HomeMy WebLinkAbout02-18-1982 Regular Meeting• MLNUT~S -REGULAR MEETING OF THE LA PORTE FIRE CODE REVIEW COMMITTEE FEBRUARY 18, 1982 M~ERS OF THE COMMITTEE PRESENT: Jack Owen, Joe Sease, Jerry Hodge, Carlos Smith, Tom Handy, Al Fields, Paul Hickenbottom, Delbert Walker, Wilson Dugger. Ervin Griffith representing David Paulissen M~ERS OF THE COMMITTEE ABSENT: Greg Yakim, Robert Byars, Mark Williams, James Sitton, Ellis Ebarb, Morris Rose, & Kevin Graves. OTHERS PRESENT: John Dunham & Bob Mc Laughlin PRESIDING: Jac~.Owen, Chairman 1. CALL Ti0 ORDER -Jack Owen called the meeting to order at 1903 hrs.. 2. READING OF THE MINUTES - The minutes were not read. They will be rea at a next meeting. 3. OLD BUSINESS - None 4. NEW BUSIlVESS - A copy of a letter from Al Fields was passed out and 'scusse (See copy attached.) FIRE OODE REVISION -Article 2 -Division 3 -Section 2.15 -Subsection a - e There was an open discussion by the committee. Motion to approve this revision was made by Delbert Walker. Motion seconded Carlos Smith Mlotion approved by a vote of Ayes: 9 Nays: 1 FIRE CODE REVISION -Article 2 -Division 2 -Section 2.9 -Subsection (d) Car os Smith questioned the twenty-five (25) feet mi.nim~n operational corridor and turnaround for the pumper. There was a brief discussion and it was decided to table this revision until Joe Sease and Paul Hickenbottom could check on more information concerning this. FIRE CODE REVISION -Article 2 -Division 3 -Section 2.16 -Subsection (a) Motion was made y Jerry Hodge to accept the revision with the following addition of the word "fire" in subsection (a). (a) Zl~e fire prevention division shall inspect, as often as necessary, all buildings and premises, including such other hazards or appliances, as the fire marshal may designate for the purpose of ascertaining and causing to be corrected any conditions which would reasonably tend to cause fire or contribute to its spread, or any violation of the purpose or provisions of this code and of any state law or standard affecting fire and life safety. Notion seconded: Wilson Dogger Notion approved by a vote of: Ayes: All For Nays: None FIRE CODE REVISION -Article 3 -Division 5 -Section 3.11 Subsection (c) ter 'scussion by the coamittee, Jerry Hodge made a motion to delete Subsection (c) Notion seconded: Carlos Smith Motion failed by a vote of: Ayes: 3 Nays: 7 Motion to table this revision was made by :Delbert Walker Notion seconded: Carlos Smith Notion approved by a wte of: Ayes: All For Nays: None No formal action was taken on Article 3 -Division 5 -Section 3.11. SUBJECT: La Porte Fire Ordinance Code Revision Committee Meeting 2-11-82 I will be traveling out of .state this Thursday and will be unable to attend our meeting. T feel, however, that I should express my concern about the importance of this initial meeting. I strongly object to any ordinance or revision of ordinance which would have a retroactive effect to buildings currently complying to the established code and then having to re-comply with new revisions. It seems to me that this situation is grossly unfair to a landlord or property owner because its true liability is never known. Provisions in Article II, Division 3, Section 2.15, Paragraph B-2 and Article III, Division 5, Section 3.11, Paragraph C, seem to have this retroactive effect. I wish only that'you would present the other committee memebers with the contents of this memo so that these provisions are adequately discussed. Albert D. Fields ADF/cls
