The meeting was called to order by Chairman Doug Latimer at 7:00 P.M. Members of the Commission Present: Chairman Doug Latimer, Members Bobby Blackwell, Lola Phillips, Karl Johnston Members of the Commission Absent: Members Janet Graves, Bruce Hammack, Charlie Doug Boyle Citv Staff Present: Assistant City Manager Richard Hare, Assistant City Attorney John Armstrong, City Engineer Bob Speake, Director of Community Development John Joerns, Assistant City Secretary Laura Hall, Engineering Secretary Tina Anger Others Present: Mr. and Mrs. Arlie Brantley, Mr. and Mrs. William Bower, Mr. Rod Lynn, Mr. Larry Jureski, Mr. Tommy Moser, Ms. Adair Sullivan, Mrs. Georgia Fleener, Ms. Margaret Conner, Ms. Barbara Neal of the Bayshore Sun. 2. Chairman Latimer called the Public Hearing to order at 7:02 P.M. . ,. • A Public Hearing was held to consider the request of Mr. and Mrs. Arlie Brantley to rezone Lots 161 and 162, Block 10, Section 2 of Spenwick Place from residential to commercial. A. Those wishing to speak in favor of the rezoning request Mrs. Brantley stated that she had explained her request at a prior meeting of the Planning & Zoning Commission Mr. William Bower stated that he was in favor of the rezoning request of the Brantley's. Chairman Latimer read a letter that was sent to the Commission from Mr. Russell French stating that he was in favor of the rezoning request. (A copy of Mr. French's letter is attached to these minutes for permanent record.) • '' • .-. Those wishing to speak in opposition of the rezoning request • Chairman Latimer asked if anyone wished to speak in opposition to the rezoning request. No one did. Chairman Latimer asked if anyone else had anything to say either for or against the rezoning request. No one did. Motion was made b~Bobbv Blackwell to anorove the request of the Brantley's to rezone Lots 161 and 162, Block 10,. Section 2 of Soenwick Place from residential_to commercial. Second by Karl Johnston. The motion carried, 4 ayes and 0 nays Ayes: Latimer, Blackwell, Johnston, Phillips Nays: None A Public Hearing was held to consider the request of the Eagles Lodge in La Porte to rezone Lots 17 through 32, Block 149, City of La Porte, from residential to commercial to accommodate a parking lot for the new Eagles Lodge A. Those wishing to speak in favor of the rezoning request Chairman Latimer asked if anyone wished to speak in favor of the rezoning request for the Eagles Lodge. Mr. Rod Lynn spoke in favor of the rezoning request stating that the only plans for the property_Were for a parking lot. He stated that there had been some problem with the parking lot entrance and exit exiting on 7th Street. He stated that if that would cause a conflict the parking lot could be made to exit in a different location. He also stated that the Senior Citizens Park would remain in its present location. Chairman Latimer asked if anyone else wished to speak in favor of the rezoning request. No one did. Those wishing to speak in opposition to the rezoning request. Mr. Larry Jureski asked to speak to the Commission about his concerns of having the parking lot exit onto 7th ~1._. • • Minutes, Public Hearing and Regular Meeting La Porte Planning & Zoning Commission May 2, 1985, Page 3 • Street stating that he was raising a family in that location and preferred not having all of the traffic congestion. He was also concerned that 7th Street would become a "Race Track" for outgoing traffic. • Mr. Tommy Moser asked to speak to the Commission about his concerns of having the parking lot exit on 7th Street and that he would prefer not having a "beer joint" close to his home. Chairman Latimer asked if anyone had any further comments concerning this rezoning request. City Engineer Bob Speake stated that he and Chief Building Official David Paulissen had taken a "windshield tour" of the area and noted that the area was predominately R-1 residential and that having this facility located here would not be in compliance with the Comprehensive Master Plan. Chairman Latimer then read the Staff recommendation on this item. (A copy of that memorandum is attached to these minutes for permanent record.) After further discussion of this item by the Commission members, Chairman Latimer entertained a motion to consider this item at a future date. Motion was made by Bobbv Blackwe~_1 to table this item until such time as the Commission has more information concerning the parking lot and until such time as the Commission has full membership present to vote on tie item and also that • this item be rescheduled for a second gublic hearing. Second by Karl Johnsto_n_. The motion, carried, 3 ayes and 1 nay. Ayes: Latimer, Blackwell, Johnston Nays: Phillips Chairman Latimer then called the public hearing closed at 7:34 P.M. and stated that the Planning & Zoning Commission would submit a recommendation in writing to the City Council on these two items. 