3. OLD BUSINESS- Article 16 -Division 6 -Section 16.40 was discussed and
approved with changes as .follows:

servicing internal combustion engines, receiving or dispensing of flammable or
combustible liquids. "No Smoking-Stop Engine" signs shall be posted. The
placement of said signs shall be at each end of the pump island, clearly visible
to the person being served, or at the discretion of the Fire Marshal. Letters
on such signs shall be not less than two (2) inches in height and three-eights
(3/8) inch stroke on contrasting background. The motors of all vehicles being
fueled shall be shut off during fueling operations.
(b) At least two (2) 10 BC rated portable fire extinguishers in proper
working order are to be provided on the premises separated as far as practical,
consistent with the layout of she station and approved by the Fire rlarshal. At
least one of the aforementioned fire extinguishers must be within seventy-five
(75) feet of the pump island.
(c) The two (2) aforementioned fire extinguishers provided in accordance
with Subsection (b) of this section shall be inspected at least once a year by
afire extinguisher company licensed by the State of Texas for servicing of
portable fire extinguishers.
(d) Dispensing into portable containers. No delivery of any Class I
liquids shall be allowed into portable containers unless the container is U.L.
rated or Factory Mutual approved for such use and is properly labeled with the
word CASOLIl~.
(1) All approved portable containers over fifteen (15) gallon capacity
shall be secured while being transported in a manner approved by the
Fire Marshal.

(e) Daily inventory records shall be maintain and reconciled on all
Class I flammable liquid storage tanks for possible indication of leakage
from tanks or piping. Such records shall be made available to the office
of the Fire Marshal upon request.
(f) It shall be unlawful for any gasoline filling or service station
owner, lessee, operator, manager or other person in charge thereof to vacate
or discontinue doing a gasoline filling or service station business or any
similiar business there at without notice thereof and without having first
given the Fire Marshal at least five (5) days written notice thereof and
without having all storage tanks in a condition as provided for in Section
16.19 and without having such filling or service station building axxi the
premises surrounding the same and used in connection therewith cleared of all
rags, paper,cans and all other combustible rubbish and/or trash.

that this shall not prevent:

or unloading of the vehicle, and except during actual discharge of
the fuel, the provisions of Section 16.46 shall apply.
(2) Stops for meals during the day or night, if the street is
well lighted at the point of parking.
(3) When, in case of accident or other emergency, the operator
must leave to obtain assistance.
(b) At no time shall a vehicle transporting flammable and/or combustible
products be allowed to park in a predominately residential area or within two
thousand (2,000) feet of a school campus, except in case of emergency, at
which time the Fire Marshal shall be notified.
(c) At no time shall an unattached tank trailer, (empty or loaded) or other
types of trailer loaded wish flammable and/or combustible products be allowed
to park inside the city limits of La Porte except:
(1) Inside a bulk plant and twenty-five (25) feet from the property
line or within a building approved for such use.
(2) At other locations approved by the Fire Marshal but not less than
fifty (50) feet from any building except those approved for the storage
or servicing of such vehicle.
(3) When, in case of breakdown or other emergency, the operator must
leave the trailer to take necessary action to correct the emergency,
at which time the Fire Marshal shall be notified.
(d) No person shall park a vehicle transporting flammable or combustible
products at any one point for longer than one hour except:
(1) Off of a street, highway, avenue, or alley at an approved location.
(2) Inside a bulk plant and twenty-five (25) feet from the property
line or within a building approved for such use.
(3) At other approved locations not less than fifty (50) feet from
any building, except those approved for the storage or servicing of
such vehicle
(4) When, in case of breakdown or other emergency, the operator must
leave the vehicle to take necessary action to correct the emexgency.

(e) Vehicles transporting flammable and/or combustible products shall not be
parked or garaged in any building other than those specifically approved for use
by the Fire Marshal.

(a) Flammable and/or combustible spray finishing operations shall not be
conducted in buildings being used for assembly, educational, institutional
or residential occupancies, except in a room designed for the purpose,
protected with an approved system of automatic sprinklers and separated
vertically and horizontally from other areas by construction complying with
the requirements of the building code.
(b) In other occupancies, all flammable and/or combustible finishing
operations shall be performed in an approved spray booth.
(c) Flammable and/or combustible spray finishing operations shall be
prohibited in basements or sub-basements, except in approved spray booths and
by written permission of the Fire Marshal.

displayed upon each side and the front and rear of the vehicle, placards as per
DOT regulations. At no time shall a vehicle be allowed to park in a predominately
residential area, or within two thousand (2,000) feet of a school campus, except
in case of emergency, at which time the Fire Marshal's office shall be notified.

