1. CALL TO ORDER
The meeting was called to order by Mike Mosteit at 6:02 p.m.
Members of the Committee Present: Chairperson Mike Mosteit, Committee Members Barry

MEETING
Motion was made by Committee Member Chuck Engelken to approve minutes as presented.
Second by Committee Member Barry Beasley. Motion carried unanimously.
3. PETITIONS, REMONSTRANCES, COMMUNICATIONS, AND CITIZENS AND
TAXPAYERS WISmNG TO ADDRESS THE FILL DIRT REVIEW COMMITTEE
The following citizens addressed the Fill Dirt Review Committee:
Randy Peake, 10820 North L Street, La Porte, Texas 77571, Mr. Peake informed City Council his
property floods, he is concerned about not being allowed to use fill dirt for low areas on his
property .
Don Harbuck, 2302 Lomax Drive, La Porte, Texas 77571, Mr. Harbuck informed City Council he
lives in Lomax and is in favor of using fill dirt to build up property.
Sidney A. Grant, 1907 Lomax Drive, La Porte, Texas 77571, Mr. Grant informed Council he has
been using fill dirt on his property; and is in favor of continuing use offill dirt. Mr. Grant
provided City Council with information in their meeting packets; recommending Council
eliminate the moratorium; and consider a bond approval for flood control.

The Chairman announced the Committee would take Item 4 first on the agenda and conduct the
tour at 6:00 p.m. The Chairman announced there would be no discussion or action taken during
the tour. The Committee returned from the tour at 7:05 p.m. and reconvened the meeting.
5. DISCUSS AND REVIEW THE ACCEPTANCE FOR FILING AND THE ISSUANCE OF
PERMITS UNDER ORDINANCE 1444-A AND RESOLUTION 2003-19 THE
MORATORIUM REGARDING THE ACCEPTANCE FOR FILING AND THE
ISSUANCE OF PERMITS UNDER ORDINANCE 1444-A AND PROVIDE STAFF WITH
DIRECTION TO RESEARCH THE BACKGROUND ON THE CITY OF LA PORTE
DRAINAGE, mSTORY OF ORDINANCES, AND TESTIMONIES FROM THE
CITIZENS.
Chairperson Mike Mosteit asked the Committee for their comments.
Committee Member Chuck Engelken complimented staff on putting information together so
promptly, noting there was a high volume of permits.
Council member Bruce Meismer commented on the high volume of dirt being brought in.
Committee Member Beasley would like the Committee to act quickly concerning what is fair to
all citizens. When dirt is brought on property, measures need to be taken to protect neighbors
from flooding. Citizens obtaining permits should not be allowed to exceed the load amount
approved.
Councilmember Meismer voiced his concerns about property being raised and flooding other
citizen's property. Mr. Meismer does not want to see problems occur from using fill dirt; noting
we need to look at the entire City.
Committee Member Engelken is concerned about property on Lomax Drive; it appears that two
homes using fill dirt could cause their neighbors to flood. This problem is not unique to Lomax,
but to the entire City. The Committee needs more time to study the information provided by
Staff; requesting Staff to check the current contract; determining how much fill dirt is left.
Committee Member Beasley questioned staff on the status of follow-up on permits and a time
frame for follow-up.
City Manager Debra Feazelle stated this is a temporary situation and provisions need to be made
to ensure staff has time to inspect fill dirt permits.
Chairperson Mosteit noted this has been a long-standing problem. The Ordinance is not adequate
and suggested the following items be reviewed:
· Silting of drainage ditches
· City and County need to maintain drainage
· Monitor silting of ditches where fill dirt has been brought to the property
· Research timeline of how long it takes vegetation to grow on red clay dirt
· Once clay dirt has been researched, make recommendation to property owners
· Assess and research damage to roads from heavy trucks hauling fill dirt
· Assess whether or not trucks hauling fill dirt are allowed on streets
· Assess the adequacy of ditches
· Determine who is responsible for poor drainage in built up areas

Chairperson Mosteit interpreted the Ordinance to allow fill dirt for low areas and holes, not to
build up the entire property level. While on tour, it appears some citizens were still filling in
property, when they had been asked to stop using fill dirt.
Councilmember Meismer questioned if there is a penalty for violation for abuse of the Ordinance;
with a response of a "yes" answer from City Manager Feazelle. Staff is to follow-up on this
issue.
Chairman Mosteit reminded the Committee their purpose is to determine if the Ordinance is
adequate and is being complied; stating there needs to be clarification on the total number of
loads that can be delivered to a property. Mr. Mosteit wants adequate time to review the
Ordinance.
Councilmember Meismer noted the moratorium did not cause citizens not to get dirt; abuses of
citizens not complying with the Ordinance contributed to the decision on the moratorium. An
additional Ordinance may be necessary for filling holes and low areas; and another Ordinance for
larger pieces of property needing an Engineering Study, if it changes topographical lay of the
land.
If the Ordinance were revised, Committee Member Beasley would like to include silting
language, including seeing vegetation within a certain amount of time, to avoid silting.
Chairman Mosteit recommends Staff research whether or not the City should have an
environmental test done on the fill dirt; questioning whether or not the County recently tested the
dirt; with Assistant City Manager John Joerns informing the Committee he was certain the dirt
had been tested.
City Manager Feazelle questioned if the City's Ordinance should include parameters or ratios
based on the property size.
Chairman Mosteit noted if we allow fill dirt, we should increase the capacity of drainage and
protect those citizens who are unable to raise their property levels.
Councilmember Meismer stated the property owner should be responsible for determining impact
and provide staff with information they can review. Mr. Meismer requested Staff to determine
how larger cities handle their fill dirt issue.
Chairman Mosteit noted the moratorium could be stopped at any time; the moratorium does not
have to last a complete 180 days.
Committee Member Engelken suggested the Committee review the Ordinance section by section
at the next meeting.
Staff was directed to research what would constitute a qualified plan and make suggestions on
changes needed to the current ordinance.
The Committee will brief City Council at the next Council Meeting. The Committee will meet
again on Friday, July 18, at 5:30 p.m.; the Committee will provide a brief presentation at the
Monday, July 21, City Council Workshop Meeting and tentatively plan to provide
recommendation to City Council at the Monday, July 28, City Council Meeting.

