NOTICE IS HEREBY GIVEN THAT THE LA PORTS PLANNING AND ZONING
COMMISSION WILL HOLD A REGULAR MEETING, AT 7:00 P.M. ON THE 27TH
DAY OF JUNE, 1985, IN THE COUNCIL CHAMBERS OF THE CITY HALL, 604
WEST FAIRMONT PARKWAY, LA PORTS, TEXAS.
I HEREBY CERTIFY THAT I POSTED THIS NOTICE ON THE BULLETIN
BOARD LOCATED AT A PLACE CONVENIENT TO THE PUBLIC IN THE CITY HALL
OF THE CITY OF LA PORTS AT 5:00 P.M. ON THE 24TH DAY OF JUNE, 1985,
AND THAT SUCH NOTICE WAS POSTED FOR AT LEAST THE THREE DAYS

MINUTES OF 6/27/85 PLANNING AND ZONING MEETING
1. The meeting was called to order by Chairman Andy Wilson at
7:02 p.m.
Members of the Commission Present: Chairman Andy Wilson,
Members Charlie Doug Boyle, Janet Graves, Bruce Hammack and
Bobby Blackwell
Members of the Commission Absent: Lola Phillips and Karl
Johnston
City Staff Present: Director of Community Development John
Joerns, City Engineer Bob Speake, Chief Building Official
David Paulissen, Assistant City Attorney John Armstrong,
Executive Secretary Gwen Jackson, Engineering Secretary Tina
Anger
Others Present: Ms. Adair Sullivan, Decker McKim and several
interested citizens.
2. STAFF PRESENTATION OF TEXT OF PROPOSED ZONING ORDINANCE.
• A staff panel headed by Director Joerns presented an overview
of the text of the proposed new Zoning Ordinance. In his
opening remarks, Mr. Joerns introduced the other members of
the panel: Mr. Randy Walters of Vernon Henry and Associates,
consultant and principal author of the text; Assistant City
Attorney Armstrong; Chief Building Official Paulissen who is
also Zoning Enforcement Officer; and City Engineer Speake.
The panel traced the history of zoning in La Porte during the
past 25 years, noting that the current ordinance was enacted
in 1960 when La Porte had a population of about 1200. Mr.
Joerns emphasized the importance of the ordinance text as a
major tool to be used in carrying out the comprehensive
plan. He illlustrated the enforcement problems with the
current ordinance, pointing out the inconsistencies between
the text and the "official" map, the problems involved in
having insufficient and poorly defined zones, and other
problems which have made administration of the current
ordinance difficult. Mr. Joerns noted that many of the 90
plus rezonings which have occurred over the years were from
residential to commercial; he stated that this was probably
because the commercial zone permits the widest variety of
uses of any zone and landowners were simply positioning their
land for greatest flexibility for resale or development.

PLANNING AND ZONING MEETING
Much of the land rezoned remains vacant today. Mr. Joerns
emphasized the great amount of staffwork which has gone into
correcting these deficiencies into new ordinance.
At this point, Mr. Walters reviewed the process he followed
in drafting the text of the new zoning ordinance. He
emphasized his involvement with the entire comprehensive
planning process and how the text is closely related to the
plan. He also stated that the main problem he found with the
existing ordinance was not what it said, but what it didn't
say. The existing ordinance was very poorly defined
Performance Standards to Enable the City to Evaluate
Compatibility Between Adjacent Land Uses. It also does not
adequately spell out zoning administration procedures, such
as maintenance of the zoning map and rules for processing
rezoning requests. The new ordinance includes detailed
performance standards and carefully defines zoning
administration procedures. The administration portion of the
ordinance very methodically and logically lays out the
process by which to adopt , modify and update the ordinance.
Mr. Walters went on to say that the panel also examined the
types of uses currently existing within the City of La
Porte or anticipated through life of the Comprehensive Plan,
and tried to produce as flexible ordinance which would
correct current zoning problems and address future needs as
well.
At this point, Assistant City Attorney Armstrong and Chief
Building Official Paulissen presented an overview of each
section of the ordinance. (see attached Table of Contents).
Closing remarks by Mr. Joerns ended the Staff Presentation.
Chairman Wilson commended the staff on the presentation. He
stated that a 15 day notice would be needed for a Public
Hearing which would make the first available date July 18th.
Chairman Wilson then suggested a motion be entertained to
conduct the public hearing for July 18th.
Motion was made by Bobby Blackwell to set the public hearing
for -the -18th of_Ju~. The motion was seconded
