HomeMy WebLinkAbout10-12-06 Ad Hoc Meet and Confer Law Review Committee Minutes MINUTES OF AD HOC MEET AND CONFER LAW REVIEW COMMITTEE MEETING October 12, 2006 1. The meeting was called to order by Chairman Barry Beasley at 6:04 p.m. Members Present: Councilmembers Moser, Beasley, Mosteit, Police Chief Richard Reff, City Attorney Clark Askins and Patrol Officer/President of La Porte Police Officer's Association Matt Novosad. Members Absent: Councilman Engelken and Alternate Councilman Clausen. Others Present: Assistant City Secretary Sharon Harris, Patrol Sergeant Matt Daeumer, Patrol Officer Nathan Gates, L.P.l.S.D. Officer Brian Larkey and John Handy ofthe Houston Chronicle. 2. Motion was made by Council member Mosteit to approve the minutes of the Ad Hoc Meet and Confer Law Review Committee Meeting held on September 18, 2006. Second by Council member Moser. 3. Chairperson Barry Beasley advised the committee the petition had been signed by La Porte Police Officer's Association but the thirty days would begin when the original petition is formally presented to the full governing body at the October 23,2006 City Council Meeting. Matt Novosad informed the committee the La Porte Police Officer's Association also was in full agreement. Matt Novosad President of La Porte Police Officer's Association read the cover page of the petition to the committee and informed there was 100% signature participation of the La Porte Police Officers Association. The petition took a week to obtain signatures due to the different schedules of the Police Officers. There were a total of sixty seven eligible signatures. Chief of Police Richard Reff and Assistant Chief of Police Aaron Corrales were not eligible due to Constitutional By-Laws and the Meet and Confer Law, another not eligible was a Police Officer employed by the City of La Porte at the academy as a cadet and not a commissioned Peace Officer and a non member of the La Porte Police Officer's Association. 4. The committee discussed the three options for action of the petition. 1. The full governing body may recognize the La Porte Police Officer's Association petition and grant recognition of the Association as the police officers bargaining unit and not have to conduct an election by voters. 2. The full governing body may defer recognition and order an election by the voters regarding whether or not the City may meet and confer with the Association. 3. The full governing body may order a certification election under section 142.053 paragraph 3 of the Local Government Code to determine whether the Association represents the majority of the affected police officers. 5. Councilman Mosteit made a motion to the committee to recommend the full governing body to accept the petition at the October 23, 2006 City Council Meeting as signed by the La Porte Police Officer's Association and recognize the Association as the police officers bargaining unit and not have to conduct an election by voters. Second by Councilman Moser. Chairman Beasley also in agreement with motions. 6. The committee discussed providing a report from the committee to the full governing body October 23, 2006, presentation of petition from La Porte Police Officer's Association and a possible action item. 7.
