Q~ ~~ «• • • ,' • • CITY OF LA PORTE INTER-OFFICE MEMO T0: Plan g and Zoning Commission FROM: D ~ ulissen DATE: 02/12/86 SUBJECT: Rezoning B1k. 2, Lts.22-24 Spenwick Place, Section 1 The City has received a request from Mrs. Vivian Covington to rezone Blk. 2, Lots 22 thru 24,•Spenwick Place, Section 1 from its temporary "R-1" Residential classification to "C" Commercial. The reason for the request is to allow the business to operate in a more efficient manner. As the business. has a legally established pre-existing use no rezoning is recommended until the entire area has been rezoned. HISTORY The property is located on the South side of West Main between Hillsdale and Ridgefield in the Spenwick area. A used car lot and grocery store is located and operating on the site. This property is in the most recently annexed area of La Porte and has not yet received its final zoning classification. The Comprehensive Plan indicates that this area should remain "R-1". This issue has received much study by the Commission and past policy indicate that rezoning should not take place on any tracts not prevented from developing by zoning. ANALYSIS The entire Main St. frontage in this area has been discussed at length by the Commission within the past year. The area in question has received attention due to disagreements with the proposed zoning. The result of the discussions was a policy of only rezoning in the area if a use is proposed that fit. the character of the area and zoning would prevent such development. No specific use is proposed and the reason given for the request is "t0 comply with the master plan". One half of the lots under consideration (Lts. 1-8) are recommended to remain "R-1" by the plan. Although lots g-16 are proposed to become General Commercial, GC, no use is given and past policy indicates that rezoning without a use should not take place. HISTORY The property in question is located between the North/South alley between First St. And Second St, and "H" and "I". This entire one • half (1/2) block faces a built out section of residential uses West across Second St, from the site. The property is vacant at this time. A review of the tax role indicates that lots 7 thru 10 are not owned by Mr. Brieden. ANALYSIS Lots 1-8 are currently "R-1" Residential and proposed to remain so under the comprehensive plan. Lots 9-16 are however proposed to become "GC" General Commercial .under the plan. No proof of ownership is enclosed as required by the current Zoning Ordinance and should be required before the public hearing takes place. With no proposed use given, it is impossible to determine the impact of the rezoning on the surrounding area and the residential use across Second St. from this '~; ~ property. RECOMMENDATION One half of the lots in question are proposed to remain residential and no use is given for the remaining half of the lots. Jones A-x482, Exxon The City has received a reo,uest from Exxon's Marketing Department far the rezoning of .918 acres out of the Wm. M. Jones A-r+82 survey. T}~,e request asks for a rezcning from its temporary "R-1" Residential classification to "C" Commercial. The proposed use is for the r'constructicn and operation of an EXXON service ~t~tion. With a clear use indicated by the applicant this request should be considered for rezoning. HISTORY This property is located at the North West corner of Fairmont Fkw. and Underwood Rd. It is directly across Underwood Rd. from the Circle K_ at Underwood and Fairmont. The proposed zoning has been compared to • the Comprehensive Plan and proposed zoning map. The area in question is proposed to be "R-2" Medium Density Residential. As witYr ottrer requests in this area, the frontage along Fairmont has been discussed at length with the focus centering around whether thoroughfare frontage of this type should be considered as developable for residential. As mentioned, there is a proposed use far this site and the failure of the request will prevent development. ANALYSIS There have been several other request in this area with the most recent being a rezoning of a tract about one half mile further West to allow the construction of a Brownies Store. The site in question does not meet the specific guidelines of the comprehensive plan but past discussions ~ia~le indicated a conflict with the prohibition of Commercial uses along Fairmont Pkw. The rezoning of this corner property would not seem to inhibit further residential development in the immediate area which has been a problem with past requests in this area and would have only minor impact on the plan. It should be noted that botYi water an sewer must be extended to this site RECOMMENDATION The rezoning of this tract would have only minor impact on the plan and would not preclude the development of Residential uses adjacent to • the site.
