1. Meeting was called to order at 7:21 p.m. by Assistant
Chairman Bobby Blackwell.

1. Approved minutes of the meeting held on 12/5/86 after
making amends to the last motion by Ed Murphree.
2. Rezoning request from Mrs. M. D. Collette for lots
111, 112, 113 Block 7, Spenwick Place, Sec. 1 - to
rezone said property from temporary R-1 to "C"
Commercial.
David Paulissen suggested that the Commission go ahead
and set a public hearing for Mrs. Collette even though
she was unable to attend the meeting.

SUBJECT: Land Use/Zoning Map Review Process
You should all be thanked for the hard work and effort on the text of
our new proposed Zoning Ordinance. That element of the adoption
•process is behind us with the text forwarded to the City Council on
September 5, 1985. Progress continues on the review and, adoption
process of the Zoning Ordinance text. The text has been formally
presented to Council and has subsequently had its required public
hearing. .Input from the public hearing is being documented and
reviewed by the city staff. Council will receive the report on the
public input sometime in January.
The next step in the process is the presentation and review of the
Land Use and Zoning Maps with the public. In order to hit the ground
running, once Council approves the text of the Ordinance after the
first of the year, we will discuss at January's meeting the approach
we will take in gathering public input for preparing a draft map and
its recommendation to Council.
A plan for the input and review of the Land Use and Zoning Maps would
include several neighborhood meetings throughout La Porte. Areas have
been chosen based on common social and neighborhood concerns of the
citizens. Every effort will be made to insure that these meetings are
kept informal. The final meeting will be the required public hearing
on the maps at City Hall. Outlined below are the proposed
neighborhood areas and alternate meeting location.

and input of our citizens are crucial to the progress and future
development of La Porte.

I am asking that the Planning and Zoning Commission and
City Council of LaPorte to please consider my request to rezone
my property in Spenwick Place Addition that faces Spencer
Highway from residential to commercial.
The legal description of these lots are Tracts Nos.
111, 112, and 113 of Block No. 7, of SPENWICK PLACE, Section 1,
a subdivision in the William M. Jones Survey, Harris County,
Texas, according to the map or plat thereof recorded in the Deed
Records of Harris County, Texas.
We bought this land in the 19501s, over thirty years ago,
for an investment and paid them out. We have paid taxes to the
City, County, and Schools of LaPorte and also for the San Jacinto
College all this time.
These lots are really not suited for residential as they
are on a busy highway and businesses have filled about every
space on the east and west side of my property with a large
shopping center in the same block on Underwood and Spencer Highway.
The Harris County Appraisal District has set the market
value of these lots too high for residential purposes since
they amount to just under $2,000.00 for taxation.
Even though I'm well over age 65, I cannot apply for any
exemptions because it is vacant land; therefore, I am requesting
your consideration to rezone this property.

The City has received and reviewed a request for the re -zoning of
Block 7, Lots 111,112,& 113, Spenwick Place, Sec. 1
Mrs. M. D. Collette of Lufkin has submitted a request for rezoning on
the above described property. The request is to change the zoning
classification from temporary "R-1" to "C" commercial. No specific
use is given.
SUMMARY
• This property is located at the Southeast corner of Hillsdale and West
Main St. (Spencer Hwy.). The site is just West of the Glen Tolar/Mike
French Shopping Center and across West Main St. from the Safeway
Shopping Center. The surrounding uses in this area are commercial/
retail.
This request is not in keeping with the current Planning and Zoning
policy for re -zoning in the annexed area. No use is proposed and
construction is not planned at this time. This area is now under
consideration in the proposed master plan and zoning ordinance. Based
on these facts the staff must recommend that this request be denied
until such time as a specific project is proposed. If a project is
proposed then staff will review it based on its merits at the time.

SUBJECT: Re -Zoning LTS. 15 & 16 Blk. 155, La Porte
The City has received an application from Mr. Gus Brieden for the
re -zoning of lts. 15-16, blk. 155 LP from their present "R-1"
Residential classification to "C" Commercial. The stated purpose of
the re -zoning is to make the property consistent with the
Comprehensive Plan.
The property in question is located at the Northeast corner of 2nd and
"H" street in a developed single family neighborhood. The site
presently contains a single story residential dwelling and is
• surrounded on two sides by residential uses. The East and South sides
abut vacant property. No proposed use is given in the request and the
reason for the request is to make the property conform to the
Comprehensive Plan.
ANALYSIS
The site faces S. 2nd Street on the front and nHn Street on the side.
A comparison to the Comprehensive Plan indicates that this property
should remain "R-1" Residential. The site in question is on the edge
of a totally residential area with no other commercial use in the
block. As mentioned above, no use is given for the property so
further analysis is impossible.
The re -zoning to Commercial is not consistent with the Comprehensive
Plan or proposed zoning map.

The staff has reviewed this request with respect to the proposed
Zoning Map and Comprehensive Plan and find it to be in complete
non-conformance with them. Based on this information, the lack of a
proposed use and the residential character of the neighborhood, the
staff recommends that this request be denied.

