Goodman, Jim Hudgens, Vic Taylor, Jimmy Crate-representing Joe Sease. MEMBERS OF THE COMMITTEE ABSENT: R.L. Caldwell, Roy Groda, Tom Barrett, J. R. Spradling. OTHER PERSONS PRESENT: Frank Angel, Jerry Carpenter, Bruce Angel, John Brown, Joe Jardina, Anthony Dittrich, O.J. Watson, Tom Helenberg, Spud Miller, Cliff Hyde, John Merritt, Charles Boyle, Duane Matula. PRESIDING: Jim Hudgens, Chairman + + + CALL TO ORDER: MINUTES - SPECIAL MEETING Jim Hudgens called the special meeting to order. READING OF MINUTES: None OLD BUSINESS: None NEW BUSINESS: Jim Hudgens explained to the group present about Section 16.48, subsection A of the La Porte. Fire Code and why the letters that they had received were sent out and what the Fire Code Committee was trying to accomplish. He then asked for comments from the group. Mr. Bruce Angel, 711 West Main St., La Porte, representing Angel's Self Service Stations and Oil Co. stated that he could not get fuel during the hours of 12:00 midnight and 7:00 a.m., and be- cause of the 2,100 gals. load allowed, it would take too many trips to fill his tanks and would eventually put him out of business. John Brown, 115 West Main St., La Porte, representing Brown's 66 Service, stated that 2,100 gals. in a trailer is more dangerous than a full one . Joe Jardina, 400 South Broadway, La Porte, representing Joe's Phillips 66 Service, stated that he could not get fuel during these hours. • Special Meeting 03-20-79, page 2 Anthony Dittrich, 4830 Red Bluff, Pasadena, Texas, representing Dickson Oil Co., who is a Gulf Distributor in La Porte, stated that the more trips that he had to make to La Porte would cost more money and he would have to pass this cost on to the operator who in would turn pass it on to the consumer, and it would also be a inconvenience to his company. O.J. Watson, representing Bayport Aviation at the La Porte Airport, stated he cannot get fuel at night, and doesn't all- ways know when the fuel will come in. Tom Helenberg and Spud Miller, representing Gulf Coast Aviation, at the La Porte Airport, stated because of the special hours, it would cost more because it would be a special delivery of fuel. Cliff Hyde, representing Cliff Hyde Aviation, La Porte Airport, stated he never knows when the fuel will come in. He also stated he ordered a load of fuel two weeks ago and it shill has not come in. John Merrittt, 111 N. Eleventh St., La Porte, representing Merritt Shell, stated he had no problems getting fuel at the hours set out in the code. Chairman Jim Hudgens then asked for comments from the La Porte Fire Code Review Committee members. Rusty Shepperd stated I don't see how operators can stay in business as the code now stands. He feels a change is needed in this section. Jimmy Crate stated that, I feel that it is not feasible to enforce this section at this time because of the fuel allocation. Fred Westergren said he would be in favor to modify or drop this part of the code. J.M. Goodman stated, I feel we should modify this section of the code. Vic Taylor stated, I feel we should modify this section of the code. Jim Counts stated, there needs to be a more clear definition of areas served because there are areas in La Porte which are more dangerous to be served at certain hours of the day. J.J. Meza stated, he felt that this section of the code should be amended. D.R. McLaughlin stated again what the committee was trying to prevent as far as accidents were concerned with this section of the code and asked the operators present, how many had tried to get fuel at these hours, and for the most part the operators stated that they had not tried to get fuel at the hours but felt that they probable could not. • Special Meeting 03-20-79, page 3 Fred Westergren made a motion to suspend the delivery time (12:00 midnight to 7:00 a.m.) of this section until further study and revision could be made. This motion was seconded by Vic Taylor Ayes: All for Nays: None Chairman Jim Hudgens then instructed the Fire Marshal's Office staff to revise this section (16.48, subsection A) and bring it back to the Fire Code Review Committee for their review in the near future. Fire Marshal D.R. McLaughlin asked permission of the members to check with the Chamber of Commerce about replacing Mr. Tom Barrett, who represents the Chamber of Commerce on the Fire Code Review Committee, since he had not attended any of the meetings. Permission was granted by the members. Fire Marshal D. R. McLaughlin explained to the members that since Mr. Rusty Shepperd is not longer in the lumber business without special permission, Mr. Shepperd could no longer serve on the Fire. Code Review Committee. Mr. Fred Westergren made a motion stating that since Rusty was a good committee member, that he be allowed to continue on the committee in that position. Seconded by J.J. Meza Ayes: All for Nays: None ADJOURNMENT: Motion by Fred Westergren, seconded by J.J. Meza t at the meeting adjourn. Motion carried by the following vote: Ayes: All for Nays: None The meeting adjourned at 8:15 p.m. Paul R.