OVERVIEW
At its July 10, 2003 meeting, the Fill dirt Review Committee (FDRC) addressed and discussed
numerous issues involving the City's fill dirt permitting and practices.
The committee requested staff to review and research several aspects of the fill dirt issue and
report its findings at the July 18, 2003 meeting of the FDRe.
Staff has compiled data pertaining to state law, information on HCFCD's detention basin
construction, sodding & seeding practices, truck weight regulations and building pad elevation
requirements. Additionally, current City practices, large fill dirt operations and staff resources
are addressed.

(v) The provisions of this section, except Subsection (a), do not
apply to:
(1) a proposed transfer which in combination with any existing
transfers totals less than 3,000 acre-feet of water per annum from
the same permit, certified filing, or certificate of adjudication;
(2) a request for an emergency transfer of water;
(3) a proposed transfer from a basin to its adjoining coastal basin;
or
(4) a proposed transfer from a basin to a county or municipality or
the municipality's retail service area that is partially wi thin the
basin for use in that part of the county or municipality and the
municipality's retail service area not within the basin.

0~ S 11.086. Overflow Caused by Diversion of Water
~", .
(a) No person may divert or impound the natural flow of surface
waters in this state, or permit a diversion or impounding by him to
continue, in a manner that damages the property of another by the
overflow of the water diverted or impounded.
(b) A person whose property is injured by an overflow of water caused
by an unlawful diversion or impounding has remedies at law and in
equity and may recover damages occasioned by the overflow.
(c) The prohibition of Subsection (a) of this section does not in any
way affect the construction and maintenance of levees and other
improvements to control floods, overflows, and freshets in rivers,
creeks, and streams or the construction of canals for conveying water
for irrigation or other purposes authori zed by this code. However,
this subsection does not authorize any person to construct a canal,
lateral canal, or ditch that obstructs a river, creek, bayou, gully,
slough, ditch, or other well-defined natural drainage.
(d) Where gullies or sloughs have cut .away or intersected the banks
of a river or creek to allow floodwaters from the river or creek to
overflow the land nearby, the owner of the flooded land may fill the
mouth of the gullies or sloughs up to the height of the adjoining
banks of the river or creek without liability to other property

~ 11.087. Diversion of Water on International Stream
(a) When storm water or floodwater is released from a dam or
reservoir on an international stream and the water is designated for
use or storage downstream by a specified user who is legally entitled
to receive it, no other person may store, divert, appropriate, or use
the water or interfere with its passage downstream.
(b) The commission may make and enforce rules and orders to implement
the provisions of this section, including rules and orders designed
to:
(1) establish an orderly system for water releases and diversions in
order to protect vested rights and to avoid the loss of released
water;
(2) prescribe the time that releases of water may begin and end;
(3) determine the proportionate quanti ties of the released water in
transit and the water that would have been flowing in the stream
without the addition of the released water;
(4) require each owner or operator of a dam or reservoir on the
stream between the point of release and the point of destination to
allow free passage of the released water in transit; and
(5) establish other requirements the commission considers necessary
to effectuate the purposes of this section.
(c) Orders made by the commission to effectuate its rules under this
section shall be mailed by certified mail to each diverter of water
and to each reservoir owner on the stream between the point of
release and the point of destination of the released water as shown
by the records of the commission.

Detention Basin (HCFCD - Deer Park)

DETENTION BASIN - HCFCD IN DEER PARK
The regional detention pond, B512-0 1-00, currently under construction in Deer Park,
Texas is not just a detention pond project. It is part of the greater B 1 09 project which
also includes channel improvements in its project scope. As of Tuesday July 15, 2003,
there were 267 working days left in the contract. Given the addition of rain days, the
project is expected to continue for more than a year. The start date for the project was
July 29, 2003. The project manager for the project is Gene Rushing with the Harris
County Flood Control District. (HCFCD) available at 713-684-4000. Currently the
project is estimated to be 30% complete. For r~ference the project was 10% complete in
January.
City staff has requested a copy of the soils report for the project which can be found
attached. It was conducted by a reputable geotechnical engineering firm in Houston,
Aviles Engineering, under the direction of Don A viles. Staff was informed that a
standard Phase I environmental study was completed for the site in November of 1993. It
indicated that a Phase II environmental assessment was not needed. In other words, the
preliminary environmental study yielded no suspicious or extraordinary findings that
would warrant further study.

INTRODUCTION
The study reported herein is a Preliminary Geotechnical Investigation of subsurface conditions at
the site of the proposed detention basins at H.C.F.e.D. Unit 8-512-01-00 in Harris CoUDly,
TeXas. The 200 :I: acre tract is located at the northwest comer of Spencer Highway Ind
Underwood near Pasadena, Texas.

