MEMBER Councilmember District 3 MINUTES OF DRAINAGE AND FLOODING COMMITTEE December 5, 2011 The Drainage and Flooding Committee of the City of La Porte met on Monday, December 5, 2011, at the City Hall Council Chambers, 604 West Fairmont Parkway, La Porte, Texas, at 5:00 p.m. to consider the following items of business: 1. Call to Order Chairman Mike Mosteit called the meeting to order at 5:03 p.m. Members of the Drainage and Flooding Committee present: Chairman Mike Mosteit and Committee Members Chuck Engelken, John Zemanek and Alternate Member Daryl Leonard. Councilmember Dottie Kaminski was also present at the meeting. Absent: Vice Chairman Mike Clausen. Members of City Executive Staff and City Employees Present: City Manager's Office: Steve Gillett and Traci Leach City Secretary's Office: Sharon Harris Planning Department: Tim Tietjens, Julian Garza and Brian Sterling Public Works Department: Dave Mick Consider approval of amended Minutes of the Drainage and Flooding Committee Meeting held on July 11, 2011 and Minutes of the Drainage and Flooding Committee Meeting held on August 4, 2011— S. Harris Alternate Committee Member Leonard moved to approve the minutes as presented. Committee member Zemanek seconded. MOTION PASSED. Ayes: Chairman Mosteit, Committee members Engelken, Zemanek and Alternate Member Leonard Nays: None Absent: Vice Chairman Mike Clausen 3. Receive presentation by Texas Energy Coalition or its membership regarding regulatory framework of pipeline industry and discuss areas of concern regarding pipeline/drainage conflicts — T. Tietjens Planning Director Tim Tietjens informed the Drainage and Flooding Committee Members the Texas Energy Coalition and its membership were present to address concerns of existing pipelines, the ability to perform drainage projects due to pipelines and construction practices. Chairman Mosteit requested the Texas Energy Coalition to offer solutions and improvements for De -silting projects in addition to protecting homes and pipelines during heavy rainfall. Alternate Committee Member Leonard questioned if adding new pipelines across current drainage areas could create issues or restrict drainage. Chairman Mosteit commented a recent ordinance had been adopted addressing the depth of new pipelines and not restricting the flow of drainage and prior ordinances were to protect pipelines. Chairman Mosteit also commented pipeline corridors are hindering improvements of drainage projects in the community. Page 1 of 2 December 5, 2011, Drainage and Flooding Committee Minutes Planning Director, Tim Tietjens added the F101 Project was being affected by pipeline corridors and requested solutions to resolve current issues. Haskel Rogers with ExxonMobil advised ExxonMobil owned the majority of the pipelines in the areas of concern. Mr. Rogers advised the committee, when new pipelines are constructed across flood control ditches or rivers, ExxonMobil verifies with the governing authorities and construct pipelines to accommodate current and future plans. Mr. Rogers informed pipelines inside F101 date back to the 1930's and understands there is an issue with flood control and ExxonMobil is willing to work with the city to resolve concerns. Mr. Rogers requested clarification of the cause of flooding along the pipelines corridors from the committee. Chairman Mosteit responded committee members were informed ditches could not be excavated low enough to continue drainage flow downhill. Mr. Rogers informed a City of La Porte drawing had been received showing ten general areas of drainage concerns. Mr. Rogers advised drawings with specific detailed plans are required from the city to determine if the areas of concerns have pipelines involved. Mr. Rogers informed pipelines that are required to be taken out of service have a process and efforts would have to be coordinated between the city and ExxonMobil. Chairman Mosteit directed staff to meet and work with ExxonMobil to resolve areas of concern regarding pipeline/drainage conflicts and to notifying at least one committee member to also attend future meetings with the Texas Energy Coalition and/or its membership. 4. Set date for next Drainage and Flooding Committee Meeting Chairman Mosteit set the next Drainage and Flooding Committee Meeting for January 16, 2012 at 5:00 p.m. 5. Committee Comments Chairman Mosteit, Committee member Engelken and Alternate member Leonard thanked the Texas Energy Coalition or its membership for attending the meeting and explaining the processes for working with the city to resolve drainage conflicts. 6. Executive Session There was no executive session. 7. Adjourn There being no further business, Alternate Member Leonard moved to adjourn the meeting. Committee Member Engelken seconded. Motion Passed.
