Planning & Zoning Commission met June 2, 1980 with the follow- ing members present: Dal Wright, Lind Pfeiffer, J.B. Womack, Sidney Crrant, Pat Muston. Bob Blackwell was also present, but removed himself from the Commission due to his involvement in one issue: Guests present included: Carlos Smith, Mr. & Mrs. W.A. McKee, Mr. & Mrs. Larry Tucker, Mrs. Edra Blackwell, Kevin Blackwell, A.C. Wandell, Mr. & Mrs. Danny Jeanes, Mr. & Mrs. Paul Covington, Sara Armand, and Louis Heintshel Jr. • Request for re-zoning Lots 1?-22, Block 1337 - ADA Resources: Requesting public hearing. Our recommendation is for re- zoning from "R-1" to "C". Request for variance for front yard fence at 5213 Crestway - Larry Tucker: Planning & Zoning feels that the fence does not violate the ordinance. Recommend that the fence be allowed to remain. Request for expansion of Mobil Home Park at 10916 North L - Bob Blackwell: Sidney Grant made a motion to hold a joint public hearing with the City Commission with no recommendation. Motion was seconded by Lind Pfeiffer. Vote was unamious. Respectfully, Pat Muston, Chairman • • June 3, 1980 • • T0: Mayor and City Commissioners FROM: Planning & Zoning Commission • SUBJECT: Request for re-zoning Lots 17-22, Block 1337 from Residential (R-1) to Commercial (C) - ADA Resources. The above referenced property was annexed to the City of La Porte in 1976 with the temporary classification of "R-1", as is the standard procedure. The property has been the site of a service station since 1965, and is'well suited for commercial use. The adjacent property is also used commercially. Planning and Zoning considers that the present classification "R-1" is unsuitable for said property. We therefore recommend a change in classification to "C" Commercial in accordance with its use. L.D. Tucker. Mr. Tucker received a notice of violation from the Inspection Department of the City of La Porte regarding a front yard fence. Section 13-205 (3) of the zoning ordinance prohibits front yard fences. Mr. Tucker has a decorative split-rail fence across the front of his property, to be used with shrubbery in his landscaping plan. The fence is open at the sidewalk and driveway and is approximately two feet high. It does not extend along the side property lines. The zoning ordinance does not define the term "fence". The de- finition found in serveral dictionaries refers to a barrier form- ing an enclosure. Since Mr. Tucker's fence does not form an enclosure of any kind, and since the low and open nature of the structure does not pre- • sent a barrier for access of fire equipment, Planning and Zoning Commission does not consider it a violation of the ordinance. We feel that no variance is required. We recommend that Mr. Tucker be allowed to keep his front yard "fence" . The City will expect this notice within 10 days or formal legal proceedings • will resume. • I feel you were not informed that written notice must be initiated by you.