PURPOSE
The purpose of the investigation was to determine the subsurface soil conditions at the subject site
and assess the suitability of constructing a detention pond. The investigation also included
assessing the suitabUity of the excavated soils from detention basin construction as highway
embankment material.
SUBSURFACE EXPLORATION
The subsurface exploration at the site was accomplished by means of eleven (11) undisturbed core
borings drilled to a depth of twenty five (25) feet below existing ground surface. The approximate
boring locations are shown on the attached Boring Plan as depicted in Plate 1.
The borings were of three-inch. nominal diameter. Undisturbed samples of the cohesive soils were
obtained from the borings by means of thin-wall,. seamless st~i Shelby Tube samplen. All
undisturbed samples were extruded mechanically from the core barrels in the field, wrapped in
aluminum foil, and sealed in plastic bags to prevent moisture loss and disturbance. All of the
samples and cores were then placed in core boxes and transported to our laboratory for testing and
further study. .

Granular soUs were sampled with a split-barrel sampler. Penetration resistance of the split-barrel
sampler!las recorded as "Blows Per Foot" and is shown on the boring logs.
. LABORATORYTFSI'ING'
All samples from the borings were examined and classified in the laboratory by a soils engineer.
Laboratory tests were performed on selected soil samples in order to evaluate the engineering
properties of the foundation medium in accordance with the prescribed ASTM Standards. All test
results are pres~ on Plates 2 through 12.
Atterberg Limits, Percent Passing No. 200 Sieve and Moisture Content tests were performed on
typical samples to establish the index properties and to aid in the proper classification of the
subsurface materials.
Strength properties of the soils were determined by means of unconfmed compression tests
performed on undisturbed samples.
SUBSURFACE CONDmONS
The soils at the site generally consist of fum to very stiff clays. Stiff sandy clays were
encountered in Borings B-3. B-4, B-7, B-I0 and B-ll, generally between four (4) and twelve (12)
feet. Granular solls such as silty sands and clayey sands, were encountered only 'in BoriQg B-4
between twelve (12) and seventeen (17) feet and between twenty two (22) and twenty five (2S) feet.
The surficial sandy. clay and clay soils are generally medium to highly plastic and are classified as
.CL. and IICH" type salls in accordance with the Unified Soil' Classification System. The
plasticity index of the soils throughout the site varies between fifteen (IS) and fifty two (52).
Groundwater was only encountered in Boring B-4 at a depth of fifteen (1S) feet below existing
grade during drUling.
GROUNDWATER VARIATIONS
The information in this report summarizes conditions as found on the date the boriDgs were drilled.
The depth to the static water table may be expected to vary with environmental variadoDS such as
freqUeJ,lcy and magnitude of rainfall and the t.ilne of year when coDStrucdon begins.

Infonnation made avaUable to this office indicates that a detention basin is planned for CODStruction
at the site.
DETENTION BASIN .
A stoIm water dete~tion basin is planned at the site. The soils generally consist of moderate to
highly plastic sandy clays and clays. Groundwater was only encountered in Boring B-4 at a depth
of fifteen (IS) feet. The clay (CH) soil~ at the site are highly plastic and do not meet the
requirements of Texas Department of Transportation Item 132, Type A material for embankment
construction. However, sandy clays encounter~ in Borings B-3, :8-4, B-7, B-I0 and B-ll,
generally between four (4) and twelve (12) feet appear to meet the requirements of Type A
material.
B~ed on local experience, 1 (V) to 3 (H) side slopes of the basin in cohesive soils such as sandy
clays and clays should be stable for slope heights of approximately ten (10) feet. Maximum depth
of excavation should be limited to eight (8) feet in the vicinity of Boring B-4 to provide sufficient
cover above the water bearing sands at twelve (12) feet. Apart from sliding stability consideration,
a 1 (V) to 3 (H) slope is easier to maintain and will sustain vegetation much better than steeper
slopes.
Based on this preliminary study, the site is suitable for construction of a detention basin.
However, a deta!led investigation program should be undertaken, especially in the vicinity of
Boring B-4 to delineate any sballow waterbearlng sand layers that may adversely affect the
proposed detention basin.
SITE PREPARATION
. In order to remedy construction problems, which may develop, if attempts are made to work.the
surface materials following pr~longed periods of rainfall, which are common to this area, it is
recommended that. prior to starting any work at the site, that proper construction drainage be
provided to maintain a relatively 'dry construction site.

DESIGN REVIEW
It is recommended that Aviles Engineering Corporation be allowed to review the design and
construction plans and specifications prior to release to make Certain that the geotechnical
recommendations and design criteria presented herein have been properly interpreted.
The infonnation contained in this report summarizes conditions found on the date that the borings
were drilled. The attached Boring Logs are a true representation of the soils encountered at the
specific boring locations on the date of drilling and represent the stratigraphy as found during
drilling of the subject, property. Reasonable variations from the subsurface information presented
in this report are assumed. If conditions encountered during construction are significantly different
than those presented in this report, Aviles Engineering Corporation should be notified
immediately.

