Call to Order President Pat Muston called the meeting to order at 5:04 p.m. Members Present: Pat Muston, Bill Love, Tommy Moser, Chuck Engelken, Mike Clausen and Deborah Johnson Members Absent: Ed Matuszak and Peter Griffiths. Staff Present: City Secretary Martha Gillett, Assistant City Manager John Joerns, Assistant Finance Director Michael Dolby, Assistant City Manager John Joerns and City Manager Debra Feazelle Others Present: Gina Manlove, Quality of Life Task Force Committee Chairman 2. Motion was made by Chuck Engelken to aPlJrove the Minutes of March 28.2005 . Second by Bill Love. Motion carried unanimously. Receive Report from Alliance on Quality of Life Task Force -Project Stars- Alliance Representative-Quality of Life Task Force Committee Chairman Gina Manlove provided the Board with report from Alliance on Quality of Life Task Force - Project Stars. In addition, she provided the members handouts. The committee noted they want to know at a future meeting whether or not 4b could expend funds on Project Stars. 4. Receive current financial report/sales tax analysis. Assistant Finance Director Michael Dolby provided the board with an overview of the financial report and sales tax analysis. 5. Receive Report on Health Care Meeting Update Assistant City Manager John Joerns provided the Board with report on Health Care Meeting Update He informed that Harris County is still considering La Porte for a potential location of a medical facility. Bayshore Medical Center is making a presence in La Porte and considering a facility similar to the one located on Fairmont Parkway and Jana in La Porte. 6. Receive Report on Beautification Efforts - Tree City USA- La Porte Development COIl'oration - 7/11/05 - Page 2 Assistant City Manger John Joerns provided the Board with report on Beautification Efforts - Tree City USA. He informed the Board the City Council just adopted and ordinance to make La Porte a part of the Tree City USA program. 7. Administrative Reports There were no administrative reports. 8. Legislative Update Assistant City Manager John Joerns provided the board with an overview on recent legislative bills affecting the 4b board. 9. Board Comments There were no board comments. 10. The FY05-06 Budget includes funds for an Economic Development Study focusing on retail opportunities. One company that provides such focus on retail is Buxton & Associates. The proposal from Buxton offers a 10% price reduction (from $70,000 to $63,000) if the City is willing to execute an agreement by September 30,2005. The product is a sole source product. The scope of services to be provided by Buxton includes: Retail Potential and Retail Site Determination 1. Establishment of retail trade areas for each site based upon drive times 2. Analysis to the suitability of each site and its trade area. Factors considered include but are not limited to: a. Psychographic analysis of households b. Demand for retail goods and services c. Existing retail and retail trends in the trade area and surrounding region d. Site setting, situation and configuration e. Growth plans and relevant developments 3. Buxton recommendation of the retail site and trade area with the most potential 4. The City Council hereby approves and authorizes the contract, agreement, or other undertaking described in the title of this ordinance, a copy of which is on file in the office of the City Secretary. The City Manager is hereby authorized to execute such document and all related documents on behalf of the City of La Porte. The City Secretary is hereby authorized to attest to all such signatures and to affix the seal of the City to all documents. Section 2. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government Code; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 3. The objective of this proposal is to summarize and outline the comprehensive scope of work Buxton will provide as the City of LaPorte pursues its retail attraction and expansion goals. Please note that in this proposal the term "retail" is inclusive of restaurants. Utilizing data, methods and proprietary technologies developed specifically for matching retailers with communities; Buxton will assess the potential for the City of LaPorte to recruit and expand its retail sector, and will identify and provide marketing packages for specific retail targets. Buxton's initial analysis of up to three (3) distinct retail locations, selected by the City of LaPorte, will yield a recommendation of the site best positioned for retail recruitment. With that recommendation, the City of LaPorte will make a final determination of the retail site to be selected for retail matching. Once the site for retail matching is determined, Buxton will compare the site's trade area with the established locations of individual retailers. This analysis results in a preliminary list of matched retailers. Only retailers with locations in trade areas similar to the City of LaPorte's trade area will be identified as potential matches. The preliminary list is then refined by Buxton on the basis of other retail location criteria to yield a list of up to twenty (20) specific, matched retailers for the City of LaPorte. Buxton will provide the list of matched retailers to the City of LaPorte for review and discussion. A marketing package will be prepared for each targeted retailer. The marketing packages are intended for presentation to retailers, as well as developers, potential franchisees, or other persons in a position to support the City of LaPorte's retail goals. Each marketing package is unique to the specific targeted retailer, providing compelling and precise information that demonstrates the City of LaPorte's qualifications as a location. Additionally, Buxton will contact each targeted retailer on behalf of the City of LaPorte. Buxton will notify the retailer that the City of LaPorte has been identified as a potentially viable location. Following is an outline of the scope of work for this project. The SCOUT system is a professional online location management system. The system provides high-level dynamic mapping and site score sheets as well as demographic report reviewing capabilities. The SCOUT system is comprised of four (4) primary components, which enables the City of LaPorte users the ability to navigate the system for the purpose of viewing, organizing, searching, and querying site location data. These 4 components are as follows: . Search Engine · Mapping Tool . File Depository Specifically, these components will enable the City of LaPorte personnel the following capabilities: Search Engine - View existing and potential locations by type, market, and other user defined criteria. Mapping Tool - View the data visually at any geographic level with filters for including existing and potential locations, retail centers, traffic counts, and any other user defined point or region data. File Depository - Store and archive virtually any document or report related to any respective existing or potential site, including aerials, lease documents, financial reports and property management documents. The password protected SCOUT system will be accessed via the internet by the City of LaPorte personnel or any interested parties authorized by the City of LaPorte. Internet access service and related computer systems will be provided by the City of LaPorte. Buxton. The City of LaPorte is eligible to receive a ten (10) percent discount if this agreement is executed by September 30, 2005, for a discounted price of $63,000 payable as follows; 1. $10,000 due upon execution of this agreement 2. $21,500 due upon project kick-off 3. $20,000 due upon determination by the city of the site for retail matching 4. $11,500 due upon delivery of retail marketing packages The City of LaPorte agrees to pay Buxton the pre-arranged, mutually agreed actual cost of travel associated with services rendered. This does not include travel associated with the presentation or negotiation of this agreement. It only includes travel costs incurred by Buxton at the request of the City of LaPorte; such as for a community presentation or workshop following completion of the project. For services specifically requested by the City of LaPorte and performed by Buxton outside the scope of this agreement, an hourly rate of $200 will apply. This agreement may be terminated by either party at any time upon written notice of thirty (30) days. If this agreement is terminated, Buxton will be paid for services performed up to the date the written notice is received. In order to avoid paying State of Texas Sales and Use Tax, the City of LaPorte may be required to provide Buxton with a certificate indicating it is a non- profit corporation and not subject to Texas Sales and Use Tax. The Parties agree that an independent contractor/employer relationship is created as a result of this agreement. This agreement may be terminated by either party at any time upon written notice of thirty (30) days. If this agreement is terminated, Buxton will be paid for services performed up to the date the written notice is received.
