THE CITY OF LA PORTE MEET AND CONFER COMMITTEE MET THE 19TH

I. CALL TO ORDER
The meeting was called to order at approximately 2: 10

OFFICERS ASSOCIATION (LPPOA) IN ATTENDANCE

3. OPEN DISCUSSION RELATING TO ITEMS PREVIOUSLY INTRODUCED
BY POLICE ASSOCIATION AND/OR CITY OF LA PORTE
a) The Association and City agreed that the wage scale would be retro
active as of I May2009.
b) The Association addressed concerns about Article 7 regarding comp
time. The City stated that it must be able to buyout comp time,
responsibly. New wording indicates that there must be a written
request for comp time. Both City and Association agreed on
wording,
c) The Association addressed the need to change wording for Duration
section, Article 9. The City and Association agreed that wording to
be added would be that "both parties would have to mutually agree
to extension" indicating that both would benefit from the extension.
d) The Association requested clarification on Officer Ranks, Article 2.
The City clarified that if you are an experienced officer then you
may bypass the civil service exam and enter with no seniority.
e) Physical Fitness pay was clarified by the city that if an officer is
taking a Physical Fitness test then they will be paid for that time,
however, training on the side to maintain physical fitness is not
covered under this article.
f) Wages and incentives concerning "top-out officers" in the evaluation ~-
process were discussed. The Association requested the same process
be applied to topped out officers as is to an officer who still-receives
a step increase. The City defended that this could compromise the
quality and objectivity of evaluations. The Association did indicate
that they would like to implement a training course on evaluations to
be sure they are done appropriately. The results of this discussion are
still pending.
g) Grievance procedure in regards to which type of 3rd party
intervention would be used in order to clear disputes was discussed.
The Association proposed that binding arbitration be used and The
City indicated that as advised by multiple attorneys, that binding
arbitration was not in the best interest of the City. The Association
voiced their concerns with what has been sacrificed in order to be
civil service. The Association broke for caucus and returned
indicating that they would agree to mediation, if and only if that in
the case of an unfavorable result they may be able to then engage in
arbitration. The City broke for caucus and answered that they cannot
go against the legal advice provided, that it would cause detriment to
The City. The Association then requested the matter be brought
before Council. This subject, too, is pending.
