The meeting was called to order by Chairman Andy Wilson at 7:00 p.m. Members of the Commission Present; Chairman Andy Wilson, Members Lola Phillips, Charlie Doug Boyle, Janet Graves, Bobby Blackwell Members of the Commission Absent: Member Karl Johnston City Staff Present: City Engineer Bob Speake, Executive Secretary Gwen Jackson Qthers Present: Mrs. Adair Sullivan, Barbara Neal of the Bayshore Sun 2. The Commission considered approval of the minutes of the meeting held on June 20 and June 27, 1985 Motion was made by Bobby Blackwell to a~nrove the minutes o~ meetings held on June 20 and June 27} 1985. Second by Janet Graves. Motion carried with 5 ayes, 0 naves. 3. The proposed zoning ordinance was discussed and a motion was made to set a public hearing for August 15, 1985. Bobbv Blackwell made the motion for the public hearing. Janet Graves seconded the motion. The Motion carried with 5 ayes 0 naves. 4. City Engineer Bob Speake gave a brief talk on the General Plan submitted by Dana Tank Container Inc. for their La Porte wash facility. Members of the Commission Present: Chairman Andy Wilson, Members Bobby Blackwel Bruce Hammack, Charlie Doug Boyle, Janet Graves Members of the Commission Absent: Members Karl Johnston, Lola Phillips City Staff Present: City Attorney John Armstrong, City Engineer Bob Speake, Chief Building Official David Paulissen, Director Parks & Recreation Stan Sherwood, Engineering Secretary Tina Anger, Executive Secretary Gwen Jackson Others Present: Ms. Adair Sullivan, Ms. Margaret Conner, Ms. Barbara Neal of the Bayshore Sun, Rita Jackson and several ® interested Citizens. 2. Andy LJilson called the Public Hearing to order. ~,. I t em 1 Request of Mrs. Georgia Fleener to rezone Block 653, lots 1-32, from commercial to industrial. Mrs. Fleener was not present to present her request. The Commission decided to pass on to the next public hearing and suggested Mrs. Fleener be placed on the next Agenda for Planning and Zoning if she wished to be. Item 2 Request of Mrs. Margaret Conner to consider approving a duplex in an "R-2" Residential zone with the property located in block 983, North half of lot 25 and all. of lots 26 and 28. Mrs. Conner came before the Commission stating her name and address and the above request. Andy Wilson asked if there was a motion to rezone Mrs. Conner's property .. ' w~ . ~' Minutes, Regular Meeting • La Porte Planning ~ Zoning Commission June 20, 1985 - Page 2 of 3 Commissioner Boyle made a motion that Mrs. Conner's property be rezoned, 2nd by Commissioner~.Hammack. The motion carried. Ayes: 4 Nayes: 0 The Public Hearing was closed at 7:08 3. Chairman Wilson moved to item 3 on the Agenda to Consider the Approval of the Minutes of the Regular Meeting Held on May 16, 1985, and item 4, to Consider the approval of the minutes of the Regular Meeting held on May 30, 1985. Commissioner Hammack made a motion to approve the minutes, Commissioner Boyle seconded. The motion carried Ayes: Boyle, Hammack, Graves, Blackwell, Wilson Nayes: 0 4. Item 4 approved with item 3 above. 5. Chairman Wilson asked that a motion be entertained to vote on Beautification and Conservation and Open Space and Recreation Plans that were presented at the last Planning and Zoning meeting on May 30, 1985. Commissioner Blackwell made the motion that these plans be approved. Commissioner Hammack seconded. Motion passed with 4 ayes 0 nayes. Ayes: Boyle'; Hammack, Graves, Blackwell, and Wilson. Nayes: 0 6. Andy Wilson asked that Mr. Bob Speake present the Community Facilities and Safety Plans. Mr. Speake, City Engineer, gave a brief synopsis of the Community Facilities and Safety Plans as was discussed in the attached memo. To keep up with the City's needs, expansions are planned for the library, city hall, airport and police and public works departments. A brief discussion of the proposed expansion of the airport drew comments from Commissioner Charlie Boyle. He said the prime concern should be safety and he also stressed the need for a lengthened runway, saying it should be 4,000 to 4,500 feet to accomodate larger aircraft and .to allow for pilot's error. He also said that better lights and improved instrument percision capabilities for landing are needed. It