Call to Order Chairman Jones called the meeting to order at 7:15 p.m. Members Present: B. Compton, J. Suggs, J. Joerns, J. Jones, J. Oliphant, and M. Campise Members Absent: T. Dye Others Present: None 2. Consider Approval of Minutes of April 18, 2005 Meeting Motion to approve minutes as read was made by Mr. Compton and seconded by Mr. Campise. Motion passed unanimously. 3. Administer Oath of Office for Members not Previously Sworn in: Jack Oliphant, Mark Campise Mr. Jones administered the Oath of Office to Mr. Oliphant and Mr. Campise. 4. Consider Approval or Other Action Regarding Certification of Physical Fitness for Members for the Following Situations: Existing Members, New Members, Use of Employment Physicals Obtained by Members Following some discussion between trustees, Mr. Compton made a motion that the payment of certifications of physical fitness be made from the Fire Chiefs budget. Seconded by Mr. Campise. Motion passed unanimously. 5. Consider approval of retirement for member Steve Reynolds. Motion to approve Mr. Reynolds retirement was made by Mr. Campise and seconded by Mr. Suggs. Motion passed unanimously. 6. Consider approval or other action regarding It was decided that after the third month of a member's Leave of Absence the member should be removed from the pension system. The member would be reinstated upon return to service. A motion to allow Chairman Jones to proceed with a recommendation to members relative to the necessary constitutional amendment was made by Mr. Suggs and seconded by Mr. Oliphant. Motion passed unanimously. 7. Administrative Reports No reports 8. Board Members Comments Mr. Jones reported City Council's intent to increase City funding for pension from $35 to $55 per member, per month - pending final Council approval. 9. Enclosures PENSION SYSTEM CONTRACT AMENDMENT TEXAS EMERGENCY SERVICES RETIREMENT SYSTEM City of La Porte on behalf of the La Porte Volunteer Fire Department Effective October 1 , 2005 Page 1 of 3 SECTION I. PENSION SYSTEM CONTRACT AMENDMENT The Office of the Fire Fighters' Pension Commissioner (the "Office") on behalf of the Board of Trustees of the Texas Emergency Services Retirement System ("System") and the City of La Porte (Governing Entity), on behalf of La Porte Volunteer Fire Department. ("Participating Departmenf') hereby agree to this Amendment of the Fund Contract effective December 1, 1999. The Contract is amended to increase the participating department contribution rate by $20 per month per member from $35 to $55 effective October 1, 2005. All other terms of the Fund Contract, including any portion of the amended document that is not expressly amended below, remain in effect. SECTION II. AUTHORITY This Contract is entered pursuant to the statutory authority of the Title 8, Government Code, Subtitle H Texas Emergency Services Retirement System. SECTION III. PARTIES This Contract is made and entered into by and between the Participating Department, the Governing Entity, and the Commissioner on behalf of the System. The parties, in consideration of their respective agreements and covenants contained and recited herein, agree to the mutual obligations and performance of the tasks hereafter described, and contract as set forth below. A. The Participating Department: La Porte Volunteer Fire Department is a public entity that performs fire, rescue, or emergency medical services with a mailing address of P.O. Box 713, La Porte, TX 77572. B. The Governing Entity: The City of La Porte is a municipality of the State of Texas. The billing address is 604 W. Fairmont Parkway, La Porte TX 77571. C. The Commissioner: The Office of the Fire Fighters' Pension Commissioner is an agency of the State of Texas and is located at 920 Colorado Street, Austin TX 78711. SECTION IV. CONTRACT PERIOD This Contract Amendment is effective October 1, 2005. SECTION V. AMENDMENT AND ASSIGNMENT Except as otherwise provided herein, any amendment or other modification of any term of this Contract must be in writing and signed by parties. WITHDRAWAL FROM THE PENSION SYSTEM A governing body that has elected to participate in this system may not rescind that election. SECTION VII. SERVICES PROVIDED BY THE PENSION SYSTEM A. The System shall provide pension, disability and survivor benefits provided by the Texas Emergency Services Retirement System to each person who performs service as a volunteer and auxiliary member of the Participating Department. The administration of the System is governed by the System rules (Texas Administrative Code Title 34, Part 11, Chapters 302, 304, 306, 308, and 310.) B. On behalf of the Governing Entity, the Office will administer the Governing Entity's Texas Local Fire Fighter Retirement Act (TLFFRA) pension program. The Office will pay a monthly pension of $50.00 to each TLFFRA retiree. SECTION VIII. REQUIRED CONTRIBUTIONS AND REPORTS A. The Governing Entity shall make monthly contributions on behalf the Participating Department in the amount of $55.00 per active member in the participating department. B. The Governing Entity shall reimburse the Office for all TLFFRA pension payments made on behalf of the Governing Entity. C. Membership Reconciliation Report 1. The Commissioner shall send to the Chairman of the Local Board of Trustees of each participating department, 30 days before the last day of the quarter, a pension roster report detailing the name of each member of the department who is identified as a member of the retirement system, and a summary of contribution charges and credits. This pension roster report will fully disclose the basis for the billing. 2. The Chairman of the Local Board of Trustees or department head shall review the accuracy of the pension roster report. To add or terminate members incorrectly identified in the pension roster report, departments must file appropriate personnel forms to add or terminate members. 3. To facilitate the collection of member contributions, the Chairman of the Local Board of Trustees of each participating department, before 10 days of the last day of the quarter, shall file with the Commissioner a certified membership roster that states the name of each member of the department who is a member of the retirement systems. D. Billing PENSION SYSTEM CONTRACT AMENDMENT TEXAS EMERGENCY SERVICES RETIREMENT SYSTEM City of La Porte on behalf of the La Porte Volunteer Fire Department Effective October 1, 2005 Page 3 of 3 1. The Commissioner shall bill governing entities on a quarterly basis on the last business day of November, February, May, and August. 2. To receive payment, the Office shall submit an invoice summarizing contribution charges to the billing address of the Governing Entity. 3. The Commissioner shall bill the governing entity for: a) Monthly contributions for participating members, b) Prior service contributions, c) TLFFRA pension payments on behalf of the department, d) Late payment interest charges, e) Administrative penalties, and f) Other appropriate charges. E. Payments are due within 30 days after the invoice date. Late payments accrue interest at the most recent assumed actuarial rate of return on investments of the fund. SECTION IX. GOVERNING LAW This Contract shall be construed in accordance with and governed by the laws of the State of Texas. Venue for the resolution of any and all litigation arising under this Contract shall be in the courts of competent jurisdiction in Austin, Travis County, Texas. Austin, Texas 78701 GENTLEMEN: Complying with the provisions of the Firemen's Relief and Retirement Fund SB 411, Acts of the 65th Legislature, Regular Session, 1977, we wish to advise that: 1. The City of La Porte, Texas, held a meeting on August 5, 1981, and have decided to participate under the provisions of the above Act beginning on July 1, 1981. (Effective date of entry.) 2. Contributions by the governing body are to be made payable to the "Firemen's Relief and Retire- ment Fund SB 411", and mailed to the office of the Firemen's Pension Commissioner. The contributions are to be paid in advance, at least semiannually, as required by the provisions of SB 411. a. Contributions of at least $12.00 per month will be made in behalf of each participating firefighter, to be paid in advance and at least semiannually. b. A sump sum payout has been chosen to fund the buy back (with accrued time) and/or the accrued time (without buy back) according to the pro- 2 d.