SUBJECT: IMPROPER ZONING REQUEST, GUS BRIEDEN
The City has received a rezoning request from Mr. Gus Brieden that was
the contained in the same letter as the other request from Mr. Brieden
dated November 27, 1985. The ordinance requires that each request be
separate and be accompanied by a rezoning application fee of $100.00.
This request does not meet either of the above requirements and must
therefore be re -submitted in accordance with Sec. 17-100 of the
current zoning ordinance.
It is recommended that the City Secretary's Office be directed to
contact Mr. Brieden and have him re -submit the rezoning application as
the legal requirements of the ordinance have not been met at this
time.

The City has received a request to rezone 13.7143 Acres out of the W.
Jones Survey A-482. The request asks for a re -zoning to a high
density residential zone. The request is to allow a density of 50
dwelling units per acre (D.U.A.) and allow units varying in size from
100 to 500 SF per unit.
There are several items contained in this request that do not fall
within the parameters of a rezoning. As the ordinance is now written
a rezoning could not be granted without the creation of a high density
residential zone.
This request contains several items that are in direct conflict with
the terms of the existing zoning ordinance. These items are (1) unit
size is too small, ie. 100 SF instead of the 500 SF required in the
current ordinance, (2) Dwelling units per acres is nearly twice the
current limit, ie. 50 D.U.A. instead of the current 27 D.U.A.
By reading between the lines it appears that this project would be
ideally suited to P.U.D. development. The mixed uses indicated would
lend themselves well to this type of development.
Based on the facts discussed above and the requirements of the current
zoning ordinance, staff must recommend that this request be denied for
the following reasons;
( 1 ) Lack of a high densii; / r Esidential zone
(2) Non-conformance to the required 27 D.U.A.
(3) Non-conformance with the minimum dwelling unit size
The developer would be encouraged to discuss the project with the
Planning and Zoning Commission if he decides to pursue this project in
order to map out a possible path for development. The developer may
chose to hold or re -submit this request under the terms of the new
zoning ordinance. Please note that even under the terms of proposed
ordinance the density is substantially higher than the 27 D.U.A.
proposed.

SUBJECT: Land Use/Zoning Map Review Process
You should all be thanked for the hard work and effort on the text of
our new proposed Zoning Ordinance. That element of the adoption
•process is behind us with the text forwarded to the City Council on
September 5, 1985. Progress continues on the review and adoption
process of the Zoning Ordinance text. The text has been formally
presented to Council and has subsequently had its required public
hearing. Input from the public hearing is being documented and
reviewed by the city staff. Council will receive the report on the
public input sometime in January.
The next step in the process is the presentation and review of the
Land Use and Zoning Maps with the public. In order to hit the ground
running, once Council approves the text of the Ordinance after the
first of the year, we will discuss at Januaryls meeting the approach
we will take in gathering public input for preparing a draft map and
its recommendation to Council.
A plan for the input and review of the Land Use and Zoning Maps would
include several neighborhood meetings throughout La Porte. Areas have
been chosen based on common social and neighborhood concerns of the
citizens. Every effort will be made to insure that these meetings are
kept informal. The final meeting will be the required public hearing
on the maps at City Hall. Outlined below are the proposed
neighborhood areas and alternate meeting location.

Section 12.08 of City Ordinance 1444 (The Development Ordinance) states
that the "Planning Commission upon recommendation of the Director and
the Parks & Recreation Department and in accordance with Comprehensive
Plan of the City shall promulgate an official parks and recreation map
for the City..." A copy of Section 12.08 is attached as Enclosure 1.
Enclosure 2 is the staff -recommended Official Parks and Recreation Map
for the City. It was prepared in conformance to the City Comprehensive
Plan, as currently proposed. Enclosure 3 demonstrates that this map
satisfies the requirements of Section 12.08 of Ordinance 1444. The
• following procedure is reflected in Enclosure 3:
1. Using the proposed Land Use Map, measure the approximate
total residential acreage (all densities) in each park zone
(A).
2. Using the ratio (R) of 248 acres City park land required to
serve the projected 5522 residential acres, determine the
acres of parkland needed to serve each zone (B).
COMMENTARY: Column B is an important one. Until Column B
has been achieved within a zone, developer cash payments in
lieu of park land dedication (where required) will apply
toward City acquisition of park land. After Column B has
been achieved, developers may not dedicate park land within
the zone; they may only make cash payments to reimburse the
City for park land acquisition and development costs.
3. Using the City Parks and Recreation Department park land
inventory, determine the existing acres of park land within
each Zone (C).
4. Subtract existing (C) from required (B) zone park land
acreages to determine future park land acreage (D) needed
within each park zone.

COMMENTARY: Zone 2 (Fairmont Park) is short about 7 acres
park land, but, since its density is 4.8 lots per acre rather
than the City-wide average density up 7.5 in the
Comprehensive Plan, Zone 2 has adequate park land to serve
all its future residents. Zone 6 (Little Cedar Bayou
Regional Park) has about twice as much park land as needed to
serve its future population, but its park serves the entire
City. All other park zones match the City-wide ratio (R).

family that owns land in East Austin

that the landowners said destroyed

Isham said that once the decision {
.was final, the city considered pur-
chasing the property. Isham said
that the Ehrlich family's asking +
price was based on its value as in- i
dustrial property, even though the
Ehrlichs claimed In court that the
land was worth only $25,000. To use j
the property for Industrial develop-
ment, it must be rezoned by the
city, which already- paid for the