TECHNICAL SPECIFICATION
CITY OF LA PORTE
ITEM VIII
SODDING
PART 1 - GENERAL
1.01 Description
A. Scope: Furnish plants, materials, labor, equipment and appliances, and perform all
operations in connection with the planting of sod within the areas designated on the
PLANS for the purpose of surface stabilization, channel stabilization and/or vegetation
buffer strips.
B. Related work as called for on PLANS as specified elsewhere in this or other
TECHNICAL SPECIFICATIONS.
1.02 Quality Assurance
The following documents, used as standards, are to be considered a part of these
specifications.
1. American Joint Committee on Horticultural Nomenclature, "Standardized Plant
Names," Second Edition, 1942.
2. American Association of Nurserymen, Inc. "American Standard for Nursery
Stock."
PART 2 - PRODUCTS
2.01 Materials
A. Sod: Certified grade cultivated S1. Augustine grass sod; with strong, fibrous root
system; free from stones and burned or bare spots.
B. Topsoil: Fertile, agricultural soil typical of locality and capable of sustaining vigorous
plant growth; from well drained site that is free of flooding; free from admixture of subsoil,
slag or clay, stones, lumps, live plants and their roots, sticks and other extraneous
matter; pH value of minimum 5.4 and maximum 7.0. Use topsoil excavated from site only
if conforming to specified requirements.
C. Fertilizer: Commercial type conforming to FS 0-F-241, Type 1, Grade A recommended
for grass, with fifty percent of the elements derived from organic sources; of proportion
necessary to eliminate any deficiencies of topsoil as indicated in analysis.
D. Wooden Pegs: Of sufficient size and length to ensure satisfactory anchorage of sod on
slope in excess of 2: 1.
E. Roll Lite Erosion Control Mulching Fabric as manufactured by Gulf States Paper
Corporation or equal.
F. Water: Clean, fresh, and free of substances or matter which would inhibit vigorous
growth of grass.
PART 3 - EXECUTION
3.01 General
A. Provide erosion and sedimentation control systems at the locations shown on PLANS.
Such systems shall be of the type indicated and shall be constructed in accordance with
the requirements shown on PLANS and set out in this Item.

B. Inspect and repair or replace components of all erosion and sedimentation control
systems as specified for each type of system. Unless otherwise directed, maintain the
erosion and sedimentation control systems until the project is accepted by the Owner. C.
Remove and dispose of sediment deposits at the project spoil site. If a project spoil site is
not designated on PLANS, dispose of sediment offsite at location not in or adjacent to
stream or floodplain. Sediment to be placed at the project site should be spread,
compacted and stabilized in accordance with the Owner's directions. Sediment shall not
be allowed to flush into stream or drainage way.
D. Equipment and vehicles shall be prohibited by the Contractor from maneuvering on
areas outside of dedicated rights-of-way and easements for construction. Damages
caused by construction traffic to erosion and sedimentation control systems shall be
repaired immediately.
E. Contractor shall employ protective measures described in Item General Source
Controls to avoid damage to existing trees to be retained on the project site. Conduct all
construction operations under this Contract in conformance with the erosion control
practices described in that Item.
3.02 Preparation of Subgrade
A. Fine grade subgrade, eliminating uneven areas and low spots. Maintain lines, levels,
profiles, and contours. Make changes in grade gradual. Blend slopes into level areas.
B. Remove foreign materials, undesirable plants and their roots, stones, and debris. Do
not bury foreign material beneath areas to be sodded. Remove and replace subsoil which
has been contaminated with petroleum products.
C. Cultivate subsoil to a depth of 3 inches where topSOil is to be placed. Repeat
cultivation in areas where equipment, used for hauling and spreading topsoil, has
compacted subsoil.
3.03 Placing Topsoil
A. Spread topsoil to a depth of minimum 2 inches over entire area to be sodded.
B. Place topsoil during dry weather and on dry unfrozen subgrade.
C. Grade to eliminate rough and low areas, ensuring positive drainage. Maintain levels,
profiles, and contours of subgrade.
D. Remove stones, roots, grass, weeds, debris, and other foreign nonorganic material
while spreading.
3.04 Fertilizing
A. Apply fertilizer at rate recommended by manufacturer. Apply after fine grading and
prior to compaction. Mix thoroughly into upper 2 inches of topsoil.
B. Lightly water to aid the breakdown of fertilizer.
C. Apply fertilizer within 48 hours before laying sod.
3.05 Laying Sod
A. Lay sod as soon as possible after delivery to prevent deterioration.
B. Full Sodding: Lay sod closely knit together with no open joints visible, and pieces not
overlapped. Stagger sod units to avoid continuous seams. Lay smooth and flush with
adjoining grass areas, paving, and top surfaces of curbs.
C. Strip Sodding: Lay sod in the following patters: 3-inch continuous sod strip, 12-inch
topsoil, 3-inch continuous sod strip. See dirt areas between sod strips.
D. On slopes 2:1 and steeper, lay sod perpendicular to slope and secure every row with
wooden pegs at maximum 2 feet on center. Drive pegs flush with soil portion of sod.
E. Prior to placing sod, on slopes 3: 1 or where indicated, place Hold/Gro or Roll/Lite or
equal over topsoil. Securely anchor in place with posts sunk firmly into the ground at

maximum 16 feet on center along pitch of slope and equal to width of wire mesh
horizontally across slopes.
F. Immediately water sodded areas after installation. Water in sufficient amounts to
saturate sod and upper 4 inches of soil.
G. After sod and soil has dried sufficiently to prevent damage, roll sodded areas to
ensure good bond between sod and soil and to remove minor depressions and
irregularities. Ensure rolling equipment weight not over 250 pounds or less than 150
pounds.
3.06 Maintenance
A. Begin maintenance of plant materials immediately after planting and continue
maintenance until issuance of Certificate of Acceptance of project.
B. Maintenance to include measures necessary to establish and maintain plants in a
vigorous and healthy growing condition, including the following.
1. When herbicides are used for weed control, apply in accordance with
manufacturer's instructions. Remedy damage resulting from use of herbicides.
2. Watering sufficient to saturate root system.
3. Disease and insect control.
3.07 Measurement and Payment
Measure by the square yard of area sodded. Payment for work under this Item will be
made at contract price for "Full Sodding,. or "Strip Sodding", as indicated on
PROPOSAL, which price to be full compensation for all fertilizer, sod, equipment,
materials, and labor necessary for fertilizing and sodding.

