The meeting was called to order by Chairman Andy Wilson at 7:05 p.m. Members of the Commission_ resent: Chairman Andy Wilson, Commissioners Lola Phillips, Ed Murphree, Charlie Doug Boyle, Karl Johnston Members of the Commission__absent: Commissioners R.J. Blackwell, Janet Graves Ci~__ Staff Present: Chief Building Official David Paulissen, Director Community Development John Joerns, Assistant City Attorney John Armstrong and Executive Secretary Gwen Vann Others_ Present: Bayshore Sun's Barbara Neal, Bruce Hammack, Mrs. Adair Sullivan, Rita Patterson, David • Wheat, V.P. of Bayport National Bank, Janet Gray and other interested citizens. 2. Chairman Andy Wilson asked that we suspend the agenda and entertain minutes of the meeting for Sept. 5, 1985. Discussion on last page of minutes where Chairman Wilson asked Mr. Murphree to file a report. Due to the fact that there was no explanation for this, it was suggested that this portion be struck from the minutes. Chairman Wilson asked if any other questions on the minutes. Since there were no question, the minutes were approved by the Commission. • 3. Public Hearing was called to order. Item 1 - To consider request of Al Pardoe to rezone a tract of land (legal description attached) at Hwy. 225 and Hwy. 146 from Zone "C" commercial to zone "I" industrial to allow a new car marshalling yard. Chief Building Official David Paulissen explained that everything was in order, staff sees no problem with the rezoning. • ~~ • Minutes of Planning and Zoning October 3, 1985 Page 2 Chairman Wilson asked if there was anyone who wished to speak in favor or in opposition to Mr. Pardoe's request for rezoning. AIo one did. He then asked if anyone was there to represent Mr. Pardoe. Ms. Rita Patterson approached the microphone and stated her name and that she was with Decker McKim Realtors. No one else had anything to say in reference to this rezoning so Mr. Wilson moved to Item 2. Item 2 - Request of Mr. Ron McCrary to rezone lts. 1-32, blk. 653 from their present "C" commercial classification to "I" industrial. The purpose being to make the property consistent with other properties in the immediate area and to make the property easier to sell or lease. • Mr. Paulissen told that as of now, there was no proposed use for this property. This area is recommended to be heavy industrial uses. It does compare favorably with the Comprehensive Plan. Chairman Wilson asked if there was an applicant present to speak on behalf of the rezoning. Mr. David Wheat, Vice President of Bayport National Bank. He stated that Mr. Paulissen had stated the request quite succinctly. There were no questions or oppositions to the request. Chairman Wilson declared the public hearing closed. He then asked for a motion on item no. 1 to approve the request as proposed. Motion by Mr._Boyle, Seconded _by Mr. Joh~~on~._~he_mQt~on carried with_no opposition. Consider setting a public hearing date for H. Wayne Taylor and Mr. Bill Hartman. Public Hearing date was set for November 7. Consider SIP Engineering request for variance from section 11.01 of the City of La Porte Development Ordinance on behalf of Dana Transport Inc. John Joerns gave a brief discussion on behalf of Dana Transport. Mr. Joerns gave his full support for this variance request. He also indicated that there would be many requests of this nature in the future and that this doesn't always mean that staff will make a recommendation to approve every variance request. Mr. Boyle made a motion to approve the variance as r~ recommended by staff. Seconded by Mr. Karl Johnston. The motion carried with no oopo~ition. 6. Consider approving minutes of the meeting on August 29. t'on by Mr. Johnston and Seconded by Mrs. Phillips to adopt above minutes. Motion carried with no opposition, minutes were adopted. 7. There being no other business, Mr. Johnston made a motion that we adjourn the meeting. A ulissen, DATE: 9/26/85 CBO & Zoning Administrator SUBJECT: Rezoning-A1 Pardoe, Property at hwy. 225 & hwy. 146 The City has received a request from Mr. Al Pardoe to rezone a tract of land (legal description attached) at Hwy. 225 and Hwy. 146 from zone "C" Commercial to zone "I" Industrial to allow a new car marshalling yard. The proposed use lends itself well to an "I" Industrial zoning classification as it is the closest zoning classifiction to the "LI" proposed. This property is within 1/2 mile of several marshalling and storage yards including the Barbours Import Service, BMW of North America, and Central Freight Line on the west side of 146. gecommendation The proposed use of this property as a new car marshalling yard is in line with the comprehensive plan and the proposed new zoning map. A special use permit must also be granted by the Planning and Zoning Board of Adjustments prior to the development of the site. CITY OF LA PORTS INTER-OFFICE MEMO T0: La Po e Planning and Zoning