On Premise License has been received by this office. The request
is for 535 Bayshore Drive: This building is -located across from

_ aAs the Commission is aware, several years ago, an ordinance was
passed to limit the locations for on premise consumption. It was
determined that -the Commission would have-the'opportunity to consider, .
any additional requests. ..The -Commission may or may not wish to amend,

RE: Lots 4 and 5 in Block 2, Sylvan Beach Subdivision; request
for variance
Gentlemen:
I represent the Estate of G. E. Bauer, Deceased, and his surviving wife, Dorris
Bauer who are the owners of the above described real property situated in the
city of LaPorte. This property is also known as 208 Cypress Street and 220
Cypress Street. Mrs. Bauer's daughter and her husband are presently residing on
the property.
In order to prevent people from parking on the front part of their property and
fran throwing trash on the property and to better define the approximate boundaries
of the property Mrs. Bauer contracted with Montgomery Ward to install a four
foot chain link fence around the property including the front property.
Mrs. Bauer was not aware of any ordinance that would prohibit her from placing
this fence on her property. After construction had begun and all of the fence
posts had been set in concrete she was advised by Mr. A. B. Steckman that the
portion of fence across the front of the property was in violation of an ordinance.
I am enclosing two pictures of the subject property with the fence nearly oompleted.
That portion of land between the street and fence as shown in the picture is a
.city easement so that the fence is totally on the property of the Bauers' and
not in any way on the city easement nor is it up next to the street.
Mrs. Bauer was given a copy of Page 18 out of the city ordinance regarding
certain regulations including those set forth in Article 13-205. I am assuming
that these regulations govern this particular subdivision. It is my understanding
that this is a very old subdivision and the Bauers have owned these two lots for
quite a number of years. The fence that has been placed on the property by the
Bauers is certainly in keeping with the general scheme and development of this
subdivision as a residential area.
Mrs. Bauer has advised me that there are fences surrounding the following properties
in the same subdivision including the front of said properties, to -wit:
201 Jefferson, 204 Sylvan Drive, 201 Forest, 220 Forest, 215 Garfield, 228
Cypress, 210 Cypress, 1010 Bayshore, 900 Block Seabreeze,.1902 Blackwell, 1500
S. Nugent.
While some of these fends may have been constructed prior to.the date of the
city ordinance it is believed some of them were constructed subsequent to such
date.
If in fact the construction of this particular fence is a violation of the city
ordinance I request that you issue a variance or exception in -this case so that
the fence may remain as it is presently constructed.
It is my understanding that Mrs. Bauer has received or is receiving a notice to
remove the fence from Mr. Steckman and it is further my understanding that the
notice will provide that if the fence has.not been removed within three (3) days
then a ccn plaint will be filed to.have the fence removed and presumably there
will be a hearing on the matter in the municipal court. Because of this I
request that you give this matter your earliest attention.. Mrs. Bauer and I
shall be happy to appear before you for a hearing at any time at your convenience
to further explain and clarify this situation in support of.obtaining the variance
to the ordinance.
In the meantime if you have any questions or would like any additional information
for consideration please do not hesitate to contact me.

Gentlemen:
I Gordon Robb being a resident at the above address do hereby request
a variance for a fence to be placed two feet inside the sidewalk on
the side o-f my house. Mr.James has informed me that the fence should be
30 feet from the center of the street which would put the fence app-
roximately 8 feeti.inside the sidewalk.
My plans are to have a drive in my backyard for a boat which I will
not be able .to 'do' otherwis' e.This was the purpose 'for my spending addi-
tional money for a' corner lot . I plan on ' landscaping -the area in
and place flower beds between the fence and the sidewalk.AS you can
see Trom the pichures there will not. be any traffic obstructions nor
are there any objections from my neighbors.

Dear Mr. Hudgens:
Because of the recent change in the make up of the Planning and Zoning
Commission and because of ,the degree to which the City Council must
rely on the recommendation of the Planning and Zoning Commission in
its decision'to grant or deny our #request, I would like to suggest that prior
to our hearing with the City Council we be allowed the opportunity to pre-
sent our proposal to the new Planning and Zoning Commission,

In any evelit;' it is our desire to follow through with the appeal process in
whatever sequence is consistent with the La Porte Zoning ordinances.

