Fairmont Parkway La Porte, Texas 77571 281-470-5019 Minutes of the City of La Porte Civil Service Commission Meeting Held February 11, 2016, at 1:00 p.m. The Civil Service Commission of the City of La Porte met in a meeting on Thursday, February 11, 2016, at the City Hall Council Chambers, 604 West Fairmont Parkway, La Porte, Texas, at 1:00 p.m. to consider the following items of business: 1. Call to Order The meeting was called to order at 1:00 p.m. Members present: Keith Trainer, Les Bird, and Debra Gallington. Director Patrice Fogarty was also present. 2. Consider approval of minutes from the February 2, 2016, meeting. Commissioner Gallington made a motion to approve the February 2, 2016, minutes as presented. Commissioner Bird seconded the motion. Motion passed unanimously. 3. Open hearing and take action concerning the appeal of certain test questions missed by a candidate on the Promotional Examination for Rank of Sergeant which was administered on January 18, 2016, in accordance with Chapter 143, Local Government Code, and the City of La Officers present: M. Novosad, R. Gonzalez and J. Plemons Question 13, appealed by Officer Novosad: Officer Novosad had no further response to this appealed question. Commissioner Bird made a motion to keep the answer the same as the original test key. Chairman Trainer seconded the motion. Motion passed unanimously. Question 44, appealed by Officer Novosad: After discussing this question, and taking into account comments from Justex that the correct answer is B and not D as was on the grading key, there is a change on the correct answer to this question. Commissioner Gallington made a motion stating B is the correct answer. Commissioner Bird seconded the motion. Motion passed unanimously. Question 45, appealed by Officer Novosad: After discussing this question, and taking into account comments from Justex that both A and B are acceptable answers, the dual correct answers are both A and B. Commissioner Gallington made a motion stating both A and B are correct answers. Chairman Trainer seconded the motion. Motion passed unanimously. Question 54, appealed by Officers Gonzalez and Novosad: Going off the record at 1:17 p.m., Director Fogarty left the meeting to retrieve the test questions. Back on the record at 1:19 p.m. After discussing this question, Commissioner Gallington made a motion to keep the answer the same as on the original test key. Chairman Trainer seconded the motion. Motion passed unanimously. Question 56, appealed by Officer Novosad: After discussing this question, Commissioner Bird made a motion to keep the answer the same as on the original test key. Commissioner Gallington seconded the motion. Motion passed unanimously. Question 66, appealed by Officer Gonzalez: After discussing this question, Chairman Trainer made a motion to keep the answer the same as on the original test key. Commissioner Bird seconded the motion. Motion passed unanimously. Question 70, appealed by Officers Plemons, Novosad and Gonzalez: After discussing this question and Commissioner Gallington stating that the question is misleading, Commissioner Bird made a motion to allow more than one correct answer, with both A and C being correct. Commissioner Gallington seconded the motion. Motion passed unanimously. Question 78, appealed by Officer Gonzalez: After discussing this question and taking into account comments from Justex, Commission Bird made a motion to eliminate this question. Commissioner Gallington seconded the motion. Motion passed unanimously. Question 81, appealed by Officers Gonzalez and Plemons: After discussing this question, Commissioner Bird made a motion to keep the answer the same as on the original test key. Chairman Trainer seconded the motion. Motion passed unanimously. Question 86, appealed by Officer Gonzalez: After discussing this question, Commissioner Gallington made a motion to keep the answer the same as on the original test key. Commissioner Bird seconded the motion. Motion passed unanimously. Question 91, appealed by Officer Gonzalez: After discussing this question, Commissioner Gallington made a motion to keep the answer the same as on the original test key. Commissioner Bird seconded the motion. Motion passed unanimously. Question 92, appealed by Officer Gonzalez: After discussing this question, Commissioner Gallington made a motion to keep the answer the same as on the original test key. Commissioner Bird seconded the motion. Motion passed unanimously. The hearing closed at 2:07 p.m. Director Fogarty was instructed to rescore all candidates score sheets. HR Manager Matt Hartleib helped in this regard. 4. Discussion/Action Certify the Promotional Eligibility List for Rank of Sergeant. Director Fogarty read the list to be certified in the order of scoring. Ties had to be broken by years of service. The Commission certified the list, and all three commissioners signed off on it. Chairman Trainer stated they did not need a motion to adopt the certified list. 5. Commission Comments Matters appearing on agenda; Inquiry of staff regarding specific factual information or existing policy. There were no comments by the Commissioners. 6. Administrative Reports. There were no administrative reports. 7. Set date for next meeting. No future meeting date was set. 8. Adjourn Commissioner Bird made a motion to adjourn the meeting. Commission Gallington seconded the motion. Motion passed unanimously.