PART 3 - EXECUTION
3.1 GENERAL
e
A. Perform turf establishment as soon as practical after construction activities,
but not later than 21 calendar days. Long term exposure of bare earth will
not be permitted. Engineer may stop work on the project until exposed
areas receive the designated turf establishment.
B. Do not perform work on areas that are so wet that equipment operation
causes tracking and compaction of the ground or when the soil is in a non-
tillable condition.
3.2 SEEDBED PREPARATION
A. Seedbed is defined as the soil designated to support turfgrass and/or sod,
approximately 6 inches in depth below the design surface or as directed by
the Engineer.
B. Correct irregularities in finished seedbed surfaces to eliminate depressions.
C. Disk, harrow, rake or grade the seedbed until it is free of clods and roots.
D. Remove roots and woody plants over 1 inch in diameter.
E. Leave final surface in a roughened condition.
F. Avoid surface crusting of the seedbed after rainfall or compaction, prior to
turf establishment. Disk, harrow or rake to loosen soil surface.
G. Grade the seedbed adjacent to existing turfgrass or pavement for areas
receiving sod to permit sod to be flush with adjacent surfaces.
H. Protect prepared seedbeds from damage by pedestrian or vehicular traffic.
I. Obtain prepared seedbed inspection and acceptance from the Engineer
prior to other turf establishment activities.

3.5 DRY APPLICATION
A. Spread fertilizer evenly and uniformly. Incorporate fertilizer by disking,
raking or harrowing into the seedbed prior to seeding.
B. Seeding.
1. Plant seed with a broadcast seeder or a culti-packer seeder. Plant
grass seed no deeper than 1/4 inch, with the distance between rows of
12 inches or less. Distribute seed uniformly.
2. Roll the planted seedbed with a culti-packer immediately after seeding
and prior to applying mulch cover.
3. Seed may be broadcast by hand for small areas or areas inaccessible
to seeding equipment, as approved by the Engineer. Areas seeded by
hand shall be rolled or lightly compacted, if possible.
C. Mulching.
1. Spread straw or hay mulch to seeded areas with a slope steeper than
6H:1V immediately after application of seed.
2. Apply straw or hay mulch at a rate per acre to create a uniform mat of
coverage a minimum of 1/2 inch thick to protect the seedbed.
3. Secure straw or hay mulch with hydromulch or other approved
methods.
a. Apply a hydromulch, consisting of an homogeneous aqueous
mixture of recycled paper fiber, water and tackifier, to achieve a
rate of 1,000 pounds of paper fiber mulch per acre over the straw
mulch. Apply guar gum tackifier at a minimum rate of 50 pounds
(dry weight) per acre.
b. Application rate for other tackifier/soil binder compounds shall be in
accordance with manufacturer's recommendations and approved
by the Engineer.
3.6 HYDROSEEDING WITH MULCH
A. Hydroseeding with mulch is the application of an homogeneous aqueous
mixture of seed, water, fertilizer, dye, wood fiber mulch and tackifier/soil
binder to the seedbed.
B. Add completely water soluble fertilizer to the aqueous mixture no more
than 30 minutes prior to application to prevent damage to the seed.
C. Apply guar gum tackifier at a minimum rate of 50 pounds (dry weight) per
acre.
D. Apply wood fiber mulch at a rate of 2,000 pounds (dry weight) per acre.
E. Application rate for other tackifier/soil binder compounds shall be in
accordance with manufacturer's recommendations and approved by the
Engineer.
3.7 OVERSEEDING
A. Overseeding is the broadcast application of seed (per Seed Plan 4, 5 or 6)

3.8 SODDING
A. Place sod in areas as shown on the Plans or as directed by the Engineer.
B. Refer to Section 02922 - Sod. As a minimum:
1. Spread slow release fertilizer evenly and uniformly and incorporate by
disking, harrowing or raking into the seedbed prior to placing sod.
2. Lightly water prepared seedbed immediately prior to placing sod.
3. Place sod panels tightly against each other in rows.
4. Stagger lateral joints. Exercise care to ensure the sod is not stretched
or overlapped and joints are butted tightly with no spaces between
strips.
5. Place a minimum of 4 staples per sod panel.
6. Tamp or roll the sod after placement to ensure good contact with the
seedbed.
7. Lightly water sod during installation to prevent excessive moisture loss.
8. Immediately after installation of sod, remove extraneous clumps of sod
or soil on sod and rake or wash off plant remnants on sod or adjacent
pavements.
C. Provide irrigation in accordance with Section 02940 - Irrigation for a
minimum of 60 days.
3.9 ACCEPTANCE AND CONTRACTOR'S RESPONSIBLlTIES
A. Engineer will approve turf establishment when specified planting method is
complete.
B. Repair areas damaged until the turf establishment is accepted by the
Engineer. Repairs include, but are not limited to, damage due to erosion,
rilling, traffic or other deleterious acts.
C. Replace dead sod panels for a period of 60 days after installation.