3. The Commission considered the approval of the minutes of the Regular Meeting held on April 18, 1985. Second by Karl Johnston. The motion carried, 4' ayes and 0 nay. • Ayes: Latimer, Blackwell, Johnston, Phillips Nays: None 4. The Commission considered the approval of the minutes of the Regular Meeting held on April 25, 1985. Motion was made by Bobby Blackwell to approve the minutes as presented Second by Karl Johnston. The motion carried 4 ayes and 0 nays. Ayes: Latimer, Blackwell, Johnston, Phillips Nays: None 5. The Commission considered the request of Georgia Fleener to rezone Lots 1 - 32, Block 653, Town of La Porte, on 17th Street from commercial to industrial. Chairman Latimer called on Mrs. Fleener to present her request. Mrs. Fleener stated that it would be to her benefit to have the property considered commercial or light industrial because she was trying to sell the property. She stated that the property was in a light industrial zone and that she felt her property would be put to best use, by being zoned in line with the other light industry in the area. Chairman Latimer asked if Commission'~iembers had any discussion on this item. There being no further discussion, Chairman Latimer stated tl~~t this item would be scheduled for a public hearing on June 6, 1985. 6. The Commission then reviewed and discussed the proposed Southern Pacific rezoning. Chairman Latimer explained that this rezoning matter had been started in early 1982, but had never gone to City Council for final approval after the Commission had made their decision. Chairman Latimer stated that he would like to have this item placed on the May 16th agenda for discussion. ~ :f ~~! .. • Minutes, Public Hearing and Regular Meeting La Porte Planning & Zoning Commission May 2, 1985, Page 5 7. The Commission considered the approval of the Thoroughfare Plan. ~~ City Engineer Speake briefed the Commission on the proposed Thoroughfare and Safety Plan components of the • Comprehensive Plan. Mr. Speake restated the objectives of the Thoroughfare Plan approved by the Steering Committee (Found on Page 1-13 of Volume 1) and explained how the proposed Thoroughfare Plan satisfies those objectives. Mr. Speake noted the one change to that plan recommended by the Staff, which was to upgrade North L street to a secondary arterial instead of North H. Staff believes this to be a better route than that recommended by the Consultants. 8. The Commission considered the approval of the proposed Safety Plan. Mr. Speake stated that the Safety Plan includes provisions for emergency shelters as well as evacuation routes. The Staff will cover the shelter aspect of that plan the night the Staff briefing on the Community Facilities Plan is presented. Mr. Speake explained the evacuation route system and stated that, at present, route capacity allows the City to be evacuated in four or five hours. When the City has matured, that time may triple. Mr. Speake emphasized the importance of City participation in a regional evacuation plan. 9. There being no further business, the meeting was duly adjourned at 8:34 p.m. ± •. I would like it know that I am for the rezoning of this property. I own the retail strip center that is East of Mr. & Mrs. Brantleys retail strip center. I believe the businesses in The Brantley's center are beneficial to the LaPorte area and xould like to see it rezoned to commercial property. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE: Section 1. The City Commission of the City of La Porte and the City of La Porte Planning and Zoning Commission have hereto- fore called, and have held, a Joint Public Hearing on August 17, 1970, to consider amending the City of La Porte Zoning Ordinance, Ordinance No. 780, so that Section 13-201, Sub-paragraph (2), shall hereafter read as follows, to-wit: "(2) Duplexes, upon petition of the property owner and after notice and public hearing thereon as provided in Article Seventeen hereof." Section 2. Following such Joint Public Hearing, the City Planning and Zoning Commission has met in executive C session, and has issued its final report, which is attached hereto as Exhibit A, incorporated by reference herein, and made a part hereof for all purposes, finally recommending such amend- ment to Ordinance No. 780. Section 3. Section 13-201, Sub-paragraph (2), is hereby amended, and shall hereafter read as follows, to-wit: "SECTION 13-200 'R-1' SINGLE-FAMILY DWELLING AND DUPLEX DISTRICT REG CATIONS ~•~ "13-201 (2) Duplexes, upon petition of the property owner and after notice and public hearing thereon as provided in Article Seventeen hereof." The City has received a request from Mrs. Margaret Conner to allow the conversion of a single family home in a "R-2" district to a duplex. HISTORY The site in question is located PJorth of Main Street on N. Holmes. The home is surrounded on all sides by single family dwellings. This home was damaged by fire and will require extensive remodeling before it could be occupied. Since remodeling is required, i~[rs. Conners wishes to convert the home into a duplex. The Zoning Ord. requires • that duplexes in a "R-2" zone contain at least 850 sq. ft, per unit. This request proposes-1100 sq, ft, per unit. The home presently contains