was suggested that 1`ir. Before the meeting adjourned, Mrs. Helen Mc Ferren wanted to address the Commission about sewer problems behind her house across Little Deer Creek. The meeting was called to order by Chairman Andy Wilson at 7:02 p.m. Members of the Commission Present: Chairman Andy Wilson, Members Charlie Doug Boyle, Janet Graves, Bruce Hammack and Bobby Blackwell Members of the Commission Absent: Lola Phillips and Karl Johnston City Staff Present: Director of Community Development John Joerns, City Engineer Bob Speake, Chief Building Official David Paulissen, Assistant City Attorney John Armstrong, Executive Secretary Gwen Jackson, Engineering Secretary Tina Anger Others Present: Ms. Adair Sullivan, Decker McKim and several interested citizens. 2. STAFF PRESEtJTATION OF TEXT OF PROPOSED ZONING ORDINAPJCE. A staff panel headed by Director Joerns presented an overview of the text of the proposed new Zoning Ordinance. In his opening remarks, Mr. Joerns introduced the other members of the panel: Mr. Randy Walters of Vernon Henry and Associates, consultant and principal author of the text; Assistant City ,Attorney Armstrong; Chief Building Official Paulissen who is also Zoning Enforcement Officer; and City Engineer Speake. The panel traced the history of zoning in La Porte during the past 25 Years, noting that the current ordinance was enacted in 1960 when La Porte had a population of about 1200. Mr. Joerns emphasized the importance of the ordinance text as a major tool to be used in carrying out the comprehensive plan. He illlustrated the enforcement problems with the current ordinance, pointing out the inconsistencies between the text and the "official" map, the problems involved in having insufficient and poorly defined zones, and other problems which have made administration of the current ordinance difficult. Mr. Joerns noted that many of the 90 plus rezonings which have occurred over the years were from residential to commercial; he stated that this was probably because the commercial zone permits the widest variety of uses of any zone and landowners were simply positioning their land for greatest flexibility for resale or development. e •, +. ~ MINUTES OF 6/27/85 JUNE 27, 1985 PAGE 2 OF 2 r PLANNING AND ZONING MEETING Much of the land rezoned remains vacant today. Mr. Joerns emphasized the great amount of staffwork which has gone into correcting these deficiencies into new ordinance. At this point, Mr. 4Jalters reviewed the process he followed in drafting the text of the new zoning ordinance. He emphasized his involvement with the entire comprehensive planning process and how the text is closely related to the plan. He also stated that the main problem he found with the existing ordinance was not what it said, but what it didn't say. The existing ordinance was very poorly defined Performance Standards to Enable the City to Evaluate Compatibility Between Adjacent Land Uses. It also does not adequately spell out zoning administration procedures, such as maintenance of the zoning map and rules for processing rezoning requests. The new ordinance includes detailed performance standards and carefully defines zoning administration procedures. The administration portion of the ordinance very methodically and logically lays out the process by which to adopt , modify and update the ordinance. Mr. Walters went on to say that the panel also examined the types of uses currently existing within the City of La Porte or anticipated through life of the Comprehensive Plan, and tried to produce as flexible ordinance which would r correct current zoning problems and address future needs as well. At this point, Assistant City Attorney Armstrong and Chief Building Official Paulissen presented an overview of each section of the ordinance. (see attached Table of Contents). Closing remarks by Mr. Joerns ended the Staff Presentation. Chairman Wilson commended the staff on the presentation. He stated that a 15 day notice would be needed for a Public Hearing which would make the first available date July 18th. Chairman Wilson then suggested a motion be entertained to conduct the public hearing for July 18th. Motion was made by Bobby Blackwell to set the ublic hearing for _the 18th of Jul.