Commission FROM: D AULISSEN DATE: 9/27/85 SUBJECT: RE-ZONING LTS. 1-32, BLK. 653 LP The City has received an application from Mr. Ron McCrary for the re-zoning of lts. 1-32, blk. 653 LP from their present "C" Commercial classification to "I" Industrial. The purpose of the re-zoning is to make the property consistent with other properties in the immediate area and to make the property easier to sell or lease. The property in question is located on the West side of S. 16th between Spencer Hwy. and Barbours Cut Blvd. The site is fenced and the previous tenant used the site as a construction company yard and office. The above use was and is and acceptable use of the property with its present zoning classification. ANALYSIS • The site faces S. 16th Street on the front and S. 17th Street on the rear. Other Industrial uses exist within 1/2 mile of the site including BFI Inc. and Chemlime Corp. Both of these use are on the West side of 16th and include heavy trucking in their operations. Without a use proposed it is difficult to judge the overall impact on the area from such a re-zoning. Industrial zoning does fit the character of the area however. The re-zoning to Industrial would be consistent with the proposed new zoning ordinance and map. The proposed map shows the property to be "HI" or Heavy Industrial. The site is within one mile of the Southern Pacific Railyard and within one city block of rail service. The staff has reviewed this request with respect to the proposed master plan and find it to be substantially in conformance with it. The site is surrounded by both light and heavy industrial uses and fronts on a truck route.' The re-zoning in and of itself will not have a negative effect on the area. Any Industrial use must have a special use permit from the P & Z Board of Adjustments so individual uses will still be reviewed based on their merits. Based on the above review, staff would recommend that blk. 653 lts. 1-32 be re-zoned from "C" Commercial to "I" Industrial. • CITY OF LA PORTE . Specifically, it is proposed that the "K" Street access to the Dana Development be asphalt paving in lieu of the ordinance requirement of concrete paving with curbs. Variance Request City of La Porte File Number 85-4403 Staff has reviewed the letter submitted September 11, 1985 by Dana's Engineer, SIP Engineer, Inc. We have advised both Dana and SIP that the statements made in their letter in support of their request may require further explanation. We have recommended that the applicant make a presentation at your October 3 meeting. • Staff has evaluated this request and has the following observations to make at this time: 1. Roadside drainage for this North "K" Street extension will empty into the roadside ditch on North Broadway. That ditch is not deep enough and can't be feasibly deepened enough for curb and gutter drainage on North "K". Roadside ditches do provide an acceptable • solution. 2. The applicant wishes to construct a roadway consisting of 6" of lime stabilized subgrade, 12" of calcium sulfate base material, and 3" of hot-mix asphalt concrete surfacing. The Development Ordinance calls for a reinforced concrete roadway structure (local soil conditions dictate lime stabilized subgrade as well). A. In the past year, the City has experimented with a similar type construction to upgrade a number of our residential and commercial streets. This past winter, severe cracking was experienced in several of the streets. Some of the more serious cracks are believed to be due to problems with shrinkage of the calcium sulfate base. To solve the problem, a special repair procedure has worked out and the contractor extended his warranty an additional • year. If problems with the calcium sulfate can be eliminated by the developer, the roadway structure proposed is strong enough for the type traffic contemplated. Page Two September 26, 1985 CLP File ~~85-4403 ,. • B. An alternate to the calcium sulfate base would be 10" of crushed limestone base. C. A 7" reinforced concrete (with 6" lime stabilized subgrade) roadway structure would be required should the Commission not approve the use of asphalt concrete surfacing. 3. It should be mentioned that Staff expects North Broadway to be an important artery in the future, which may one day dictate converting to reinforced concrete with curb and gutter drainage. Such a conversion would involve lowering the roadbed to accommodate lot drainage over the curb. Side streets, such as North "K", can be more easily adjusted to match Broadway if they are constructed of asphaltic concrete. 4. Staff notes that this variance request should be based on "unusual characteristics which affect the property in question" (i.e. the existing conditions andelevations of the North Broadway road section) which is an appropriate consideration contemplated by the various provisions of the Development Ordinance (Section 13.00).