Residents of Sylvan Beach, 1st Subdivision:
tecause of the importance of the Park Place Project to the'Johnsoris,
the neighborhood, and La Porte I am sending the Residents in the area
this letter with the hope that each of you will darefully consider all of
the aspects of 'Park Place before the decision is irrevocable.
The following is a summary (as brief as I have been able to make it)
of the major points raised as objections to Park Place and'our answers:
1) Q: What do we mean by '!Townhome ? "
A: An individually owned home that is the same
as any other home except two walls are built
on property lines and are designed to resist
fire for two hours. "(A recent fire in Houston
which gutted a Townhome left the two adjacent
Tow•nhomes ur_damaged by fire.)
2) Q: What will Park Place look like?
A: The Townhomes have not yet been designed,
However the Planning on the site has been
done and it dictates two things:

2) Continued . .
1. East-West orientation of the Townhomes
with frontage on a park -like area and -,vith`
a common central drive.
2. Because of land and d.evelopment costs
-and generous park -like environment
(approximately 50% of total'site) it is
our estimate that .the: least.expensive Town -
home would cost- approximately $65, 000.
I have taken several. pictures of some existing
Townhomes in this price range which as nearly as
possible represent what Townhomes might look like
in Park Place setting. I would be glad to show them
to anyone willing to take the time to look.
` 3) O: What will keep the Townhomes from deteriorating
from lack of maintenance?
A: Would you let your $65, 000. horn.e deteriorate?
Secondly, as part of the deeded restrictions, a
committee is established consisting of owners of
the Townhomes with the obligation to levy dues for
the maintenance and upkeep of the common areas.

4) Q:
What will happen if the Tow-alaornes don't sell?
A:
A precor_dit on of the zone chrr.ge will be that the zone
change will be only for Park Place as it has been pre-
sented. if the project fails to conform in any respect;
zoning ,will. revert .tq-,�T�?:.
Secondly ,ifr; :for example;;; four townhorir,es are built and
additional sales are slovt;at `hat .time. all it will mean is
that there will.be fewer ow zho►ne.s :until such a time as
more are sold. This will not affect the quality of the
project or affect any other aspects of the project. There
will still be the same amount of open space and the same
restrictions on the project with no legal recourse to change

them. It will only mean that it will take longer to reach t•ho
maximum number of sixteen.

5) Q:
Why not build two houses since the property is zoned
R-1 and since the neighborhood has some of the nicer _
homes in town?
A:
It is zoned R- 1 and it is one of the nicest residential
areas in La Porte. It is also adjacent to commercially -
zoned -and -utilized land --a motel and an apartment
•
project. As one of your future neighbors commented,

their financing was contingent on there being adjacent
residential property and explicitly not commercial
property. Somewhere there must be a transition•
Wr,at -we are proposing includes that transition in two.
forms:
1• By providing a form of individually owned
residential development of a density in
' between that of apartments or mote -Is -and. -
that of single family residences.
2. By leaving as a buffer zone 1 1/2'lots untouched .
adjacent to Park Avenue landscaped and accessible

to the neighborhood. The zone'change would not
have to include that lot and a half, leaving it R-1 •
6) Q: What about sewer overloading?
A: It is normal and reasonable, to expect that limitations
on the sewer system will be resolved by the appropriate
department in the city at the time of application for
building permits. All other sever connections for
past, present, and future projects - -large or small --
have been handled in this manner as is appropriate.

7) Q: What about the additional traffic.from the project?
A: The traffic generated by the project will be relatively
•light in comparison with the apartment project and the
motel, and will occur as near to Willow (Oregon) as--.-
possible --approximately 70:feet (in other words as
far from Park Avenue as possible),..,and will consist
of traffic from homeowners like yourselves.
Secondly, more than adequte off-street parking will be
provided (2 1/2 cars per Townhome) sheltered from
view from the. street and adjacent property.
Thirdly, there would be only sixteen families.
8) The following are the proposed conditions for the re -zoning of
Block 16, Sylvan.Beach 1 st Subdivision:
1. Closing Willow Avenue and preserving the vegetation as
a permanent park -like green area with publicly -
accessible paths,
2. Purchasing Cedar Avenue right-of-way adjacent to the
i Johnson property.
3. Preserving 75 feet of the Johnson property along Park
Avenue as a permanent park -like green area with
Park Place

publicly -accessible paths, and not incl-ta.ding this area in the
re -zoning request. (Note this is a change from our previotis
proposal.) The area within which the actual building will
occur is .from Willow Avenue 225 feet out of the total'300 feet
along Garfield by a maximum depth of 220.feet, .for construction:
of a maximum of sixteen individually 'owned Townhomes with a
central drive and parking area.
5.. Providing deeded requirements for the maintenance of the
common public areas by the owners of the Townhomes,
6, Providing a minimum of 2 1/2 cars off- street- parking per
Townhome.
7, Accepting the precondition that the zoning change would apply
only if the preceding limitations are observed in their
entirety with any exceptions causing the zoning to revert to
R-1 as it currently exisits, '
Park Place does. not cause conflict; it resolves an existing conflict
by separating two opposing land uses--C and R-1--with an intermediate
density residential activity. It eliminates on the South side of Garfield
the kind of conflict that occurs across Garfield at Oregon Street --houses
across a street from apartments. The type of buyer attracted to a Town -
home complex of this type will be better established financially, older
Park Place.

