Mayor Virginia Cline also attended. The meeting was called to order by the Chairman, Keith Trainer. The minutes of the February 17, 1983 meeting were read and approved. Chief Freeman presented the new Police Department employee evaluation forms which were developed by TCLEOSE -for the La Porte Police Depart- ment. =:e stated that he is very pleased with .them. After going over the evaluation forms, Commissioners' Longnecker and Randall expressed that they were in agreement with Chief Freeman and that they were very impressed with the new forms. Chairman Trainer stated that he felt that TCLEOSE did an excellent job on the forms. [4eldon Randall made a motion to adopt the evaluation forms. Motion carried. • Chief Freeman informed the Commission that Mr. Bob Berard from TCLEOSE will be here on August 3rd and 4th to have an orientation on the new La Porte Police Department Rules and Regulations. Chief Freeman informed the Commission that he is very happy with the format and new procedures can be inserted and implemented at any time. A general discussion followed concerning various aspects of the Departmental Rules. Chief Freeman stated that the Commission and Council both will have to adopt these Rules and Regulations. Jim Longnecker made a motion to adopt the Rules and Regulations and presented by TCLEOSE. Weldon Randall seconded and the motion carried. Chief Freeman gave an explanation on the PAF exams which are being offered by Wollack and Associates. Commission members were given a sample of the test to enable them to see how it worked. Chief Freeman stated that he would like to be able to give this exam to all entrance applicants. Weldon made a motion to give PAF exams to all entrance applicants; Jim seconded. Motion carried. (Administrative Reports) Chief Freeman informed the Commission about a Seminar given by TML on arbitration. There being no further business, the meeting was adjourned at 4:32 p.m. • - ~ Keith Trainer, Chairman Mary Davis, Director Civil Service Commission Civil Service .., , , - • • TEST SERVICES AND SECURITY AGREEMENT THIS AGREEMENT is entered into this 22 day of February 198 3 , by and between WOLLACK ~ ASSOCIATES, A PSYCHOLOGICAL CORPORATION (hereinafter referred to as "WA") , and La Porte a governmental entity in the State of referred to as the "Agency"). Texas (hereinafter WITNESSETH WHEREAS, the Agency wishes to utilize or inspect written employment tests and /or other personnel selection materials published or otherwise offered by WA, and, WHEREAS, WA does not provide employment tests or other confidential materials to agencies or persons who have not agreed to accept and abide by certain conditions concerning the use of such materials, NOW, THEREFORE, THE PARTIES HERETO DO MUTUALLY AGREE AS FOLLOWS: I. SCOPE OF AGREEMENT The scope of this agreement is limited to the rental or inspection of employ- ment examinations and such incidental services as may be requested by the Agency. 11. TERM OF AGREEMENT This agreement shall remain in effect until terminated by either party. III. COMPENSATION Rental rates and any other fees for services shall be calculated in accordance with rate schedules published by WA and which are current as of the date upon which the Agency requests examination materials or related services. IV. METHOD OF PAYMENT WA shall periodically submit invoices to the Agency for services rendered and the Agency shall pay said invoices within 30 days following receipt thereof. -1- r '' ` ' y • • In the case of examination rental rates which are predicated upon the number of candidates tested, a duly authorized representative of the Agency shall complete and forward a notarized certification as to the number of candidates actually tested with examinations provided by WA and all invoices shall be prepared on the basis of these certifications. V. REQUEST FOR SERVICES No services or materials shall be provided except as specifically requested by an authorized representative of the Agency. Requests for services must be made in writing in accordance with procedures which may from time-to-time be specified by WA. VI. TRANSMITTAL OF TEST MATERIALS Test materials shall be shipped to the Agency in a timely fashion upon receipt of the Agency's request by WA. In the event that the Agency leases WA tests, the Agency shall return all test booklets, scoring keys and other materials to WA within 45 days of their receipt unless other arrangements have been made and agreed to in writing by WA. Materials not returned on time will be subject to a surcharge amounting to 10$ of the original rental fee. In the event that the Agency requests inspection copies of WA tests, the Agency shall return all test booklets and scoring keys within .ten days of receipt. The Agency shall return test materials to WA in a manner specified by WA and shall be responsible for and shall prepay all return shipping costs. VII. SECURITY OF TEST MATERIALS Test materials obtained from WA shall be utilized only for the official and legitimate purposes of the Agency in evaluating candidates for employment and /or promotion. Under no circumstances will materials provided by WA be made available to candidates or other unauthorized persons for the purpose of study, review, duplication, or publication. This prohibition includes circumstances in which a candidate may otherwise be given the opportunity to review a keyed or unkeyed copy of an examination in order to resolve an appeal or complaint. - 2- i ~ ~' , • • All testing materials provided by WA and in the possession of the Agency shall be handled and stored in a manner that will prevent unauthorized persons from having access to them. No official, employee, consultant, or other agent of the Agency shall loan, give, sell, or otherwise make available to any other agency or person any of the test materials provided by WA, nor shall they knowingly permit others to do so. I f any test materials provided by WA should become the subject of legal proceedings conducted by a court of law, the Agency shall inform the court of the existence and terms of this agreement, and shall request that all confidential test materials be the subject of a protective order that safeguards their confidentiality. In the event that test materials provided by WA become the subject of litigation, the Agency shall immediately notify WA. VIII. LIMITATIONS AND EXCLUSIONS Nothing contained in this agreement nor in materials provided by WA shall be interpreted as representing or warranting, directly or indirectly, that the use of examinations offered or provided by WA will be sustained by any court or governmental agency, and the Agency agrees that WA shall in no way be responsible for such litigation or administrative review or liable for the consequences thereof. The Agency shall maintain an awareness of its responsibilities as an employer. under federal statutes, compliance agency guidelines, and professional standards and shall in no way conclude that this agreement reduces or otherwise alters those responsibilities. The Agency shall comply with generally accepted practices for the handling, use, and administration of employment testing procedures, including those specified by the American Psychological Association. IX. CANCELLATION OF REQUESTS FOR SERVICES In the event that the Agency finds it necessary to cancel a previous request for services, the Agency shall pay the minimum handling charges specified in the current rate schedule for the examination materials that have been requested. -} ,.. • • r~ IN WITNESS WHEREOF, the parties have executed this agreement as of the date hereabove set forth. I consider it an honor to have been appointed and re- cently reappointed to this position. It was a very informative experience and a pleasure to have served with Mr. Keith Trainer and Mr. Weldon Randall, my Co-Commissioners.
