ADJOURNMENT :~ • • • MEMORANDUM • CITY OF LA PORTE T0: Planning & Zoning Commission Members FROM: Chairman Doug Latimer SUBJECT: Item 3, Planning and Zoning Agenda of 10-23-84 DATE: October 18, 1984 At the City Council Workshop of October 10, 1984, several citizens having businesses on Spencer Highway expressed their concern to Council that due to the annexation late last year, their business property is now in a residential zone. After discussing the situation with the citizens, Council agreed that the Planning and Zoning Commission should consider this matter and submit a recommendation to Council. The meeting was called to order by Chairman Doug Latimer at 7:03 P.M. Members of the Commission Present: Chairman Doug Latimer, Members Charlie Doug Boyle, Karl Johnston, Bruce Hammack, Bobby Blackwell and Janet Graves Members o~~isCo n~lissioIl_~bsent: Lola Phillips City Staff Present: Assistant City Attorney John Armstrong, City Engineer Bob Speake and Assistant City Secretary Laura Hall Others Present: Mrs. Vivian Covington, Mrs. Marie Herbert, Mr. Joe Hicks, and 5 interested citizens 2. The Commission considered approving the minutes of the regular meeting held on October 4, 1984. Ayes: Latimer, Boyle, Johnston, Hammack, Blackwell, Graves Nays: None 3. The Commission considered current zoning on Spencer Highway from Underwood Road to Luella Road. Chairman Latimer announced that the reason this item was on the Planning and Zoning agenda for this meeting was because this had been discussed at the City Council Workshop meeting of October 10, where several business owners in this area were present expressing their concern to Council that due to the annexation of this area late last year, their business property is now in a residential zone. After discussing the situation with the citizens, Council agreed that the Planning and Zoning Commission should consider this matter and submit a recommendation to Council. Chairman Latimer then called on the spokeswoman for the business owners, Mrs. Vivian Covington, to say a few words. Mrs. Covington stated that she represented 26 business owners in the Spenwick area, namely along Spencer Highway. She stated that their immediate concern was the fact that a long period of time could transpire if they suffered damages in a ~ ~ Minutes, Regular Meeting La Porte Planning & Zoning Commission October 23, 1984, Page 2 storm, such as a tornado or other major catastrophe, and that they would have to come to the Commission to apply For a rezoning of their property before they could rebuild which might put them out of business for a long period of time. Mrs. Covington requested that the Commission provide immediate relief to these business owners by rezoning the whole strip of land on Spencer Highway commercial. Chairman Latimer referred to the zoning map in Volume 2 of the Comprehensive Master Plan and stated that it would be impossible for the Commission to do any "spot" zoning at this time as several other areas in La Porte would suffer from this action. He stated that the rezoning would take place all at one time after the new Zoning Ordinance was created and adopted, which could be a period of 12 to 18 months. He and other members of the Commission told the citizens that there should be no cause for alarm as the Commission and City Council would work with these business owners in case of an emergency. This was not only for the protection of their businesses and living area, but for the City as a whole. Chairman Latimer thanked the citizens who represented this area for coming to the meeting and asked for their continued interest, cooperation, and support in this effort. 4. (The agenda item was "Consider information contained in preparatory reading materials concerning Thoroughfare Plan, Utilities Plan, and Community Facilities Plan of the Comprehensive Master Plan; Administrative Provisions, Street and Alley Standards, Easements, Park, Playground, and School Sites of the Subdivision Ordinance; Title, Purpose and Interpretation, Platted and Unplatted Property, and Multi- Family Private Streets sections of the Zoning Ordinance.) Minutes, Regular Meeting La Porte Planning & Zoning Commission October 23, 19$4, Page 3 R Because of the time factor spent discussing the Spenwick zoning situation, the Commission did not have ample time to discuss any other aspect of this agenda item other than the Thoroughfares Plan. Chairman Latimer then called on City Engineer Bob Speake to present the Thoroughfares Plan to the Commission. Mr. Speake stated that he had prepared a slide presentation to better reflect the discussions on the Thoroughfares Plan. Several slides were shown displaying some of the major thoroughfare concerns in the area including Bay Area Blvd., Farrington, Highway 146 at the Highway 225 underpass, and old La Porte Road. After some discussion between Mr. Speake and the Commission, it was decided that there should only be one regular meeting which would take care of all the regular zoning business and two (2) other meetings per month to be used as workshop meetings to discuss and study the proposed Subdivision and Zoning Ordinances and how the Comprehensive Plan relates to them. Also, a decision was made by the Commission to have Assistant City Attorney Armstrong prepare a Resolution stating that all planning and zoning matters should be brought before the Planning and Zoning Commission with a recommendation made to Council on the particular request. The Resolution would then be presented to City Council for their approval. Motion was_made b~Karl Johnston to avg ~.