All vehicles transporting hazardous materials shall b e in proper repair and
follow preset truck routes as prescribed in Article 5 of the City of La
Porte Code of Ordinances and shall deviate from these routes only to make
deliveries.
(a) No person shall leave a vehicle transporting hazardous materials
unattended on any street, highway, avenue, or alley, except that this shall
not prevent:
(1) The necessary absence of the driver in connection with loading
or unloading of the product, the provisions of Section 16.46 (b)
shall apply.

transporting of liquified petroleum gases shall be in accordance with Article 16,
Division 7 of this code and Docket 1 of the L.P. Gas Division of the Railroad
Commission.
(b) During the unloading or transfer of liquified petroleimn gas, the
vehicle shall be located or parked clear of public thoroughfare, unless:
(1) The failure to transfer would create a hazard.
(2) It is impossible due to topography.
(c) Industrial trucks, powered by L.P. gas, when not in use shall be
parked in areas approved by the Fire Marshal or his representative.
(1) All fueling operations for L.P. gas equipment shall be done in
an approved mariner and location.
(2) Each piece of equipment using L.P. gas as a fuel shall have one
approved fire extinguisher of a minimtIIn 5 BC rating attached to the
equipment.
(3) Storage of L.P, gas containers for this type service shall not
exceed the requirements of Division II of Docket 1.

Article 31- Division 2 -Sec. 31.17 was read and approved as presented:
ARTICLE 31: SPECIAL OCCUPANCIES
DIVISION SCHOOLS AND EDUCATIONAL INSTITUTIONS (EXCLUDING: COLLEGES,
UNIVERSITIES, ETC.
L Doors, exits, installation of warning equipment, fire drills in
scnools.
-~~ Doors and exits:
(1) No superintendent, principal, teacher, or other person in charge
of any building used for a public, private, or parochial school or
any other type educational institution shall either lock or permit
to be locked, any exit doors leading from such building during such
time a.s said building is occupied.
(2) All exit doors leading from schools or educational institutions
shall open outward and be equipped with approved panic hardware.
(b) Installation of .warning equipment. The superintendent, principal,
teacher, or any other person in charge of maintenance in a public, private,
or parochial school or any other educational institution shall erect, install,
and maintain in good condition any and all required illuminated exit signs.
The required fire alarm system in a public, private, parochial school or any
other educational institution shall be installed as per N.F.P.A. standards and
inter-corniected with all buildings on campus. The abovementianed fire alarm
system shall be independent in sound from and not cocmected to the class bell
change system. Maintenance and inspection of the fire alarm system shall be
done by a fire alarm installation superintendent with a current license issued
by the State Fire Marshal. All new fire alarm systems must be tested and
approved by the La Porte Fire Marshal or his designated representative prior to
the time such building is occupied by students.
(c) Fire drills
(1) The superintendent, principal, teacher or person in charge of
any public, private , or parochial school or educational institution
shall prepare a plan of evacuation of the building which is approved
by the Fire Marshal or his designated representative to be used in
event of fire and shall post such plan of evacuation in every class-
room where it is clearly visible and shall be responsible, furthermore
that every teacher and student occupying such building is thoroughly
indoctrinated in the evacuation procedure.
(2) The Fire Marshal or his designated representative is authorized
to enter any public, private, or parochial school or other educational
institution at any time without notice and conduct a fire drill.
(3) It shall be the duty of the superintendent, principal, teacher,
or other person in charge pf any public, private, or parochial school
or educa.tianal institution to hold one classroom and one assembly
fire drill each month and make written reports thereof to the Fire
Marshal at the end of each month or part thereof that such school is
in session, giving the time and date each fire drill is held during
the mrmth.
(4) All students in any public, private, or parochi.a.l school building
or any other educational institution shall immediately leave the
school building upon the sounding of a fire alarm in accordance with
the evacuation plan prepared for the school.
(d) Delay in sounding alarm is prohibited. No superintendent principal,
teacher, or other person in charge of any public, private, or parochial school
or other educational institution shall cause or permit any delay in sounding of
fire alarm or evacuation of the building when receiving a signal from any auto-
matic or manual fire alarm station.

