Hickenbottom, Al Fields, Morris Rose, James Sitton. Steve Gillett representing Jerry Hodge; John Dunham representing Joe Sease. MEMBERS OF THE COMMITTEE ABSENT: Greg Yakin, Ro ert Byars, Mar Williams, Ellis Ebarb, Tom Handy, Delbert Walker, H. Carlos Smith. READING OF MINUTES - Minutes of the February 25, 1982 meeting were rea . Motion to approve the minutes as read made by David Paulissen. Motion seconded: Wilson Dugger Ayes: All For Nays: None 3. OLD BUSINESS - Article3 - Division 5 - Section 3.11 (a-e) was again iscussed and tabled There was general discussion of Article 3 - Division 5 - Section 3.20, which was tabled as was Article 3 - Division 5 - Section 3.21 since they work in conjuncture with Article 3 - Division 5 - Section 3.11 (a-e) and more work will be needed on this Article before acceptable to all. FIRE CODE REVISION Artic e - Division 6 - Section 12.28 (a) After discussion by the Committee, the revision was made in Sub- section (a) to read as follows: ARTICLE 12 - CRYOGENIC FLUIDS DIVISION 6 TRANSPORTATION SEC. 2.2 Vehic e re uirements a Vehic e transporting cryogenic products shall be placarded as per DOT regulations. At no time shall an aforementioned vehicle be allowed to park in a predominately residential area or • LJ within two thousand (2,000) feet from a school campus, except in case of emergency, at which time the Fire Marshal shall be notified. All vehicles transporting cryogenic products shall follow preset truck routes as prescribed in Article 5 of the City. of La Porte Code of Ordinances and shall deviate from these routes only to make deliveries. Hickenbottom Motion seconded: Morris Rose Ayes: All For Nays: None FIRE CODE REVISION - Article 12 - Division 6 - Section 12.29 (a-b-c) A ter a brie iscussion by the Committee, this NEW SECTION was approved to read as follows: ARTICLE 12 CRYOGENIC FLUIDS DIVISION 6 TRANSPORTATION SEC. 9 Leavingvehic es transporting crvo~enic products unattended on streets, hi hwa s, etc., ar in tank vehicles. a No person s a eave a ve is e transporting cryogenic pro- ducts unattended in any street, highway, avenue, or alley, except that this shall not prevent: (1) The necessary absence of the driver in connection with loading or unlodaing of the vehicle, and except during actual discharge of the product, 'the provisions of Section 16.46 (b) shall apply. (2) Stops for meals during the day or night, if the street is well lighted at the point of parking. (3) When, in case of accident or other emergency, the operator must leave to obtain assistance. (b) At no time shall an unattached tank trailer be allowed to park in the city limits of La Porte except: (1) Inside a bulk plant and twenty-five (25) feet from the property line or within a building approved for such use. (2) At other locations approved by the Fire Marshal, but not less than fifty (50) feet from any building, except those approved for the storage or servicing of such vehicles. (3) When, in case of breakdown, or other emergency, the operator must leave the tank trailer to take necessary action to correct the emergency, at which time the Fire Marshal shall be notified. (c) No person shall park a vehicle transporting cryogenic products at any one point for longer than one hour, except: (1) Off of a street, highway, avenue, or alley at an approved location. (~) Inside a bulk plant and twenty-five (25) feet from the property line or within a building approved for such use. (3) At other approved locations not less than fifty (50) feet from any building, except those approved for the storage or servicing of such vehicles. • (4) When, in case. of breakdown operator must leave the vehicle to correct the emergency. A ication of article rovisions This artic e an or edera aws re ating to explosives as amended, whichever is more stringent, shall apply to the manufacture, possession, storage, sale, transportation and use of explosives and blasting agents. Motion made by: Al Fields Motion seconded: David Paulissen Ayes: All For Nays: None FIRE CODE REVISION - Article 15 - Division 1 - Section 15.2 A ter a iscussion by the Committee, the Article was approved to read as follows: rARTICLE 15: FIREWORKS DIVISION GENERALLY SECTI N Genera prohibition against manufacture, sale, disch- arge, transportation, etc., Except as otherwise specifically provided in this article: (a) It shall be unalwful for any person to manufacture, assemble, store, transport, or receive any fireworks of any description. (b) It shall be unlawful for any person to keep, sell or have in his possession with intent to sell, use, discharge, cause to be discharged, ignite, detonate, fire or otherwise set in action any fireworks of any description. Motion made by: David Paulissen Motion seconded: Morris Rose Ayes: All For Nays: None FIRE CODE REVISIONS - Article 15 - Division 1 - Section 15.8 (a-b) A ter iscussion by the Committee, the Article was approved to read as follows: ARTICLE 15: FIREWORKS DIVISION GENERALLY SECTION 5. Vio ation of article a Any person w o sha manufacture, assemble, store, transport, receive, keep, sell, offer for sale, or have in his possession any fireworks in violation of this article shall be fined two hundred dollars ($200.00) for each offense. If the fireworks are separately wrapped or or packaged, the doing or omitting to do any act prohibit- ed by this article shall be a separate offense as to each such separately wrapped or separately packaged fireworks. Each day that • • a violation of this article shall continue with respect to any pack- age of fireworks shall constitute a separate offense. (b) Any person who shall use, discharge, cause to be discharged, ignite, detonate, fire or otherwise set in action any fireworks in violation of this article shall be fined not less than twenty-five dollars ($25.00) nor more than two hundred dollars ($200.00). Any parent or guardian of any minor child below the age of fourteen (14) who permits or allows such minor child to use, discharge, ignite, detonate, fire or otherwise set in action any fireworks in violation of this article shall be fined not less than twenty-five dollars ($25.00) nor more than two hundred dollars ($200.00) Motion made by: David Paulissen Motion seconded:.
