The meeting was called to order at 6:35 P.M. by President Jerry Bramlett. MEMBERS PRESENT: President Jerry Bramlett, Vice-President Al Fields, Secretary, Rick Matthews, Member Cary Burnley. OTHERS PRESENT: City Manager Bob Herrera, Authority Attorney John Armstrong, Acting Director of Public Works Steve Gillett, Neil Bishop and Cecil Allen of Turner Collie & Braden. 2. Motion was made and seconded to approve the minutes of the meeting held on September 25, 1986. It passed unanimously. 3. Mr. Bob Herrera was introduced to the Board and reported that he had met with Ron Neighbors of the Harris-Galveston Coastal Subsidence District. He also had a meeting with Lannie Lambert, City Manager, City of Seabrook, on their plans for conversion to surface water. 4. The City Council of La Porte approved on November 3, 1986, the sum of $10,000 to retain legal counsel for the La Porte Area Water.~uthority whose functions will include the study of raw water contracts, the study of the proposed Houston contract and advise to the Board on which direction to take. Motion was made for the City Manager to research and review attorneys well versed in water law and to provide the Authority with several possibilities to choose from. Passed unanimously. 5. Motion was made to elect new officers as follows: President - Cary Burnley, Vice President - Al Fields, Secretary - Rick Matthews. Passed unanimously. OTHER BUSINESS NOT ON AGENDA: Steve Gillett reported that on November 12, 1986, at 7:00 P.M., the City of Houston and Friendswood would hold a meeting at the Subsidence District to discuss the Southeast Plant. Also, DuPont has contacted Steve to discuss their raw water contract with CIWA that they wanted to get out of. Copies of the contract will be delivered on Friday. This meeting was to discuss surface water supplies, and the role of the La Porte Area Water Authority. PERSONS PRESENT: Norman Malone, Mayor, City of La Porte, Bob T. Herrera, City Manager, City of La Porte, Steve Gillett, Public Works Director, City of La Porte, Cary Burnley, President, La Porte Area Water Authority Board, John Grimes, Mayor, City of Morgan's Point, Roy Fuller, City Attorney, City of Morgan's Point, Bill Haiflick, Mayor, City of Shoreacres, George Mahlstedt, Director, Bay MUD, R. C. Morris, Bay MUD member. Cary Burnley, La Porte Area Water Authority President, briefed the group on the history of the Authority 1 and its present position. John Grimes, Mayor of Morgan's Point asked what the Authority would do if the attorney retained by the Authority rendered the opinion that Houston could not limit contract period for raw water. It was stated that the Authority would request Houston to supply raw water on a 20 year basis, and if Houston refused, Authority would conside'r qoing to the Texas Water Commission. A discussion was held on what would happen if the attorney ruled Houston could offer a contract for any term wanted. A question was raised as to whether a signed contract or a letter of intent is needed by January 1, 1987 to purchase capacity at the Southeast Water Treatment Plant. Roy Fuller, City Attorney for the City of Morgan's Point will call the City of Houston in order to get answer __ to this question, and he will report back to the Authority. There is a meeting scheduled on December 9, 1986 at 5:30 P.M. at City Hall to update the area cities. Please schedule on your calendars. SG/lw