two (2) kitchens and two (2) full baths. ANALYSIS The zone in which this home is located is called a single family dwelling and duplex district. Prior to August of 1970 a duplex was an allowable use within a "R-2" zoning district. The Zoning Ordinance was amended in 1970 to require notice and public hearings (see amendment 780-G attached). The current ordinance requires that a duplex go through essentially a re-zoning process from its current status to "duplex". The ordinance now requires that notice and public hearing be completed and, as with a true re-zoning, council must make the final determination. Duplexes in and of themselves are traditionally compatible with single family homes. No negative impact is expected on the surrounding area. The site now contains two (2) on site parking spaces, as required by ordinance, so parking will not be a problem. RECOMMENDATION Plans submitted by Ms. Conner indicate that the structure can be remodeled to meet the requirements of the zoning ordinance and building codes. Based on the above information the staff sees no • problem with the granting of duplex zoning for the site in question. The applicant intends to constructea shell parking lot to provide supplementary off-street parking for its new lodge building to be constructed on the west half of Block 149. The property under consideration for rezoning faces 7th Street between G and H Streets. It borders the "C" commercial zone in which the lodge building is to be constructed. The south half of the property contains the small City park where "The Walk" is located. (See Location Map, attached) The City Police Administration complex is located south of this property.- To the east and north are single-family homes. To the west are a mixture of single-family homes and small commercial establishments. (See Key Map, attached). ANALYSIS The property lies within an "R-1" residential zone in which there are no non-conforming uses. The consultants were aware of the purity of this zone and recommended that it remain "R-1" in the comprehensive plan. If this commercial rezoning were- to be approved, it could establish a precedent for further non-conforming encroachment into a zone which is entirely residential in character. It should be noted that the applicant has satisfied City off-street parking requirements within the boundaries of his commercially-zoned property. STAFF RECOMMENDATION r~ U Having a fraternal lodge located just next to a quiet residential neighborhood is probably incompatible, but it does conform to current zoning and has the legal right to be there. Adding their parking lot next door does not make matters worse, except for the dust raised from a gravel parking lot. Nonetheless, because this request conflicts with the comprehensive plan and because allowing this rezoning now may establish a bad precedent for the future, staff recommends this request be denied. Fleener for the re-zoning of lts. 1-32, blk. 653 LP from their present "C" Commercial classification to "I" Industrial. The purpose of the re-zoning is to make the property consistent with other properties in the immediate area and to make the property easier to sell or lease. ~II~TQRY • The property in question is located on the West side of S. 16th between Spencer Hwy. and Barbours Cut Blvd. The site is fenced and the previous tenant used the site as a construction company yard and office. The ,above use was and is and acceptable use of the property with its present zoning classification. The request indicates that the City "re-zoned the property over a year ago." The property was not re-zoned but several uses were removed from the parameters of Commercial and placed under Industrial. Mrs. Fleener was not aware of the change and has lost at least one group of tenants whose truck terminal use was not allowed on the "C" zoned property. ~1 LA YSIS The site faces S. 16th Street on the front and S. 17th Street on the rear. Other Industrial uses exist within 1/2 mile of the site including BFI Inc, and Chemlime Corp. Both of these use are on the West side of 16th and include heavy trucking in their operations, Without a use proposed it is difficult to judge the overall impact on the area from such a re-zoning. Industrial zoning does fit the character of the area however. The re-zoning to Industrial would be consistent with the proposed new zoning ordinance and map. The proposed map shows the property to be "HI" or Heavy Industrial. The site is within one mile of the Southern • Pacific Railyard and within one city block of rail service. E' - 3 • • PAGE 2 RE-ZONE BLK. 653 CONT. RECOMMENDATION The staff has reviewed this request with respect to the proposed master plan and find it to be substantially in conformance with it. The site is surrounded by both light and heavy industrial uses and fronts on a truck route. The re-zoning in and of itself will not have a negative effect on the area. Any Industrial use must have a special use permit from the P & Z Board of Adjustments so individual uses will still be reviewed based on their merits.