SODDING FOR EROSION CONTROL AND FINAL STABILIZATION
(BLOCK SODDING)
162.1 Description. Sodding for erosion control and for final stabilization shall
consist of providing and planting Bermuda grass, San Augustine grass, or
other acceptable sod along or across such areas as are designated on the
drawings and in accordance with the specification requirements herein
outlined.
162.2 Materials. The sod shall consist of live, growing Bermuda grass, San
Augustine grass, or other acceptable sod, (ninety-five percent pure),
secured from sources where the soil is fertile and has been fumigated. The
sod shall have a healthy virile root system of dense, thickly matted roots
throughout. The sod shall be cut from the field so that there is a minimum
of one-half inch of soil on the roots of the sod, and so that no roots show
on the bottom of the soil. Sod shall be dense, with the grass having been
mowed to 1 inch height before lifting from field. Sod shall be in a vigorous
condition, dark green in color, free of disease and harmful insects. The
contractor shall not use sod from areas where the grass is thinned out, nor
where the grass roots have been dried out by exposure to the air and sun to
such an extent as to damage its ability to grow when transplanted. The sod
shall be free from obnoxious weeds or other grasses and shall not contain
any matter deleterious to its growth or which might affect its subsistence
or hardiness when transplanted. Unless the area has been closely
pastured, it shall be closely mowed and raked to remove all weeds and
long-standing stems.
Care shall be taken at all times to retain the native soil on the roots of the
sod during the process of excavation, hauling and planting. Sod material
shall be kept moist from the time it is dug, until planted. When so directed
by the Engineer, the sod existing at the source shall be watered to the
extent required, prior to excavating. Do not stack sod for more than 36
hours between the time of cutting and the time of installation. The
Engineer reserves the right to reject any sod deemed unacceptable for
installation.
All planting shall be done between the average date of the last freeze in the
spring and six weeks prior to the average date for the first freeze in the fall,
according to the U.S. Weather Bureau.
Fertilizer shall conform to the requirements of the Item, "Fertilizer" and
shall be applied at the rate of 480-pounds per acre.

162.3 Construction Methods. Immediately after the finished grade has been
approved, begin sodding operations to reduce excessive weed growth. If
the sod bed is dry, immediately prior to sod installation, dampen the
surface with a fine mist of water.
162.4
Grass shall be turf sod, cut into sixteen (161 inch strip widths for those
areas behind a curb. All other areas can receive various cut widths and
lengths.
All areas to be sodded shall be raked to true lines, free from all unsightly
variations, bumps, ridges or depressions. All sticks, stones, roots or other
objectionable material which might interfere with the formation of a finely
pulverized seed bed, shall be removed from the soil.
Lay sod so that adjacent strips butt tightly, with no spaces between strips.
Lay sod on mounds and slopes, with strips parallel to contours. Stagger
joints. Sodded areas shall be Bush with adjoining seeded areas. All sod
shall, of course, be laid green side up. Tamp and roll the sod thoroughly to
make contact with the sod bed, or as directed by the Engineer.
Peg sod on slopes three to one or steeper with pegs driven through sod into
soil, until pegs are Bush with the turf. Space pegs 18 inches on center.
Pegs to be 1 inch square, 6 inches long or, 6 inch lengths oflath.
Commercial fertilizer as outlined in the Item, "Fertilizer" shall be applied
to the entire sodded area at the prescribed rates, immediately following
laying of the sod. Immediately after fertilizing, water the entire area to a
saturated depth of 2-inches. If rain is imminent. then the application of
fertilizer shall be postponed until weather conditions exist such that the
potential for the runoff of fertilizer from the site is minimized.
Immediately after installation of the sod, remove sod clumpsJ, soil, and any
plant material from roadways and pavements. Edges along curbs and
drives, walkways, etc., shall be carefully trimmed and maintained until
accepted.
Only as approved by the Engineer. in areas where sod is dead. satisfactory
growth may be accomplished with application of seeding or hydromulch
seeding. in lieu of replacing the dead sod. Costs for labor. materials. tools
and equipment for the application of seeding or hydromulch seeding over
dead sod shall be incidental to this pay item.
Contractor's Maintenance & Guarantee Period. It shall be the
responsibility of the contractor to maintain all sodded areas until
satisfactory growth has occurred as determined by the Engineer and for !!

The Contractor shall be responsible for one (1) mowing per month
between the months of April to October. The Contractor shall also be
responsible for one (1) mowing every six (6) weeks between the months of
November to March.
In addition, the Contractor shall water all sodded areas as often as
necessarv to establish satisfactOlY growth and to maintain its growth
throughout the duration of the project.
Contractor shall make as many repeat plantings as necessary to achieve a
minimum of Q~% of the area planted covered with the specified grass with
no bare or dead spots greater than 10 square feet. Such replanting is to be
performed within 14 calendar days of notification by the Engineer.
162.5 Measurement. Work and acceptable material for block sodding shall be
measured by the square yard, complete in place.
162.6 Payment. Work performed and material furnished under "Measurement"
shall be paid for at the unit price bid for "Block Sodding", which price shall
be full compensation for furnishing materials, preparation of ground for
planting, planting of sod, pegging of sod. raking, fertilizing, watering,
sprinkling, maintenance, and for labor, tools, equipment and incidentals
necessary to complete the work. Additional payment shall not be made for
those areas that are renlanted.

