HomeMy WebLinkAbout10-27-06 Civil Service Commission Meeting minutes Police Civil Service Commission Meeting Minutes 10-27-06 12:10 pm The Police Civil Service Commission Meeting was called to order by Commission Chairman, Keith Trainer. Commission members in attendance: Commission Chair, Mr. Keith Trainer, Vice-Chair, Mr. Les Bird and Commissioner, Larry Cox. Others in attendance: City Attorney, Clark Askins, Police Chief Richard Reff and Director Civil Service, Robert Swanagan. Commission reviewed the City of La Porte Police Officers' Rules and Regulations. Chief Reff noted the addition of Chapter # 15 Military Time Leave Account. He indicated that since it had been in effect only one officer has donated time. At the present time there is not any officer that is on military duty; however a Military Time Leave Account is required by 143. Commissioners received hard copies of the new Rules and Regulations. A form for Commissioners approval signatures will be prepared and given to the Human Resources Department for their signatures. Once all commissioners have signed it copies will be distributed to all police personnel. Also, a cover sheet with the rendering of the new police station will be added to the Rules and Regulations. Motion was made by Keith Trainer to approve the new Police Officers' Rules and Regulations. Larry Cox seconded the motion and the motion was approved by the Commission members. The next planned order of business administering the Oath of Office to Keith Trainer as Commission Chairman was changed until a Notary could be located. Next Chief Reffupdated the Commission on pending Arbitrations: ChiefReff indicated in reference to Bob King there was a 3rd Party Hearing Examination pending. Carl Davis was given a three (3) day suspension in reference to Mr. Perez. and filed an appeal for a 3rd Party Hearing Examiner. Carl has since pleaded out on assault. Carl also submitted a letter withdrawing his appeal. No further action will be taken. ChiefReff and Clark Askins briefed the Commission on Meet and Confer. Both indicated it was CLEAT driven and approved by TML. A Meet and Confer Agreement does not have to the meet Civil Service Rules, it can be changed. The question was raised, what is the impact of cost of overtime with regards to FSLA? Another question was asked; in the Bargaining Agreement is there a requirement of budget allocation for bargaining in "good faith' in the language of Meet and Confer? It was suggested to discuss this with Labor Attorney Betty Lynn. ChiefReff discussed the Police Cadet position indicating the pay for the position would be at 4% below Patrolman pay. Cadets would have an eighteen (18) month Probationary Period and it would not be a Civil Service position. The Offer Letter would document the conditions of the offer. Next, we moved back to the order of business; the administration of the Oath of Office to Keith Trainer- Clark Askins administered the Oath of Office to Keith Trainer and Bonnie Garrison from the City Secretary's Office notarized the document signed by Keith Trainer. Motion was made by Keith Trainer to schedule the next meeting on 1-31-07. Larry Cox seconded the motion and the motion was approved by the Commission members. The Commission will re-appoint the Chair and Vice- Chair at the January meeting. With there being no further business the meeting was adjourned by Chairman Keith Trainer at 1:37 pm.
