Minutes of the Regular Meeting
of the Main Street Committee
August 2, 2004
1. CALL TO ORDER
The meeting was called to order at 7:00 P.M. by Bill Manning, Chairperson.
2. ROLL CALL
Introduction and brief statements received from Members of the Committee Present: Nick Finan,
Debra Dye, Brenda Brown, Bill Manning, Doug Martin, Paul Berner, Pat Muston, Gloria Lair,
Vicki Campise, Deborah Johnson and Bobby Schlenk.
3. PRESENTATION OF DRAFT RECOMMENDATION FOR MAIN STREET DISTRICT
ZONING CLASSIFICATION.
Interim Planning Director Nick Finan described the boundaries of the proposed district and
reviewed a comparison of current and proposed regulations.
4. CONDUCT PUBLIC HEARING ON DRAFT RECOMMENDATION FOR MAIN STREET
DISTRICT ZONING CLASSIFICATION.
The public hearing began at 7:35 P.M. The following individuals offered comments:
W. Cooper -109 San Jacinto: Happy with the City of La Porte. Likes the idea of allowing
residential with commercial.
W. T. (Bill) Manning, Jr. -108 S. 2"d: Likes the Committee's recommendations. Asked how front
parking requirements would affect residential. Debra Dye stated it would only apply to the overlay
district.
Brent Heckendorn - 518 W. Main: Concerned about parking in the rear setback area. His business
(Allen-Kerber) utilizes front parking, similar to some of the other nearby businesses. Suggested
separating the businesses in the 500 Block of Main west to SH 146 from the other businesses along
Main, with regard to parking.
Kathleen Lemon - 601 W. Main: Excellent work by the Committee. Also utilizes front parking for
business. If ever expanded, would want to retain the same character. Likes commerciaVresidential
mix.
Don Hulen -111 S. 8`s: Owns tool business on S. 8t". Trying to understand how the proposed
district will affect his business.
JJ Meza -10310 Winding Trail: Owns several properties in the subject area. Opposes restrictive
ordinances. Concerned he will lose the rights to use his property as residential and continued
outdoor storage of personal property.
Larry Zaborowski - 211 S. 1St: Concerned with the 20' rear setback for his residential property.
Tom Parker -101 E Main (Two Sisters): Owns the block from Broadway to Virginia on East
Main. He had to provide required parking when he built his building. Not fair others will not be

required to do the same. Additional lot coverage will affect drainage. Disadvantaged because
traffic can't get to his business when barricades go up at Broadway for Main St. events.
A. J. France -resides at 202 S. 2"a: Owned a business on Main St. for 11 years. Wants City to
provide final recommendation in writing for property owners to review prior to adoption.
Mike Shanahan - 200 S. Virginia: Concerned that the proposed setbacks would result in the alley
between San Jacinto and Virginia being opened for commercial traffic.
B. Don Skelton - 233 San Jacinto: Previously met with the Committee. Likes the idea of
residential and commercial uses.
Chairperson Manning closed the public hearing at 8:13 P.M.
5. DISCUSS AND POSSIBLY TAKE ACTION ON DRAFT RECOMMENDATION FOR MAIN
STREET DISTRICT ZONING CLASSIFICATION.
Mr. Finan explained the order of events that will occur. Staff will work with the City Attorney to
draft the committee's recommendations in ordinance form. The Committee will have an
opportunity to review the drafted ordinance and then make a recommendation to the Planning and
Zoning Commission. The Planning and Zoning Commission will perform a review and forward
their recommendation to City Council for final action.
Chairperson Manning stressed the importance of forwarding to the Planning and Zoning
Commission, the concerns expressed during the public hearing. These and other issues include
boundaries, commerciaUresidential mixed uses, parking, drainage, lighting, sidewalks, setbacks, lot
coverage, landscaping, signage, and dumpsters.
Motion by Pat Muston to accept the proposal presented for the Main Street District zoning
classification, with the noted exceptions and clarification of language. Second by Deborah
Johnson.
Discussion ensued as to what specific exceptions the Committee wanted to include as part of the
motion. Chairperson Manning called fora 15-minute recess at 9:03 P.M. The meeting reconvened
at 9:18 P.M. Discussion continued.
Motion by Pat Muston to withdraw the previous motion. Second by Deborah Johnson. The motion
carried unanimously.
Motion by Paul Berner to approve the recommendation for the Main Street District zoning
classification as presented by staff. Second by Deborah Johnson. The motion carried with all
Committee Members in favor with the exception of Bobby Schlenk and Brenda Brown, who voted
in opposition.
6. COMMENTS FROM COMMITTEE MEMBERS
There were none.
7. ADJOURN
Chairperson Manning adjourned the meeting at 9:30 P.M.

fl noticed that a footnote #7 was listed in the headings but there was no footnote to Qo with it, so I incorporated
your footnote into #7 and also added it to the Max Height column. Somehow neither Gwen Goodwin, John nor I
caught that when it was sent in to MCC.1
I created a new subdivision V. under Division 3 and left Sec. 106-500 through 106-509 as.reserved for any
additions to Subdivision IV. General Commercial District. That is unless the Main Street AveFlay District will be
classified as being part of the Subdivision IV. General Commercial District. I agree with how you did it.
Division 3. Commercial District Regulations
Subdivision V. Main Street Avefls~ District with Overlav -
Sec.106-570 Purpose
The purpose of the Main Street AveAay-District is to preserve then character of the original Main Street
area of La Porte. The intent ~AFit#iaof a Main Street District within an Overlay area~i##ir~ n~,;., c«~ee~ «~e ;.,+e.,• is
to allow greater flexibility oaf normal Citv requirements and create an environment reflective of an era when travel
was based less on vehicular traffic and more on pedestrian access aa~with retail trade morewas closely
clustered.. .The ea neral boundaries of the Main Street Overlay portion of the District shall be from SH 146 to
Kansas, from the allev one half block north to the alley one half block south of Main Street.-alley (except one

Sec. 106-511 Permitted, accessory, and special conditional uses.
Commercial and all residential activities, except warehousing and storage; however, owner or incidental
to a primary business would be allowed. Refer to Table A, Main Street Overlay uses, section 106-441
Sec. 106-512 Density/intensity regulations.

Sec. 106-513 Special regulations and procedures.
For new construction no customer parking is required; however, businesses are required to provide a
minimum of two employee parking spaces. Also for new construction, no parking lots shall be developed in front
of the building within the Overlav portion of the Main Street District . Alley ways within the district shall be
considered as driving aisles for the purposes of parking requirements.
.Each business is allowed one wall sign not to cover more than 25% of the their exterior facade, as well
as one shingle with a maximum face of 15 sq. ft. ep r side and a required 8 ft. minimum clearance.
When most of a dumpster is visible from a public street the sdumpsters shallwill be screened.
If it is visible only via the alley from a public
street, screening will not be required.