Except as otherwise provided by law, no commercial motor vehicle, truck-trailer, trailer or
semitrailer, nor combination of such vehicles, shall be operated over, on or upon the public
streets and highways within the corporate limits, having a weight in excess of one or more of
the following limitations:
(1) No such vehicle nor combination of vehicles shall have a greater weight than 20,000
pounds carried on anyone axle, including all enforcement tolerances; or a tandem axle
weight in excess of 34,000 pounds, including all enforcement tolerances; or an overall
gross weight on a group of two or more consecutive axles in excess of that produced by
application of the following formula:

where W equals overall gross weight on any group of two or more consecutive axles to
the nearest 500 pounds, L equals distance in feet between the extreme of any group of
two or more consecutive axles, and N equals number of axles in group under
consideration, except that two consecutive sets of tandem axles may carry a gross load
of 34,000 pounds each, providing the overall distance between the first and last axles
of such consecutive sets of tandem axles is 36 feet or more; provided, however, that
such overall gross weight may not exceed 80,000 pounds, including all enforcement
tolerances.

(2) No such vehicles nor combination of vehicles shall have a greater weight than 600
pounds per inch width of tire upon any wheel concentrated upon the surface of the
highway and using high-pressure tires, and a greater weight than 650 pounds per inch
width of tire upon any wheel concentrated upon the surface of the highway and using
low-pressure tires, and no wheel shall carry a load in excess of 8,000 pounds on
high-pressure tires and 10,000 pounds on low-pressure tires, nor any axle a load in
excess of 16,000 pounds on high-pressure tires, and 20,000 pounds on low-pressure
tires.
(3) Nothing in this section shall be construed as permitting size or weight limits on the
national system of interstate and defense highways within the corporate limits of the
city in excess of those permitted under 23 use 127. If the federal government
prescribes or adopts vehicle size or weight limits greater than those prescribed by 23
use 127 for the national system of interstate and defense highways, the increased
limits shall become effective on the national system ofinterstate and defense highways
within the corporate limits of the city.

(4) In this section, an axle load is defined as the total load transmitted to the road by all
wheels whose centers may be included between two parallel transverse vertical planes
40 inches apart, extending across the full width of the vehicle. Tandem axle group is
defined as two or more axles spaced 40 or more inches apart from center to center,
having at least one common point of weight suspension.
(5) Any police officer, having reason to believe that the gross weight or axle load of a
loaded motor vehicle is unlawful, is authorized to weigh the vehicle by means of
portable or stationary scales approved by the police department ofthe city for such use,
or the police officer may cause the loaded motor vehicle to be weighed by any public
weigher and may require such vehicle to be driven to the nearest available scales for
the purpose of weighing. If the gross weight of a vehicle weighed pursuant to this
subsection, is found to exceed the maximum gross weight authorized by law, plus a
tolerance allowance of five percent of the gross weight authorized by law, such police
officer shall demand and require the operator or owner of the motor vehicle to unload,
or cause to be unloaded, such portion of the load as is necessary to decrease the gross
weight of such vehicle to the maximum pennitted by law, plus such tolerance
allowance. Such vehicle may not be operated further over the public streets and
highways within the city until the gross weight of the vehicle has been reduced to a
weight not in excess of the maximum authorized by law plus such tolerance allowance,
except as authorized under this subsection.. If the axle load of a vehicle weighed
pursuant to this subsection, is found to exceed the maximum authorized by law, plus
a tolerance allowance of tive percent of the axle load authorized by law, such police
officer shall demand and require the operator or owner of the motor vehicle to decrease
the axle load to the maximum authorized by law plus such tolerance allowance. The
owner or operator may reduce such load by rearranging the cargo, if possible, or by
unloading or having others to unload such portion of the cargo as is necessary to
decrease the axle load to the maximum authorized by law, plus such tolerance
allowance. Such vehicle may not be operated further over the public streets and
highways within the city so long as any axle load exceeds the maximum authorized by
law plus such tolerance allowance except as authorized under this subsection. If the
load of a motor vehicle consists of livestock, the operator shall be pennitted to proceed
to the destination without unloading providing the destination is within the state. If
the gross weight of a motor vehicle or an axle load exceeds the maximum pennitted by
law, plus a tolerance oftive percent ofthe gross weight authorized by law, but the police
officer believes that the cargo cannot be unloaded or rearranged safely at the place
where such vehicle was weighed, or the police officer believes that the unloading or
rearranging of the cargo at such place would create an unreasonable disruption of
traffic, he shall require the operator to proceed to a location where the cargo can be
unloaded or rearranged safely without causing disruption to traffic. Such location shall
be the nearest such place on city property, or property under the control of the driver
or his principal, or on property where consent has been given for such loading and
where it is feasible to unload or rearrange such cargo.

