Box 1115 La Porte, Tx. 77571 Dear Mrs. Black: In keeping with our discussion of July 23, 1984, I am hereby requesting that the following property be rezoned from Residential to Commercial: Lots 18 and 19, Block 1 of Spenwick Place, Section I, City of La Porte, Harris County, Texas. This property faces on Spencer Highway at Ridgefield Street and was reserved for business use in the orginal deed restrictions (see attached General Warranty Deed), however it was recently annexed by the City of La Porte as Residential along with the rest of Spenwick Place. The other property facing Spencer Highway in this area is used for commercial purposes and includes grocery stores, a car lot, a lawn mower shop, a trailer repair shop, etc. This property is currently on a Real Estate Sales Agreement and the prospective buyer plans to establish a rental business for home type items ® (lawn mowers, air compressors, etc.) If I can provide any additional information please call on me. Alexander to rezone Lots 18 and 19, Block 1 of Spenwick Place, Section I from residential to commercial to allow the establishment of a commercial rental business . 1. Those wishing to speak in favor of the rezoning request: • Mr. James Alexander spoke in favor of the request stating that ._ he had a buyer for the property who wished to establish a commercial rental business. Discussions were held about the location of the properties on Spencer Highway. It was stated that the properties were along Spencer Highway should only be suitable for commercial establishments and not residential. Mr. H. A. Pickens stated that he owned Lots 107, 106, and 109 along that strip of land and could not see how anything other than a commercial business, could be feasible. Chairman Latimer concluded the discussions on this item and asked for a motion from the Commission. Motion was made by Bruce Hammack to approve Mr. Alexander's re uest to rezone Lots 1$ and l9, Block 1 of S enwick Place, Section I rom residential to commercial to allow the esta is ment o the commercia renta usiness. Chairman Latimer continued the public hearing to consider the request of Decker McKim to rezone reserve tracts E, F, G, and H in the Brookglen Addition from single family residential to commercial. Chairman Latimer stated that Mr. McKim had called the City Secretary's Office earlier in the day and had asked that his request be removed from the agenda because he had had a conflict that would prevent his attending the meeting. (A letter from Decker McKim stating he wished to withdraw his rezoning request from this agenda, is attached to these minutes for permanent record.) Chairman Latimer then closed the public hearing at 7:45 P.M. and stated the Planning and Zoning Commission would now request a public hearing of City Council on Mr. Alexander's request and would make their recommendation in writing to City Council. 4. The Commission considered the preliminary plat approval of Parkview Terrace Subdivision. At this point in the regular agenda, Chairman Latimer asked the Commission to consider and take action of the emergency addendum item of considering the request of Carlos Smith for preliminary plat approval of Bay Area Business Park. Mr. Joerns stated that because of the decision during the last meeting of Planning-and Zoning to have this item placed ' on the September 6th agenda, action would have to be taken. The item was not initially placed on the agenda because the developer and Mr. Carlos Smith had not conferred with Mr. Joerns concerning the changes that needed to be made to the-plat and because gentlemen had decided to place the item on "hold" for a future meeting. However, it was decided at the last meeting and placed in the minutes of said meeting, that this item would be placed on this agenda. Mr. Joerns stated that his recommendation was to disapprove this item until such time that the developer and Mr. Smith had had a chance to work with staff and are ready to have the Commission consider reviewing and approving the preliminary plat of this development. A discussion was held on the implementation procedures for the new subdivision ordinance. Newly employed City Engineer Bob Speake discussed how the Staff would work with the Planning and Zoning Commission in several workshop sessions to study and adopt each aspect of the subdivision ordinance hopefully by Thanksgiving. The Commission decided jointly to have an overview of the subdivision ordinance at the next meeting and go through one section at a time and vote at the end of the meeting or the first part of the . Final approval of the subdivision ordinance would then be made by the Commission and it would be submitted to City Council for final adoption.