SEC. Dai y inspection required; general procedures for conducting fire
gills .
-~ The superintendent, principal, teacher, or person in charge of any
public, private or parochial school or any other educational institution shall
make a daily inspection of the school building and eliminate any violations of
the fire code of the City of La Porte he may discover, immediately. This duty
applies during the school term when the school building is occupied by students.
(b) The following general procedures shall be used in conducting fire
drills in public,private, parochial and other educatiana.l institutions:
(1) Drills shall be conducted without warning and should simulate
fire conditions.
(2) Drills should not be held during weather when the children going
outside without their wraps would be unnecessarily exposed to extreme
cold, rain or snow.
(3) School fire exit drills are an exercise in discipline, not speed,
though reasonable prompt emptying of the building is required.
(4) No rurming or horseplay shall be tolerated. Children should not
be permitted to stop to put an wraps.
(5) No teacher or student should be permitted to remain in the
building during a fire drill.
(6) The drill shall include a rollcall by classes outside the building
to make sure that no one is left behind. There shall also be a
routine for a complete check of the entire building, including toilet
roams, to make sure that no one is left behind.
(7) Close all doors to classrooms before leaving.
(8) All exits shall be used in drills, but routes should be varied
from drill to drill. Occasional drills should be held simulating
conditions when one exit cat~mot be used because it is blocked by fire
or smoke. All drills shall include provisions to sim.~late calling the
fire department.
(9) In a very small school (50 students or less) an elaborate fire
alarm system is not necessary. A manually operated whistle or bell is
sufficient if it can be clearly heard in all parts of the building and
is approved by the Fire Marshal.
(10) All schools (50 students or more) are required to have a fire
alarm system. Said alarm system shall be installed as per N.F.P.A.
standards. Fire alarms and fire warning systems protecting areas
requiring more than four (4) manual stations shall be provided with
zone indicating devices such as annunciator panels for non-coded
systems or tape registers for coded-type systems to indicate the zone
or area location of the fire as required by the Fire Marshal.
EXCEPTIONS:
(1) School occupancies of single story construction. Fire alarm systems of the
automatic type employing heat-actuated devices to initiate a warning signal shall be
provided with zone indicating devices, as required by the Fire P?arshal. All schools
shall use the same fire drill signal, (march-cadence-horn), to prevent delays and
confusion of students during fire drills.

(11) Fire Drill Procedure

orderly manner.
2 Whistle blasts or 2 bell rings - Return to roam.
Schools (50 students or more)

SEC. 31.19 Fire Ext' 'shers

shall be provided on each floor and distributed throughout the structure or
premises in such a mariner that the horizontal distance of travel to the nearest
unit from any point in a building shall not exceed seventy-five (75) feet.
(b) One or more additional extinguishers of suitable type and size shall be
installed for the protection of special hazards as designated by the Fire Marshal.
These shall include:
(1) Stages. One extinguisher having a 2A only classification on each
side of the stage.
(2) Kitchens and laboratories. Kitchens shall have extinguishers having
a 2A lOBC classification and vent hoods st~.ll have an approved
vent hoed fire extinguishing system. Laboratories shall have
extinguishers with a 2A lOBC classification,
(3) Storage areas and work shops. Extinguishers•liaving an A,B, or C
classification, as type and extent of hazard indicate.
(c) Training of teachers, custodial personnel, in use of extinguishers shall
be done under a continuing plan approved by the Fire Marshal. At all times there
shall be a miniurnan of two (2) trained personnel available and gross average of one
trained individual per each one htmdred(100) occupants or major fraction.
(d) An approved contingency plan for various emergencies shall be prepared
for each school facility and subject to annual review. This plan shall include
(but not limited to):
(1) Designate ambulance loading location.
(2) Means of sending afire alarm.
(3) Contingency location for inclement weather and wind storms.
(4) Emergency points of entry through fences, walls and gates.
(5) Exact procedures for transmitting alarm of fire to the La Porte
Fire Department.
(e) An annual pressure test shall be made of all gas piping in compliance with
Article 3, Division 6 of this code.