2. For non-curb and gutter streets, the developer may use open channel (channel or ditch)
methods to dispose of storm water specified above. Such channels may be in dedicated
drainage easements outside the standard street right-of-way upon City approval of the
location and alignment of such easements. Alternatively, the developer may widen the
street right-of-way to accommodate an open channel of greater capacity than the standard
streetIditch section.
3. If the developer locates the channel in a widened street right-of-way, the City shall approve
the right-of-way width and channel configuration. The depth of flow in the channel shall
not exceed one (1) foot as measured from the ditch flowline to the point on the roadway
established as the high water level in this section.
4. The developer shall design and construct all channels to terminate at an approved outlet.
'* 5.6.4 Habitable StlUctures
The developer shall provide adequate means for storm water run-off in excess of the "design storm"
capacity (i.e., 3, to-year storm) to flow around habitable stIUctures.
a.) The developer shall provide a grading/drainage plan which shows that all building sites can
provide a finished floor elevation:
(1) At least one foot (1 ') above the top of the curb using the highest point along the
portion of such curb fronting the building site, or
(2) At least eighteen inches (18") above the crown of road elevation, using the highest
point along the portion of such road fronting the building site.
(3) At least one foot above the grotind elevation along all sides of the building site.
b.) In addition to paragraph (a) above, the developer shall provide a grading/drainage plan
which meets or exceeds the provisions of Chapter 94, Code of Ordinances, Flood Hazard
Reduction.
c.) The developer shall design and construct all streets to minimize any fill required to bring
building pads into compliance with this Code.
d.) Alternate methods of building protection may be accepted by the City upon submittal of
detailed information, review and approval by the City Engineer.
5.6.5 Drainage System Criteria
If an underground drainage system is required, and a 60-inch or smaller pipe will handle the
design slow, pipe shall be used. If a 6O-inch pipe is not adequate, the developer has the option
to use concrete pipe or natural and/or a lined open drainage channel. If pipe is selected, the
maximum allowable velocity shall be 8 fps in the pipe. Lining materials, if used, shall be

eight (8) man hours are estimated spent per complaint on fill dirt issues. This includes receiving

writing and refining the letter to the violator (if needed) including upper management input,
meeting with or phone calls to the violator and subsequent reinspection.

FILL DIRT PERMITS

and Procedures
1. Contact Planning Department (281-471-5020) and schedule appointment with City Engineer
or his designated assistant. Fill dirt pennit application can be obtained at inspections desk.
2. Property owner should bring at least one sketch, surveyor site plan showing all of, but not
limited to, the items/features listed below:
. Approximate layout of property.
. Location of existing and proposed buildings, if applicable.
. Location of nearest channel(s) or drainage ditch(s), including Harris County Flood
Control District channels.
. Location of any existing and all proposed swales
. Location of proposed fill placement, and existing and final grades.
. Final grades should indicate slope of fill and direction of flow for storm water runoff.
. Engineer will review, approve, and sign sketch after verifying that the placement and
grading of the proposed fill will not affect, alter, or block the natural flow of storm water
to adjacent properties.
3. After the property owner has demonstrated sufficient compliance with the intent of these
policies and procedures, a permit may be issued through the Inspection Division. There is no
fee for this permit at this time.
Permits will be issued for a maximum of 40 truckloads. For additional dirt placement
additional permits may be sought but a site visit shall be required. For significant additional
dirt placement, inforplation regarding the topography of the 10t(s) shall be submitted with the
application. Permits shall not be issued for properties that do not have an address assigned to
them.
Fill may be obtained from private contractors or developers doing construction projects in or
around the city. Contact them directly for fill availability and delivery. The City is not
responsible for providing fill dirt.
NOTE: Most ofthis fill is NOT topsoil and there is no guarantee as to its condition. The fill
is usually emptied from the dump trucks at a desired location, but not graded. Grading is up
to the property owner.
Any deposited fill dirt that is liable to hold stagnant water is a violation of section 34-128 of
the city's code of ordinances. The property owner shall properly spread all fill within thirty
(30) days or otherwise face fines or monetary penalties for non-compliance.

QUALIFIED PLAN FOR LARGE PROJECTS
In establishing regulations for large fill dirt projects, Staff has compiled the following criteria to
be considered.
A Large Project is defined as the introduction of fifty (50) or more loads offill onto an individual
tract consisting of one (1) or more acres. An applicant will be required to submit a Site
GradinglDrainage Plan prepared and sealed by a registered professional engineer as well as a
corresponding Stormwater Pollution Prevention Plan for review/approval by staff Large
Projects will also require the permit holder to establish drainage swales no less that five (5') feet
from his property lines.
The maximum amount of fill allowed per acre should be no more than 800 cubic yards (80
loads). This amount allows the permit holder to raise his property a maximum of six (6") inches
above the existing grade. Additionally, Staff recommends that an elevation "cap" be established
for all tracts. This "cap" should be set at a point no higher than six (6") inches below the crown
of the primary road serving the subject property to allow for overland flow in a flood event.
A table summarizing proposed regulations for both small and large fill dirt operations is attached
for your review.

In order to have continual follow-up on each permit under the current permitting system, it is
estimated that approximately 5-1/2 to 7-1/2 man-hours will be needed.
This includes discussing the proposed drainage plan, attaching backup data, issuing the permit,
driving time to and from the site, reinspection, meeting with or phone call with permittee for
reinspection, release or letter of substantial completion.
This assumes perfect construction found after first reinspection and does not include the counting
of trucks.
*Note: There were 61 open permits at the time of moratorium commencement.

J would like to address the matter of drainage in Lomax, along North L st and my naberhood.
On the 15th of JUly we had about a 3" rain, in witch the ditch in front of my house and others were full
and the water from North L st was backing up into the naberhood of Lomax Gardens. J took pictures of
North L st and what I found was that the amount of run off that North L was getting around the Lomax
Gardens area was more than it could drain off As I went down North L st to the east I found that the
water flow drop offmore than half, by the time it got to the new Lateral it was very low as seen in the
picture.
I said it before I'll say it again with all the dirt that's been dumped in the area the city has to do a better job
of managing our drainage, and we still need to improve the water flow on North L st. and keep our homes
from becoming a holding pond. It is not right for someone to inprove their property and devalue many
others in the prosse.
