THE CITY OF LA PORTE MEET & CONFER COMMITTEE MET THE 25TH
DAY OF JANUARY, 2011, 4:00 P.M. AT CITY HALL, COUNCIL CHAMBERS, 604
WEST F AIRMONT PARKWAY, LA PORTE, TEXAS.
I. CALL TO ORDER
The meeting was called to order at 4: 1 0 p.m. In attendance were committee
members: Traci Leach, Assistant City Manager, Ken Adcox, Chief of Police, Ron
Parker, Assistant Chief of Police, Heather Weger, Human Resources Manager -
Civil Service Director, Matt Novosad, Patrol Officer - LPPOA President, Matt
Daeumer, Patrol Lieutenant - LPPOA Member, Marcus Upchurch, Support
Services Sergeant - LPPOA Member, Sherman Moore - PAR Officer - LPPOA
Member. Other attendees included Tom Barby, Representative from CLEAT.
Audience members included Steve Deardorff, Assistant Chief of Police, Robyn
Gallion, Patrol Officer - LPPOA Member, Kyle Jones, Patrol Officer - LPPOA
Member, Kenny Martin, Patrol Officer - LPPOA Member, , Tracy Phelan, Patrol
Officer - LPPOA Member, Lee Stewart - Sergeant - LPPOA Member,
Councilman Tommy Moser.
II. Minutes from January 25,2011 were reviewed and approved with no changes.
III. BEGIN DISCUSSIONS ON ITEMS PROPOSED BY THE LA PORTE
POLICE OFFICER'S ASSOICATION AND THE CITY OF LA PORTE
Chief Adcox distributed a draft contract. He indicated that all language was
original, with the exception of highlighted areas. Yellow highlights were changes
made based on requests by LPPOA and language clean ups. Blue highlights were
based on City proposals.
All parties reviewed the contract.
Per Chief Adcox a change should be made on the last page, indicated negotiations
should begin in year 2013 not 2012.
LPPOA called a caucus at 4:28 p.m. and returned at 4:45 p.m.
Review of contract items began with page 5, language will be revisited. The
LPPOA will provide a sample of what specifics they would be looking for to
include in this section regarding a part-time officer program.
On Page 7/8 the LPPOA would like a slight revision under #2; changing
"evaluation above a 4" to "evaluation above a 4.0". This is for clarification
purposes should future interpretation of above a 4 differ from the current
interpretation.

Page 9, number 4 should read "exceptional".
Page 10, number 6, at the end of paragraph should state "add with longevity pay".
Page 11, number 2 - 60 hours college credit was further discussed and the LPPOA
will provide language they are comfortable with.
Page 17, number 1 - sick leave before or after a holiday is provided for in
personnel policy, LPPOA did not feel comfortable with this in the contract. The
LPPOA would like to change the number of occurrences in number 2 to six. The
chief advised he would be okay with pulling off the table, but along with that he
would have to pull off number 3 (sick buy back provision) and incentive pay in
regard to minimum staffing.
The LPPOA called a caucus at 5:20 p.m. and returned at 5:35 p.m.
Page 17 was discussed again. The LPPOA still felt comfortable with utilizing the
City policy for number 1 and agreed to leave number 2 the same. They believe
number 3 should state fiscal year versus calendar year and include language for it
to be paid with longevity. They will also provide language regarding this never
interfering with the 720 hours they can be paid of accrued sick leave under civil
service. The LPPOA understand that if you have less than 720 hours, you would
not receive any hours or credit for hours you were previously paid for under the
sick buy back provision.
Page 18, numbers 1, 2 and 4 were okay. The LPPOA would like to fine tune the
language in regard to assessment centers, taking out "video" and including
language where the LPPOA and City will form a "Board" to review the outside
firms the City would consider using for the center and that the board would also
develop the criteria for the firm to utilize when they are testing (examples:
leadership capabilities, problem solving, conflict management, prioritizing).
Page 19, language needs to be cleaned up and LPPOA will provide some sample
proposals in regard to that language.
Page 20, LPPOA would like to reword language in regard to changing of work
schedules. They will look at changing the number of days to seven calendar days.
The Chief was not comfortable with the two weeks the LPPOA proposed. The
parties will relook at this provision.
The Chief stated he did review the pay chart the LPPOA provided. The Chief
stated that we need to look at the chart and make sure that we develop an "even
keel" approach. Another way to develop the chart is to take what it costs to get to
median, then at 20% on top of it and divide that 20% evenly among the ranks. The
LPPOA believes that scales for supervisors should be reduced to fewer steps. Lt.

Daeumer advised he will run numbers. The Chief advised he will review those
proposed to him.
The Chief advised to remember that the figure the LPPOA provided does not show
the full budgetary impact to the City. The figure is for salary only, and does not
provide for difference in overtime payments or benefits.
The Chief advised that no matter what pay chart is agreed upon, the City would
look to implement 50% on April 1, 2011 and 50% on October 1, 2011. On
October 1, 2012 pay adjustments would be made based on current survey. The
overall goal would be for salary to be reviewed and implemented once a year, and
the difference would not exceed 3%. Negotiations for the next contract would
begin prior to the next implementation of a salary adjustment (10-1-2013).
IV. SET DATE AND TIME FOR NEXT MEET AND CONFER COMMITTEE
MEETING
The next meeting will be held February 1,2011 at 4:00 p.m.
