1. CALL TO ORDER - Meeting called to order at 1915 hours.

2. CONSIDER CLOSING EASEMENT (LAYNE STREET) REQUEST OF
J. D. STRINGER - BETWEEN 'LOT 1, BLOCK 3, AND LOTS 1
AND 2, BLOCK II, BAYSIDE TERRACE ADDITION - HARRIS
COUNTY, TEXAS - Mr. and Mrs. Stringer talked to the
Commission about why they wanted the street closed
between lot 1, block 3, and lots 1 and 2, block II,
Bayside Terrace Addition. A full explanation was given
as to how they would purchase the easement. Mrs. Stringer
stated that Knox Askins is handling the purchase of this
property.
All members of the Commission agreed the street should
be closed. J. C. Hebert made the motion to close: That
portion of Layne Avenue, located South of the South right-
of-way line of Bayside Drive, and located East of and
adjoining the East line of Lot One (1), Block Three (3),
• Bayside Terrace Replat, a subdivision in the W. P. Harris
Survey, Abstract No. 30, according to the map or plat
thereof recorded in Volume 86, Page 18, of the Map Records
of Harris County, Texas, being a tract of land 40' x 100',
more or less.

This refers to your letter of February 14, 1977,
requesting abandonment of Layne Street south of Bayside Drive
• being situated between Lot 1, Block 3 and Lots 1 and 2, Block
11 of Bayside Terrace Addition, Harris County, Texas.
Southwestern Bell Telephone Company presently
has no facilities in the right-of-way mentioned above and has
no objection to abandonment. Any request for future telephone
service within this area will require easement(s) provided aC
the owner's expense to conform to any future development.

Bayshore tiunicipal Utility District maps and records show no
facilities within this easement, nor is there any intention
of this utility district to use the easement in the future.
Therefore there is no objection to having this easement closed.

Commissioner's. Court has been requested to abandon and cancel
a portion of Layne Street in the Bayside Terrace Subdivision, Harris
County, Texas. Houston Lighting & Power•Company has existing dis-
tribution facilities located at the end of the street to be abandoned.
• The applicants for the abandonment of that portion of Layne Street
' have granted our Company an. easement covering these existing facili-
ties, a copy of which is attached. 6Je, therefore, can interpose no
'objections to the abandonment~as requested.

BE IT REMEMBERED that at a meeting of the Planning & Zoning
Commission of the City of La Porte, Harris County, Texas, on the
day of 1977, there was presented and
considered by said Commission, the petition of J. .D. STRINGER
and wife, BETTY RUTH STRINGER, asking for an Order cancelling a
portion of the subdivisions. known as Bayside Terrace Addition,
• and Bayside Terrace Replat, so as to vacate, abandon, and rescind
the dedication of a portion of Layne Avenue hereinafter described.
The City of La Porte Planning & Zoning Commission having
considered the matter and having determined that the dedication
of said portion of Layne Avenue as.hereinafter described,,has
never been accepted by•user or in .any other manner, and that it
is in. the best interests. of the City of La Porte and to the public
in general that such dedication be not accepted, and that the
petition for the abandonment and discontinuation of said portion
of Layne Avenue, and the cancellation of that portion of said
subdivisions described in said petition and recision of said
portion~of Layne Avenue, and that said•portion of said subdivision
described in said application, as hereinafter described, be
• vacated, cancelled,. and annulled, it was, upon motion duly carried
by unanimous vote that the petition be granted; .
WHEREFORE, IT IS HEREBY ORDERED BY THE CITY OF~LA PORTE
PLANNING & ZONING COMMISSION, that the dedication of the here-
• inafter described portion of Layne Avenue, to-wit:
• That portion of Layne Avenue, located South of the

Petitioners pray. this Honorable Planning & Zoning Com-
mission to enter its Order, pursuant to Article 974a, Section
5, Vernon's Annotated Revised Civil Statutes of Texas, vacating,
cancelling, and annulling that portion of the subdivision of
Bayside Addition as hereinafter described, to-wit: .
• That portion of Layne Avenue, located~South of the
South right-of-way line of Bayside•Drive, and
located East of and adjoining the East line of Lot
One (1), Block Three (3), Bayside Terrace Replat, -
a subdivision in the W: P. Harris Survey, Abstract
No. 30, according to the map or plat thereof recorded
in Volume 86, Page~18, of the Map Records of Harris
Coun'ty,~ Texas, being a tract -of land 40' x 100'•, •

rescinding the dedication of, and abandoning and discontinuing
• said portion of the street dedication of Layne Avenue, as shown
on that portion of. the .plats of the above described subdivisions,
as described above, ~as being located in and upon the land included
