuyBoard Contract #568-18, in the amount of $53,000.00 in year one (1) and $31,150.00 in years two (2), three (3), four (4) and five (5) with a total cost of $178,000.00 over a five- (5-) year period. Award Bid #24011, Brookglen Subdivision Drainage Improvements to Branch Construction Group, LLC - Award Bid #24011 'Brookglen Subdivision Drainage Improvements" to Branch Construction Group, LLC, and authorize the City Manager to execute a construction contract in the amount of $12,318,155.00, with a construction contingency of $1,231,815.00, for a total authorization of $13,549,970.00. Planning and Zoning Commission appointments/re-appointments - Presentation, discussion, and possible action to approve the appointment of current Planning and Zoning District 5 Commissioner Victor Peres as the Chairman/Mayor's Appointee and of Dewey Walls as the new Planning and Zoning District 5 Commissioner. [Mayor Helton and Councilperson Martin] 8. REPORTS a. Report of the LaPorte Development Corporation Board of Directors meeting. [Mayor Pro Tem Engelken] Mayor Pro Tern Engelken said the Board had met, received an update from Ed Revak on his plans for the building at 228 West Main Street, awarded an enhancement grant not to exceed $6,200 for enhancements at Sam and Dave's; and opened a 60-day comment period for a potential project at 1001 S. Highway 146 for an incentive payment up to $587,093.00. 9. ADMINISTRATIVE REPORTS • Drainage and Flooding Committee, October 14 • City Council, October 14 • Planning and Zoning Commission, October 17 Finance Director Michael Dolby provided a fund balance update. 10.COUNCIL COMMENT - Hear announcements concerning matters appearing on the agenda; items of community interest; and/or inquiries of staff regarding specific factual information or existing policy from the Mayor, Councilpersons, and City staff, for which no formal action will be discussed. Councilpersons thanked staff for their concerted pipeline fire response, especially the first responders and noted the community's appreciation of communications during the event; shared the success of the Chamber's First Responder's Golf Tournament; TML T E A A S OFFICIAL BALLOT Texas Municipal League (TML) Region 14 Director Election This is the official ballot for the election of the Region 14 director of the TML Board of Directors. You received this ballot because you are the city's primary contact person with TML. Each TML member city is entitled to one vote, which vote must be cast by a majority vote of the city's governing body. M� r Signature Authorized Official 1 _ (Title Printed Name of Authorized Official Printed Name of City Region 14 Director Candidate Biographies Frank W. Robinson, Councilmember, Shenandoah Frank W. Robinson, BA, MPA, ICMA-CM (Retired) is an elected member of the City of Shenandoah City Council and an accomplished public administrator. He holds a bachelor's degree from the University ofNorth Texas and a Master of Public Administration degree from Sam Houston State University. After 38 years of public service, 29 of those years as a chief administrative officer and city manager in Texas and California, Mr. Robinson retired in 2017. Mr. Robinson began his public service career as a police officer in Denton, eventually receiving an appointment as chief of police in the City of West University Place before transitioning to city management. He is best known for his role in the development of The Woodlands downtown. Mr. Robinson served 14 years as the president and township manager for The Woodlands Township (formerly known as the Town Center Improvement District of Montgomery County). Mr. Robinson led the organization through visioning and goal setting to define the Township's vision and mission as a local government focused on creating public benefit. In 2020, Frank came out of retirement to assist the City of Coaroe in the position of downtown manager and implemented the newly adopted Downtown Conroe Development Plan that promotes the historical preservation and economic development of downtown Comoe. Mr. Robinson successfully attracted new entertainment and dining venues to the downtown's central business district, brought in an estimated $54 million in new development investment, and facilitated the recertification of Conroe as a Texas Main Street Community and receiving the coveted cultural district designation by the Texas Commission on the Arts. In January 2023, Mr. Robinson retired once again and was elected to the City of Shenandoah's City Council in May 2024. He remains an active member of the Texas City Managers Association. Joe Zimmerman, Mayor, Sugar Land (Incumbent) Mayor Zimmerman was elected the 10th mayor of Sugar Land on June 11, 2016, after serving four years as the at -large, position 2, city councilman. He is currently serving his fourth and final term as mayor. He serves on the Finance & Audit, Economic Development and Intergovernmental Relations Committees of the City of Sugar Land and is the City's representative on the HGAC Board and Transportation Policy Council. He is a past president of Texas Municipal League (TML) Region 14 and currently represents Region 14 on the TML Board of Directors. Mr. Zimmerman is a Senior - ' Consultant for HalffAssociates, Inc., a Texas -based civil engineering consulting firm founded in 1950. He has extensive business experience, having served in senior management positions in a number of different industries. Mr. Zimmerman earned his BSCE from the University of Houston, an MBA from Houston Baptist University, and is a licensed professional engineer in the State of Texas. He and his wife of 48 years, Nancy, have lived in Sugar Land since 1990 and are active members of Second Baptist Church Woodway. Their daughter, Allison, her husband Chris Wallace, granddaughter Emmy and grandson Campbell live in Houston.