transient population corrimonly associated'.witli apartments,
The Houston./Harris County area is experiencing a large amourit of
growth, particularly in outlying areas. La Porte will certainly share a
fair portion of this regardless of how Park Place is resolved. However,
the growth should be balanced covering all segments of the income range.
This is necessary for the merchants to be able to provide a full range of
,services, for *the city to provide adequate services, and for- La. Porte
property values to keep pace with the
rest of -the region.
And, after all,
an increased
tax'base directly yields
increased revenue
and better city
.services,
The Johnsons are attempting to follow through with Park Place for
several basic reasons even though the chances of relization are con-
siderably less than with the practical, immediate alternative:
1, Their basic pride in La Porte and conviction that the
content and 'character of La Porte are worth the time
and cash investment involved in Park Place.
2. Their conviction that there is a market for sensibly
planned and designed Townhomes outside of the
traditional areas of growth --like the Memorial and
Southwest areas of Houston,

3. Their conviction that considering all of the factors,
Park Place is the best alternative for Block 16 re-
gardless; of who is responsible-forthe project.
4. The monetary returns would be greater with Park Place
than any of the alternatives both for the•Johnsons and
for La Porte.
Our approach is, and will continue to be one of complete openess with
all aspects of the proposal. Evidence of t. is..was.willingness to "show
and tell" well before we were required -to, and of'our confidence i.n the
correctness of our proposal.
I would also like to take this opportunity to state that neither the
Johnsons nor I have any obligation or commitment to any particular
realtor.

6. CONSIDER APPROVING PLANS AND SPECIFICATIONS AND FINAL PLAT
OF FAIRMONT PARK WEST, SECTION IV - Stan Sherwood, City Parks
Director, at this point informed the Commission that no park
area or substitute per City Ordinance #705 had been estab-
lished. Due to the fact that the plat had approval from the
past Commission and needed reapproval because of title changes,
a motion was made for approval on these grounds. The motion
was seconded and passed.
7. CONSIDER APPROVING PRELIMINARY PLAT OF FAIRMONT PARK,
SECTION V - A motion was made for tabling this item due to
park land issue. The motion was seconded and passed.
B. CONSIDER APPROVING REQUEST FOR HOUSE MOVED TO 421 SOUTH
CARROLL, LOT 11 AND 12, BLOCK 48, BAYFRONT ADDITION -
Motion was made for approval, due to the fact the house has
already been moved. Motion was seconded and passed.
9. CONSIDER REQUEST OF M. D. ROSE TO REZONE LOTS 1 THROUGH
7 AND LOTS 16 THROUGH 26, SEABREEZE BtOCK OF BAYSHORE
ADDITION FROM RESIDENTIAL TO 'C' APARTMENT AND COMMERCIAL
FOR A MULTI -FAMILY 4-PLEX - It was established that eleven
of these 4-plexes are intended to be constructed in the
future. There was a request for a plat showing location of
proposed buildings. Due to the large number of locate
land owners present, a motion was made to table this appli-
cation for rezoning until a later date. The motion was
seconded and passed.

10. CONSIDER PETITION OPPOSING REZONING OF LOTS 1 THROUGH 7,
AND LOTS 16 THROUGH 26, SEABREEZE BLOCK OF BAYSHORE ADDITION -
The petition was taken into consideration under Item 9 for
further study.
11. DISCUSS ZONING OF LOTS 1, 2, AND 3, BLOCK 30, BEACH PARK,
535 BAYSHORE DRIVE - WHETHER COMMERCIAL OR RESIDENTIAL
PROPERTY,- City Records s ow the lots to be R1 property but
over the past 10.years the property has been used for com-
mercial. Motion was made to change Lots 1, 2, and 3, Block
30, Beach Park to Commercial. The motion was seconded and
passed.
12. CONSIDER REQUEST FOR VARIANCE FOR 208 CYPRESS STREET AND
220 CYPRESS STREET, LOTS 4 AND 5, BLOCK 2, SYLVAN BEACH
SUBDIVISION, TO FENCE FRONT PROPERTY - After much discussion
• with Mr. Al Steckman, Mrs. Bauer, and her lawyer, Mr. Peeples,
a motion was made for granting the variance, seconded, and
passed.
13. CONSIDER REQUEST FOR VARIANCE FOR 5102 CREEKVIEW, LOT 15,
BLOCK 3, GLEN MEADOWS, TO FENCE TWO FEET RATHER THAN EIGHT
FEET INSIDE THE SIDEWALK - Mr. Al Steckman informed the
Commission this fence is actually four feet on City property.
A motion was made to deny the request for variance. The
motion was seconded and passed.
14. CONSIDER REQUEST FOR REZONING OF BLOCK 16, SYLVAN BEACH
1ST SUBDIVISION FROM SINGLE FAMILY RESIDENTIAL TO ALLOW
16 TOWNHOMES - Commission denied the request on the grounds
that the past Commissioners had already ruled on this issue
and that the request must be made before the City Commissioners.
